Our annual meeting
is just around the corner! This is a
time when we gather as friends
and neighbors. We
also hold a busi-ness meeting as
mandated by the federal government for non-profit or-
ganizations. In recent years, the atten-
dance has dropped substan-
tially. We wanted to know why and how to bring residents
back together. In a survey sent via our e-com (e-mail
communications), we learned
neighbors want to attend but that family and obligations of-
ten prevent them from attend-ing on weeknights. A number
of residents told us the meet-ing is too long, several others
suggested a Saturday gather-
ing. We listened to the feedback so
this year our annual meeting is being held on Saturday, June 1 at Marquez
Charter Elementary School’s outdoor
cafeteria from 11am—1pm. The gathering will start with a
Social Hour from 11am—Noon so residents can mingle with other
neighbors, talk to MKPOA board
members, and exchange information and thoughts with fire and police of-
ficials. During this time, sand-wiches, desserts and refreshments
will be served accompanied by Music
from Alper’s Young Musicians Big Band and Alper’s Young Jazz Combo

honor our special guest, Bill Rosen-
dahl for his eight years of outstanding service to our community—there will
be time for a brief Q & A. We will also make the presentation of the Presi-
dent’s Awards, given annually to an outstanding board
member and a deserving
Marquez Knolls Resident. We will then hold a short business
meeting to recap the past year, including the Treasurer and
Membership Reports. MKPOA
residents who are current with their dues will vote for the
slate of new board members for 2013-2014. The biographies
of the nominated candidates are on pages 4-5.

Last September, MKPOA Board members Christy Dennis, Haldis Toppel, and Jim Rea were ap-pointed by DWP, LAUSD, and CD11 to the LADWP Task Force along with twelve other community leaders to review 15 sites under consideration for a new distribution substation. Task Force mem-bers ranked the sites, considering geology, public safety, proximity to schools and homes, and cost of construction and/or land acquisi-tion. Threats against Task Force Members and the City's inability to provide indemnification resulted in its dissolution. DWP continues the site selection process and will move forward with public notices and hearings required for the Con-ditional Use Permit (CUP) and the California Environmental Quality Act (CEQA) and more.
Since March, public buses have been on a temporary detour: LADOT is making a loop via Temescal Canyon and PCH to return to its regular route on Sunset BLVD wh i l e a wa i t i ng re -configuration of the traffic island at west Marquez Ave. The Santa Monica Big Blue Bus (BBB) is looping through crowded Marquez Avenue, which has raised complaints about noise and vibration and serious safety concerns from merchants, residents, parents and school administrators of Marquez Charter Elementary school. Many letters, e-mails, and phone calls have been received by MKPOA, BBB, LADOT, and Council District 11 (CD11). Concerned parents circulated a petition asking for the immediate removal of the BBB from Marquez. MKPOA has
LAPD Traffic Committee Vice Chair, Amy Kalp, as Advisor and liaison between CD11, LADOT, and BBB, and has passed a motion, urging LADOT to complete the reconfigura-
tion of the west Marquez Island in the most expeditious manner.
The Marquez Knolls e-Com list helped reunite a dog that escaped from a home on Enchanted Way. As soon as the e-com alert went out neighbors on Enchanted Way and Donna Ynez went in search of the dog on the loose. Dexter, a rescue dog now living in Brentwood, was with a pet sitter who brought him to Marquez Knolls for a play date. Once the play time was over and Dexter was outside, he bolted up Enchanted Way. Within minutes, the e-com alert went out and several neighbors joined in to help find Dex-ter. The elusive dog was spotted but evaded any attempts at a capture. Dexter’s adventure took him down the hill to Donna Ynez where a neighbor found him hiding in a gar-den. The pet sitter was finally re-united with Dexter and wrote “I was...and, of course still am...most grateful to all of you. To me, you were like “good Samaritans”.
Marquez Knolls resident Greg Lehrhoff was recently named Mr. Palisades at the 2013 Palisades Teen Contest sponsored by the Chamber of Commerce. Lehrhoff and Miss Palisades, Hannah Wasserman, both received a $1,500 Cathy Wisnick Memorial Scholarship. Mr. and Miss Palisades will ride in the upcoming 4th of July Parade.

