Over the course of the past fewmonths I have been in communication with both John Telmos and Luanne Underwood inregards to the Stock Purchase of ME and our position of the acquisition of Mercy by a thirdparty.

As, the 100% transition of ownership has yet been completed, we will see the complete closureon August r2014 if everything goes as planned as both Dana and will resign from our positionsof Mercy. Today, it is Jr understanding that Mercy's management team will assist Mr. Jawed inthe operations and daily oversight of ME's operations. Mr Jawad has been with Mercy and anactive participant in the direction of Mercy since May 5,. 2014. I personally feel that we willprovide ME with great direction and success in the forthcoming years.

Due to lack of insurance, you are now suspended from operating in the City of Los Angeles. Ifyou desire to resume operations at this time, you must submit a valid Automobile LiabilityCertificate (for an admitted carrier) with renewal of insurance for approval by the CAO, RiskManagement prior to June 30, 2014, or the Department will take action which may lead to arecommendation to the Board of Transpcirtation Commissioners that your permits be revoked.
Please provide your insurance company with the enclosed guidelines and forms, and have themEll out and return two Automobile Liability Certificates if you wish to continue operating.
However, if the reason for the lapse in insurance coverage is that you have decided todiscontinue operating the permitted vehicle(s) for a temporary period of time, you must submitthe decals to the Department for decal removal. On June 4, 2014, at approximately 1:53 p.m, two unrestricted permitted private ambulances,California license 50866F1, VIN: 1FDSS3EL7CDA11416 and California license 50814F1, VIN:1FDSS3ELXCDA54888, registered to and operated by your company was observed droppingoff patients from 4929,Van Nuys Blvd, Sherman Oaks, California, in the City of Los Angeles.
Ambulances used for patient transportation within the City of Los Angeles are required to bepermitted by the Department of Transportation. At the time of this incident AssociatedAmbulance, Inc. d.b.a. Mercy Ambulance (Mercy) was under an LADOT mandated notice tocease all transportation operations due to a failure of the company to maintain required autoliability insurance. • YOU AND YOUR COMPANY ARE HEREBY DIRECTED TOIMMEDIATELY CEASE AND DESIST from using unpermitted vehicles to pick up passengerswithin the City of Los Angeles until you have obtained the proper vehicle permit as required bySection 71.02(a) of the Los Angeles Municipal Code.
Due to the seriousness of this incident, the Department is requiring Mercy to submit, tothe Department, driver's logs for the dates of May 19, 2014 through June 4, 2014. Thosedocuments must be submitted to a Department Investigator no later than Tuesday, June17, 2014.
This is due notice to cease and desist from picking up passengers in the City of Los Angeleswithout proper permits. Failure to comply with this notice is a misdemeanor offense and subjectto criminal prosecution of both the driver of the vehicle and the owner(s) of the company. Boththe drivers and the owners may be subject to arrest and/or being assessed a .monetary penaltypursuant to the Board of Transportation Ccimmissioners' Board Order No. 580.

That your Board:
FIND that from May 19 through June 4, 2014, Associated Ambulance, Inc., d.b.a.Mercy Ambulance (Mercy) illegally operated permitted and unpermitted PrivateAmbulances for a total of 594 verified violations while under a Departmentmandated suspension and was appropriately assessed a monetary penalty of$324,300.00 by the Department pursuant to Board Order 580;
b. FIND that Mercy failed to comply with the rules and regulations contained in theLos Angles Municipal Code; Board Order 257 and Board Order 580, Rule 1 (etal), by authorizing permitted and unpermitted drivers, attendants and vehicles topick up and drop off patients within the City while under a Department mandatedsuspension;
c. DENY Mercy's appeal and uphold the Departments July 1, 2014, administrativehearing findings and subsequent assessment of monetary penalties totaling$324,300.
d. DIRECT Mercy to submit payment of the assessed Monetary Penalty orsurrender the company's five (5) unrestricted Private Ambulance decals to theDepartment by 3:00 p.m., on August 8, 2014.

The Department initiated this report in view of Mercy's failure to abide by the rules andregulations of the City of Los Angeles and the Department of Transportation andMercy's repeated illegal transportation operations from May 19 through June 4, 2014,while the company was aware that it was under a Department mandated suspension.

