The Executive Directors Message 2019

The Association monitors legislation at the federal, state and local

level. Most of our activities are confined to Albany where the bulk of

the legislation is introduced.

Since 1973, most of the time the New York State Senate has been

controlled by the Republicans and the Assembly by the Democrats.

Using the different philosophies of each party and the personality of

each legislator we have been able to oppose legislation that was

detrimental to the industry while supporting legislation that was

helpful.

The 2019 session will be different. The New York State Senate is now

in the hands of the Democrats, the Assembly did not change, and the

governor is a Democrat. Therefore all legislation that is promoted and

supported by Democrats, which we have been able to stop when

necessary, will be passed because we are dealing with one party.

We expect a host of legislation to be introduced that will follow those

that were introduced in past year. Many will provide a tremendous

burden to the industry.

We will need to monitor this legislation very carefully and call on the

industry for support when we have to oppose or support a bill. That

support should come from you knowing your local legislator and

being able to contact them on the phone, and have them listen to your

problem. The Association will be happy to provide the information on

how to do this.

Below is listed a number of topics on which we expect bills to be

introduced, some good, some bad, but mostly bad. You can look over

the topics and expect to see these bills being introduced on a regular

basis. We will comment on each bill that is derogatory to our industry

and those that are in support, and we will provide memorandums in

support and opposition and hope that industry (you) will lobby behind

our suggestions and make this legislative session as painless as

possible.

2019 Year in Review

As the countdown to ring in 2019 is right around the corner, a new year

means new laws taking effect in New York State.

Here's a countdown of some the changes you can expect.

#5 - Starting Monday, December 31st, minimum wage employees will make

$11.10 an hour. That's up from $10.40. While some small businesses owners

say customers may pay the price, advocates say it will give more workers a

living wage. Minimum wage will eventually go up to $15 an hour statewide.

#4 - Volunteer firefighters diagnosed with cancer will get disability benefits.

Only firefighters with certain cancers who are diagnosed after January 1st

are eligible.

#3 - Now the State Department of Health will review the safety of

ultraviolet nail dryers, which are often used for gel manicures and pedicures.

They'll research if there's a correlation between those dryers and skin cancer.

#2 - Now changing tables are required in public women and men's

restrooms. Businesses must have them in new or renovated restrooms.

#1 - People will get longer paid family leave, as it's increasing to 10 weeks.

Now eligible employees will be able to take that time off to bond with a new

child, care for a sick family member, or help loved ones when a relative is

deployed on active military service. A person can take that time off at any

point during the first 12 months of a child's birth, adoption or foster care

placement. The number of weeks employees can take off will continue to

rise through 2021 -- by then people will be able to take 12 weeks of paid

family leave.

Going into 2019, a major topic will be legalizing recreational marijuana.

Majority leader Crystal Peoples-Stokes has said that she believes something

will be passed during the next legislative session. The State Legislature

meets again January 9th.

Are you ready for 2019?

Are all your permits and licenses (including your own and your employee’s driver’s

licenses valid?

1. Are you paying your employees under the new minimum wage law as

follows: workers in New York City, employed by large business (at least

11 employees) - $15.00 workers in New York City employed by small

business (10 employees or fewer) - $13.50 workers in Long Island and

Westchester counties - $12.00 workers in all other areas of the state -

$11.10?

2. Are you performing inspections with a two-piece window tint meter in

accordance with the new inspection regulations regarding tinted glass?

3. Are you displaying signs mandated by D.M.V. and other government

agencies including the posting of licensed inspectors at inspection stations?

4. Are you completing and filing the immigration forms for all new

employees, “i-9”? Are you completing and filing the N.Y.S. “newly hired

employees” form?

5. Are you checking your vapor recovery equipment & complying with the

needed 5 year test (this is being phased out but is still enforceable at this

time)?

6. Are you filing your year-end taxes? Are you prepared to maintain daily,

accurate, gasoline inventory records as required by law (dip books are

available from your association)?

7. Are you maintaining the proper color code on your gasoline fill lines?

8. Are you displaying the oil sign: “we accept waste oil for recycling?

9. Are you handling used oil filters properly?

10. Are you displaying the sign: “we must accept vehicle batteries for

recycling”?

11. Are you maintaining the file of material safety data sheets (MSDS)?

12. Are you and your employees aware of the possible health hazards

associated with the various chemicals and the precautions that should be

taken?

13. Have you filed your “community right to know” form on stored substances

in N.Y.C.? The deadline is March 1st.

14. Are you maintaining a safe working environment?

15. Are all your fire extinguishers and suppression systems properly charged

and working? Safety is free! Use it generously.

