  • Indian Top Awards i.e Padma Award and Bharat Ratna Award.

    The Indian Award System/Indian Honor System is a primary recognition from the government of the

    Republic of India. It is an honorary declaration to the personalities who have contributed to the

    progress, achievements, and human endeavor for the nation or the community. The Indian award

    system is broadly categorized into 5 categories, they are; Leadership, Literature, Civilian, Patriotic and

    particular. No prize of money is associated with these awards.

    Let's discuss about civilian awards which honor civilians of India for their prowess, achievement, and

    inspiring millions of others to walk in their path; there are two types awards that are awarded; they are;

    Bharat Ratna and Padma Awards.

    Bharat Ratna Award is the highest civilian award in the Republic of India; it was instituted in the year

    1954 on 2nd January. Its first recipients were politician C.Rajagopalachari, scientist C.V.Raman, and

    philosopher Sarvepalli Radhakrishnan who were honored in 1954.

    Since then, the award was bestowed to 45 individuals including 11 who were awarded posthumously.

    The recent recipients were sportsman Sachin Tendulkar, Indian independence activist and the president

    of INC(Indian National Congress) in 1909-18 Madan Mohan Malaviya(posthumously), and former Prime

    minister Atal Bihari Vajpayee; among these recipients Sachin Tendulkar was the youngest recipient and

    the only sportsman to ever receive this award at the age 40 and the eldest recipient was social reformer

    Dhondo Keshav Karve awarded on his 100th birthday.

    Bharat Ratna was also surrounded with many controversies one of them occurred on 23rd January 1992,

    when a press communiqu was published by the President's Secretariat conferring to posthumously

    honor Subhash Chandra Bose ; which led to led to the first PIL(Public Interest Litigation) filed over Bharat

    Ratna award in Calcutta High Court to revoke the award .

    Padma awards are the second highest honors awarded to the civilians of the Republic of India honoring

    their prowess and contribution to the progress of their field of work; these awards are mainly classified

    into 3 classes or known as Vargh; namely Padma Vibhushan(Pehla Vargh), Padma Bhushan(Doosra

    Vargh), Padma Shri(Teesra Vargh).

    Padma Awards order of precedence puts Padma Vibhushan in the highest order; Padma Bhushan in

    second and Padma Shri in the third position. Over the years many recipients have refused to accept

    these awards due various reasons including personal pride and what is construed as 'national interest'.

    Some of the famous refusals were S Janaki, Ustad Vilayat Khan, Romila Thapar, Sitara Devi,

    Phanishwarnath Renu and Salim Khan .

    Though, Indian Awards System has recognized a great many of personalities to bestow their work with

    awards and as such titles. It is always to be remembered that an award is just a compliment to the

    persons' work but shouldn't be taken as the absolute reason behind the work and remember that in the

    grand scheme of things it is the persons' virtue and services are remembered the most than the awards

    they received.

    Justice is not a prosecuted output of cases in courts, it's a unsubdued persuasion to hit your self-

    conscience for accepting the truth

    Jurisdiction is one of the trusted and seek upon authorities which lays down the foundation of a

    successful democracy. Be it corporation or issues relevant to state or central government, legal

    resolution becomes an unavoidable necessity. This leads to queries about it being unbiased and

    transparent enough to not get succinct to complacency of evidences or witnesses which may maneuver

    it to biased conclusionary decisions.

    Considering the example of bail in the justice system, we are used to news where politicians getting bail

    even after getting convicted for certain offences. These scenarios lead us to doubting the very notion of

    unprejudiced functionality of such legal systems. We start questioning, Are our courts losing objectivity

    in the long term? The complete idea of jurisprudence has failed in running a successful democracy due

    to factors which has made it amenable to favoritism?

    But let's not be swayed by pessimism without delving into the facet of a legal system. The Legal system

    as we know is in itself highly complex and is limited in its decisions by the nitty-gritty details and

    unfathomable causal relationships between various aspects of cases. It is as ambiguously defined under

    laws with repetitive amendments, as with any language limited to its exact expression. These laws and

    rules evolve overtime but the essence of integrity and truth remains constant. Thus this temporal and

    lexical dependency leaves any authentic explanation of different legal cases and its aspects to a

    debatable point.

    Most of the times in such high profile cases involving politicians or other such power holders, there are

    classified information regarding these cases which can easily mislead or effect directly/indirectly the

    court case. It also becomes easy to taint the reputation of a public figure.

    For the general public it may seem like courts are at politicians whims and they can easily get bails even

    after found guilty, but there is a need for more tolerance in terms of acceptance and honoring courts

    decisions.

    The question that strikes now is how to monitor legal flaws i.e. if a system works on the premise of

    inscrutable subjects, Is there a possibility to get proper feedback in terms which appear satisfying that

    since such a big personality found convicted in an offence is released on bail is a legally justifiable

    decision which is at par with court and fit with the public.

