PART 1 –INTRODUCTION

A. Construction activities and project progress during the previous 6 month Brief Project Description 1. Highway A-380 with total length of 1.2 thousand kilometers is part of the transit corridor

connecting Uzbekistan with Turkmenistan and Afghanistan on the South. This highway also connecting Uzbekistan with Kazakhstan, and further – with Russia on the North. Project 3 comprises of reconstruction of 40 km section of the existing A380 highway (two lane asphalt concrete road) between Km 315 and Km 355 into upgraded four lane road, widening of the existing road within its own RoW with separated strips, dual carriageway, and concrete pavement.

2. The next (neighboring) section of A-380 related to Kazakhstan. It starts from Beyneu - small Kazakh town of Mangystau oblast, situated on the border with Uzbekistan, connectingA380 highway with port of Aktau in the Caspian Sea.

3. When completed, upgraded A380 will provide access for Uzbekistan and other Central Asian countries, to the Caspian Sea, and further - to the Black Sea. On the south this highway will go to South Asia (via road corridors being built in Armenia, Azerbaijan, and Georgia).

4. Entire section of 40 km will be rehabilitated, including widening and resurfacing, using more or less 150,000-165,000 cubic metres of concrete and seven times greater amount of sub-base materials. The main working width will be 8-10m centered over the existing carriageway.

5. In compliance with ADB Environmental Safeguard requirements the project has been classified as type “B”. Therefore, semiannual environmental monitoring report is required to be submitted to ADB. This Environmental Monitoring Report covers the periods from January to June 2016.

6. In February 2013 “Renardet S.A.” (Switzerland) in association with “Rhythm Plus Consulting Services” (Uzbekistan) was selected as Construction Supervision Engineer and mobilized in January 2014. On August 27of 2013 the Republican Road Fund signed the civil works contract with Euro-Asian Construction Corporation "Evrascon". In December of 2013, the contract was registered in relevant authorities of Uzbekistan.

7. Contractor started mobilization of resources, equipment, machinery and personnel in February 2014. Mobilization of major construction equipment and machinery was completed in October 2014. Contractor established camp site on an area of 15 hectares near Gazli city of Bukhara region. Offices and accommodation of the Contractor and Engineer at the camp site completed and fully operational.

8. Project experienced delays due to Contractor’s slow progress of works caused by delay in equipment's mobilization; fuel and materials’ supply. Starting from May 2015

Contractor started to catch up the delayed works. However, currently the progress of works is still slow due to financial difficulties of the Contractor.

9. The Contract has expired on 4 July 2015, and no time extension has been approved yet by Client. The permitted elapsed (past due) time is 30 months. Based on the elapsed time of original time schedule, project total length is 166.67%.

10. Engineer’s recommendation for Contractor’s project extension was finalized and submitted to EA, awaiting approval from the RRF. In total the project is behind schedule with a negative slippage of (-) 66%.The project is expected to be completed in September 2016.

Methodology 11. In brief, the approaches for preparing this report include:

(i) descriptive method, based on visual monitoring of the object and description of ecological condition;

(ii) physico-chemical method of monitoring, based on data of laboratory analysis of air, water, soil, and background noise of the object;

(iii) content analysis of the project documentation, the IEE, contract and cost

sheet reviewed using the mentioned above methods;

(iv) data collection - the process of gathering and measuring information on variables in the established systematic fashion that enables to evaluate outcomes.

Project Progress for the Reporting Period 12. Major works have already been completed by Contractor. Small works such as shoulders, installation of guardrails, road signs and road marking is still remaining. Cumulative progress as of June2016 is as following:

(i) Engineer’s Facilities and camp is completed for 95%.

(ii) Subgrade preparation, including cutting and grubbing (Haloxylon removal). Cumulative length of completed subgrade preparation works equals to 80 km, which corresponds to 100% of project section total length.

(iii) Diaphragm and sub base construction works. Cumulative length of

completed works equals to 80 km, which corresponds to 100% of total length of the project section.

(iv) Base Course Construction Works. Total cumulative length of completed

works equal to 80 km, which is 100% of total length of base course construction works.

(v) Cement Treated Base Course Construction Works (CTB). Cumulative

length of completed CTB layer up to date equals to 80 km, which corresponds to 100% of total length of CTB construction works.

(vi) Concrete Pavement Construction Works. Cumulative length of completed

Concrete Pavement up to date is equal to 79,93 km, which corresponds to 99,91% of total length of Concrete Pavement works.

(vii) Shoulders. Cumulative completion of Shoulders comprises of 21,25% of total length of Shoulder works.

(viii) Guardrails. Cumulative installation of Guardrails comprises of 0,00% of total length of Guardrails installation works.

