This information booklet has been designed to acquaintyou with the role of ECFMG in administering the Exchange Visitor Program, as well as to introduceyou to regulations governing sponsorship of the J-1 visa.   • 2EDUCATIONAL COMMISSION FOR FOREIGN MEDICAL GRADUATESExchange Visitor Sponsorship Program (EVSP)

    The Educational Commission for Foreign Medical Graduates (ECFMG) is authorized by the UnitedStates Information Agency (USIA) to sponsor foreign national physicians as Exchange Visitors inaccredited clinical training programs and in short-term advanced research programs (involvingprimarily observation, consultation, teaching or research) in the United States. Foreign nationalphysicians sponsored by ECFMG are issued a Certificate of Eligibility for Exchange Visitor (J-1 Visa)Status. This certificate is referred to as Form IAP-66 and can be issued by ECFMG for a minimumperiod of three weeks and a maximum period of one year.

    The objectives of the Exchange Visitor Sponsorship Program are to enhance international exchangein the field of medicine and to promote mutual understanding between the people of the United Statesand other countries through the interchange of persons, knowledge and skills.

    The Program is administered by ECFMG in accordance with the provisions set forth in a Memorandumof Understanding between ECFMG and the USIA and the Federal Regulations established toimplement the Mutual Educational and Cultural Exchange Act. ECFMG is responsible to ensure thatall Exchange Visitors and host institutions meet the federal requirements for participation.

    ROLE OF THE EXCHANGE VISITOR

    The individual Exchange Visitor is required to obtain and remain in valid J-1 visa status throughout theduration of his/her stay in the United States. If an Exchange Visitor wishes to extend his/her stay inthis country beyond the end date on the most recent IAP-66, he/she must file the appropriateapplication with ECFMG at least six weeks prior to the IAP-66 expiration date. Each IAP-66 is issuedto reflect specific training dates, training level, and training program. The IAP-66 is not transferableand is to be used exclusively for training at the institution indicated on the Form. The ExchangeVisitor is required to notify ECFMG of any proposed changes to his/her training specifics (e.g., traininglevel, training dates, etc.) and/or departure from a training program.

    EXCHANGE VISITOR DEPENDENTS

    ECFMG is authorized to sponsor the spouse and unmarried minor children of the Exchange Visitor forentry to the United States under J-2 visa status. A minor child is defined as one under the age of 21.Parents, brothers, sisters, other family members, or domestics are not eligible for sponsorship as J-2dependents.

    TRAINING PROGRAM LIAISONS

    The host institution in the United States providing the clinical or research training designates anindividual to act as an intermediary between ECFMG and the program. This individual is known as theTraining Program Liaison (TPL). The TPL communicates with ECFMG on all matters pertaining to J-1visa sponsorship.

  • 3CATEGORIES OF SPONSORSHIPECFMG is authorized by the USIA to sponsor foreign nationals who are graduates of accreditedmedical schools in either clinical training programs of graduate medical education or in non-clinicalprograms of observation, consultation, teaching or research.

    Physicians sponsored as J-1 Exchange Visitors for participation in accredited clinical programs ofgraduate medical education or training are categorized as alien physicians.

    Physicians sponsored as J-1 Exchange Visitors for participation in non-clinical programs primarilyinvolved with observation, consultation, teaching or research are categorized as researchscholars. Unlike alien physicians, participants in these programs generally do not have to passU.S. medical licensing or English examinations and are not required to be ECFMG certified.Research scholars are limited to activities involving no patient contact or incidental patient contact.

    While ECFMG is the only agency authorized to sponsor alien physicians for J-1 status, many U.S.hospitals and training institutions are USIA-designated sponsors for J-1 research scholars.Therefore, ECFMG only provides research sponsorship to those physicians participating in programsat hospitals or institutions that do not have their own J-1 research designation.