Discussion
Company History
On July 25, 2002, Mercy Ambulance, (Company Code 1189.0) under the ownership ofCraig Esterly, was granted authorization to operate one unrestricted Private Ambulanceby the Board of Transportation Commissioners. The company was invalidated onDecember 5, 2007, for failure to pay the required annual Vehicle Permit Renewal fee asrequired on its one (1) permitted vehicle. During the time period that the company wasauthorized to operate there were three (3) incidents in which the company was foundguilty of violating Los Angeles Municipal Code § 71.03(b) — unpermitted driver; 71.04 —unpermitted attendant and 71.10 — operating while under a period of suspension.
On August 11, 2011, Mercy Ambulance Service, Inc., (Company Code 1456.0) withCraig Esterly as President and CEO was granted authorization to operate twounrestricted Private Ambulances by the Board of Transportation Commissioners.During the time that the company was active under this Company Code it was foundguilty of violating Los Angeles Municipal Code § 71.02(a) unpermitted vehicle,71.03(b) — unpermitted driver, 71.04 — unpermitted attendant and 71.14 — failure tosubmit proof of required automobile liability insurance twice. Mercy remained activeunder Company Code 1456.0 until its reassignment on February 13, 2014.
Mercy Ambulance Service, Inc. under Company Code 1456.0 was acquired byAssociated Ambulance, Inc., DBA Mercy Ambulance due to a Sale of All Assets. OnMay 14, 2013, the Department received a request for the reassignment of the twopermitted ambulances under Company Code 1456.0 and approval for three (3)additional Private Ambulances by Associated Ambulance, Inc., DBA Mercy Ambulance.
On February 13, 2014, the Board of Transportation Commissioners granted the newcompany, under Company Code 1527.0, authorization to operate the two PrivateAmbulances transferred from Company Code 1456.0 and also granted three (3)additional Private Ambulances for a total of five (5) unrestricted Private Ambulanceauthorities. (Attachments 1A & 1B)
The company was required to render payment for an open violation that occurred whenan unpermitted Mercy ambulance was found picking up passengers from 2310 AlcazarStreet in the City of Los Angeles. This violation was determined to have occurred afterthe date of sale to Associated Ambulance, and was therefore deemed to have beenacquired along with the assets and permits when the company was sold to AssociatedAmbulance, Inc. That fine ($500.00) was paid on February 25, 2014. Under the newCompany Code, Mercy had 120 days to comply with the City's requirements forinsurance, permitted drivers and attendants, facility inspection and vehicle inspectionsof 5 private ambulances. The deadline to accomplish this was June 25, 2014. Due toseveral paperwork and procedural problems and delays, the first vehicles were notinspected and placed into service until June 12, 2014. The company currently has five(5) permitted Private Ambulances in service.

Documented Violations
May 29, 2014
On May 28, 2014, the Department's Bonds and Insurance clerk received an informalNotice that Mercy's Automobile Liability Insurance policy had been cancelled by MarkelInsurance Company on May 19, 2014, for non-payment. The Department's RiskManagement office confirmed that the official date of cancellation on the policy was May19, 2014. Failure to maintain the required insurance is a violation of § 71.14 of the LosAngeles Municipal Code.
A "Notice to Cease Operations for failure to maintain a Policy of Liability Insurance" asrequired by § 71.14 of the Los Angeles Municipal Code was issued to the company.(Attachment # 2) The notice was mailed and faxed successfully to the company. Sucha notice means that the company shall not operate at all within the City of Los Angelesuntil such time as the deficiency that dictated the issuance of the Notice to CeaseOperations has been remedied and a Notice to. Resume Operations is issued to thecompany.
June 4, 2014
At approximately 1:43 p.m., a staff Investigator observed an unrestricted permittedPrivate Ambulance owned and operated by Mercy Ambulance drop off a patient atSherman Oaks Hospital located at 4929 Van Nuys Blvd, Sherman Oaks, California91423:

He observed a second permitted unit drop off a patient at the same location atapproximately 2:22 p.m.:

A check of Department records indicated that in addition to the company-widesuspension, both vehicles were still permitted under the old Mercy AmbulanceCompany Code of 1456.0, and were therefore not authorized to operate within the Cityof Los Angeles.
The Investigator, after approaching and identifying himself, allowed the patients to betaken back into the facility, then arrested the drivers and attendants of bothambulances* *NOTE: During the impounding process a third Mercy ambulance was observed picking up a patient andleaving the area. Because the Investigator was already dealing with two impounds, no effort was made tointerfere with this vehicle.