    There are authorities for providing cross-check over the decisions that court cases make. Supreme Court

    is the ultimate decisive authority in any criminal/non-criminal offence. And under the scanner of Right to

    Information, public can seek any such information to particular cases. Public Interest Litigation can also

    be helpful tool in this scenario. Central Bureau of Investigation is also one of such discreet authorities

    not persuaded by changing governments and whose investigation has shown commendable results. In a

    democracy where two more parties are involved in decision making, there are chances to stigmatize

  • opposite party members holding politically sensitive positions, called criminal defamation in legal terms.

    But the discretionary powers of our high court and Supreme Court are not impregnated by political

    interference. Combined with that our rights and litigations are the powerful tools which should be

    exclusively used by public for scrutinizing decisions or court orders.

    The high profile convict was bailed leaves an impression of anarchy wins over authority, but Justice is

    the undeniable truth and nothing is more true that truth itself.

    Mahendra Singh Dhoni, retirement from Test Cricket is it too

    early? Comment.

    Recently the news of the retirement of M.S. Dhoni, Indian Cricket team captain was a debatable issue

    both off and on the field. Some welcomed this decision of Dhoni while others opposed this by arguing

    that it was not the right time for declaring the retirement. Dhoni, who not only captained Indian cricket

    team to the World Cup but also proved to be a mentor of many young players, announced his

    retirement on the third day of ODIs against Australia in Melbourne taking everyone by surprise. He

    served as a hope and support of the team during difficult situations. As every coin has two sides similarly

    this issue has two views to be looked upon and discussed.

    Some Members of the cricket council like Mohinder Amarnath welcomed his decision as they thought

    that the announcement came at the right time since in last matches the performance of Indian team

    was not up to the mark. They believed that his captainancy had lost his flair and that Dhoni's news of

    retirement came at the right time so that his responsibility could be taken by a deserving player. Also

    some felt that new players had to be given opportunity to show their talent. Virat Kohli, who served as

    the captain of the Indian team on the last ODI against Australia is the front runner and most probable

    player who can fit in the place of Dhoni. Kohli can be said to have experience regarding captaining Indian

    team and is not a fresher on this job as he has led the Indian to victory in the home series against Sri

    Lanka in absence of Dhoni. Kohli had also led the team in the initial matches of Australian Tour when

    Dhoni was injured. Even though matches were lost, critics praised the way he led the team.

    Some cricketers are of the view that Dhoni's announcement of his retirement halfway in the middle of

    the ODI's was not a good decision and that too when the team's performance is already under scanner

    ahead of the forthcoming World Cup 2015 Series. He was still the best wicketkeeper and Batsman. He

    could have continued as a player. Though there is fresh and young Talent in the team but there is no

    sufficient time to take risks as the new captain will take some time to groom.

  • Many cricketers wondered that in spite of being the best wicketkeeper cum batsman why he choosed to

    retire although he could have opted out of captainancy and continued as a player. Some predicted that

    Dhoni was not willing to play under a junior to him. Sunil Gavaskar said that he also had an experience of

    performing under Kapil Dev who was his junior without any issue. But Dhoni's personality was quite

    different and he might not be willing to play under a junior and so he opted for retirement from ODI.

    Sachin Tendulkar had to also give up captainancy and decided to score the runs. Dhoni should have

    remained in the team to play his part.

    In the end we may conclude by saying that Dhoni was a pillar of strength not only for the team but also

    for the Indian fans. He was a symbol of hope as he maintained the interest in the match and in many

    such situations didn't let the fans down. And in between all this the major responsibility comes on the

    shoulders of Viraat Kohli who has not so prepared team under him. We can't neglect the fact that M.S.

    Dhoni's fate in the team in future depends on his performance of the team in 2015 World Cup.

    Atal Bihari Vajpayee's Birthday celebrated as Good

    Governance Day. Discuss.

    In the recent memory of our nation, there have been few politicians who have been the recipient of our

    collective respect and affection as much as Shri Atal Bihari Vajpayee. While there have been numerous

    other powerful politicians who have dominated the political scene but Shri Vajpayee occupies a special

    place in the Indian polity. In the quicksand that is the Indian politics, Vajpayee's stature has not just

    remained firm but actually grown with time. He is admired by politicians across the party lines even if

    their ideology and their idea of India differ vastly from that of Vajpayee's. He is the only non-congress

    prime minister to serve a full five year in the office. What makes this achievement even more

    praiseworthy is the fact that Vajpayee managed this feat by taking along a large number of different

    political parties. If the BJP led coalition ruled under the arch of NDA or the National Democratic Alliance,

    Vajpayee played a stellar role in making this coalition both "national" as well as "democratic". One

    wouldn't be accused of exaggeration if one said that Vajpayee made the BJP much more acceptable to a

    vast section of society that had till then some misgivings about the party. He was the liberal, the

    moderate face of the BJP.