    The categories of alien physician and research scholar are specifically defined in the U.S. Code ofFederal Regulations as follows:

    ALIEN PHYSICIAN (Clinical Training Program)An alien physician is...a foreign medical graduate seeking to pursue graduate medical education ortraining at accredited schools or medical or scientific institutions [22CFR514.27(a)]. The termgraduate medical education is further defined as a program in which the alien physician willreceive graduate medical education or training, which generally consists of a residency orfellowship program involving health care services to patients, but does not include programsinvolving observation, consultation, teaching or research in which there is no or only incidentalpatient care. This program may consist of a medical specialty or a directly related medicalsubspecialty or both... [22CFR514.2].

    RESEARCH SCHOLAR (Non-clinical Program)A research scholar is...an individual primarily conducting research, observing, or consulting inconnection with a research project[22CFR514.4(f)].

  • 4GENERAL QUALIFICATIONS FOR ALIEN PHYSICIANCLINICAL TRAINING PROGRAM

    Foreign nationals applying for sponsorship as alien physicians must meet the following generalrequirements:

    Pass USMLE Step 1 and Step 2 or the former VQE, NBME Part I and Part II orFMGEMS; (Note: The former one-day ECFMG Medical Examination does not meet therequirements for J-1 visa sponsorship.)

    Hold a valid Standard ECFMG Certificate*; (Note: Graduates of LCME-accredited U.S.and Canadian Medical Schools are not required to be ECFMG certified.)

    Hold a contract or an official letter of offer for a position in an ACGME-accreditedprogram that is affiliated with a LCME-accredited medical school;

    Provide a statement of need from the Ministry of Health of the country of nationality orlast legal permanent residence. This statement must provide written assurance that thecountry needs specialists in the area in which the Exchange Visitor will receive trainingand that he/she will return to the country upon completion. (Note: If permanent residenceis in a country other than that of citizenship, the Ministry of Health letter must come fromthe country of most recent legal permanent residence.) *See Ministry of Health SampleLetter on page 7.

    * Please note that the new requirement for ECFMG Certification includes a Clinical Skills Assessmenteffective July 1, 1998. Refer to ECFMGs home page at www.ecfmg.org for additional information. Duration of Stay: ECFMGs sponsorship for programs of graduate medical education is limited to thetime typically required to complete specialty/subspecialty training requirements as determined by theABMS. The duration of sponsorship is further limited to a maximum of seven years.

    GENERAL QUALIFICATIONS FOR RESEARCH SCHOLAR NON-CLINICAL PROGRAM

    Foreign nationals applying for sponsorship as research scholars must meet the following generalrequirements:

    Be a graduate of a U.S., Canadian or foreign medical school; Hold a contract or official letter of offer for a position; Obtain the appropriate certification statement (see Initial Application Checklist); Have not been physically present in the United States as a J-1 or J-2 non-immigrant for

    the twelve-month period immediately preceding the contracted program start date.

    Duration of Stay: Duration of sponsorship is limited to a maximum of three years.

    SELECTED FEDERAL REGULATIONS GOVERNING EXCHANGE VISITOR PHYSICIANS

    Exchange Visitor physicians and host institutions should be familiar with the policies outlined in the U.S. Code ofFederal Regulations which relate to an Exchange Visitors stay in the United States. Following is a summary ofthe major requirements affecting Exchange Visitor physicians. Applicants are encouraged to also review acomplete copy of the regulations which are located in the Code of Federal Regulations, 22 CFR Part 514.Copies are generally available at university, law school or public libraries, or USIAs home page atwww.USIA.GOV. DURATION OF STAY: The duration of stay of the Exchange Visitor in the United States is limited to the timetypically required to complete the advanced medical education program. For clinical training programs, the timetypically required refers to the medical specialty and subspecialty certification requirements published by theABMS. The duration of stay in clinical programs is further limited to a period of no more than seven years.Foreign national physicians participating as research scholars in programs of observation, consultation, teachingor research are allowed a maximum stay of three years to complete an educational objective. VISA CATEGORY CHANGE : Exchange Visitors may not, as a matter of course, change from one J-1 categorydesignation to another. The categories most often used by foreign national physicians are: research scholar,professor, student, and alien physician. For example, physicians entering the United States in J-1 statusunder the category of research scholar may not change to the alien physician category for clinical training.Likewise, physicians entering under the alien physician category are not eligible to change to the researchscholar category. CHANGE OF SPECIALTY : The Regulations state that ...the alien physician may once, and not later than twoyears after the date the alien physician enters the U.S. as an Exchange Visitor (or acquires exchange visitorstatus), change his/her designated program of graduate medical education or training... [22CFR514.27(f)].ECFMG is authorized to issue a change in program specialty before the completion of the second year oftraining. Once an Exchange Visitor enters the third year of training, a change in specialty is no longer permitted.Below you will find a list of medical specialties recognized by the ABMS.     SELECTED FEDERAL REGULATIONS GOVERNING EXCHANGE VISITOR PHYSICIANS

