    This document is an annual procurement plan of the Ethiopian Pharmaceuticals

    Supply Agency for the 2013 Ethiopian Fiscal Year which defines the appropriate goods

    (pharmaceuticals products, lab chemical and reagents and medical equipment) that

    the agency will obtain from local and international suppliers.

    The purpose of the document is to inform the list of required goods, to estimate the

    forecasted expenses and to define the tendering procedures and implementation

    timelines. This procurement plan helps the agency define its procurement

    requirements and to decide where and when to procure.

    Consistent with the Federal Public Procurement Proclamation 649/2009 Chapter

    Three-Section 22, Public bodies shall have to prepare an annual procurement plan

    showing their procurement for the concerned budget year and containing such

    details are stated in the directive to be issued by the Minister.

    The procurement plan shall have to be approved by the head of the public body

    concerned and communicated to the relevant departments of the public body and the

    Agency until Hamle 30 of the Ethiopian Calendar.

    In light of fairness and transparency the procurement plans shall be published and

    made available to the general public. Through publication of the Procurement Plans,

    interested bidders can be made aware of the upcoming tenders and thus have ample

    time to prepare themselves accordingly.

    By publishing the plans, the public is also made aware of the different activities to be

    undertaken by the agency within the specified year and in turn it gives a clearer

    picture of public spending.

  • Introduction

    The Procurement Plan is an annual document which defines the products and

    services that a Public Body will obtain from external suppliers. A sound procurement

    plan helps a Procuring Entity to define their procurement requirements and to decide

    what, when where and how to procure.

    EPSA being a public institution, its procurement and contract management is

    governed by procurement legal frameworks (Proclamation 649/2009, Directive 8th

    June 2010 and Manual 2011) issued by PPA. Tender management directorate must

    ensure total compliance with the provisions and conditions of the legal frameworks.

    Annual Procurement planning is one of the critical process that each public

    Institution is required to undertake to ensure annually the needs to sustain their

    operations are planned through annual procurement planning processes. This

    process must be aligned with available resource to ensure delivery of required

    services to general public. Tender management always ensure proper planning of

    requirements for EPSA to ensure that EPSA constantly delivers services expected of

    them by the government and the general public. Procurement planning at EPSA is a

    complex process that requires proper and advance planning since it involves so

    many stakeholders internally and externally that relies a lot on EPSA services.

    Tender management therefore must work very closely with the key stakeholders to

    ensure annual procurement planning processes is achieved and necessary

    approvals granted before implementation of the plan.

    Background Pursuant to section 22 of Proclamation 649/2009 and section 8 (Part III) of the

    Directive June 2010 on procurement planning provides for the following.

    1) Public bodies shall have to prepare an annual procurement plan showing

    their procurement for the concerned budget year and containing such

    details as are stated in the directive to be issued by the Minister.

    2) The procurement plan to be prepared by public bodies in accordance with

    sub-article (1) of this Article, shall have to be approved by the head of the

    public body concerned and communicated to the relevant departments of

    the public body and the Agency until Hamle 30 of the Ethiopian Calendar.

  • 3) Any Public Body and other entities accountable to such Public Body shall be

    required to prepare a procurement plan supported by action plan enabling

    them to execute in due time, the procurement necessary to implement their

    work program.

    In view of the above conditions, tender management directorate

    commenced annual procurement planning for EPSA requirements for

    financial year 2013. This process was commenced through a workshop in

    Adama with all key stakeholder present to ensure the objectives of the

    workshop is achieved. The workshop focused on review of legal

    frameworks to a certain the condition and provisions of the same,

    documentation used for planning as provided by the legal frameworks and

    risk identification associated with the planning processes & mitigation

    measures.

    Advantage of the procurement plan

    The advantages of the procurement planning process are as follows:

    • Strong alignments and cooperation with key stakeholders

    • Economies of scale are gained by uniting the requirements of different

    areas to achieve better deals

    • There are no surprises when requirements manifest

    • Everyone can plan and schedule resources more effectively.

    • Periodic indicative notices can be published based on the procurement

    plan

    • The procurement plan is linked to the strategic plan of the agency

  • Objectives Pursuant to section 8 (Part III) of the Directive June 2010 on procurement planning

    provides for the following.

    1. The procurement plan shall be prepared in such a way as to enable the

    attainment of the following objectives: -

    a) To ensure compliance with principles of public procurement stated in

    article 5 of the Proclamation.

    b) To achieve the work program of the Public Body.

    c) To ensure economy and efficiency in the operation of the Public Body by

    discouraging piecemeal purchase.

    d) Exercise prudence and make the necessary preparation to forestall

    problems that might be encountered in the execution of procurement.