After issuing a "Notice to Appear" to the drivers and attendants of each vehicle, theInvestigator released them and impounded both ambulances. A 30-day hold wasplaced on both vehicles. Notification of the impounds were sent to the company at itsaddress of record, 7700 Imperial Highway, Suite "D", Downey, California 90242, thesame day. Additionally, Hearing Notice 60914 and a Notice to Cease UnlawfulTransportation Operations" (Attachment #3) was issued to the company for the allegedviolations of § 71,10 of the Los Angeles Municipal Code — Operating while undersuspension. The Administrative Hearing was scheduled for 2:00 p.m., on July 1, 2014.
On June 5, 2014, a current Certificate of Liability Insurance and a Warranty AgainstClaims in Absence of Insurance were submitted, by Associated Ambulance, Inc., DbaMercy Ambulance to the Department's Risk Management Office. After verifying theveracity of the documents through Risk Management a Notice to Resume Operationswas issued to the company. (Attachment # 4)
On June 10, 2014, staff notified Mr. Robert Williams, Risk Manager for the companythat as part of the on-going investigation, the company needed to submitDriver/Dispatch Logs and Patient Care Reports (PCRs) for the time period of May 19,through June 4, 2014 for Units No.: 614 and 616 (the units that were impounded).Those documents were received, via e-mail later the same day and staff began theexamination of those documents.
Examination of these documents indicated the extensive use of not only the twovehicles that were impounded on June 4th, but, at least six (6) other unpermitted privateambulances (Units No.: 601, 611, 612, 660, 661 and 664) to pick up and drop offpatients to various locations within the City of Los Angeles during the time period thatthe company was under the mandated suspension. The initial monetary assessment forall violations found was $310,700.00.
While examining the documents staff realized that there were large date, document, andtime gaps in the documents submitted on June 10th. On June 19, 2014 a request foradditional, specific documents was e-mailed to Mr. Williams. Staff repeated the requeston June 20th with a more complete listing of the missing documentation. The additionaldocumentation was not submitted by the company.
July 1, 2014 Administrative Hearing
Mr. Robert Williams attended the hearing as the company representative. Also inattendance was Souheil Jawad who presented himself as the new owner, in process, ofacquiring the company. He stated that he is the current owner of Extreme CareAmbulance, Inc. a company based in San Diego and he is in the process of acquiringthe Mercy's stock. Mr. Jawad was allowed to attend the hearing, but had no input in theresults of the hearing as he was not a recognized owner. Department InvestigatorsShawn Martin, Dale Horton. and Senior Investigator Barker also attended the hearing.
During the hearing, Mr. Williams indicated that most, if not all, communications hadbeen routed to Mr. Risher's office and Mr. Risher had not disseminated information from

the Department to the company's staff, which was why he and Mr. Blake Cadogan, theOperations Manager were unaware of the Notice to Cease Operations or of any emails,including the e-mails specifically addressed to him and/or Mr. Cadogan from June 20ththat went unanswered.
Mr. Williams was advised of the excessive amount of violations found in the paperworksubmitted on June 10th, and the amount of the fine that would be assessed was$310,700.00, in addition to an additional fine of $500.00 for failure to submit theadditional documentation asked for in the June 20th e-mail. Mr. Williams stated that hewould submit the additional information as soon as he got back to the office and that asthe company representative he wanted to appeal the proposed fine. He also indicatedthat any call for service originating from the County of Los Angeles would not have aPCR. He did not extend an explanation for the other missing documentation.
The hearing concluded when Mr. Williams filed an official "Request For Hearing Beforethe Board of Transportation Commissioners." (Attachment # 5)
The requested additional documents were submitted, via e-mail to the Department lateron July 1st. Staff immediately examined these documents and found that of the datesand documents requested:
• Four (4) PCRs were submitted from calls that appeared to have originated fromCounty of Los Angeles medical facilities within the City.
• Twenty-six documents appeared to be screen shots from their CAD (ComputerAssisted Dispatch) program. These documents gave limited information at best.
• There were still documents listed on the e-mail which were not submitted.
Examination of the second set indicated that further violations had occurred in additionto the original paperwork submitted. It was the determination of staff to consider everypick up and drop off as separate violations due to the fact that the company wascognizant of the Notice to Cease Operations and continued to operate. The final countof violations and monetary penalty assessments are: (See Attachment # 6)

