MALACANAN PALACE MANILA BY THEPRESIDENT OF THEPHILIPPINES EXECUTIVE ORDER NO. 47 REORGANIZING, RENAMING AND TRANSFERRING THE COMMTSSION ON INFORMATION AND COMMUNICATIONS TECHNOLOGY AND ITS ATTACHED AGENCIESTO THE DEPARTMENT OF SCIENCE AND TECHNOLOGY, DIRECTING THE IMPLEMENTATION THEREOF AND FOR OTHER PURPOSES WHEREAS, the developrnent of information and communications technology (lCT) is crucialto the country,s global competitiveness; WHEREAS, whileour country has enjoyed the major share of the global ICT oulsourcing busine_ss, its long{erm sustainability hinges on our ability to innovate on ICTsolutions and facilities which is crucial to our lCf industry', .ori"titiu"n"5ln " dynamic global market; WHEREAS, the Commission on lnformation and Communications Technology (CICT) established under Executive Order No.269 (s.200ajactsas the executive arm in promoting, developing and regulating integrated and strategic ICT systems and reliable andcost-efficient communication facilities andservices; WHEREAS, the CICT, under the Office of the President, has direct supervision and control over the National ComputerCenter 0rfiCl and the Telecommunications Office (TELOF) by virtue of Executive OrderNds.26'9 (s. 2004) and780(s.2009) as amended, respeciively; WHEREAS, the transfer and reorientation of the functions of CICT and its attached agencies to the Department of Science and Technology (DOST) will strengthen the alignment of ICT development with the thrust of thJ'department to provide continuing innovation as the coreof the sustained global .orpuiitiueness of ourcountry's ICT industry; and v '- - -'-' . ii. WHEREAS, the President, under Article Vll, Section 1T of the Constitution, hasthe power and control overexecutive deparlments, bureaus and offices, as well as the continuing authority under existinglaws to reorganize such executive departments, bureaus and agencies. REORGANIZING, RENAMING AND TRANSFERRING THE COMMTSSION ONINFORMATION AND COMMUNICATIONS TECHNOLOGY AND ITSATTACHED AGENCIES TO THE DEPARTMENT OF SCIENCE ANDTECHNOLOGY, DIRECTING THE IMPLEMENTATION THEREOF ANDFOR OTHER PURPOSES

WHEREAS, the developrnent of information and communications technology(lCT) is crucialto the country,s global competit iveness;

WHEREAS, while our country has enjoyed the major share of the global ICToulsourcing busine_ss, its long{erm sustainabil ity hinges on our abil ity to innovate onICT solutions and facil i t ies which is crucial to our lCf industry', .ori"t it iu"n"5ln

WHEREAS, the Commission on lnformation and CommunicationsTechnology (CICT) established under Executive Order No. 269 (s. 200aj acts as theexecutive arm in promoting, developing and regulating integrated and strategic ICTsystems and reliable and cost-efficient communication facil i t ies and services;

WHEREAS, the CICT, under the Office of the President, has directsupervision and control over the National Computer Center 0rfiCl and theTelecommunications Office (TELOF) by virtue of Executive Order Nds. 26'9 (s. 2004)and 780 (s. 2009) as amended, respeciively;

WHEREAS, the transfer and reorientation of the functions of CICT and itsattached agencies to the Department of Science and Technology (DOST) wil lstrengthen the alignment of ICT development with the thrust of thJ'department toprovide continuing innovation as the core of the sustained global .orpuiit iueness ofour country's ICT industry; and v '- - - '- '

WHEREAS, the President, under Article Vll, Section 1T of the Constitution,has the power and control over executive deparlments, bureaus and offices, as wellas the continuing authority under existing laws to reorganize such executivedepartments, bureaus and agencies.

Iadministrative supervision of DOST. The ICTO shall be headed by an ExecutiveDirector, with the rank of an Undersecretary, who shall reporl directiy to the DOSTSecretary. The positions of Chairman and Commissioners of the CICT are herebyabol ished.

sEcTloN 2. Functions. The lcro shall perform the following functions:

Formulate, recommend and implement an appropriate policy and programframework that wil l promote the rapid development and improved globalcompetit iveness of our country's information and communications technologyindustry through research and development and through effective l inkages toindustry;

Ensure the provision of efficient and effective information andcommunications technology infrastructure, information systems andresources to supporl efficient, effective, transparent and accountablegovernance and, in particular, suppotl the speedy and efficient enforcementof rules and delivery of accessible pubric services io the people;

conduct continuing research and development in partnership with theacademe towards improving the quality of ICT education and the productionof globally competit ive ICT manpower;

Build_the capacities of public sector institutions and their personnel in the useof lcr to improve planning, management, delivery of mission, crit icalfunctions and monitoring and evaluation;

Formulate the Government Information System Plan and administer the E-Governance Fund; and,

Perform such other related functions as may be. assigned.

SECTION 3. Transfer of the NCC and the TELOF to DOST. The NCC andthe TELOF are hereby transferred to DOST and wil l form part of the internalstructure of the ICTO.

SECTION 4. Retention of Other Agencies under the Office of thePresident. The Nat ional Telecommunicat ions Commission (NTC) and the phi l ippinePostal Corporation (PHILPOST) shall continue to be under the Office of thePresident.

SECTION 5. Preparation and Approval of Rationalization plan. The DoSTSecretary is hereby directed to submit to the Office of the President within three (3)months upon the effectivity of this Order, a rationalization plan which wil l:

a) Prepare a medium-term development plan for ICT research and developmentand its l inkages to the lcr industry, and a medium-term

infrastructure and information systems plan in order to support improvementsin the global competit iveness of our country's economy;

b) Based on the medium-term plans, define the appropriate internal structureand functional configuration as well as the staffing pattern of the ICTO,considering its redefined functions and the integration of the NCC and IELOFinto it;

c) Reconfigule_.the appropriations and all other funding sources of the CICT,NCC and TELOF into an efticient budget that wil l sup:port the irnplementationof the medium-term plans and the neilorganizationai structure; and,

d) Provide safety nets, including retaining, redeployment, retirement and otherappropriate services and benefits to all affected personnel in accordance withcivil service and other relevant laws and generally build the cap-acities of theICTO manpower.

sEcrfoN _6. continuity of operations pending the Approval of theRationalization Plan' Pending the submission and approval of the rationatizationplan, all personnel whose functions are not otherurrise abolished under this ordershall continue to perform functions as may be assigned by the Dosr secretary.

' SECTION 7. Separabil ity Clause. lf any provision of this Executive order isdeclared invalid or unconstitutional, the other provisions not affected thereby shallremain valid and subsisting.

SEcTloN 8. Repealing Clause. All orders, rules. regulations, and issuances,or parts thereof, which are inconsistent with this Executive Order, are herebyrepealed, amended, or modified accordingly.

SECTION 9. Effectivity. This Executive Order shall take effect immediatelyupon publication in a newspaper of general circulation.