    EPSA Tender management directorate will ensure that the stated objectives

    are achieved during development and implementation of the annual

    procurement planning.

    Scope The annual procurement planning will focus on procurement of Medical Supplies,

    Laboratory Reagents & Chemicals, Medicines and Medical Equipment’s for both RDF

    and Program items. All the items under RDF must in the approved EPSA procurement

    list consideration with National Essential Medicine List and items for stock.

    Program commodities and capital medical equipment annual forecast and plan will

    be done in collaborations with Ministry of Health and stakeholders respectively.

    Purpose The main purpose of the annual procurement planning process is to ensure all

    requirements from all key stakeholders are properly planned for and acquired during

    the financial year for respective use and increase coordination of service delivery at

    all SDP’s by ensure constant supply of Medical commodities.

  • Legal Framework that supports Annual procurement planning EPSA being a public institution within the Federal Government its procurement

    processes are governed by the following legal frameworks:

    Proclamation 649/2009

    Directive June 2010

    Manual 2011

    Financial Management Act (Proclamation 648/2009), (970/2016)

    Audit & Governance Act (Proclamation No 649/2010), (982/2016)

    Tender Management team must ensure total compliance with provisions and

    conditions of the state legal frameworks during annual procurement planning and

    implementation without breach.

    Source of Funds The procurement of all health commodities in view of EPSA Procurement List will be

    based on the following sources of funds:

    Revolving Drug Fund (RDF): This will focus on stock items where EPSA

    warehouse and distribute at a cost recovery through mark ups.

    Program Based Fund: This focus on non-stock items-based service

    oriented in line with donor program requirements which EPSA stock

    and distribute for free.

    Supply Plan and Budget Allocation Tender management adopted items for annual procurement planning based upon

    approved supply plan with proper budget, right procurement items in compliance

    with procurement list and required approval from respective EPSA management.

    Procurement Method and their applications Pursuant to section 15 (Part IV) of the Directive June 2010 on methods of procurement

    to be used during planning provides for the following.

    15.1 The following procurement methods are approved as per article 33 of the

    Proclamation.

    b) Restricted bidding

    c) Request for quotations

    d) Single source/ direct procurement

    e) Request for proposal, and

    f) Two stage bidding

    15.2 Except as otherwise provided in the Proclamation and this Directive, public

    bodies shall use

    open bidding as the preferred procedure of procurement.

    15.3 Public bodies may use a method other than open bidding only where

    conditions for use

    of such other method stipulated in the Proclamation and this Directive are

    satisfied.

    15.4 A Public Body using a method of procurement other than open bidding

    pursuant to article

    33/3 of the Proclamation. Shall record a statement of the grounds and

    circumstances on

    which it relied to justify the use of that method.

    1. Approval and Amendment of procurement plan, consolidated plan,

    implementation plan & risk mitigation plan

    Pursuant to section 8 (Part III) of the Directive June 2010 on approval and amendment

    of procurement planning provides for the following.

    1. Procurement units of public bodies have to submit the annual procurement

    plan they

    have prepared to the head of the Public Body for approval after consultation

    with the Procurement Endorsing Committee of the Public Body.

    2. The head of a Public Body has to monitor the execution of procurement by

    establishing a

    system enabling him to ascertain that the conduct of procurement

    conforms to the approved procurement plan.

  • 3. The head of a Public Body shall send a copy of the approved annual

    procurement plan to

    the appropriate departments and the Agency for implementation and follow

    up in accordance with the provision of article 22/2 of the proclamation.

    4. Public Body shall not split procurements nor deviate from the annual

    procurement plan once it is approved by the head of the Public Body and a

    copy of it is sent to the Agency.

    5. Notwithstanding the provision of sub article 4 of this article, a Public Body

    may at any time modify its procurement plan where necessary.

    6. A procurement plan modified in accordance with sub article 5 of this article

    shall be sent to those departments and the Agency for which the initial

    procurement plan was sent.

    In view of the above conditions, each coordinator will ensure their

    respective plans are ready, examined by Director Procurement, cleared by

    Deputy Director General inbound, Reviewed by Tender Endorsement

    committee and approved by Director General. Tender Management will only

    implement approved annual procurement plan that has been endorsed by

    EPSA Executive Committee and Board of Directors.