It is the recommendation of staff that due to the extensive number of violations and thecompany's non-compliance with a Department mandated Notice to Cease Operationsby continuing to operate a Private Ambulance service within the City of Los Angelesduring the suspension period and the company's flagrant disregard for the rules,regulations and ordinances put forth by the City of Los Angeles, that the company bepermanently revoked, effective immediately without collecting the imposed MonetaryPenalty of $324,300.00 and that the Board direct the Department that it may not acceptany future permit applications from Associated Ambulance, Inc.; Mercy Ambulance orMercy Ambulance Service, Inc. or its principals operating under any other companyname.
It should be brought to the Board's attention that Mr. Robert Williams, the company'sRisk Manager, has put forth to the Department, a proposal that in order for the companyto continue operating, it be allowed to pay the assessed penalty in payments, with theduration and amount of the payments to be determined by the Board.
Los Angeles Municipal Code § 71.05(d) states:
"Any money due to the Department of Transportation by any applicant for avehicle permit, including money owed for outstanding parking tickets or other finesassessed by the Department, must first be paid, or the matter otherwise resolved to thesatisfaction of the Department, prior to the issuance of such permit."

Applicable Regulations
Vehicle permits are addressed in LAMC Section 71.02(a) which states, in part:
"No person or corporation shall drive, operate, or use, whether as owner, lessor,lessee
or otherwise, any of the vehicles defined in Section 71.00 to pick up or attempt to pickup passengers within the limits of the City of Los Angeles, or allow or permit to beoperated, driven, or used, whether as owner, lessor, lessee, or otherwise, any of thevehicles defined in Section 71.00 to pick up or attempt to pick up passengers within thelimits of the City of Los Angeles, unless a written vehicle permit for the operation of suchspecifically defined vehicles has been obtained from the Board . ."
Driver permits are addressed in LAMC Section 71.03(b) which states, in part:
"No person shall drive a non-ambulatory passenger vehicle as defined in Section71.00 without first having obtained a non-ambulatory passenger vehicle driver permitfrom the Board."
Attendant permits are addressed in LAMC Section 71.04, which states:"No person shall act as an ambulance attendant in a private ambulance unless
such person holds an ambulance attendant permit or an ambulance driver permit issuedby the Board."
Operating a company during a suspension period is address in LAMC Section 71.10:
"From the time of the revocation or during the suspension of any permit, noperson whose permit is suspended or revoked shall drive, operate or be in charge ofany of the vehicles defined in Section 71.00, or permit the vehicles on which the permithas been suspended or revoked to engage in the several classes of businessmentioned in Section 71.00 or allow any such vehicle to stand while awaitingemployment at a location designated in such suspended or revoked permit until a newpermit has been procured or until the period of suspension shall have expired."
Insurance requirements are addressed in LAMC Section 71.14, which states, in part:
"(a) Before any vehicle permit or franchise is issued for any vehicle mentioned inSection 71.00, the operator of the vehicle shall file with the Department, and shallthereafter keep in full force and effect a policy of insurance in such form and amountsas the Board in consultation with the City Administrative Officer's Risk ManagementSection may from time to time require but not less than the appropriate sums specified. .. Such insurance shall be written by an insurance company authorized to do businessin the State of California, insuring the operator against' liability for any loss or damagethat may result to any persons or property from the operation of such vehicle."

