President Painter noted a change made to the Executive Committee alternates after the list had been sent out to the board. Robert Brown’s alternate is now Carla Fiehrer. President Painter then called for any other corrections to the 2021 Executive Committee Alternates. There being none he asked for a motion.

Mr. Knochelmann moved that the Executive Committee concur with the President’s appointment of the 2021 Executive Committee alternates. Mr. Aiello seconded the motion; motion carried.

B. Approval of January 14, 2021 Board of Directors Meeting Minutes

President Painter called for corrections and/or additions to the January 14, 2021 minutes of the Board of Directors meeting. There being none, Judge Knochelmann moved that the minutes be approved as presented. Mr. Sams seconded the motion; motion carried.

C. Executive Director’s Report

Mr. Mark Policinski, OKI CEO, informed the Executive Committee that for several months and using the work of Dr. Zhou, of the OKI staff, the pandemic still has a strong hold on traffic. He said immediately after the onset of the pandemic, traffic declined about 45%.

Mr. Policinski said, as 2020 continued, traffic increased continuously, but was still down 9-10% from August through October.

Mr. Policinski admitted that though one month’s data does not make a trend, traffic could be down from gains made last year. January traffic is down about 15% from 2020. He said truck traffic actually increased throughout 2020. The question is will traffic continue to remain depressed into the foreseeable future.

Mr. Policinski said that we will see how traffic plays out in the coming months. However, he reiterated what he told this Board for several months; if these patterns persist they could be the harbinger of dramatic changes caused by remote work. He said, our lives, everything from commute times to real estate values to gas prices to adaptation of electric vehicles to which projects this Board will approve, will be affected. He said, he was not advising we have reached a watershed moment, but our staff will continue to keep you appraised of the changes in traffic to guide your deliberations.

Mr. Policinski mentioned that OKI is partnering with CVG, BlueSpace.ai, an AV tech firm based in California, TANK, Clean Fuels Kentucky and other public and private agencies to submit a concept paper to the Department of Energy’s (DOE) Fiscal Year 2020 Advanced Vehicle Technologies Research Funding Program. The project is called CVG Connect: Accelerating Smarter & Cleaner Mobility with First Mile/Last Mile Autonomous Transit Vehicles.

Mr. Policinski said that the projects purpose is to integrate autonomous technologies onto an electric passenger transit vehicle. He said that the project seeks a first-mile/last-mile connection from the TANK’s CVG Airport Transit Hub to a network of satellite locations within the CVG Job Hub area for major company employers. As employers and employees will attest, moving workers efficiently to, around and from their worksites is a massive challenge. This challenge is front and center at CVG as its dramatic growth has made it a city within a city, covering over 7700 acres and serving as “home” to over 70 companies with about 15,000 employees.

Mr. Policinski said BlueSpace.ai’s patented software utilizes the latest generations 4D sensors to provide real-time, full range of motion measurement to autonomous driving that was not previously possible. This allows for a safer, cost effective and time efficient operation for all connected and autonomous vehicles. Again, this automation can be combined with latest generation electric drivetrain bus technologies.

Mr. Policinski explained that this project hits all major themes of OKI’s push over the past five years to meld technology to mobility: automation, electrification, mobility for all, economic acceleration, cleaner environment and transit evolution.

Mr. Policinski said that the project’s outcome is expected to yield a model with autonomous and electric technologies by which communities and collaborative transportation networks may be replicated not just across the OKI region, but across the nation.

Ms. Purcy Nance, staff, reported that the Finance Officer’s Report was via Constant Contact. She explained that this report contains the financial statements for the period ended December 31, 2020 and includes current cash information.

Ms. Nance referred members to page 2 for the current information. As of February 5, OKI had $651,243 in the PNC checking account, $19,769 in the HSA/FSA checking account and $312,482 in the STAR Ohio money market mutual fund. Ms. Nance reported that there has been no recent activity on OKI’s line of credit and there is no outstanding balance at report date.

Ms. Nance stated that page 3 contains the balance sheet as of December 31. She reported that Cash and Investments are down 13% from this time last year. Receivables are down 1% from this time last year. Ms. Nance reported that at December 31, there were $1,095,000 in receivables, $703,000 associated with November and December invoices and $392,000 outstanding from October and earlier. She further stated that payables are up 193% or $105,000 from this time last year due to the Duke Energy project activities and timing of routine invoices.

