On October 25, the SanJose Police Depart-ment announced it re-

ceived $382,259 from theCalifornia Office of Traffic Safetyto continue with checkpoints inthe City of San Jose and arrestdrivers under the influence of al-cohol.

According to authorities anaverage of nearly 11,000 peoplehave died annually as a result ofDUI traffic accidents nationwide.In California, authorities indicatethat 950 people have lost theirlives because of drunk drivers.

It is good public policy tolimit the number of drunk drivers.What is questionable is the paral-lel policy of arresting those whodo not have licenses, and cannotobtain licenses because of theirimmigration status. These are thenew DUIs: Detaining UnlicensedImmigrants.

Detaining and arresting theseindividuals does nothing to ad-vance the policy of getting drunkdrivers off the road. In fact, ittakes time and resources awayfrom the real goal and focus: as-suring that drunk drivers are notallowed to drive.

The San Jose Police Depart-ment DUI Checkpoint Manual re-lies on guidelines and proceduresfrom two sources: the 1990 “Useof Sobriety Checkpoints for Im-paired Driving Enforcement” is-sued by the National HighwayTraffic Safety Administration(NHTSA) and Ingersoll v. Palmer,a 1987 California Supreme Courtcase that reviewed sobriety check-point standards on El Camino

Real in Burlingame. Neither source mentions or

recommends combining sobrietycheckpoints with the laboriousand unrelated task of checking forunlicensed drivers. In fact, theyrecommend stops long enoughonly to detect alcohol abuse:

1. The NHTSA 1990 guide-lines recommend: “A uniformstatement/question to the drivershould be used, for example:‘Good Evening. You have beenstopped at a Department Namesobriety checkpoint. We usecheckpoints in an effort to detectand deter the impaired driver.Have you consumed any alcoholor controlled substance today?’ Ifthe driver’s answer is no and thereis no other compelling reason todetain the vehicle, the officershould permit the motorist to pro-ceed.” No mention is made ofasking for a driver’s license.

2. The 1987 CaliforniaSupreme Court case stated the fol-lowing: “Minimizing the averagetime each motorist is detained iscritical both to the intrusiveness ofthe stop on the individual driverand to maintaining safety byavoiding traffic tie-ups. As oc-curred in the Burlingame andCHP checkpoints, each motoriststopped should be detained onlylong enough for the officer toquestion the driver briefly and tolook for signs of intoxication,such as alcohol on the breath,slurred speech, and glassy orbloodshot eyes. If the driver doesnot display signs of impairment,he or she should be permitted todrive on without further delay.”No mention is made of asking for

a driver’s license.In the immigrant community

the problem of arresting thosewho do not have licenses and arecaught at the checkpoints is ahuge issue: immigrants lose theirvehicles, thousands of dollars inwages lost, and the loss of onlyway to get to work or take theirkids to school. The grants forDUI checkpoints should be usedto go after the real DUIs—thoseDriving Under the Influence—notto go after the detention of unau-thorized immigrants.

According to Zélica Ro-driguez, Policy Director ofSIREN, “Those driving without alicense face detrimental conse-

quences at checkpoints and also atpatrol stops. The cars of workingimmigrant families are being im-pounded for 30 days resulting inabout $2500 in fines and fees.”

Rodriguez is also concernedabout the other stops made by theSJPD. “Cars of undocumentedimmigrants are also being im-pounded in large numbers at pa-trol stops due to equipmentviolations or other minor viola-tions. They lose their means oftransportation that way too.”

SIREN has contacted boththe City and the acting PoliceChief to discuss the city’s currentimpoundment policy. “We arelooking at its disparate impact on

low income immigrant familiesand how it compromises publicsafety”, said Rodriguez.

The Crime Analysis Unit ofthe SJPD reports that in 2007 theyarrested 2,406 persons under theinfluence of alcohol. In 2008 theyarrested 2,526 and in 2009 theyarrested 2,155 individuals for thesame reason.

In 2008 the SJPD impounded379 vehicles. In 2009 the numberof impoundments was 251, and in2010 only through the first 9months of the year the SJPD im-pounded 301 vehicles. This totals931 impounded vehicles. While854 persons were stopped duringthese 33 months for driving with-out a license, only 292 personswere arrested for DUIs. It is clearthat the vast majority of impound-ments are a result from undocu-mented immigrant drivers, notfrom persons driving while drunk.