RECOMMENDATIONS
That your Board:
a. Find that, based upon current evidence of patients in need of transportation, publicconvenience and necessity requires the operation of five unrestricted Private AmbulanceVehicles by Associated Ambulance Inc. dba Mercy Ambulance.
Grant five unrestricted Private Ambulance Vehicle permits to Associated AmbulanceInc. dba Mercy Ambulance contingent upon:
1. The applicant filing with the Department in such form as the Department requiresand thereafter keeping in full force and effect a policy of automobile liabilityinsurance acceptable to the City Attorney and the City Risk Manager;
2 ThedriVerS and attendants obtaining the required City permits;
3. The applicant obtaining commercial or exempt registration for the vehicles;
4. The vehicles passing Department inspection;
5. The applicant complying with all Board rules and regulations. and City ordinancespertaining to the operation of Private Ambulance Vehicles;

6. The applicant submitting a current BusinessTax Registration Certificate (BTRC)with the applicant's correct name and address prior to decaling the vehicles;
7. The applicant charging only those rates for Private Ambulance Vehicle service setforth in Board Order No. 601 (Ordinance No. 182,385) and successor regulations;
&. The vehicles being placed into service within 120 days after Board approval orsuch authority shall become invalid. Upon written request and for a valid reason,the Department may grant an extension of time to this condition.
c. Place Associated Ambulance Inc. dba Mercy Ambulance on a six-month probationaryperiod where any violation of the Board rules and regulations and City ordinances willbe brought before the Board immediately for consideration of disciplinary action,
d. Revoke two unrestricted Private Ambulance Vehicles previously granted to MercyAmbulance Service, Inc.
INITIATED BY
On May 14, 2013 the Department received a request for the reassignment of two unrestrictedPrivate Ambulance Vehicle permits and three additional unrestricted Private Ambulance Vehiclepermits from Robert Risher, Chief Executive Officer, of Associated Ambulance Inc. dba MercyAmbulance, 7700 Imperial Highway Suite D, Downey, CA, 90242 (Attachment 1). Additionaldocuments needed to complete the application including the application fee were received onAugust 7, 2014.
DISCUSSION
Associated Ambulance Inc. dba Mercy Ambulance is not currently authorized by the Board ofTransportation Commissioners (Board) to operate any type of vehicle for hire in the City of LosAngeles. On August 11, 2011, the Board authorized Mercy Ambulance Service, Inc., to operatetwo unrestricted Private Ambulance Vehicles.
On October 26, 2011, Associated Ambulance Inc. filed Articles of Incorporation with theCalifornia Secretary of State establishing the company (Attachment 2). On January 28, 2013,Associated. Ambulance Inc. filed a Statement of Information with the California Secretary ofState naming Robert Risher as the Chief Executive Officer and Chief Financial Officer and DanaRisher as the' Secretary of Associated Ambulance Inc. (Attachment 3). 'On July 11, 2012Associated Ambulance Inc. filed a Fictitious Business Name Statement with the Los AngelesCounty Clerk's office to do business as Mercy Ambulance (Attachment 4)..

Public Convenience and Necessity
The application of Associated Ambulance Inc. dba Mercy Ambulance was. evaluated againstSection 2 of the Guidelines for Establishing Public Convenience and Necessity for Applicantswith no Unrestricted Private Ambulance Vehicle Permits as approved by the Board on August11, 2005 (Attachment 5).
a. Experience — The applicant submitted the resume of Associated Ambulance Inc. dbaMercy Ambulance's Director of Operations, Dana Risher. Staff confirmed that Ms.Risher has sufficient experience and her responsibilities include overseeing managementstaff, overseeing patient care compliance, recruiting and training of employees.Associated Ambulance Inc. dba Mercy Ambulance is currently licensed to operate in the'County of Los Angeles.
b. Background Check — The owners and manager of Associated Ambulance Inc. dba MercyAmbulance submitted to Department of Justice Criminal Background check and werefound not to have any disqualifying criminal history.
c. Financial Capability — The applicant submitted financial documentation demonstratingsufficient liquid assets to support the request for five private ambulance vehicle permits.The applicant also submitted the DMV registrations for five private ambulance vehiclesthat are ready to be placed into service within 120 days.
d. Reason for Requesting Permits — Associated Ambulance Inc. dba Mercy Ambulance hadpurchased all assets and Licenses of Mercy Ambulance Service, Inc. and requests thereassignment of the permits. Associated Ambulance Inc. dba Mercy Ambulance iscurrently licensed to operate in the County of Los Angles and has not been 'able toprovide service to some of their clients in the City of Los Angeles.
e. Public Benefit — The applicant states that the public would benefit from AssociatedAmbulance Inc. dba Mercy Ambulance's prompt and professional service.
f. Impact on Existing Transportation Providers - The applicant anticipates no negativeimpact on existing Private Ambulance service providers as the demand for ambulanceservice is increasing rapidly.
g. Business Plan - The applicant has prOvided a business plan including Driver/EMTtraining, staffing of operations, dispatching procedures, compliance programs for stateand federal regulations and a break even type analysis.