Ms. Nance stated that Revenue information is located on page 4. She reported that at December 31, OKI was approximately 50% of the way through the budgeted year. Overall, revenues are at 43.5%, which is under budget. She noted the following items: Federal revenues are under budget due to the timing of FTA 5310 pass through project activities; State Revenues are under budget due to timing of OEPA contract execution, timing of Rideshare outreach activities and delay of transportation traffic counts to FY22; Local Revenues are ahead of budget due to the timing of County funding payments; Miscellaneous Revenues are under budget due to the cancellation of OKI’s annual meeting; and Contributed Services is under budget due to timing of 5310 Pass Through activities; offset by the seasonal nature of the Clean Air outreach campaign.

Ms. Nance stated that page 5 contains Expense information. She reported that overall, expenses are at 43%, which is under budget.

Ms. Nance noted the following items: Category 3, Travel, Subsistence and Professional Development, is under budget due to the COVID related cancellation of staff and Board activities requiring travel, combined with timing of agency membership renewals and Category 4, Printing, Marketing; Contractual is under budget due to timing of FTA 5310 project activities and traffic counts; and Category 6, Contributed Services is under budget due to timing of 5310 Pass Through activities; offset by the seasonal nature of the Clean Air outreach campaign.

Ms. Nance stated that page 6 contains the General Fund Balance information. She reported that the General Fund Balance has had net decrease of approximately $47,000 year to date. The two components of this decrease are timing differences and year to date activities. The timing differences include a $73,000 increase due to timing of county funding payments and $178,000 decrease due to application of negotiated fringe and indirect rates. The remaining $58,000 increase is associated with year-to-date operations and timing of active projects.

Resulting in a year to date fund balance of $1,453,000. Of this amount, $271,000 is committed to active projects.

Mr. Reed moved that the Executive Committee accept and file the Finance Officer’s Report dated January 9, 2020. Mr. Haley seconded the motion; motion carried.

ITEM #2: PRESENTATION OF THE OKI CERTIFICATION REVIEW—MR. FRANK BURKETT, FEDERAL HIGHWAY ADMINISTRATION (OHIO)

Mr. Frank Burkett, of the Federal Highway Administration, presented the findings on the certification review he conducted on OKI in November. This review is conducted every four years, and OKI’s staff and entire operation are evaluated to an exceptional level. The review’s positive recommendation is necessary for OKI to continue as the federally designated MPO for the region.

Mr. Burkett said he was very pleased to announce that the federal team fully certifies the transportation planning process as conducted by OKI for an additional four years. He stated that the report, which was sent out via Constant Contact, includes two recommendations to improve the regional transportation planning process. The first is to update the planning agreements to include new partners. The second includes suggestions to improve participation of transit providers throughout the entire process. He said that both recommendations are already being acted upon by OKI staff and he expressed his full confidence that those will be satisfied soon.

Mr. Burkett said he also had the distinct pleasure to tell the board that the report includes ten commendations for exemplary practices that are considered to represent national best practices. He said he would be remiss if he didn’t point out that ten commendations is an exceptional number for one MPO. He said that in the 35 reviews that he has participated in the past only once has the federal team given four or more commendations and coincidentally that was during a prior review of OKI. He also noted that each presentation given by the staff was of the highest quality he had ever witnessed during a review. He said they represent the highest professional standards and that the review has shown that the OKI staff has exceptional experience, expertise and commitment to the regional transportation planning process that reflects well, not only on them, but on OKI management and their leadership of this board.

ITEM #3: OKI SOLSMART INITIATIVE - PROGRAM OVERVIEW - ANDY MEYER, OKI SENIOR PLANNER

Mr. Andy Meyer, OKI Staff, at the end of December, OKI was awarded a Silver designation from SolSmart. SolSmart is a partnership of the ICMA and the US Department of Energy whose mission is to promote local government best practices, which support the development of solar energy. OKI was awarded this designation for its work in promoting best practices in energy, including the 2014-16 Solar Ready II project, the 2016 update of the Elements of an Effective

Local Comprehensive Plan guide which added an Energy Element, and the 2017-2020 Community Energy Planning program.