At the end of April 2013, the lowest-priced available home in Marquez Knolls was a 4-bedroom, 2.5-bath on Enchanted Way being offered at $1,280,000. The highest-priced property is a 5-bedroom, 4-bath on El Hito Place being offered at $5,295,000. There were 8 homes in escrow at the start of May, and an average length to sell a home was 64 days.
The lowest sale price as of April 30 was a 4-bedroom, 2.75-bath on Las Casas Place which sold for $1,065,000. The highest Marquez Knolls area sale so far this year was a 5-bedroom, 3-bath on Merrivale Lane, which sold for $2,550,000.

In early spring, Marquez Knolls be-
came the first neighborhood in Pacific
Palisades to install an “Ocean Friendly
Garden”, a national program des-
ignation awarded by the Surfrider Foun-
dation for residential and other land-
scapes that are successfully transformed
from water-thirsty lawns to eco-friendly
gardens applying the three Ocean
Friendly principles of “CPR”: resource
Conservation, soil and surface Perme-
ability, and rainwater Retention.
“We wanted to replace our boring
front lawn with vibrant California na-
tive and Mediterranean plants that
transformed the
front lawn while
learning how to
create berms and
swales for visual
interest and rain-
water retention.
They planted more
than 50 climate-
friendly plants,
applied compost
tea and mulch to
build soil health,
reduce watering needs, and retard weeds.
“It’s astonishing how quickly the space
was converted from blah to beautiful,”
said Laura. “Now we look forward to step-
ping out of our front door each morning.
And the bees are happy too! We are so
appreciative to both Surfrider and the
Marquez community for their support!”

Lachman Lane and Jacon Way. The com-
munity is welcome to stop by and see the
transformation.

MKPOA Slate of Board Members for 2013-2014
Sylvia and Jon1 Boyd are native
Californian’s who attended high
school together. They married after
graduation while Jon was serving in
the Marines during the Korean War.
The Boyd’s moved to the Palisades
in 1976. Jon was an L.A. fireman
and joined forces with Sylvia’s part-
time career in Tupperware. They
took on a franchise, became corpo-
rate staff and traveled and lived all
over the world for 45 years. Sylvia
retired as President of Tupperware
Canada in 2001. During the ten
years they lived in the Asia Pacific
and Canada, the Boyd’s retained
their Palisades home. The Boyd’s
are actively involved in the Pali-
sades Presbyterian Church, PAPA
(July 4th Parade), Discovery Shop
(American Cancer Society), Chrysa-
lis and Las Dorados.

Wakalopulos Christy has served as
MKPOA president for the past two
years and newsletter editor for the
past four years. She has lived in Pa-
cific Palisades since 2007, after
leaving her corporate job with Pa-
cific Gas and Electric Company in
San Francisco. She served as a
spokesperson in the Communica-
tions Department. She is a former
television news reporter specializing
in environment and health care. Fol-
lowing her TV career, she joined a
nonprofit land trust that gained na-
tional recognition during her tenure.
She is a graduate of Leadership
Fresno and a past president of Busi-
ness and Professional Women.
Christy serves on the PPCC board.
George has lived in Marquez Knolls
since 1975. He is an engineer
who founded three high tech
companies, holds more than 35
patents, and has published numer-
ous scientific papers. He devel-
oped the world's most rugged
electron gun that was used by the
military for "star wars" lasers,
and the Min-EB, the world's
smallest, least expensive, and
lowest voltage electron beam
vacuum tube. He holds an M.S. in
Quantum Electronics from USC
and a B.S. in Electrical Engineer-
ing from UCLA.
Lou Del Pozzo has lived in
Marquez Knolls since 1978. After
teaching in Culver City for 30
years, he went into real estate. He
has been a realtor for 20 years.
Lou holds a B.S. and M.S. in
Business from UCLA. Lou has
two grown children, his son at-
tended the Naval Academy in
Annapolis and his daughter holds
an MBA from UCLA. Lou chairs
the private patrol committee and
provides information when an
escrow in Marquez Knolls opens,
or when a new owner purchases
property to allow our records to
stay current.
Sidney (Sid) Galanty has lived
in Marquez Knolls since 1966
and has been a Board member of
MKPOA for over 12 years. Sid is
an advertising specialist, political
media consultant and seasoned
director in broadcasting, televi-
sion, and political media. He was
a consultant to the U.S. Army’s
Space Program and later joined
the administration of President John
F. Kennedy when he received the
Distinguished Government Service
Award. In 1990 Sid helped create,
produce and market the “Jane Fonda
Workout”. In addition to many other
industry awards, Sid won the Berlin
Film Festival award for “Seeds of
Hope” and Cannes Film Festival
Award. He has lectured at Yale, Co-
lumbia, Lewis & Clark and UCLA.
Barbara Gould first moved to
Marquez Knolls in 1957 where she
attended Uni High School (there was
no Pali High at that time). She also
attended Santa Monica City College.
She and her husband Joe moved
back to Marquez Knolls in 2000,
when her parents passed away. She
has three sons, a stepdaughter and
six grandchildren. For the past 15
years she has worked in sales for a
large candy distributor. Barbara re-
cently celebrated her 25th wedding
anniversary. As the newest member
of the MKPOA board, she says “I’m
thrilled to be on the board.”
Amy Greenwood was a teacher at
Immaculate Heart High School in
Hollywood in the 1970s shortly after
she completed her Bachelor’s degree
in Political Science at UCSB. She
loves teaching all age groups. She
decided to continue her education at
UCLA where she completed her
Master’s Degree in Library and In-
formation Science. Amy worked in
the online information industry for
over 25 years. Her clients were edu-
cational institutions and corporations