    TWO-YEAR HOME COUNTRY RESIDENCY: In accordance with Section 212(e) of the Immigration andNationality Act, as amended, all Exchange Visitors categorized as alien physicians (and all accompanying J-2dependents) are required to return to their country of origin or country of last legal permanent residence for anaggregate of at least two years before becoming eligible for a change or adjustment in visa status. Researchscholars, in some instances, may not be subject to this requirement. MANDATORY INSURANCE REQUIREMENTS: Federal Regulations require that Exchange Visitors anddependents obtain health, accident, medical evacuation and repatriation of remains insurance. Insurance mustprovide the following coverage:

    1. medical benefits of at least $50,000 per accident or illness 2. repatriation of remains in the amount of $7,500 3. expenses associated with the medical evacuation of the Exchange

    Visitor to his/her home country in the amount of $10,000 4. a deductible not to exceed $500 per accident or illness.

    ECFMG will provide insurance for the Exchange Visitor and his/her accompanying dependents for medicalevacuation and repatriation of remains (numbers 2 and 3 above). The policy will match the prescribed levelsstipulated by Federal Regulations and becomes effective on the start date indicated on the IAP-66. A copy of thepolicy will be sent with the IAP-66. It is the responsibility of the Exchange Visitor to obtain the other insurancespecified in numbers 1 and 4 above. In many cases, this insurance is provided as a benefit of the trainingprogram at the host institution. TRAINING AUTHORIZATION: The primary objective of each ECFMG-sponsored Exchange Visitor is to receivegraduate medical training in the United States which will ultimately enhance his/her skills in a specialty field ofmedicine. Visa sponsorship, which is documented by the IAP-66 issued by ECFMG, authorizes a specifictraining activity and associated financial compensation. Federal Regulations do not permit activity and/orfinancial compensation outside of the defined parameters of the training program. Therefore, employmentoutside of approved residency or fellowship training is not permitted. Dependents of the Exchange Visitor in the United States with J-2 status may file an Application for EmploymentAuthorization (Form I-765) with the office of the Immigration and Naturalization Service for permission to acceptand/or continue employment, provided that the earned income is not needed for support of the principle (J-1)Exchange Visitor. Form I-765 may be obtained by calling the INS Forms Request Line at (800)870-3676 oraccessing the INS home page at www.ins.usdoj.gov. REPEAT TRAINING: Exchange Visitors are expected to advance through progressive levels of training asrequired by specialty/subspecialty Boards. Repetition of any portion of training is discouraged. Requests forrepeat training will only be considered upon strong recommendation by the Program Director.

  • 7 MINISTRY OF HEALTH SAMPLE LETTER U.S. Public Law 94-484, effective January 10, 1978, requires that Exchange Visitor applicants providea statement of need from the Ministry of Health of the country of his/her nationality or most recentlegal permanent residence. Such statement must provide written assurance, satisfactory to theSecretary of the United States Department of Health and Human Services, that there is a need in thatcountry for persons with the skills the alien physician seeks to acquire. If applicant has acquired legalpermanent resident status in a country other than that of citizenship, the statement of need mustcome from the Ministry of Health of the country of most recent legal permanent residence. The letter must accurately reflect the program being pursued as follows: If applying for sponsorship in a residency training program, the statement of need must

    specify a need for the specialty being pursued (subspecialty letters are not acceptable).The specialty indicated must be recognized by the ABMS.

    If entering a subspecialty training program, the statement of need must reflect thesubspecialty being pursued.