Mr. Meyer said that OKI is one of the first MPOs in the country to be awarded a SolSmart designation, and the first to be awarded silver or above. A SolSmart designation is a recognition that a community has taken proactive steps to implement best practices in supporting solar energy development, a signal to the solar industry that a community is “open for business”, and comes with the technical assistance from SolSmart to continue to support local solar development.

ITEM #4: INTERMODAL COORDINATING COMMITTEE REPORT

Mr. Andy Reser, OKI staff, said that the Intermodal Coordinating Committee met on Tuesday February 9th. The special guest was Bernadette DuPont of Federal Highway-Kentucky division and she gave a presentation on biking and public health. Andy Meyer, OKI staff, presented information on OKI’s SolSmart Initiative. Bob Koehler, OKI staff, presented information on the upcoming project prioritization process and the ICC concurred with minor revisions to the air quality and environmental justice scoring. The ICC approved a TIP Administrative Modification and three Resolutions were recommended for your approval. All 3 resolutions have to do with transportation safety and performance targets and you will hear more about this from Brett Porter, OKI staff.

Mr. Reser had one announcement for the board. Immediately following next month’s ICC meeting, on March 9th, OKI will host a workshop on how to get OKI-allocated federal transportation funding through the 2021 Project Prioritization Process. The normal ICC mailing list will get an invite, but it is open to all. If someone would like an invitation link, please contact Mr. Reser at [email protected]. The workshop will also be recorded and a link on will be posted on the OKI website.

ITEM #5: SUPPORT OF TRANSPORTATION SAFETY PERFORMANCE MEASURE TARGETS FOR THE STATES OF OHIO, KENTUCKY AND INDIANA

Mr. Brett Porter, OKI Staff, said the FAST Act mandates that States establish and maintain a performance and outcome based program to guide transportation decisions. This includes developing quantitative measures to address transportation safety on the National Highway System (NHS). Annually each state is required to update targets for five transportation safety performance measures: number of fatalities, number of serious injuries, fatality rate, serious injury rate and number of non-motorized fatalities and serious injuries. MPOs are then required to establish their own transportation safety targets or support the state safety targets. OKI has elected to support each state’s transportation safety performance measure targets.

Mr. Knochelmann moved the Executive Committee approve Resolution 2021-01 Adoption to support Transportation Safety Performance Measure Targets for the States of Ohio, Kentucky and Indiana. Ms. Driehaus seconded the motion, motion carried.

ITEM #6: ADOPTION OF REGIONAL TRANSIT SAFETY PERFORMANCE TARGETS FOR THE

OKI METROPOLITAN PLANNING AREA Mr. Brett Porter, OKI Staff, FTA and FHWA published the Public Transportation Agency Safety Plan Final Rule, which requires public transit providers establish safety performance targets. MPOs are then required under Federal Rule to establish regional transit safety performance targets for the MPO Planning area for 7 performance measure. Mr. Probst moved the Executive Committee approve Resolution 2021-02 Adoption of Regional Transit Safety Performance Targets for the OKI Metropolitan Planning Area. Mr. Sams seconded the motion, motion carried. ITEM #7: ADOPTION TO SUPPORT THE ADJUSTED INFRASTRUCTURE AND CONGESTION

PERFORMANCE TARGETS FOR THE STATES OF INDIANA AND KENTUCKY Mr. Brett Porter, OKI Staff, the FAST Act mandates that States and MPOs establish and maintain a performance and outcome based program to guide transportation decisions. They are required to establish transportation performance measures and targets for certain goal areas including safety, infrastructure condition, and congestion and system performance. In regards to infrastructure and congestion performance, there are 12 areas States and MPOs must establish 2 and 4-year targets for. These areas include: percent of interstate pavement in good and poor condition, percent of non-interstate NHS roadway pavement in good and poor condition, percent of NHS bridges in good and poor condition, percent of reliable interstate miles traveled, percent of reliable non-interstate miles traveled, interstate truck travel time reliability index, annual hours of peak hour excessive delay per capita, percent of non-single occupancy vehicle travel in the urbanized area, and emissions reductions from CMAQ projects. Mr. Porter said State DOTs may adjust an established 4-year target in the Mid Performance Period Progress Report and coordinate with MPOs when adjusting such targets. He said the State of Indiana has elected to adjust five performance targets - percent of interstate pavement in good condition, percent of non-interstate NHS pavement in good condition, percent of NHS bridges in good and poor condition, and Truck Travel Time Reliability Index. Mr. Porter said the State of Kentucky has elected to adjust four of their targets - percent of interstate pavement in poor condition, percent of NHS bridges in good and poor condition, and Truck Travel Time Reliability Index. Mr. Porter mentioned MPOs have 180 days following the adjustment and reporting of the performance targets to support the State-adjusted targets or set their own adjusted targets. OKI has elected to support both Indiana and Kentucky’s adjusted targets.