16. Are you using approved repair order forms?

17. Are you providing all information required on the order form by D.M.V.?

18. Are you a member of your association sponsored worker’s compensation

group? Those who are received dividends for over 25 years.

19. Are you also providing disability insurance for your employees as required

by N.Y.S.?

20. Are you providing quality repairs?

21. Are you using quality parts? Don’t create future problems with a false

economy?

22. Are you and your technicians making time for education (work smarter not

harder)?

23. Are you maintaining a clean, attractive location? Look around, you may

be surprised.

24. Are you maintaining a sensible profit margin? You cannot survive without

it.

25. Are you prepared to sit down with accountant and review your operations?

26. Are you performing inspections properly? Do it right or don’t do it at all!

27. Are you giving written inspection appointments? Written appointments

must be on your letterhead.

A00154 – Tire Safety

One of the earliest bills to surface and probably the the most rediculas one we will

see is A154. It requires repair ships to only repair flat tires that will pass inspection.

Hard to do when there is no standard or regulations

This is the beginning of the ignorance that will be displayed in the legislative bills

SUMMARY OF SPECIFIC PROVISIONS:

The bill would prohibit motor vehicle repair shops from repairing any

tire which would fail to meet Department of Motor Vehicle tire standards after the

completion of the repair.

JUSTIFICATION:

This legislation would prohibit a tire repair from being made to a tire

that would not meet Department of Motor Vehicles (DMV) standards for the use of

tires by vehicles operated in New York State. Improper tire repairs pose a safety

risk to motorists. Repairing a tire that would not meet DMV standards for passing a

New York State motor vehicle inspection would greatly increase the risk of tire

failure. Improperly repaired tires can fail while in service, which may result in a

vehicle crash and cause serious personal injury or death. (there is no rule or

regulation), also we would like to know what made this legislator such and expert.

A tire will fail a New York State motor vehicle inspection if the tread

is worn to less than 2/32 of an inch, the tire has a fabric break or a

cut in excess of one inch in any direction and is deep enough to reach

the body cords, the tire has visible bumps, bulges, or the tire has any portion of the

ply or cord structure exposed or the tire is marked for specific non-highway uses. In

any case, a tire will only fail an inspection if it is a badly damaged tire that should

not be driven on

for safety reasons. If a person attempts to repair a tire that would not

pass inspection, it is in the best interest of public safety to not

allow a tire repair to be performed.

For the above reasons the New York State Association of Service Stations and

Repair Shops, it members, and affiliates oppose this bill and asked for it to be

defeated.

SEXUAL HARASSMENT POLICY

Under a new law (Sec. 201-g of the Labor Law) every employer in New York is

now required to establish a sexual harassment prevention policy to combat it. In

addition, there is a model sexual harassment prevention policy to be found on our

website www.nysassrs.com..

Take this law seriously. Failure to follow it can lead to action against business

owners in multiple state agencies, including the Labor Department and the Division

of Human Rights. Larger cities may have additional agencies to which you may be

responsible. Moreover, private attorneys can also bring an action against you in

court. The financial penalties can be very high, and that's not even counting

attorney fees and other litigation costs even if you prevail. Now that this law has

been passed you can be certain that there will be many attorneys and government

inspectors out there running around looking to hang you up. Some examples of

conduct that may constitute sexual harassment in a gas station-convenience

store/repair shop business follow:

• Making sexual gestures, or displaying suggestive objects, pictures, cartoons,

posters, calendars or computer screens.

• Making or using derogatory comments, epithets, slurs or jokes of a sexual nature.

• Verbal sexual advances or propositions.

• Verbal abuse of a sexual nature, graphic commentaries about an individual's body,

sexually degrading words used to describe an individual, suggestive or obscene

letters, notes, electronic mail messages, or invitations.

• Physical acts of a sexual nature such as touching, pinching, patting, kissing,

hugging, grabbing, brushing against another employees body or poking another

employee's body, rape, sexual battery, molestations or attempts to commit these

assaults.

• Needless to say, any retaliation against an employee for coming forward about

such conduct is strictly forbidden. • Sexual harassment can also take place between

two employees of the same sex and can also take place outside of the workplace

between two employees. Even if there is no overt sexual harassment claim made

against you by an employee, you can still be liable to substantial fines and other

penalties from the government if you fail to institute the required policies to combat

sexual harassment and fail to keep records of which employees have received this

training and when, their contact information when they leave your employ, and so

Class A and/or B Authorized Operator

All Petroleum Bulk Storage Facilities YOU WERE REQUIRED TO DESIGNATE

MVAC Training

Any person who repairs or services a motor vehicle air conditioning (MVAC)

system for consideration (payment or bartering) must be properly trained and

certified under section 609 of the Clean Air Act by an EPA-approved program. All

technicians servicing MVAC-like appliances must be certified. This means that in

order to purchase refrigerant, you must be certified for EPA section 609. To get that

training, go to www.nyssasrs-training.com and follow the links. This restriction

does not apply to do-it yourselfers.

