ESEA

•Reauthorized about every 5 years

•Last reauthorization was in 2002 (NCLB)


NCLB – Reauthorized ESEA(2002)

Purpose: To close the achievement gap with accountability, flexibility, and choice, so that no child is left behind.

•Annual tests based on challenging State standards in reading and mathematics

•All students proficient within 12 years

•Results broken out by poverty, race, ethnicity, disability, and limited English proficiency – “no group left behind”

•Sanctions - Failure to meet AYP means “in improvement,” corrective action, and restructuring

•Schools that meet or exceed AYP objectives or close achievement gaps will be eligible for State Academic Achievement Awards

2. More choices for parents and students

•Choices available to the parents of students attending Title I schools that fail to meet State standards (opportunity to attend a better public school, including a charter school, within the district; must use 5% of Title 1 funds to provide transportation)

•Persistently failing schools must use 20% of Title 1 funds for supplemental educational services to eligible students

The contention: This helps ensure that no child suffers because he/she is “trapped in a failing school” and gives incentive for low performing schools to improve because of loss of FTE/$ and risk of structuring.




3. Greater flexibility for states, school districts, and schools

•Allows states to transfer up to 50% of $ to 5 grant programs: Teacher Quality State Grants, Ed Tech, Innovative Programs, Safe & Drug-Free Schools or Title 1

•Competitive State Flexibility Demonstration Program permits states to consolidate federal grant funds for use for ESEA authorized purposes

•Reading First state grant (screening/assessments to identify K-3 students at risk for reading failure and give reading instruction PD for K-3 teachers)

provide flexibility to states” looking for relief from NCLB

Washington’s ESEA Flexibility Waiver Story Continued…

A. August 2011 – Obama directed Duncan to “move forward with plans to provide flexibility to states” looking for relief from NCLB

B. February 2012 – Washington submitted its waiver request

C. July 2012 – Washington’s waiver was approved

D. August 2013 – US Department of Ed issued a letter to WA indicating that we were on ”high risk” and may not be renewed in 2014-2015 if we did not make changes

I. New index implemented a year later (14-15)

II. Rules about student growth as a significant factor in TPEP (WA definition is inconsistent with ESEA Flexibility requiring incorporating results of statewide assessments as a measure of SG beginning 14-15)

Letter from Arne Duncan to Sup’t Dorn…final guidelines for teacher and principal evaluation and support systems that meet the requirements of ESEA flexibility, including requiring local educational agencies (LEAs) to use student achievement on CCR State assessments to measure student learning growth in those systems for teachers of tested grades and subjects. Your March 27, 2014, letter indicates that the State will be unable to provide such guidelines. I recognize that requiringthe use of statewide assessments to measure student learning growth requires a legislative change, and that Governor Inslee and your office worked diligently to obtain that change. I thank you for your leadership and courage in those efforts.

However, because those efforts were unsuccessful, and your legislature is not scheduled to reconvene until January 2015, I cannot extend Washington’s authority to implement ESEA flexibility, and Washington and its LEAs must resume implementing the requirements of Title I of the ESEA, as amended by the No Child Left Behind Act of 2001 (NCLB), as well as all other ESEA requirements that were waived under ESEA flexibility, for the 2014–2015 school year.

I appreciate that transitioning back to NCLB is not desirable, and will not be simple.