On November 15, 2013, Mercy Ambulance, Inc. was cited for operating illegally in the City ofLos Angeles. On December 3, 2013, the company appeared for their administrative hearing andwas found to be in violation of the Los Angeles Municipal Code Sections 71.02 and 71.03(a) foroperating without a valid vehicle permit and ambulance driver's permit respectively. Thecompany was assessed a monetary penalty of $600.00.
Should the Board grant the reassignment of two unrestricted Private Ambulance Vehicle permitsand three additional unrestricted Private Ambulance Vehicle permits to Associated AmbulanceInc, dba Mercy Ambulance, the company would be permitted to operate five unrestricted PrivateAmbulance Vehicles in the City of Los Angeles.

GUIDELINES FOR ESTABLISHING PUBLIC CONVENIENCE AND.NECESSITY FOR PRIVATE AMBULANCE VEHICLE PERMITS
APPROVED BY THE BOARD ON AUGUST 11, 2005
The applicant for Private Ambulance Vehicle Permits shall have the burden of proof toestablish by clear and convincing evidence that public convenience and necessity requiresthe operation of additional private ambulances. .In addition to the information required bySection 71.13 of the Los Angeles Municipal Code, such evidence should include, but notbe limited to, the following:
1. Applicants Who Presently Hold Unrestricted Private Ambulance Vehicle Permits
a. Background Check - The appliCant must submit to a Department of JusticeCriminal Background Check for all majority owners, management officialsand supervisors at the time of application. Any majority owners, managementofficials and supervisors with criminal history listed in Board Order No. 600shall be disqualified.
For all permitted companies, should any change in owners, managementofficials, or supervisors occur, they must be fingerprinted by the Departmentwithin 30 days of the change or the Department shall revoke the company'spermits. If a company does not replace a majority owner, managementofficial or supervisor when the Department of Justice reports any criminalhistory in violation of the above Board Orders, the Department shall revokethe company's permits.

b. Financial Capability- The applicant must provide proof of financial ability toacquire, equip and place the requested vehicles into service within 120 days:
The applicant must submit proof of ownership of the vehicle(s) (DMVregistration) to 'be permitted, or submit evidence of $20,000 in liquidassets (bank statement) for each vehicle, with a tentative lease agreement,purchase agreement or vehicle conversion order which shows the deliverydate for each vehicle.
c. A statement explaining the reason for requesting additional permits.
d, A description of how the public will benefit from the additiOnal vehicles.
e. A description of the impact of the proposed service on existing transportationproviders.

a. Experience — The applicant must be able to submit proof that they or their,full-time manager have at least one (1) year of experience operating a privateambulance transportation service in California,
b. Background Check - The .applicant must submit to a Department of JusticeCriminal Background Check for all majority owners, management officialsand supervisors at the time of application, Any majority owners, managementofficials and supervisors with criminal history listed inBoard Order No. 600shall be disqualified. .

g. A business plan including current and pro forma profit and loss statements,depreciation scheddle and current balance sheet. The depreciation scheduleshould include a list of vehicles currently owned as well as a list of vehicles tobe permitted. Data should be submitted showing the estimated average cost ofoperating one trip and the number of trips per day a vehicle must run to beprofitable; the costs per trip should be itemized. Break-even type formulasshould be used to show the economic feasibility of the 'proposed operation.
3. EXCEPTION — Private Ambulance Vehicle Permits to Service GovernmentContracts
. .
AppliCants that submit a signed contract with a public agency or an agencyauthorized to make such contracts for the expenditure of public funds for privateambulance transportation need not submit the above data. However, vehiclesauthorized for such service shall be granted only restricted permits, can serve onlythe clients of the agency under the terms of the contract, and shall be permittedonly for the duration of the contract. No charges shall be paid to the grantee for,this service other than that paid by the public agency.