    The following is the exact wording that has been approved by the U. S. Secretary of Health andHuman Services for the Ministry of Health letter: Name of Applicant for Visa: _________________________ There currently exists in (country) a need for qualified medical practitioners in the specialty* of

    ______________________. (Name of Applicant for visa) has filed a written assurance with the government of this country that he/she will return to his/her country upon completion of training in the United States and intends to enter the practice of medicine in the specialty* being sought. Include Stamp (or Seal and Signature) of issuing official of named country. Include Date and Signature of Official of named country. *and/or subspecialty The Ministry of Health letter must be prepared on the official letterhead of the Ministry of Health, bearthe seal of that government, and be signed by the duly-designated official.

    I-94 CARD: ARRIVAL AND DEPARTURE RECORD The I-94 Card is the Arrival/Departure Record issued by the U.S. Immigration and NaturalizationService either upon entry to the United States or upon filing of INS Form I-539/Application to Extendor Change Non-Immigrant Visa Status. This small white card is placed in the Exchange Visitorspassport and documents legal status in the United States with the following information: Date ofEntry to the U.S.; Visa Status granted upon entry; Length of Authorized Stay in the U.S.

    The length of authorized stay may be indicated in one of two ways:

    D/S (Duration of Status) - J-1 visa status is valid when in possession of both the I-94 anda valid, current IAP-66. The I-94 card with D/S status expires with the end date of the IAP-66, upon leaving the program, or upon departing the U.S., whichever comes first.

    OR

    Finite End Date - J-1 status is valid only until the specific date written on the I-94 Card,regardless of IAP-66 dates. The I-94 card expires with the finite end date on the I-94 card,upon leaving the program, or upon departing the U.S., whichever comes first.

    Please note that INS grants a 30-day grace period of lawful status from the expiration date if the I-94card is finite, or from the expiration date on the IAP-66 if the I-94 card is marked D/S. This additional30-day period, applicable only to J status, is for the purpose of making final arrangements beforedeparting the U.S. There is no employment or training authorization during this 30-day grace period.

    MAINTENANCE OF LAWFUL STATUS Lawful status can be maintained only through possession of both a valid Form IAP-66 and Form I-94.Form I-94 marked with Duration of Status (D/S) is valid until the end date shown on Form IAP-66. If,for any reason, training with the host institution concludes prior to the end date shown on Form IAP-66, sponsorship termination becomes effective as of the last day of training rather than the dateshown on the IAP-66. It is the Exchange Visitors personal responsibility to ensure that he/she maintains lawful J-1visa status.

    RECEIVING INFORMATION FROM ECFMG ECFMG will forward the IAP-66 to the host institution by first class mail (United States Postal Service). ECFMGis not authorized to release an original IAP-66 directly to an Exchange Visitor and will communicate only with thedesignated Training Program Liaison (TPL) at the host institution regarding application status. If use of an express courier for mailing of Form IAP-66 is preferred, please attach an airbill to the application.The airbill must be pre-paid and pre-addressed to the TPL.

    APPLICATION CHECKLIST FOR INITIAL SPONSORSHIP IN CLINICAL TRAINING PROGRAMS

    Verify that all required documentation is submitted at the time of application by marking the appropriate boxes below. Allowfour to six weeks for processing following submission of a complete application packet to ECFMG. If an incompleteapplication is submitted, the processing time will increase. For this reason, ECFMG requests that all requireddocumentation is submitted at one time in one package. Please retain photocopies of all application materials. STANDARD REQUIREMENTS: The following is required with every application for initial sponsorship. q FORM MF-1: APPLICATION FOR INITIAL SPONSORSHIP

    Section A (Personal Information) must be completed by the Exchange Visitor applicant. Section B(Program Information) must be completed by the Training Program Liaison. Attach additionaldocumentation as needed for questions 9, 10, 11.

    q CONTRACT OR LETTER OF OFFER

    The contract or letter of offer must be specific to the applied-for sponsorship period (not to exceed oneyear) and must list exact start and end dates, specialty and/or subspecialty, training level andapproximate training stipend. The contract or letter of offer must be signed by both the Exchange Visitorand a hospital official.