from a broad range of industries in
the western region of the U.S. and
Canada. She participated in a num-
ber of professional associations.
Amy moved to Pacific Palisades 13
years ago and enjoys participating
on the board of MKPOA, volunteer-
ing at the Rustic Canyon Preschool,
painting watercolors and traveling
the world.
Silgia Grassl moved with her hus-
band and their two children to
Marquez Knolls in 1976. They have
lived in the same house on Lachman
Lane for 37 years. Both their chil-
dren and their families live in
Marquez Knolls. Silgia volunteers
at St. John's Hospital as an Angel of
the ER. She has been on the board of
MKPOA since 2004.
Louise and Bob1 Martin met while
working at the RAND Corporation
as weapon-system analysts in the
Aero-Astro Department. They have
lived in Marquez Knolls since 1964
and participated in MKPOA’s earli-
est efforts to establish a dedicated
patrol service for our area. In the
early seventies Louise transferred to
RDA/Logicon, a spin-off of RAND,
and Bob joined Hughes Aircraft.
Since 2003 Louise has served as a
Board member of RAND’s Alumni
Association and is currently the
Alumni Association’s Vice Presi-
dent. She has served on the
MKPOA Board for the past four
years and chairs the membership
committee.
Jim Rea and his wife Jodie have

15 years. Jim has degrees in ac-
counting and an MBA, both from
the University of Texas and has
worked in entertainment, market-
ing and technology roles for 25
years at Fox, Geocities, iBeam
Broadcasting and other companies.
For the last several years, Jim has
worked as a Realtor with Keller
Williams in Pacific Palisades. He
has served on the MKPOA board
for the past three years. Jim is also
the Area 3 representative on the
PPCC board representing the
Marquez Knolls and Bel-Air Bay
Club areas. Jim additionally serves
on the boards of the California Art
Club and Autry National Center.
Haldis and Kurt 1 Toppel moved
to California from Germany sepa-
rately. They married in 1976 and
have one son. Kurt has lived on
Enchanted Way since 1960. His
early career was in data processing
and later he formed his own Inter-
national business consulting com-
pany. Kurt has received the Pali-
sades Citizen of the Year and
Golden Sparkplug award. He is
past president of MKPOA and has
served on the Board for more than
20 years. He is past Chairman of
the Santa Monica Red Cross and
PPCC. Kurt chaired the $1 million
fundraising drive to build the new
Palisades Gym. He is currently on
the Board of P.R.I.D.E. and an ad-
visor to PPCC. Haldis recently re-
tired from 20 years with the City of
Los Angeles as the Chief Informa-
tion Security Officer. She has been
a chair or Board member on a
number of professional organiza-
tions including PPCC Vice Chair.

is currently serving as vice presi-
dent of MKPOA.
Janet Turner and her husband,
Daniel Helfgott, have lived in
Marquez Knolls since 1996. She
joined the MKPOA Board in 2007.
Janet is currently President Emeri-
tus of Pacific Palisades Commu-
nity Council (PPCC) and an
elected delegate for the 50th Dis-
trict to the California Democratic
Convention 2013 and 2014. She is
a TV and movie producer and has
worked on numerous Talk Shows,
Documentaries and TV movies.
She and her husband are currently
developing a true story about the
Westminster Dog Show into a
family movie.