According to SJPD statisticsthe causes of most accidents andarrests are related to driving underthe influence. There is no infor-mation or evidence that peoplewho drive without a license arethe cause of these alcohol-relatedaccidents. So how, when, andwhy did the SJPD start attaching

license stops to sobriety check-points?

From the best sources whichinformed El Observador, licensestops began to accompany sobri-ety stops in 2005, soon after RobDavis became the Chief of theSJPD. This has led to deep dis-trust of the SJPD by the immi-grant community; the painful lossof savings and a vehicle to get towork and take kids to school; mis-demeanor convictions that under-mine self-sufficiency by notallowing a person to get a job; andthe disproportionate arrest and de-tention of minorities.

According to neighborhoodactivist Aaron Resendez, interimPolice Chief Chris Moore under-stands the need to re-gain the trustof the immigrant community. “Ibelieve Chief Moore will try tomake important improvements inthe policies that affect low-in-come immigrant families, such asthe checkpoint and impoundmentpolicies. I think the SJPD willfocus more on the actual perpetra-tors of alcohol-related accidents,the drunk drivers, not on soberimmigrants.”

Those arrested for driving under the influence of alcohol can recover their vehicle the next day. Unlicensed drivers who are not

under the influence have to wait 30 days to get their car back. Why the disparity?

People who lose their vehicles must spend about $2,500 to recover them. Some do not bother to pick up the vehicle after 30 days

because of the “under water” value of their car.

The vehicle towing company charges $60 for each tow.

Century Tow, City Tow, Courtesy Tow, Delta Tow, Matos Tow and Motor Body Tow have contracts with the city to tow vehicles.

The SJPD gives 30 minutes to speak to a licensed family member or friend who can pick up the vehicle at the checkpoint. In Oak-

land, the police allow such cars to remain in safe places and the cars are not towed at all. EO recommends the adoption of this this

practice as a policy improvement.

Did you know?

EO has just learned that the SJPD plans to announce anew policy next week where in cars will not be impoundedwhen unlicensed drivers are stopped for minor traffic viola-tions. The police will allow the car to be parked in a safespot and be picked up later by a licensed driver. Whentowed, a licensed driver will be able to pick up the car im-mediately. This lame duck Congressionalsession is, as expected by many,not getting to any of the busi-

ness which impacts the largest number ofAmericans. The biggest deal that can beenacted is one that favors the re-establish-ment of the American consumer economy.This is an issue which impacts the currentsilent majority (the middle class which isvery concerned, angry and disappointed).Why might that be? Well, for one thing,lobbyists, representing special interests, aredelivering too much influence money to astrategic group of members of Congress,both Republican and Democrat.

One of the ways to extract some goodfor the nation from the ‘influence activities’of lobbyists representing special interestsis to require payment to the U.S. Treasuryas much as they deliver to various congres-sional members as ‘influence money’.This is one way to collect a tax that is di-rectly applied to the national debt. This tax,if ever enacted and implemented, would re-ally be ‘a big deal’.

Imagine the impact of special interestmoney when it is ‘legal’ to exert influencewith money, providing that an equalamount is paid to reduce the national debt.It would be very likely that at first theywould ignore this idea; then they will fightthis idea; and then accept this tax as a‘business expense’. In the end the peoplewill benefit if an amount of money equalto that delivered by lobbyists is applied tothe national debt.

President Barack Obama is being crit-icized for making ‘a very big deal’ directlywith the Republican minority at this timein order to get certain negotiated conces-sions which will benefit the most needy ofthe American public: those who arepresently unemployed. This strategic movewill force the leadership of the Democraticleadership in both the Senate and the Houseto focus on what this deal was all about. Itis a brilliant move to force the Democraticleaders who have not supported the WhiteHouse’s proposals.

The Senate needs to assemble 60 votesto pass any legislation which will decrease(or for that matter, increase) taxes paid bythe middle class American public. Theywill not recall that special corporate inter-ests have already reduced their share of alltaxes paid from 75% some 50 years ago to

a present 25% paid by corporations today. The ‘super-rich’ need to understand

that they would not be that rich had notmany middle class Americans participatedin the competition required by a capitalisticeconomy. In addition, wars have been usedto create those situations wherein ‘an emer-gency’ exists which permits the conduct ofthis nation’s business by setting aside theusual, customary, and rational rules fordoing business.

