Arthur J. Gallagher Risk Management Services, Inc. an allied member of the Hotel Association of New York City, and the nation’s largest broker for middle market hospitality accounts, has developed a new and exclusive Environmental and Pollution Liability insurance program specifically tailored to tackle the growing risks and exposures for Hotel and Hospitality establishments. The coverage, written through an established “A” rated carrier provides for coverage unattainable in the current market.
As a package of coverage, Gallagher’s program is best suited to meet the needs of each individual insured and our team of dedicated brokers will work to tailor the program specific to the client. With the increase in claims relating to pollution and third-party liability, this program offers protection to Directors and Officers from claims of mismanagement of environmental exposures.

Coverage enhancements included in the program.
• Includes “Bioterrorism” coverage as part of the TRIA coverage.
•Provides first-party diminution of value of covered locations.
•Provides a $25,000 On-Site Cleanup sublimit for Biological Hazards and Bed Bug infestation.
•Green Replacement Options
•Covers the cost of dismantling, cleanup and damage arising out of a methamphetamine lab set up on premises.
•Ensuring agreements cover pollution “migrating” from the insured site instead of “emanating.”
•Emergency Response Cost coverage is affirmed with no temporal limitation as respects incurring of costs and the entire limit of liability applies.
•Definition of “Bodily Injury” includes medical monitoring and environmental monitoring.
•Provides coverage for exemplary, punitive or multiplied damages where permitted by law under “cleanup costs” and “loss.”
•Broadened “pollution conditions “definition includes coverage for low-level radiation and waste constituents, mold, legionella, methamphetamines, and illicit abandonment.
•Provides limited severability to insureds of nonaffiliate business entities to the Named Insured as respects misrepresentations or policy breaches.
•Business interruption is subject only to a three (3) day temporal deductible and not an additional coinsurance.
•The Intentional Noncompliance Exclusion now provides exceptions for the Insured’s good faith reliance on outside counsel or the company’s written approval or the insured’s reasonable response to emergency circumstances in order to mitigate pollution conditions.