Our community is a special place,
tucked between the ocean and moun-
tains, where many homeowners enjoy
sweeping views of Santa Monica Bay,
the shoreline, canyons and dramatic,
undeveloped mountain landscapes.
Residents know all too well how im-
portant a good view can be, both to
the value and the enjoyment of their
homes. As said in a recent appellate
court decision, in a case arising out of
the Marquez Knolls community, “to
significantly obstruct any home-
owner's view of the Pacific
Ocean is to depreciate the eco-
nomic worth of their property--
often by several hundred thou-
sand dollars--as well as dramati-
cally reduce their enjoyment of
the home they bought and live
in.”
Important as views may be,
many people are surprised to
learn that there is no general
legal right to a “view.”California
never adopted the old English
“doctrine of ancient lights,”
which assured unobstructed pas-
sage of light and air from adjoin-
ing land. Instead, in our state,
homeowners must look to other
sources for enforceable rights to pro-
tect views. Some cities have adopted
view ordinances, including, for exam-
ple, neighboring Malibu, which re-
quire newly constructed homes to be
evaluated for view impairments.
However, Los Angeles has no view
ordinance and hence no such protec-
tion exists for the City. Therefore,
residents in most cases must look to
the Conditions, Covenants and Re-
strictions (CC&Rs) that apply to their
property.
CC&Rs are agreements that “run”
with the land and bind not just the
original owners but all people who
later take title to the property. Older
developments in the Palisades, dating
back to the 1920s, 30s and 40s, often
had no CC&Rs, or, if they did, the
documents failed to provide view pro-
tections. More commonly, view protec-
tion provisions began to be included in
CC&Rs in the 1950s and to this day.
Typically, such provisions provide that
a homeowner’s views cannot be im-
paired or diminished by new construc-
tion or by trees or plantings. There is no
universal template: and the language
used, while often similar, could vary
greatly, sometimes even between adja-
cent properties. Hence, to know your
rights, you have to read carefully the
specific language of your CC&Rs.
In Marquez Knolls, most lots are sub-
ject to view rights protections. Tracts
developed by the Lachman developers
include language such as: “….no struc-
ture shall be erected, altered, placed or
permitted to remain on any building plot
other than one detached single-family
dwelling not to exceed one story in
height ….except [a] two story single-
family dwelling may be erected where
said dwelling will not detract from the
view of any other lot.”
In the Marquez Knolls, many of the
Lachman CC&Rs also include language
generally to the following effect:
“….nor shall any tree, shrub or other
landscaping be planted or any struc-
tures erected that may at present or in

lot ...”
By judicial decision, these clauses have
been interpreted to prohibit only
“unreasonable” view obstructions. The
term “unreasonably” seems certainly to be
at least intended to assure that no owner
should be prevented from doing construc-
tion on a vacant lot. Not as certain is
whether the term “unreasonably” also ap-
plies to remodels and trees. On first blush,
adding the word “unreasonably” seems to
be a fair compromise between competing
rights: property owners’ rights to freely
develop and use their property and
the protection of neighbors’ view
rights. But the practical effect has
been great uncertainty in terms of
both what construction or remodel-
ing is permissible and what is rele-
vant to resolve a view dispute in
court. Instead of simply looking at
whether the existing projects ex-
pands the original “footprints” of a
building and detracts from the view,
now parties try to make almost eve-
rything relevant to prove whether a
project “unreasonably obstructs the
view” or not. Unfortunately, this
means more litigation and more ex-
pense in enforcing view rights.
MKPOA has extensive information
regarding CC&Rs on its website
www.MarquezKnolls.com, including a
listing of the Lachman CC&Rs as well as
in the Frequently Asked Question docu-
ment. A mediation process free to mem-
bers is available to settle neighbor issues
out of court. However, time is generally of
the essence and legal counsel experienced
in this area of the law is always recom-
mended.