Be aware that the lowest tax bracket(10%) which applies to the lowest incomelevels will go up to 15% if the ‘Bush taxes’is not extended. Simply stated, the taxes onthe low income taxpayers goes up 50% ifthe Bush taxes are permitted to lapse. Thevery few ‘super-rich’ may benefit by get-ting very low tax rates applied to their veryhigh incomes, however the massive num-bers of the low income folks will benefiteven more.

Consider that individuals having lowincomes have a propensity to spend 100%of that income while the individual with avery high income does not spend all oftheir money which is deemed to be discre-tionary. Some is saved; some is invested;and certainly not enough gets back into‘circulation’ as ‘consumer’ economic activ-ity.

Consider that today many jobs havegone to off-shore locales where skilledlabor is available at much lower wageswhich enables the generation of higherprofits. The capitalist of today is interestedin profits only so that this income must betaxed at higher levels unless that profit isre-invested domestically to create jobs inAmerica. The jobs that have already been“outsourced” will never come back.

Why do all that is being done by Pres-ident Barack Obama? It is because thebiggest deal is the one that benefits thelargest number of the American workingpublic. It has been a long time since this na-tion has had a President with the intellectand brain power to deal with politicalforces who oppose dealing with the busi-ness that benefits most Americans. ThePresident has made the best deal possiblewithout any help from many Democraticmembers of Congress who need to sufferthe consequences of not dealing with thebusiness of the American people.Δ

Ihave been taking an ESL class for about 7 months at Metropolitan Adult Education. When I cameto the U.S. last year, I got good information about Adult Education. I really appreciate this programbecause my English skills are getting much better. My ESL teachers teach us not only English

skills, but also teach us the culture and history of U.S. In the ESL class, we can share ideas and understandeach other. So I have made many friends with my ESL classmates.

I am very concerned about closing the Adult Education program with Metro ED. Metro ED is a goodopportunity to study English as a first step for the English language learner. It is also a first step to freedom.Educated Adults= Educated Children!

My name is Maria Ramirez. I have been taking ESL classes since February 2009 to now atMetropolitan Adult Education. I decided to take this class because I have two daughters inelementary school and I want to help and understand their homework, Also, I work as As-

sistant Manager at Burger King, and I really need to speak, read and understand English. These are the twobig reasons that I decided to take this class. San Jose Unified School District is planning to take a lot ofmoney from Metropolitan Adult Education and many of our classes will close. I want to get my collegedegree. In the future I would like to be a nurse assistant.That's my big dream. I couldn't finish school in mycountry because I had to come here and find a job to support my daughter. She has a kidney problem andshe has to take medicine until the doctors find some new treatement that could work better for her. That'sanother reason I want to learn English so I can understand what the doctors tell me, and read the instructionson each treatment that she has to take. I hope San Jose Unified will consider keeping all the classes openbecause this will affect me and my daughters.

Santa Clara County Librarian Receives California Library Association Member of the Year Award

Ethnic advocates are upin arms for the lack ofinclusion of their busi-

nesses in the bid process for lucra-tive contracts being awarded by theCalifornia High Speed Rail Author-ity (CA-HSRA). These advocategroups include the “Lawyers Com-mittee for Civil Rights (San Fran-cisco), National Concilio ofCalifornia and The San FranciscoAfrican-American Chamber ofCommerce.

Their analysis and monitoringof the bid placement record to dateof the CA-HSRA reveals that so farof 134 companies given work, only12 were ‘owned and operated’ byminorities. This record is the basisfor an official complaint filedWednesday, December 8, 2010with the U.S. Department of Trans-portation. The complaint allegesthat the CA-HSRA “utterly failed”to attract a diverse group of busi-nesses when making contractawards valued at more than $500

million. It is this lack of ‘inclusivediversity’ which resulted in theseadvocates asking the federal agencyto pull $3 billion in funding. Theadvocacy group alleges that theCA-HSRA’s “laissez-faire” ap-proach led to an unfair disadvan-tage to ethnic-owned businessesand that this violated Title VI of theCivil Rights Act of 1964.

Diane LaCome, President, Na-tional Concilio of California andFrederick Jordan, President andChair, San Francisco African-American Chamber of Commerceare to be commended for their ef-forts and leadership in this requiredadvocacy action. On Tuesday, December 7, over 50 people gathered at San Jose’s City Hall insupport of the Development, Relief and Education for Alien Minors (DREAM) Act.