Mr. Reed moved the Executive Committee approve Resolution 2021-03 Adoption to support Adjusted Infrastructure and Congestion Performance Targets for the States of Indiana and Kentucky. Mr. Aiello seconded the motion, motion carried.

OF THE EXECUTIVE COMMITTEE OF THE OHIO-KENTUCKY-INDIANA REGIONAL COUNCIL OF GOVERNMENTS

AUTHORIZING THE FILING OF AN APPLICATION WITH THE DEPARTMENT OF TRANSPORTATION,

UNITED STATES OF AMERICA, FOR A GRANT UNDER FIXING AMERICA’S SURFACE TRANSPORTATION ACT (FAST ACT) AND A RESOLUTION COMMITTING THE LOCAL SHARE OF

FUNDS NECESSARY TO SECURE A SECTION 5311/5339/5310/5303/5304 GRANT APPLICATION.

WHEREAS, the Secretary of Transportation is authorized to make grants for mass transportation projects; and

WHEREAS, the contract for financial assistance will impose certain obligations upon the

applicant, including the provision by it of the local share of the project costs; and

WHEREAS, it is required by the U.S. Department of Transportation in accordance with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance under the Fixing America’s Surface Transportation Act (FAST Act), the applicant gives an assurance that it will comply with Title VI of the Civil Rights Act of 1964 and the Department of Transportation requirements thereunder; and

WHEREAS, it is required by the U.S. Department of Transportation in accordance with the

provisions of Section 504 of the Rehabilitation Act of 1973, that in connection with the filing of an application for assistance the applicant gives an assurance that it will comply with Section 504 of Rehabilitation Act of 1973 and the U.S. Department of Transportation requirements thereunder; and

WHEREAS, it is required by the U.S. Department of Labor in accordance with the provisions of

Section 5333(b) of the Fixing America’s Surface Transportation Act (FAST Act), that in connection with the filing of an application for assistance under the Fixing America’s Surface Transportation Act (FAST Act), and in the absence of a waiver from the U.S. Department of Labor, the applicant gives an assurance that it will comply with Section 5333(b) of the Fixing America’s Surface Transportation Act (FAST Act), and the U.S. Department of Labor requirements thereunder; and

WHEREAS, it is the goal of the applicant that disadvantaged business enterprises be utilized

to the fullest extent possible in connection with this project, and the definite procedures shall be established and administered to ensure that disadvantaged businesses shall have maximum feasible opportunity to compete for contracts when procuring construction contracts, supplies, equipment contracts or consultant and other services. Now, therefore,

BE IT RESOLVED that the Executive Committee, hereinafter referred to as Applicant’s Governing

Board, of the Ohio-Kentucky-Indiana Regional Council of Governments (OKI), hereinafter referred to as Applicant, authorizes the following in regards to Mark R. Policinski, CEO/Executive Director,

hereinafter referred to as Agency Representative:

Section 1. That Agency Representative of the Applicant is authorized to execute and file an application on behalf of the Applicant with the U.S. Department of Transportation, to aid in the financing of the planning projects described in the attachment.

Section 2. That Agency Representative is authorized to execute and file with such application an assurance or any other document required by the U.S. Department of Transportation effectuating the purpose of Title VI of the Civil Rights Act of 1964.

Section 3. That Agency Representative of the Applicant is authorized to set forth and execute affirmative minority business policies in connection with the project’s procurement needs.