    Special Procurement Methods Pursuant to section 60, 61& 63 of Proclamation 649/2009 (Chapter Eleven) on special

    procurement Methods provides for the following.

    Large Value Procurement

    1) There shall be established a central body, which shall be in charge of the execution of large value procurements having national significance procurements of supplies for which a demand is shown by more than one public body and sale of public property to be disposed of, by a regulation to be issued by the Council of Ministers.

    2) The Minister shall identify and update the types of procurements to be executed on account of their national significance by the central body which shall be established pursuant to sub article (1) of this Article.

    Procedure of Framework Contract

    1) Framework contracts may be used to fulfil similar procurement requirements

    of various

    Public bodies or recurrent procurement requirements of a public body.

    2) The following procedure of framework contract shall be followed to meet similar

    procurement requirements of public bodies within a given time frame:

    a) the Agency shall undertake a survey of the similar requirements of public

    bodies, issue a list of goods and services constituting such requirements

    and update the list regularly.

    b) public bodies shall prepare a forecast of their requirements of goods and

    services falling under the list mentioned in sub-article (2) (a) of this

    Article and communicate the same to the body authorized to conduct

    large procurements.

    c) the body to be established in accordance with Article 60(1) of this

    Proclamation shall conclude and administer framework contracts in the

    manner prescribed herein and the directive to be issued by the Ministry.

    d) public bodies shall base on the framework contract signed by the central

    body of procurement conclude the procurement by making order with the

    suppliers of goods and services that they require.

  • e) the order that public bodies place with the suppliers for goods and

    services of their requirements under the framework contract shall

    confirm to the terms of the framework contract regarding price, terms of

    payment and other matters related to the execution of procurement.

    3) Except in cases provided for in Article 37 paragraph (k) of this Proclamation,

    public bodies shall not be allowed to vary unit prices and such other

    fundamental terms of the framework contract when placing order for goods

    and services. However, the public body and the supplier may agree on terms

    that have not been dealt with in the framework contract or that do not

    materially affect the framework contract.

    4) The framework contract shall be awarded through open bidding procedure and

    may remain valid for three years.

    5) In procuring goods and services under a framework contract to fulfill their

    recurrent requirements, public bodies shall have to adhere to the criterion of

    fixing prices of goods and services to be determined in the directive to be

    issued by the Minister.

    Tender management directorate in view of the above, will adopt both methods and

    deploy based on the conditions outlined above, currently TMD is undertaking both

    large volume and framework agreements approach under strategic sourcing

    requirements. Framework agreement and large volume has proved to enable EPSA

    start reducing on lead time management and encourage private sector to participate

    in procurement process competitively thus improving on health commodity

    availability and affordability.

    Publication of Annual Procurement Plan Pursuant to section 8 (Part III) of the Directive June 2010 on approval and amendment

    of procurement planning provides for the following.

    The Agency may compile the annual procurement plans submitted to it by public

    bodies in accordance with article 13/3 of this Directive, and as necessary, publish

    procurement plans the value of which exceed the threshold specified in article 6/5 of

    this Directive by assorting such plans by type of procurement, or facilitate the use by

    public bodies of its website to post such procurement plans.

    In compliance with the provision above, Tender management directorate will publish

    the approved procurement plan in accordance with the provisions above. TMD will

    not only comply to legal framework provisions but also ensure constant

    communication to PPA and public on the plan is achieved.

  • 2. Value preposition of annual procurement plan

    Conclusions

    This procurement plan helps to define the list of the required products that the agency

    is going to purchase with a clear implementation plans in lined with the public

    procurement proclamation 649/2009 to ensure the good procurement principles and

    practices.

  • RDF Health Commodities

    Every year EPSA collects health commodities demand from health facilities, the demand information will be conducted and processed through its hubs. The

    collected data further analysed and correlated with the stock on hand, on pipelines and past consumption records, this succeed with quantification exercise

    for the upcoming year.

    Similarly, the annual procurement plan of 2013 E.C. is prepared after passing through a series discussions, cross checking, and consultations. Following the

    annual procurement plan, some the commodities will be refilled from the signed framework agreement.

    Other commodities will be procured pertinent to their market nature i.e. if there are only one manufacture the solicitation will be done through direct

    contracting and if the commodities are available on local market with additional supply the award will be determined after nationally competing the local

    bidders. Notwithstanding the above preconditions the selection of bidder will be done through floating in international tender.

    Based on the above scenarios the RDF health commodities annual procurement plan for the Ethiopian FY is provided in the below table.