The following day, the Act was passed in Congress’s House of Representativesby a 216-198 vote and on Thursday, the Senate, not having 60 votes, deferred thevote.

“I have a couple of students who are scared to reveal their status so we’re gettingour students to focus on private colleges because they are more lenient to acceptingundocumented students, said Luis Marquez, California Student Opportunity andAccess Program counselor, James Lick High School. “Unfortunately for the restwho don’t qualify, we ask them to go through the community college route and hopethat the DREAM Act does pass.”

The DREAM Act is a bill aimed at providing immigration relief to young peo-ple. The passage would grant many undocumented youth access to legal residencyand federal financial aid, removing legal and economic barriers to higher education.

Currently undocumented students can’t participate in federally funded programsdesigned to assist low-income students. Immigration laws also prohibit undocu-mented students from activities like study abroad programs, any paid internships orstudent employment.

“What keeps me going is my family, I think the struggle that I go through is allworth it,” said Kimberly Martinez, sophomore at San Jose State University.

As a freshman in high school, Martinez realized she was undocumented anddecided she had no future in a country that she has known since the age of one. Sheled a carefree life until she learned it was possible for her to attend college.

“The DREAM Act would give me an opportunity to help others through thehardships that I’ve endured with the struggle of being undocumented,” said Mar-tinez. “I’d also be able to get an education. I can’t imagine myself without it.”

With the help of scholarships, students like Martinez may graduate college butlife after that is uncertain. When others don’t see the incentive to continue their ed-ucation the U.S. is losing out on their creative productivity as well as tax revenuefrom their potentially higher earnings.

“We have to stand up and say enough is enough, we have to put a line in thesand and we have to treat all people with dignity and respect,” said councilmemberAsh Karla.

By passing the DREAM Act, Congress would give undocumented youth a pathtoward realizing their full potential and an opportunity to fully participate in thecountry that has given them the opportunity to succeed.

College is becomingmore expensive bythe year. If you

have a student entering school,you probably are faced with thesobering task of figuring outhow to pay for it. While cost ofcollege tuition continues torise, scholarships are still atried-and-true way to bring theprice tag of college to a morereasonable level.

But your child can't receivescholarship money if he doesn'tapply for it. And as with mostthings in life, “the early birdsget the worms.” Now is thetime to get those applicationscompleted in hopes of hand-some rewards in the spring andsummer.

Applying for scholarshipsshould be one of the first stepsin your plan to pay for college.However, scholarship mythscontinue to flourish and need tobe dispelled.

Myth 1: Billions of schol-arship dollars go unclaimed.

In reality, the number ofunused scholarships is minus-cule. You'll need to do your re-search and apply early to havea chance at getting your shareof available funding.

Myth 2: Scholarships goonly to the best students.

Many scholarships areawarded based on elementsother than academic achieve-ment. Some scholarships arebased on the student's majorfield of study, involvement inextracurricular and communityactivities, ethnicity and geo-graphic origin, or other factors.

Myth 3: Scholarshipsearches are worth paying for.

This myth eventually willdie as people discover themany free resources availableon the Internet or in the printmedia.

So how do students andtheir parents sort through the

myths and get to the facts? Startthe process early - January isperfect for the next school year- and utilize the resourcesaround you. To find scholarshipopportunities, start with yourhigh school guidance counselorand local library for a list ofpossible resources. Next, checkwith your college financial aidoffice. Most states and manycolleges offer scholarships, sostudents should also inquireabout them. Finally, the Inter-net and organizational websitesare excellent places to search.Remember, this informationshould always be free.

Don't count yourself outjust because you are not thevaledictorian, class president orstar athlete. There are scholar-ships available for many inter-ests, backgrounds and abilities.The bottom line is apply now,and the more scholarships forwhich you apply, especiallylocal and regional opportuni-ties, the better your odds are tobe selected.

Though the scholarship ap-plication process can be timeconsuming, most scholarshipsrequire similar information.Once you complete your firstapplication, you can easily re-use the same information foradditional scholarships.

Scholarships come frommany sources, but the studentmay have to do some detectivework to uncover them. For ex-ample, atwww.usbank.com/student-loans, you can apply to be oneof 40 high school seniors orcollege undergraduates to re-ceive a $1,000 U.S. Bank Inter-net Scholarship. Over the past13 years, U.S. Bank hasawarded more than $350,000 inscholarship funding for thisprogram. Scholarship award re-cipients are selected through arandom drawing process. Thereare no essays to complete orminimum grade point average

requirements. The U.S. Bankwebsite also features a power-

ful scholarship search engine.