Section 4. That Agency Representative of the Applicant is authorized to set forth and execute with such application an assurance that the Applicant will comply with the conditions of the Section 5333(b) Warranty as required by the U.S. Department of Labor effectuating the purposes of Section 5333(b) of Fixing America’s Surface Transportation Act (FAST Act).

Section 5. That Agency Representative is authorized to furnish such additional information as the U.S. Department of Transportation may require in connection with the application or the project.

Section 6. That Agency Representative is authorized to execute grant contract agreements on behalf of Applicant with the Kentucky Transportation Cabinet for aid in the financing of the planning projects.

Section 7. That Agency Representative is authorized to sign all grant, budgets, application and contract agreements via electronic signature on behalf of Applicant with the Kentucky Transportation Cabinet.

Section 8. This Resolution shall be in full force and effect from and after the date of its adoption.

WHEREAS, Applicant is authorized by 23CFR Section 450.310 Metropolitan Planning Organization designation to apply for and accept grants of money to assist in the implementation of a transit system or for transportation planning in the OKI Region; and

WHEREAS, Applicant has applied to the Kentucky Transportation Cabinet and the Federal Transit Administration of the United States Department of Transportation Act of 1964, in connection with the Section 5311/5339/5310/5303/5304 project; and

WHEREAS, said Applicant requires assurance of the Applicant’s Governing Board relative to the commitment of the local share for the Section 5311/5339/5310/5303/5304 project(s). Now, therefore,

ITEM #4: AMENDMENT #4 OF THE OKI FISCAL YEARS 2021-2024 TRANSPORTATION IMPROVEMENT PROGRAM

DESCRIPTION: The attached exhibit, in resolution form, describes the specific revision proposed.

BACKGROUND: OKI is responsible for preparing biennially a four-year program of projects in this region that will make use of available Federal-Aid Highway funds and Federal Transit Administration funds. Inclusion in this program is a prerequisite for such federal assistance. Because the scope, cost, and timing of the included projects are subject to periodic change, and because new projects are continually being developed, the TIP is periodically amended as needed.

The amendment reflected in the proposed resolution includes eleven projects in Ohio, twelve projects in Kentucky and two projects in Indiana. Of the twenty-five projects included in this amendment, twenty-one contain new OKI federal funds as awarded by the Board of Directors in October 2020. All projects are exempt from air quality conformity requirements and have been reviewed through the interagency consultation process.

Prior to presentation to the Executive Committee, the proposed amendment is reviewed by staff and presented to the Intermodal Coordinating Committee. The Intermodal Coordinating Committee considers the issue, and makes a recommendation to Executive Committee. The amendment has been posted to the OKI website for at least 14 days and public comments were accepted.

AUTHORITY: 23 CFR, §450.324.

FUNDING: The fiscally constrained items proposed for the amendment have an associated funding amount and source specified. Staff has determined that there is adequate funding available, or anticipated to be available, and the funding amounts are shown in year of expenditure figures for this project.

ACTION RECOMMENDED: Adoption of Resolution OKI 2021-05.

OF THE EXECUTIVE COMMITTEE OF THE OHIO-KENTUCKY-INDIANA REGIONAL COUNCIL OF GOVERNMENTS

CONCERNING AMENDMENT #4 OF THE FISCAL YEARS 2021 – 2024 TRANSPORTATION IMPROVEMENT PROGRAM

WHEREAS, the Ohio-Kentucky-Indiana Regional Council of Governments (OKI) is designated as the Metropolitan Planning Organization (MPO) by the Governors of Ohio, Kentucky and Indiana acting through the Ohio Department of Transportation (ODOT), the Kentucky Transportation Cabinet (KYTC) and the Indiana Department of Transportation (INDOT) and in cooperation with locally elected officials in the OKI region; and

WHEREAS, the Intermodal Coordinating Committee (ICC), as the technical advisory committee to OKI, has reviewed and recommended the projects listed in the resolution and recommend that they be added/amended into the Transportation Improvement Program (TIP); and

WHEREAS, all federally funded transit and highway projects in the Ohio Counties of Butler, Clermont, Hamilton and Warren, the Kentucky Counties of Boone, Campbell and Kenton and the Indiana County of Dearborn must be included in the TIP prior to the expenditure of federal funds and be listed with year of expenditure dollars; and

