Berlin meeting objectives
To consider:
• the actions taken so far with respect to the competition and market issues that have arisen from the implementation of the Directive;
• the role of the Competition Authorities with respect to ensuring this particular market area is functioning;
• the conclusions and the outcomes from market studies undertaken;• the effectiveness of both the handling of complaints brought to the attention of
the competition bodies and the enforcement of the recommendations arising from such complaints;
• how and whom within the European Competition Network should handle complaints received either from Private Companies or a pan European Private Sector PSI Re-user Associations such as the PSI Alliance; that arise from market activity across Member States;
• to consider whether the associated frameworks and tools – for example public sector accountancy practice; are present that enables competition authorities to act for example when considering dominant behaviour and market squeeze through price;
• the issues that arise when regulating the public sector itself.

Berlin meeting - Invitations
Invitations sent to:
• All the members of the European Competition Network (33 in total)• German competition bodies (26 in total) (Invitation was in German language)• Member State PSI Regulators (2 in total)• ePSIplus partners (30 in total to approach Competition bodies & invite them)• ePSIplus stakeholders (2000 in total)
• Majority of ECN members including the Commission Competition Directorate did not respond
• Of the ECN members that responded majority stated no complaints received and as such needed to focus on other markets
• PSI Regulators and the Commission report that few complaints have been received.
• In response to the above the meeting approach was changed to invite the PSI Associations and private companies to seek evidence, review the issues and develop a way forward including an action plan and recommendations for engaging competition bodies.