* Start early - Experts recommend college-bound studentsand their parents start looking as early as their freshman yearin high school. By identifying potential awards, students canchoose classes and activities that will increase their chance atwinning a specific award in the future.

* Use the Internet - But be wary of scams posing as schol-arships. If a scholarship is reputable, you should be able to findinformation about it through multiple sources. Try to use twosources and make sure the profile submitted is accurate; payingfees does not increase your chance of winning.

* Think small - Competition can be tough for large awards.Smaller awards ($1,000 and less) typically have less competi-tion and are easier to obtain.

As the school year passes thehalfway point, some kids mayget distracted from their studies.

If you and your kids want to re-focus onschool success, here are some suggestions forkick-starting learning:

* Commit to learning. With your chil-dren, come up with one or two major goalsthat you want to accomplish for the remain-der of this school year. Raising that algebragrade? Getting homework done on time andturning it in the next day? Organizing a studyarea at home? Using a planner regularly andefficiently? Agree on some age-appropriaterewards and consequences. Commit to afamily-centered goal that education is impor-tant to all of you, and work together to sup-port, encourage and help each other.

* Set up helpful routines. Give your kidsthe consistency of fairly regular routines(weekends and holidays can be breaks). Bed-time, wake-up, study, homework, play, fam-ily time -- kids rely on these routines, and thestructure helps them to feel safe, know what'sexpected of them and be successful.

* Help them organize. Organized kids dobetter in school than haphazard kids. Helpthem to set up their planners (written or elec-tronic), to keep their notebooks and back-packs neat and orderly, to break up largeassignments into smaller ones so they don'tseem overwhelming, to maintain a workspace at home that's actually workable and

not a disaster area, and to stick to the goalsyou've set together.

* Maintain healthy habits. Healthy kidsare better learners. In 2006, a woman from East San Jose decided to go on a huntfor nice glass ornaments for her Christmas tree. She wantedvery specific ornaments, Latino themed, but didn’t find any.

“I was looking for Latino ornaments and I couldn’t really findanything besides penguins and angel ones,” said Darlene Tenes, de-

signer and founder of CasaQ.She couldn’t believe she didn’t find any ornaments, despite the

number of Latinos in the country. The next year, Tenes decided to de-sign her own ornaments through her Hispanic lifestyle companyCasaQ.

Her first creation was Pancho Claus, a little man with his sack ofgifts, dressed in red with a sombrero and riding along his piñata. Fol-lowed by Sancho Snowman, the snowman that is strapped with a gui-tar, sandals and even a mustache. The Querida Collection was born.

Those two ornaments were invited to be featured in celebrity giftbaskets at the 8th Annual Latin GRAMMY® Awards and have alsomade appearances at People en Español's Christmas Party and CBS'A Home for the Holidays TV Special.

El pasado 25 de octubre, el Departa-mento de Policía de San José (SJPD)anunció que recibió $382,259 en fon-

dos por parte de la Oficina de Tráfico y Seguridadde California, a fin de continuar con los retenes enla ciudad y arrestar a conductores bajo la influen-cia de alcohol.

De acuerdo a las autoridades, un promedio de11,000 personas mueren en los Estados Unidosanualmente como resultado de accidentes de trán-sito causados por el alcohol. En California las au-toridades afirman que 950 personas perdieron lavida por culpa de conductores ebrios.

Es bueno que se controlen a los conductoresebrios. Lo que es cuestionable es el arresto para-lelo a aquellos conductores que no tienen licencia,y que no la pueden obtener debido a su condiciónmigratoria. Los retenes están detiendo a inmigran-tes indocumentados.

Deteniendo y arrestando a aquellos indivi-duos, no contribuye con la meta de aminorar el nú-mero de conductores ebrios. Es más, quita tiempoy recursos del propósito principal que es: Asegurarque los conductores ebrios no esten permitidos demanejar.