WHEREAS, the amendments are consistent with the OKI 2050 Metropolitan Transportation Plan as amended on September 10, 2020 and the OKI Regional ITS Architecture adopted on September 8, 2016; and

WHEREAS, all projects included in Amendment 4 – Fiscal Years 2021-2024 Transportation Improvement Program are exempt from transportation conformity requirements for air quality; and

WHEREAS, the opportunity for public participation has been provided per OKI’s Public Participation Plan; and

WHEREAS, the environmental justice impacts of these amendments have been considered with “Executive Order 12898 Federal Actions to Address Environmental Justice in Minority Populations and Low Income Populations”; and

WHEREAS, this amendment will result in a TIP that remains fiscally constrained: Now, therefore,

BE IT RESOLVED that the Executive Committee of the Ohio-Kentucky-Indiana Regional Council of Governments at its regular public meeting on March 11, 2021 hereby amends the Fiscal Years 2021 – 2024 Transportation Improvement Program as shown in the attached Amendment #4 project tables:

ITEM #5: PROPOSED AMENDMENT #46 TO OKI’S WATER QUALITY MANAGEMENT PLAN – SPRINGBORO/MONTGOMERY COUNTY SUGAR CREEK FPA

BACKGROUND: OKI completed the original Regional Water Quality Management Plan in 1977 (WQM Plan), as called for by Section 208 of the Clean Water Act. Amendments to the plan are needed periodically to reflect changing circumstances. Amendment #43 has been prepared to update wastewater facility planning area boundaries and management agency designations for the City of Springboro and vicinity in Warren County.

Amendment #46 would enable an addition of 13.7 acres to the wastewater facility planning area (FPA) for the City of Springboro service area, from an adjoining area located just east of the terminus of Belleclaire Road in Clear Creek Township where development is being planned. This area is currently identified as part of the Sugar Creek FPA managed by the Montgomery County Environmental Services. However, because no Montgomery County-owned wastewater facilities are in proximity to the proposed area, with none contemplated in the foreseeable future, sewer service can be provided most expeditiously and efficiently by the City of Springboro through a sewer line on the boundary of the parcel. City of Springboro sewer extension to this additional area would provide collection service for new development, and treatment would be provided by the City’s WWTP.

RESOLUTION OF THE EXECUTIVE COMMITTEE OF THE

OHIO-KENTUCKY-INDIANA REGIONAL COUNCIL OF GOVERNMENTS (OKI)

CONCERNING AMENDMENT #46 TO OKI’S REGIONAL WATER QUALITY MANAGEMENT (WQM) PLAN

WHEREAS, the governor of Ohio has designated OKI as the agency to carry out the planning requirements of Section 208 of the Federal Water Pollution Control Act Amendments of 1972 for Butler, Clermont, Hamilton, and Warren Counties in Ohio, and

WHEREAS, OKI has prepared a regional water quality management plan in accordance with applicable law, and

WHEREAS, OKI’s Executive Committee adopted OKI’s regional WQM Plan at its public meeting of February 23, 1978, and

WHEREAS, it is recognized that the regional WQM plan represents a dynamic planning process which needs to be amended from time to time to accommodate and reflect the ever changing circumstances resulting from urban activities and stemming from local, state, and federal policies and/or directives. Now, therefore,

BE IT RESOLVED, that OKI’s Executive Committee at its regular public meeting of March 11, 2021 amends OKI’s WQM Plan to permit:

1. Updating boundaries for wastewater facility planning areas (FPAs) in north central WarrenCounty to extend the boundaries of the Springboro facility planning area (FPA) as shown on theassociated map, thereby enabling water quality to be protected and maintained through theprovision of timely wastewater treatment improvements; and

2. Updating wastewater management agency designations as follows: Designating the City of Springboro as the wastewater management agency to construct,

maintain, and operate wastewater collection and treatment facilities for the area shownon the associated map within the expanded Springboro FPA; and

De-designating Montgomery County Environmental Services as the wastewatermanagement agency for the area that is being transferred from the MontgomeryCounty Sugar Creek FPA to the City of Springboro FPA.