Due to lack of insurance, you are now suspended from operating in the City of Los Angeles. Ifyou desire to resume operations at this time, you must submit a valid Automobile LiabilityCertificate (for an admitted carrier) with renewal of insurance for approval by the CAO, RiskManagement prior to June 30, 2014, or the Department will take action which may lead to arecommendation to the Board of Transportation Commissioners that your permits-be revoked.
Please provide your insurance company with the enclosed guidelines and forms, and have themfill out and return two Automobile Liability Certificates if you wish to continue operating.
However, if the reason for the lapse in insurance coverage is that you have decided todiscontinue operating the permitted vehicle(s) for a temporary period of time, you must submitthe decals to the Department for decal removal. Resumption of operation of the vehicles wouldthen require reinstating an automobile liability insurance policy and re-decaling at a cost of$45.00 for each vehicle. Resumption of operation and re-decaling must take place no later thanthe date scheduled for an annual inspection or the Department will consider your authority foroperating the vehicles expired.

NOTICE TO CEASE UNLAWFUL TRANSPORTATION OPERATIONS
On June 4, 2014, at approximately 1:53 p.m, two unrestricted permitted private ambulances,California license 50666F1, VIN: 1FDSS3EL7CDA11416 and California license 50814F1, VIN:1FDSS3ELXCDA54888, registered to and operated by your company was observed droppingoff patients from 4929.Van Nuys Blvd, Sherman Oaks, California, in the City of Los Angeles.
Ambulances used for patient transportation within the City of Los Angeles are required to bepermitted by the Department of Transportation. At the time of this incident AssociatedAmbulance, Inc. d.b.a. Mercy Ambulance (Mercy) was under an LADOT mandated notice tocease all transportation operations due to a failure of the company to maintain required autoliability insurance. • YOU AND YOUR COMPANY ARE HEREBY DIRECTED TOIMMEDIATELY CEASE AND DESIST from using unpermitted vehicles to pick up passengerswithin the City of Los Angeles until you have obtained the proper vehicle permit as required bySection 71.02(a) of the Los Angeles Municipal Code.
Due to the seriousness of this incident, the Department is requiring Mercy to submit, tothe Department, driver's logs for the dates of May 19, 2014 through June 4, 2014. Thosedocuments must be submitted to a Department Investigator no later than Tuesday, June17, 2014.
This is due notice to cease and desist from picking up passengers in the City of. Los Angeleswithout proper permits. Failure to comply with this notice is a misdemeanor offense and subjectto criminal prosecution of both the driver of the vehicle and the owner(s) of the company. Boththe drivers and the owners may be subject to arrest and/or being assessed a .monetary penaltypursuant to the Board of Transportation COmmissioners' Board Order No. 580.

Vehicle permits are addressed in LAMC Section 71.02(a) which states, in part:
"No person or corporation shall drive, operate, or use, whether as owner, lessor, lesseeor otherwise, any of the vehicles defined in Section 71.00 to pick up or attempt to pick uppassengers within the limits of the City of Los Angeles, or allow or permit to be operated,driven, or used, whether as owner, lessor, lessee, or otherwise, any of the vehicles defined inSection 71.00, to pick up or attempt to pick up passengers within the limits of the City of LosAngeles, unless a written vehicle permit for the operation of such specifically defined vehicleshas been obtained from the Board . . ."
Driver permits are addressed in LAMC Section 71.03(b) which states, in part:
"No person shall drive a non-ambulatory passenger vehicle as defined in Section 71.00without first having obtained a non-ambulatory passenger vehicle driver permit from theBoard."
Attendant permits are addressed in LAMC Section 71.04, which states:
"No person shall act as an ambulance attendant in a private ambulance unlesssuch person holds an ambulance attendant permit or an ambulance driver permit issuedby the Board."
Operating a company during a suspension period is address in LAMC Section 71.10:
"From the time of the revocation or during the suspension of any permit, no personwhose permit is suspended or revoked shall drive, operate or be in charge of any of thevehicles defined in Section 71.00, or permit the vehicles on which the permit has beensuspended or revoked to engage in the several classes of business mentioned in Section71.00 or allow any such vehicle to stand while awaiting employment at a location designated insuch suspended or revoked permit until a new permit has been procured or until the period ofsuspension shall have expired."
Insurance requirements are addressed in LAMC Section 71.14, which states, in part:
"(a) Before any vehicle permit or franchise is issued for any vehicle mentioned inSection 71.00, the operator of the vehicle shall file with the Department, and shall thereafterkeep in full force and effect a policy of insurance in such form and amounts as the Board inconsultation with the City Administrative Officer's Risk Management Section may from time to