El manual de retenes del SJPD se basa en lasdirectrices y procedimientos a partir de dos fuen-tes: La de 1990 titulada "Procedimientos en losretenes de conductores en estado de ebriedad",emitido por la National Highway Traffic SafetyAdministration (NHTSA) e Ingersoll v. Palmer, yla de 1987, un caso de la corte suprema de Cali-fornia llevado a la jurisprudencia del Tribunal querevisó las normas de estos puestos de control desobriedad en la calle El Camino Real en la ciudadde Burlingame.

Ninguna fuente menciona o recomienda lacombinación de los puestos de control de sobrie-dad, con la tarea laboriosa y sin relación de controla los conductores sin licencia. De hecho, reco-miendan usar el tiempo únicamente necesario paradetectar el abuso de alcohol:

1. Las directrices deNHTSA de 1990 recomien-dan: "Una declaración uni-forme / debe hacerse lasiguiente pregunta: "Buenasnoches. Usted ha sido dete-nido en un puesto de controlde sobriedad. Utilizamos lospuestos de control en un es-fuerzo por detectar y disuadira los conductores ebrios. ¿Ha consumido hoy al-cohol o sustancias tóxicas? ". Si la respuesta delconductor es no y no hay otra razón de peso paradetener el vehículo, el oficial debe permitir al con-ductor seguir su rumbo." No se hace mención depedir una licencia de conducir.

2. En 1987, la jurisprudencia del Tribunal Su-premo de California declaró lo siguiente: "Mini-mizar el tiempo de cada conductor cuando esdetenido, es fundamental tanto para la orden dealto de cada conductor y para mantener la seguri-dad al evitar congestiones vehiculares. Como ocu-rrió en los puestos de control de Burlingame, cadaautomovilista fue detenido sólo el tiempo sufi-ciente para que el oficial haga la pregunta breve-mente y determine si el conductor muestra signosde intoxicación, tales como el alcohol por elaliento, dificultad para hablar, y los ojos vidriososy enrojecidos. Si el conductor no muestra signosde ebriedad, la persona debe ser permitida de se-guir conduciendo, sin más demora. No se hacemención de pedir una licencia de conducir.

En la comunidad inmigrante el problema dedetener a aquellos que no tienen licencia y estánatrapados en los puestos de control es un gran pro-blema: Los inmigrantes pierden sus vehículos,miles de dólares, y el único medio de transportepara llegar al trabajo o llevar a sus hijos a la es-cuela. Las subvenciones para los puestos de con-trol de DUI debe ser utilizado para apuntar a losconductores reales por DUI y no ir tras la deten-ción no autorizada de inmigrantes.

Según Zelica Rodríguez, Directora de Políti-cas de SIREN, "Los conductores sin una licencia

pagan caras consecuencias en estos puestos decontrol y también en las paradas de las patrullas.Los coches de las familias trabajadoras inmigran-tes están siendo embargados por 30 días con ungasto de $ 2,500 en multas y honorarios".

Rodríguez también está preocupada por lasparadas de otros vehículos realizados por el SJPD."Los coches de los inmigrantes indocumentadostambién se incautan por las patrullas que los de-tienen por cometer infracciones a veces no mere-cen ser confiscados y lo son. "

SIREN ha contactado tanto a la ciudad y alJefe de la Policía para discutir la política actual."Estamos analizando su impacto desigual sobrelas familias inmigrantes de bajos ingresos y cómose compromete la seguridad pública", dijo Rodrí-guez.

La Unidad de Análisis de Crimen del SJPDinforma que en el 2007 arrestaron a 2,406 perso-nas bajo la influencia del alcohol. En el 2008 searrestaron a 2,526 y en el 2009 se detuvieron a2,155 personas por la misma razón.

En el 2008, el SJPD incautó 379 vehículos.En el 2009 el número de conductores fue de 251,y en el 2010, sólo durante los primeros 9 mesesdel año, la policía en San José ha incautado 301vehículos.

Esto suma un total de 931 vehículos incauta-dos. Mientras que 854 personas fueron detenidasdurante estos 33 meses por conducir sin una licen-cia, sólo 292 personas fueron arrestadas por DUI.Es evidente que los retenes están dirigidos a in-migrantes indocumentados y no a personas con-duciendo en estado de ebriedad.

Según las estadísticas de la policía, las causasde la mayoría de los accidentes y las detencionesestán relacionadas con la conducción bajo la in-fluencia de alcohol o drogas. No hay informacióno evidencia de que las personas que conducen sinlicencia son la causa de estos accidentes relacio-nados con alcohol. Entonces, ¿cómo, cuando ypor qué la policía incorporó la revisión de licen-cias a los puestos de control de sobriedad?

