• Mandatory energy assessment and energy saving

identification scheme for large undertakings

• It has been brought in to implement Article 8 (4-6) of the EU

Energy Efficiency Directive (2012/27/EU).

• The scheme applies throughout the UK.

• The Environment Agency is the UK scheme administrator.

• Different routes to compliance

• Fines for non-compliance (higher than the cost of

compliance)

• Less than 6 months left!

Phase 1 Timeline

• Affects undertakings that, on the qualification date (31st December 2014), have:

– An undertaking which has 250 or more employees, or

– An undertaking which has fewer than 250 employees, but has but has an annual turnover in excess of €50m (£38,937,777) and an annual balance sheet in excess of €43m (£33,486,489)

• If you are part of corporate group with an undertaking that complies with either of the

above then you will also need to comply.

• Organisations that are required to comply with the Public Contracts Regulations 2006 or

the Public Contracts Regulations (Scotland) 2012 are exempt from the scheme.

• Failure to comply with ESOS will result in fines of up to £50,000 and/or an additional fines

of £500 per day until compliance is completed (maximum 80 days),

• Additionally, offending organisations will be named publicly on the regulators website.

• Fines are designed to be more expensive that the cost of the audits.

• Non compliance may also result in the requirement to carry out an audit to meet

compliance in any case.

Non Compliance (Fines)

• ESOS is a mandatory scheme but there are benefits to it:

– Reduce costs though reduced energy bills/usage and limited exposure to fines

– Understand energy consumption in your organisation

– Help with green credentials

– Get board level buy in of energy management

– Start process towards ISO 50001 thought development of energy policy etc

• Costs will vary depending on organisations structure, locations and processes.

• Based on number of days.

• Should be minimal when compare to the savings opportunities highlighted.

• It is important to remember that audit cost are likely to be less than potential fines.