    He re-imagined the party in his own image thereby giving it a pan Indian appeal. No wonder he is

    referred to as the Bheesma Pitahma of the Indian politics. But the longevity or popularity of his

    government is not the only yardstick of his greatness. He combined his vast experience as a people's

    representative with the foresight of a visionary. In the backdrop of the economic meltdown India

    witnessed some major economic reforms under his leadership. He gave a tremendous boost to India's

    military capabilities by conducting the Pokhran nuclear test and then steering the economy to greater

    heights in the face of foreign sanction. He also enhanced India's infrastructural capacity by undertaking

    the "National Highway Development Project" as well as the "Pradhan Mantri Gram Sadak Yojana". He

    also ushered in "Sarva Siksha Abhiyan" which aimed at improving standard of education at the primary

  • and secondary level. While trying to strengthen the state of our domestic affair Vajpayee also provided a

    much needed impetus to our foreign policy, chiefly in trying to improve relations with our neighbouring

    countries, of which Pakistan was undoubtedly the most important. This led to the historic "Lahore

    Declaration" and the starting up off the Delhi-Lahore bus service.

    But soon after this Pakistan indulged in unprovoked acts of aggression and occupation of the Indian

    Territory which led to the Kargil war. During these uncertain times Prime Minister Vajpayee showed

    tremendous fortitude and decisiveness and along with the courage and heroism of our soldiers forced

    the enemy to admit defeat and retreat. This victory firmly cemented Vajpayee's place in the annals of

    history. If Narasimha Rao's government was responsible for ushering economic liberation then the Atal

    Bihari government was the architect of a brave new India. What's makes Vajpayee so likeable and his

    appeal so enduring is his multi faceted personality. An orator par excellence he had the rare gift of rising

    above rhetoric and reaching out to his audience, of infusing them with energy and inspiration. Even his

    poetry is a testament to his admiration and hope for a country that he has served for so long and with

    distinction.

    It is important and even necessary to mention here that there has been some controversy over the

    government's decision to celebrate 25th of December as "good governance day", but it is important to

    bear in mind that the controversy is regarding anointing a particular day as "good governance day" but

    that doesn't take anything away from the numerous achievements of Shri Vajpayee. The incumbent

    government should ensure that celebrating Vajpayee's birthday as good governance must go beyond

    mere symbolism; the government must provide good governance 365 days a year. That would be a

    more enduring as well as real tribute to the memory and legacy of Atal Bihari Vajpayee.

    Expression is a gift to mankind which gives it an edge over the other living species existing in nature. The

    need of expression of the Stone Age man gave rise to development of language and art. When the

    miracles of science and technology paved way to astounding inventions, little did we know that the bug

    One of the best examples of use of social networking is the success of Prime Minister, Mr. Narendra

    Modi. His ideology and path of action was shared with billions of people in no time through social

    media. The common man came closer to the governance and felt as if he is a part of this transparency.

    Shows like 'Satyamev Jayate' created a positive discussion forum through social media to discuss the

    issues that the country faces today. Social networking has given rise to feedback to every issue. Such a

    feedback completes the cycle of communication.

    But as it is rightly said, 'Some things in life can be a good servant, but a bad master', social networking

    has its dark side too. Cyber bullies are an offshoot of the growth of social media. Information shared on

    these sites is misused to give rise to fraudulent activities. Lack of information of privacy settings can turn

    out to be dangerous to the users. They fall prey to unacceptable sharing of photos and videos. Digital

    stalking leaves minimal trace and victimize large number of teenagers. Many cases have been reported

    of sexual harassment of teenagers through such networking sites. Fake profiles of celebrities has

    become another monster arising out of social media. People believe and share things without checking

    the authenticity of the same. Hoaxes of celebrity deaths have become viral in the past few years. This

    spreads like wildfire and it is impossible to extinguish the root cause. Some of the hoaxes that the

    country fell prey to were, 'Kurkure containing plastic', 'fake photo of India's illumination during Diwali',

    'Assam celebrating rape festival', and many more. There are some subtle ways in which social

    networking affects the people. Reality and common sense takes a back seat and the monster of publicity

    converts each issue into an event. Human interaction and meetings have been replaced by virtual

    meetings. Clicking the moment has become more important than living the moment. Such need of

    showcasing every hour of your private life will leave the users exhausted and hollow from inside. The

    wave of one particular social networking site will recede and make way for a new one to sweep the

    world with its force.

    It is in the hands of the users to be prudent enough to know how to enslave this technology before it

    enslaves us. The users should have thorough knowledge of what to share and how to share on social

    media. Rationality should not lose its place while we step into the whirlpool of information. Parents

    should educate their children about the cyber-crimes which lurk behind the shadows social networking.