The minimum wage

As 2019 begins, minimum-wage employees across the state can look forward to

bigger paychecks.

The biggest increase will be in New York City, where employees working at

companies with more than 10 workers (for example, fast-food spots) will have their

lowest legal pay rate rise by $2 to $15 an hour.

Employees at smaller companies in the city will get a raise of $1.50, to $13.50 an

hour. In Westchester County and Long Island, rates go from $11 to $12, and they’re

rising from $10.40 to $11.10 in the rest of the state.

The wage hikes have put New York in the midst of a movement to raise minimum

wages across the United States. The federally mandated rate is currently $7.25.

Cigarettes

Baby New Year will have a more difficult time finding a place to buy cigarettes in

the city when she turns 21.

Starting Jan. 1, pharmacies in all five boroughs will not be allowed to sell tobacco

products. That includes big-box stores and supermarkets that have pharmacies.

“People trust pharmacies to help them stay well,” the deputy mayor for health and

human services, Herminia Palacio, said in a statement last week. “They should be

helping smokers quit, not the opposite.”

The change is a result of a package of bills that Mayor Bill de Blasio signed in 2017

after anti-tobacco activists criticized the mayor for not aggressively combating

smoking. Under the same laws, the city banned the sale of e-cigarettes in

pharmacies in August.

About 500 pharmacies in the city that still sell tobacco products will be affected, the

statement said.

Birth certificates

Beginning in 2019, New York City will allow people who do not identify as male or

female to change the gender markers on their birth certificates to a nonbinary

option.

In addition to the standard gender markers of “M” and “F,” birth certificates will

also add “X,” a gender-neutral marker.

The “X,” meant to stand for a gender identity not exclusively male or female, will

set the city’s documents apart from those issued in the rest of the state, which does

not offer nonbinary options.

It may also put the birth certificates in conflict with identification issued by the state

Department of Motor Vehicles and federal agencies, like driver’s licenses, passports

and Social Security cards.

The same law adding the “X” option will also permit people to change the sex

on their birth certificates without notes from medical professionals, a shift

welcomed by transgender rights advocates.

Changing tables

A reminder for New York parents on diaper duty: A law that goes into effect on

Tuesday will require wider access to changing tables.

The bill, which was signed by Gov. Andrew M. Cuomo in April, will ensure that

new and renovated buildings with public bathrooms have changing tables in both

men’s and women’s restrooms.

Under the legislation, at least one changing table must be accessible to both genders

on each floor.

Previously, state law had not required changing tables in public bathrooms. In a

statement announcing the new law in April, Mr. Cuomo’s office said that changing

tables, when available, were disproportionately only available in women’s rooms.

Paid family leave

Under the New York State Paid Family Leave act, which the governor signed in

2016, workers will now get 10 weeks of paid time off to bond with a newborn,

adopted or fostered child; to care for family members with serious health

conditions; or to address issues related to a family member’s military deployment.

The law is part of a gradual increase in salaried time off that began in 2018, when

workers were eligible for eight weeks of paid family leave.

The increases will end in 2021, when New York residents will get 12 weeks of paid

family leave.

Foam

Don’t expect plastic-foam clamshells to disappear at midnight.

For one thing, they are notoriously tough to get rid of. The material is not

biodegradable, and it is tough to recycle. It can also fracture into small pieces — as

anyone who has had to clean up packing peanuts may know — that can lurk in

landfills.

Also, while businesses are expected to stop using the foam on Jan. 1, the city will

not start fining vendors until July 1. Until then, businesses who still use plastic foam

packaging will receive warnings.

That said, businesses have in some ways had a head start on switching to alternative

plastic-based or paper containers. The city’s ban on foam was first proposed by

former Mayor Michael R. Bloomberg in 2013 before Mr. de Blasio put the foam

prohibition into effect in July 2015.

Mr. de Blasio’s victory was initially short-lived. The ban was halted just three

months after it took effect after a coalition of restaurant owners, manufacturers and

recyclers successfully sued the city. That group offered a plan to recycle the plastic

foam containers, and the judge in the case ruled that the city had not provided

enough evidence that the material could not be recycled.

The city tried to reinstate the ban in 2017 after issuing a new report that said there

was no “economically feasible or environmentally effective” way to recycle the

material. The coalition sued again, but this time, a judge sided with the city.

And so Mr. de Blasio’s so-called Styrofoam ban — a misnomer, since Styrofoam is

a product made by Dow Chemical that is not used in disposable food containers —

will take effect.