De acuerdo a las fuentes obtenidas por El Ob-servador, la revisión de licencias en los retenes co-menzó en el año 2005, poco después de que RobDavis se convirtiera en el Jefe de la policía. Estoha llevado a una profunda desconfianza entre lapolicía y la comunidad inmigrante. Los inmigran-tes tienen que enfrentar la dolorosa pérdida de susahorros, el vehículo para ir a trabajar y llevar a losniños a la escuela; condenas por delitos menoresque atentan contra la autosuficiencia al no permitira una persona a conseguir un trabajo, y el arrestoy la detención desproporcionada de las minorías.

Según el activista Resendez Aarón, el jefe depolicía interino Chris Moore entiende la necesidadde volver a ganarse la confianza de la comunidadinmigrante. "Creo que el Jefe Moore va a tratar dehacer mejoras importantes en las políticas queafectan a familias de bajos ingresos de inmigran-tes, como los retenes y las políticas de confisca-ción de vehículos. Creo que el SJPD se centrarámás en los autores materiales de los accidentes re-lacionados con el alcohol, los conductores ebrios,no en los inmigrantes, gente trabajadora. "

En elnuevo procedimiento. los coches no serán confiscados cuando los con-ductores sin licencia sean detenidos por violaciónes de tráfico de menorimportancia. La policía va a permitir que el vehículo se encuentre esta-cionado en un lugar seguro y será recogido por un conductor con licencia.Si es confiscado, un conductor con licencia será capaz de recoger el cocheinmediatamente. años el abad Guillermo Schulenburg, puso en dudalas apariciones de la Virgen Morena y hasta intentódesacreditar la existencia del indio Juan Diego, en-viando una carta al Vaticano para que se le pusieraun alto a su canonización.

En aquel momento miles de sacerdotes, obis-pos y cardenales, se opusieron al abad, adjudicán-dole el nombre de “católico de pobre fe”.

La controversia surgió debido a unas pruebasque se le hicieron a la mantilla original, la cualsegún la historia, Juan Diego presentó como evi-dencia de las apariciones ante el poder eclesiástico.Uno de los investigadores puso en tela de juicio laautenticidad de la mantilla. Las apariciones de laVirgen María siempre han sido puestas en dudas,lo mismo sucedió en Fátima, Portugal y con la Vir-gen de Lourdes en Francia.

La Virgen se ha aparecido en diversas partesdel mundo, se ha revelado a seres humanos selec-tos y de corazón puro, para que por medio de ellos,el mensaje de luz que ella dicta, sea propagadoentre los pueblos. Los diversos nombres de la Vir-gen María alrededor del mundo se deben al nombreque se les da a las diferentes advocaciones. La apa-rición de la Virgen en México a principios del sigloXVI, tuvo una apariencia mestiza, porque la madredel Redentor quería que la nueva raza que se estabaforjando en el nuevo mundo, le recibiera comomensajera del cielo, de ese modo las nuevas gene-raciones se iniciaran en el culto Mariano y almismo tiempo los indígenas, dejaran de adorar alos dioses paganos.

La Virgen de Guadalupe fue coronada canóni-camente el 12 de octubre de 1895 por el Papa LeónXIII. San Juan Diego fue finalmente canonizadoen el año 2002 por el Papa Juan Pablo II, convir-tiéndose así, en el primer Santo de origen indígena.La Virgen de Guadalupe es la Reina de México yemperatriz de las Américas y las islas Filipinas.

History San Jose kicked off the hol-iday season by hosting a familycelebration at the History Park in

Kelley Park. The main attraction of the celebration was

Santa Claus. After arriving from the North Pole,he made his way to the park on a vintage firetruck to meet the children and parents.

There were carriage rides throughout thepark for a limited time while demonstrationsand tours were also going on.

The history park features a town atmos-phere, with trolleys, historic buildings, an icecream parlor and exhibit galleries. Some ofthose buildings were once homes and wereopen to the public. There were demonstrations

by yarn-spinners, blacksmith, lace-makers, andprinters.

History San José, a non-profit organizationdedicated to preserving and sharing the contin-uing history of the Santa Clara Valley, also or-ganized a traditional tea for the older audience.

Before heading to tea time, people gatheredat the different stations offering arts, crafts, andhands-on activities. Throughout the day, cos-tumed carolers performed holiday songs.