    With such prudency, every user can make the best of what the internet has to offer mankind.

  • Bringing back Black Money to India will increase the Indian

    Revenue, but should the names be revealed? Comment.

    The Narendra Modi Government's efforts to crack down black money abroad will have a significant

    boost in the Indian economy. The Swiss Government have already extended necessary support to the

    SIT on black money and is willing to work with NDA Government in power. Infact, the names of some

    Indian individuals and entities have already come under the scanner of the Swiss authorities during an

    ongoing exercise to identify real beneficiary owners of funds held in various banks operating in

    Switzerland, a senior Swiss Government official has said. These efforts by the Swiss Government will

    help the Indian Government to a great extent to weed out corruption. In one of the latest report the

    Swiss banks have revealed that India has more money stashed in Swiss banks than the combined other

    countries. According to a 'White Paper on Black Money in India' report, published in May 2012, the

    Swiss National Bank estimates that the total amount of deposits in all Swiss banks, at the end of 2010,

    by citizens of India were Rs 9295 crore or $2.1 billion. The Swiss Ministry of External Affairs has

    confirmed these figures upon request for information by the Indian Ministry of External Affairs.

    However, media reports say that the total amount of money parked in Swiss Banks is around Rs 1400

    crore. Rs 9295 crore deposited in all Swiss bank by Indians at the end of 2010, the black money or the

    unaccounted illegal money may generate from activities like, illegal trade, smuggling, trafficking,

    terrorism, counterfeit currency, corruption, arms trafficking, etc. Apart from these activities, illegal

    money is also a part of dishonest industrialists, corrupt bureaucrat, and scandalous politicians.

    The black money is one of the major reason for foreign debt in India leading to high fiscal deficit. If the

    unaccounted money is brought back, the entire foreign debt can be repaid in 24 hours. The

    Government's revenue is severely affected to running of a parallel economy in the country. Tax evasion

    deeply affects Government's revenue and if some reports are to be believed, the amount of

    unaccounted money in India equals to 40 per cent of the GDP (gross domestic product). The running of

    parallel economy in the country have also encouraged corruption which is deeply-rooted in Indian

    society. The NDA-Government's recent move to seek details from Swiss banks will be one of one

    landmark step in eradicating corruption. Many hawala transactions operating in the country also

    contribute to circulation of black money. The real per capita income of the people and the national

    income of the country are shown as low due to these unaccounted transactions. If all the black money

    circulating in the economy is flowed back into the national economy of the country, there will a

    substantial rise in the real incomes of the people and the national income of the country. The illegal

    money circulations also create inflationary pressure as Government raises tax rate due to its expenses in

    order to balance the budget. Terrorism, drug trafficking has been a menace for the Indian Government

    and the money used for such illegal activities have also effected the Government's revenue. The Special

    Investigation Team (SIT) on black money has sought details of all major cases of tax evasion and criminal

    financial fraud being probed by various investigative agencies which are mandated to keep a check on

    circulation of unaccounted wealth.

  • According to PTI report, the SIT has recently asked for the data in order to understand the trends and

    magnitude of the menace of black money and generation of illegal Funds in the country, which is done

    through a variety of ways like evasion of Taxes and duties, flouting of foreign exchange laws, creation of

    disproportionate assets, creation of 'benami' properties within the country and outside and laundering

    of wealth obtained through illegal and corrupt means. Though we have certain institutions to check

    black money like CBDT( Central Board of Direct Taxes), ED (Enforcement Directorate), Financial

    Intelligence Unit, CBEC(Central Board of Excise and Custom), Central Economic Intelligence

    Bureau(CEIB), we still lack proper legislation to check anti-national and illegal activities which contribute

    to accounted wealth. Hawala system is one such thing through which money can be easily siphoned

    away to different places without any inquiry.

    The Indian election process is one of the major contributor to black money with crores of wealth

    generated for campaigning for the candidates in the Lok Sabha and Assembly elections. A study by the

    Mumbai-based Centre for Monitoring Indian Economics (CMIE) found in 2006 that each parliamentary

    poll generates between $10.19 billion and $11.33 billion of black money. The Election Commission has

    also addressed these concerns in the recently concluded Lok Sabha election. After last UPA Government

    failed to bring back illegal money stashed abroad, the people have lot of expectations from the new

    NDA Government in power to check black money which is severely affecting our GDP and overall Indian

    economy.

    The Narendra Modi Government who is already facing severe challenges of high inflation, low growth

    and high fiscal deficit will have to strategically plan to bring back unaccounted wealth over a period of

    time. The Special Investigation Team (SIT) constituted by Indian Government have promised action if

    any illegality found. The Government should aim to have transparent economic management system,

    which can only help to root out the evil of black money and corruption from our society. Even though it

    may take a period of time to eradicate circulation of illegal money but no doubt the Government's

    initiative is welcomed.