    An official description of the training program is required for Exchange Visitors entering subspecialty(fellowship) training. The description must clearly outline the core curriculum, specifying clinical andresearch components, and provide an exact duration. NOTE: The fellowship description may be takenfrom a formal program brochure or may be prepared and signed by the program director.

    q SPONSORSHIP FOR NON-STANDARD PROGRAMS (see memo outlining additional requirements)

    q COPY OF MEDICAL SCHOOL DIPLOMA If applicant is a graduate of a LCME-accredited U.S. or Canadian medical school, a copy of the medicalschool diploma and certified translation, if applicable, must be submitted in lieu of ECFMG certification.

    q FULL-FACE PHOTOGRAPH

    If applicant is a graduate of a LCME-accredited U.S. or Canadian medical school, include a passport-size photograph with the application.

    Include a detailed description of the program outlining the overall curriculum and educational goals. Thedescription must specify the intended duration of the research project. The description may be takenfrom a formal program brochure or may be prepared and signed by the program director.

    q PATIENT CONTACT CERTIFICATION STATEMENT

    Official certification regarding level of patient contact (either incidental or no patient contact) is required.Please see below.

    Include USMLE/ECFMG identification number on the check or money order.

    *CERTIFICATION STATEMENT: INCIDENTAL PATIENT CONTACTPrograms with patient contact incidental to the activities of observation, consultation, teaching, or research, a description ofthe fellowship program is required. The program must be affiliated with a United States medical school which has beenaccredited by the Liaison Committee on Medical Education (LCME). The dean of the affiliated medical school or his/herdesignee is required to certify the following five-point statement. If the statement is certified by the deans designee, a letternaming the designee is required from the dean.1. The program in which Dr. (applicants name) will participate is predominantly involved with observation,

    consultation, teaching or research.2. Any incidental patient contact involving the alien physician will be under the direct supervision of a physician who

    is a U.S. citizen or resident alien and who is licensed to practice medicine in the State of (state in which thetraining institution is located).

    3. The alien physician will not be given final responsibility for the diagnosis and treatment of patients.4. Any activities of the alien physician will conform fully with the State licensing requirements and regulations for

    medical and health care professionals in the State in which the alien physician is pursuing the program.5. Any experience gained in this program will not be creditable towards any clinical requirements for medical

    specialty board certification.*CERTIFICATION STATEMENT: NO PATIENT CONTACT

    Programs with no patient contact require a detailed description of the program outlining the overall curriculum. The programdirector/mentor of the research program is required to include the following certification statement.

    This certifies that the program in which Dr. (applicants name) is to be engaged is solely for the purpose of observation, consultation, teaching or research, and that no element of patient care services is involved.

    ABMS American Board of Medical Specialties

    ACGME Accreditation Council for Graduate Medical Education: Responsible for the accreditation ofgraduate medical education programs in the United States.

    AMA American Medical Association: Major physician membership organization in the UnitedStates; instrumental in establishing standards that support graduate medical education.

    I-94 Card Record of arrival to/departure from the United States; it documents Exchange Visitors visastatus.

    IAP-66 Certificate of Eligibility. The legal document necessary to obtain/maintain J-1 status.

    INS Immigration and Naturalization Service: U. S. government agency responsible foradministration and enforcement of the Immigration and Nationality Act.

    J-1 Visa status assigned to Exchange Visitors for the purpose of education and/or training in the U.S.

    J-2 Visa status assigned to dependents of Exchange Visitors. Note: Dependents are defined asspouse and/or unmarried children under the age of 21 who are either in the United States withthe Exchange Visitor or who will accompany the Exchange Visitor in the future.

    TPL Training Program Liaison: Person at the host institution who coordinates the administrativedetails of the Exchange Visitors training program.

    USIA United States Information Agency: U. S. government agency responsible for theadministration of all Exchange Visitor Programs.

    Issued by a United States Embassy or Consulate and located inside of a passport. Allows aforeign national to enter and/or re-enter the U. S. (may be issued to allow single or multiple-entry;must include a valid end date). Should not be confused with the I-94 card; the visa stampdoes not document authorized duration of stay; it is an entry document only and does notconfer visa status.
