THE END OF THE EVICTION MORATORIUM

• March 23, 2020 – June 29, 2021: Minnesota had an eviction moratoria (Executive Orders 20-14, 20-73

and 20-79) which halted most evictions except for certain specific circumstances.

• Starting June 30, 2021, evictions are being phased back in.

• Laws of Minnesota 2021, 1st Spec. Sess. Chapter 8, Article 5

• Expecting an influx of cases

• Significant expansion of landlord's right to file evictions.

• Courts are to schedule initial appearances within 7-14 days of the issuing of the summons. Minn.

Stat. 504B.321, subd. 1(d).

• Courts may not be screening to see that only appropriate cases are being filed.

Seriously endanger the safety of others;

Significantly damage property; orEngage in criminal behavior prohibited by Minn. Stat. 504B.171, subd. 1 (guns, drugs,

prostitution or stolen property on the premises)

June 30 Tenants that owe rent and refuse to:

Apply for Rent Help MN;

Provide the landlord information necessary to apply for Rent Help MN; orProvide proof of application for Rent Help MN

June 30 Manufactured homes: Evict pursuant to 327C.09 due to endangering the safety of others or

park personnel

July 14 Material breach of lease

Sept. 12 Non-payment of rent for tenants *ineligible* for rental assistance

Oct. 12 For non-payment EXCEPT if the tenant has a *pending* application for rental assistance

June 1, 2022 Non-payment of rent regardless of rental assistance application status

79% are people of color or mixed-race

52% identify as Black or African American.