Our client Associated Ambulance, Inc., dba Mercy Ambulance ("Mercy"), is in receipt of
your correspondence of August 5, 2014, (received today at 12:00p.m. by UPS - next day air)
enclosing a stamped copy of the Board of Transportation Commissioners' Action regarding the
above referenced matter.
This letter shall confirm that pursuant to the enclosed stamped copy of the Board's Action
of August 5, 2014, Mercy was ready to submit payment of $324,000.00 by 3:00 p.m. today, in
order to avoid surrendering the company's five (5) unrestricted Private ambulance decals to the
Department, and avoid a suspension and/or revocation of its five unrestricted Private ambulance
vehicle authorities. Mercy attempted to make payment and was unable to since it found that the
offices were in fact closed prior to 2:30 p.m. Mercy, therefore intends on making payment in full
on Monday, August 11, 2014 to avoid a suspension of its operations in the city of Los Angeles. A
copy of Mercy's check, dated August 8, 2014, is also enclosed for your records.
Mercy's payment, and anything contained herein, shall in no way act as a waiver of
Mercy's review and/or appeal rights with the Los Angeles City Council (or any other such appeal
and/or review rights) in connection with the Department's July 1, 2014 assessment of monetary
penalties for multiple violations of the Los Angeles Municipal Code and Board Order 580, and/or
any subsequent decisions made by the Board on appeal.

That your Board:
FIND that from May 19 through June 4, 2014, Associated Ambulance, Inc., d.b.a.Mercy Ambulance (Mercy) illegally operated permitted and unpermitted PrivateAmbulances for a total of 594 verified violations while under a Departmentmandated suspension and was appropriately assessed a monetary penalty of$324,300.00 by the Department pursuant to Board Order 580;
b. FIND that Mercy failed to comply with the rules and regulations contained in the.Los Angles Municipal Code; Board Order 257 and Board Order 680, Rule 1 (etal), by authorizing permitted and unpermitted drivers, attendants and vehicles topick up and drop off patients within the City while under a Department mandatedsuspension;
c. DENY Mercy's appeal and uphold the Departments July 1, 2014, administrativehearing findings and subsequent assessment of monetary penalties totaling$324,300.
d. DIRECT Mercy to submit payment of the assessed Monetary. Penalty orsurrender the company's five(5) unrestricted Private Ambulance decals to theDepartment by 3:00 p.m., on August 8, 2014,

The Department initiated this report in view of Mercy's failure to abide by the rules andregulations of the City of Los Angeles and the Department of Transportation andMercy's repeated illegal transportation operations from May 19 through June 4, 2014,while the company was aware that itwas under a Department mandated suspension.

Dear Mr. Zaltash:
Our client Associated Ambulance, Inc., dba Mercy Ambulance ("Mercy"), is in receipt ofyour correspondence of August 5, 2014, (received today at 12:00p.m. by UPS - next day air)enclosing a stamped copy of the Board of Transportation Commissioners' Action regarding theabove referenced matter.
This letter shall confirm that pursuant to the enclosed stamped copy of the Board's Actionof August 5, 2014, Mercy was ready to submit payment of $324,000.00 by 3:00 p.m. today, inorder to avoid surrendering the company's five (5) unrestricted Private ambulance decals to theDepartment, and avoid a suspension and/or revocation of its five unrestricted Private ambulancevehicle authorities. Mercy attempted to make payment and was unable to since it found that theoffices were in fact closed prior to 2:30 p.m. Mercy, therefore intends on making payment in fullon Monday, August 11, 2014 to avoid a suspension of its operations in the city of Los Angeles. Acopy of Mercy's check, dated August 8, 2014, is also enclosed for your records.
Mercy's payment, and anything contained herein, shall in no way act as a waiver ofMercy's review and/or appeal rights with the Los Angeles City Council (or any other such appealand/or review rights) in connection with the Department's July 1, 2014 assessment of monetarypenalties for multiple violations of the Los Angeles Municipal Code and Board Order 580, and/orany subsequent decisions made by the Board on appeal.