Once Santa Clause made his appearance, aline was formed by anxious kids waiting fortheir chance to have their personal conversationabout their Christmas gift.

autoridades de salud del estado deCalifornia toman cartas en elasunto. Se han iniciado campañaspara prevenir que ésta enferme-dad se propague.

Martin McGowanwas a healthy,athletic 15-year-

old with a passion for baseball.After his high school baseballtryouts in early February 2005,Martin was exhausted and saidhis legs hurt from running. Hewent to bed, and at 2:30 a.m.that morning, Martin's motherawoke to hear her son vomitingin the bathroom. He had a feverof 102 degrees.

Martin's symptoms pro-gressed throughout the morn-ing, with the pain in his legsworsening. His mother calledthe doctor who recommendedeither an appointment for laterthat afternoon or to take Martinto the emergency room. Martinsaid he needed to go to theemergency room.

Once at the hospital, Mar-tin's lips were so white the ERdoctor administered intra-venous fluids. Martin testedpositive for influenza. As a re-sult of the influenza disease at-tacking his muscles, hedeveloped compartment syn-drome, which limited his blood

circulation in his legs andcaused severe pain.

The doctors explained toMartin's mother that he wouldneed an operation as soon aspossible. If the blood flowingto Martin's legs ceased for anextended period of time, theymight have to amputate hislegs.

During the surgery, Mar-tin's heart stopped beating.Shortly after, Martin died ofcomplications from influenza,merely 24 hours after his firstsymptoms appeared. Martinhad not been vaccinated againstthe flu.

After Martin's death, hismother, Diane McGowan,joined Families Fighting Flu,the only non-profit organiza-tion made up of families whohave experienced first-hand thedeath of a child due to the flu orhave had a child experience se-vere medical complicationsfrom the flu.

The flu is a serious diseasethat spreads very easily. It cancause mild to severe illness,and can lead to death - even

among healthy, older children.According to the Centers forDisease Control and Prevention(CDC), annual vaccination isthe single best way to preventinfluenza in people of all ages.

"We should have gottenMartin vaccinated," said Mc-Gowan. "Now, I can only hopethat his story will be an encour-agement for other families toget their children vaccinatedevery year."

During the 2009-2010 fluseason, the CDC estimated that274,000 people were hospital-ized in the U.S. from influenza- more than 85,000 of themwere children. Tragically, anestimated 1,200 children underage 17 died from the flu lastseason.

"In developed countries,influenza kills more peoplethan any other vaccine-pre-ventable disease," said JonAbrahamson, M.D., chair ofthe Department of Pediatrics atWake Forest University Med-ical School in Winston-Salem,N.C., and a medical advisor forFamilies Fighting Flu.

The CDC now recom-mends that everyone 6 monthsand older get vaccinatedagainst the flu, creating the firstuniversal flu vaccination rec-ommendation. For childrenyounger than 6 months, it is im-portant for family and care-givers around them to getvaccinated.

"It's not just children whoneed to get vaccinated, it's the

entire family," said Laura Scott,executive director of FamiliesFighting Flu. "A flu vaccine re-duces your risk of illness, hos-pitalization, or even death andcan prevent you from spreadingthe virus to your loved ones."

The flu virus tends tospread from October to May,with the most cases occurringin January or February. How-ever, vaccination can be given

at any time during the flu sea-son. Even getting a vaccinationlater in the season (Decemberthrough March) can still protectyou from influenza.

mente no dejó las ganancias esperadas para elpaís, que gastó demasiado en infraestructura,para albergar de la mejor manera el evento.

Marthinus van Schalkwyk, ministro de Tu-rismo de Sudáfrica, indicó que el certamenayudó, sin duda, para que cambiara la imagende los Bafana Bafana, sin embargo, el númerode visitantes no fue el que se imaginaba, másde 300 mil personas asistieron al Mundial,donde la mayoría fue europea.

"El turismo durante el torneo disputadoentre junio y julio, trajo unos 3,600 millonesde rand (casi 520 millones de dólares), muchomenos que lo que había previsto inicialmenteel Gobierno", indicó el funcionario a medioslocales.

El gobierno del presidente de Sudáfrica, Jacob Zuma, invirtió 40 mil millones derand (casi 60 mil millones de dólares), cantidad que le costó demasiado recuperar a lapotencia africana.
