    FOREWORD

    The Employees Provident Fund & Miscellaneous Provisions

    Act,1952 is an important piece of Labour Welfare legislationenacted by the Parliament to provide social security benefitsto the workers. The Employees Provident Fund Organisation(EPFO) is a statutory body of the Indian Government underLabour and Employment Ministry. It administers a compulsoryContributory Provident Fund, Pension and an Insurance

    Scheme for Indian Workforce.

    An individual employee account is being maintained at EPFOwith contributions both from the employee and the employer.The compound interest received on the investment of funds ofindividual members, systematically build over time, arecredited to individual members account. About 620 lakhworkers from 6.7 lakh establishments enrolled under EPFO atpresent.

    The intention of publishing this booklet is not only to createawareness among the functionaries of corporation and privatesector employees but also to find solutions to the day-to-day

    problems that may arise.

    I am very happy that REEMAP is attempting to createawareness and disseminate relevant information aboutProvident Fund to all the RYK youth through this publication.I congratulate the REEMAP team for this extremely useful

    Employees Provident Fund (EPF)

    Employees Provident Fund and Miscellaneous Provisions Act 1952(PF Act) is one of the important Social Security Act, intended to

    provide post-retirement benefits for the employees working in

    companies, corporations and other establishments. The schemes

    made there under namely, Employees Provident Fund Scheme (EPF)

    and the Employees Pension Scheme (EPS) provide attractive returns

    on their saving investments, apart from pension benefits. Employees

    Provident Fund Organisation (EPFO), a statutory body established

    by the government of India, administers the EPF& EPS schemes in

    the country.

    The EPF principal amount and interest earned on it belongs to theEPF account holders only. It is found that about Rs.22,600 cr is

    lying unclaimed with EPFO due to lack of knowledge among

    employees on procedures of EPF account operation. In this context,

    an effort is made through this small booklet to explain the critical

    elements of EPF which include eligibility to become an EPF member,process of getting benefits from EPF& EPS etc.

    I hope that RYK beneficiaries are benefitted from this Handbook

    on EPF. It will help in clarifying their doubts, operate their account

    in a better way and enabling them to claim their EPF amounts fully

    Employees Provident Fund (EPF)

    EPF stands for Employees

    Provident Fund.

    It is a scheme introduced by

    Government of India to help

    employees from private and non-

    pensionable public sectororganisations and State and

    Central Government Under-

    takings to save a part of their

    salary every month in a saving

    scheme.

    A small part of an employees

    salary (12% of basic + DA) and

    an equal amount is matched by

    employer is invested in EPF each

    month.

    EPF contributions and accounts

    are managed by Employers

    Provident Fund Organization

    (EPFO)

    Interest amount on EPFcontributions gets compounded

    on monthly basis.

    Contributions by the employer &

    employee are not a

    taxableincome.

    Employees Provident Fund (EPF)

    EPFO is a statutory body of GoI

    under Labour Employment

    Ministry. It is one of the largest

    social security organisations inthe world in terms of members

    and volume of financial

    transitions undertaken.

    There are two elements in ProvidentFund

    1. EPF is your Provident Fund.

    2. EPS (Employees Pension

    Scheme) is your pension.

    The 12% contribution from

    your side goes to EPF.

    Out of 12% ofemployers

    contribution, 8.33% goes in

    EPS (subject to maximum

    of Rs.541) and the rest goes

    into EPF.

    Apart from monthly compounded

    interest and loan on EPF, one can

    avail pension facility, if he/ she has:

    Attained the age of 50 years or

    more and

    Completed a total service of 10

    years or more and

    Not getting any other EPF Pension

    Anybody who works in an

    establishment covered under EPF

    and MP Act, 1952 is eligible for

    EPF benefit.

    Except apprentice and casual

    labourer, the employees drawingbasic salary up to Rs.6500

    compulsorily contribute to PF.

    Employees drawing above

    Rs.6501 have an option to

    become member of the Provident

    Fund.

    Yes. Persons employed through a

    contractor are included in the

    definition of employee under

    the Employees Provident Fund

    Act, 1952 and as such, they are

    covered under the EPFScheme.

    Nomination Form No 2 has to be

    filled to become a member of the

    Provident Fund.

    statement of every employee to

    the concerned employer.

    This Account statement containsdetails like opening balance,

    amount contributed withdrawals,

    interest earned and closing

    balance for that particular year.

    Get the copy of EFP annual

    account statement from your

    employer and verify the above

    particulars.

    Verify the above updated

    particulars at EFPO or in the

    website www.epfo.nic.in

    If you left the job after few yearsof employment, you may close theEPF account and get the entireEPFamount but not the EPSamount.

    An EPF account can be closed byduly filling Form No. 19indicating your bank accountdetails get it proper stampedattestation of the employer. Itshould be submitted at theProvident Fund Office, whereyour account is being managed.(Pl see annexure-3 for Form No19).

    The PF account closure form candirectly submitted by you aftergetting attested by a notary agazetted officer or a magistrate.

    The concerned PF office will take

    one month time to send the PFamount with interest directly toyour bank account or a througha cheque.

    You can open a new EPF accountwhenever you join theemployment again.

    The money saved in your EPFaccount can be withdrawn: In an event of any emergency,

    you can apply to EPFO andpartially withdraw from yourEPF source.

    If employer and employees of

    an establishment desires, that

    establishment can voluntarily

    opt for EPF coverage even if the

    employees employed therein is

    less than 20.

    Any establishment which hasbeen covered under theEPF&

    MP Act once shall continue to

    be governed by it, even if the

    number of employees falls

    below 20 at any point of time.

    Where a factory is closed down

    for good and only four security

    men are retained for keeping a

    watch over the assets and

    properties of the establishment,

    the Act would continue to be

    applicable only to the present

    employees of the factory.