(ix) Road Signs. Cumulative completion of Road Signs comprises of 0,00% of total length of Road Signs works.

(x) Road Marking. Cumulative completion of Road Marking comprises of 0,00% of total length of Road Marking works.

(xi) U-turns, ramps and other auxiliary works. Cumulative completion of auxiliary works comprises of 2,91% of total works.

B. Changes in project organization and environmental management team

Institutional Set-up for EMP implementation 13. The Republic Road Fund (RRF) under the Ministry of Finance is the project proponent

and the executing agency of this MFF. The RRF employed the Programme Management Unit (PMU) to lead the day-to-day implementation of the MFF. The PMU also coordinates all consulting services (construction supervision consultant or CSC) under the project.

14. The PMU hired a CSC and established Safeguards Team to oversee the planning and implementing environmental mitigation measures during construction and operation of the road.

15. The Safeguard Team and CSC are responsible to prepare and submit environmental monitoring report and other safeguard requirements related with land acquisition. The mitigation measures related with environmental impacts associated with the construction works are implemented by the Constructor under guidance of the CSC.

16. The mitigation measures related with environmental impacts during operating period the responsibility for safeguard requirements will be handed over to the regional level Uzavtoyol.

Description of Environmental Management Team

17. Mrs. Dinora Azimova is the Environmental Safeguard Specialist of PMU who oversees the planning and implementation of environmental mitigation measures during construction period. Her role is to ensure that the safeguard actions are carried out in compliance with the procedures agreed with ADB. She is responsible for:

(i) Manage and coordinate the preparation, updating, implementation and

monitoring the initial environmental examination (IEE)/environmental impact assessment (EIA) as required by the framework financing agreement (FFA) and loan agreement;

(ii) Set up internal monitoring system on the project’s environmental issues and requirements;

(iii) Project Information Management and Development;

(iv) Assess and prepare capacity building program on environmental issues;

(v) Conduct internal and external coordination with relevant parties in environment requirements of the project;

(vi) Report preparation and submission;

(vii) Provide advice/ recommendation to the EA on environment problems and/or requirements;

(viii) Provide independent monitoring on the contractors' compliance to environmental management plan;

(ix) Prepare environmental monitoring report and compliance report as required by the FFA and loan agreement;

(x) Engage with relevant civil society organizations interested in the project implementation.

18. Mr. Sergey Karandaev is the Environmental Safeguard Specialist of Construction

Supervision Consultant. He is responsible for:

(i) review all documents and reports regarding the integration of environmental including contractor’s environmental action plan;

(ii) supervise the contractors' compliance to EMP;

(iii) Support of contractor in obtaining of environmental permits and licenses

(iv) prepare compliance reports;

(v) in the event of occurrence of any unexpected environmental impacts, coordinate with the PMU to recommend necessary mitigation measures to the EA and ADB for implementation;

19. Mr. Niyazov Husein is Environmental Safeguard specialist of the Contractor starting

from August 2015. Mr. Niyazov carries out all the tasks of the Environmental Safeguard Specialist which include but not limited to the following:

(i) To prepare SEMPs and other environmental documentation, mentioned in

Contract and EIA;

(ii) To provide daily environmental field supervision;

(iii) To notify noncompliance and take relevant actions;

(iv) To keep records: maintain site diary and checklists, complete files;

(v) Communicate with local community regarding works progress;

(vi) Ensuring of receiving relevant permissions and licenses.

C. Relationships with Contractors, EA, borrower, etc

Relationship with Contractor & sub-contractors 20. In general, Contractor carries out major construction works with its own capacity. Sub-

contractors are attracted for small works like haulage of aggregates and materials from quarries and suppliers. Following sub-contractors attracted for the works:

21. During the reporting period Contractor and sub-Contractors carried out their tasks

accordingly to ecologic rules. No gross ecologic issues of concern were identified. Haulage of aggregates and materials from quarries and suppliers are still in progress. Environment Safeguard specialist of the Contractor keeps constant contact with sub-contractors to ensure their compliance with environmental requirements.

Relationship with the project owner (EA) 22. The Republic Road Fund (RRF) under the Ministry of Finance is the project proponent

and the executing agency of this MFF. The RRF employed the Programme Management Unit (PMU) to lead the day-to-day implementation of the MFF. The PMU established Safeguards Team to oversee the planning and implementing environmental mitigation measures during construction period.

23. RRF ensures that potential adverse environmental impacts arising from the investment program are minimized by implementing all mitigation and monitoring measures as presented in the environment management plan (EMP) included in the IEEs or EIAs.

24. The Safeguard Team and CSC are responsible to prepare and submit environmental monitoring report and other safeguard requirements related with land acquisition. The mitigation measures related with environmental impacts associated with the construction works are implemented by the Constructor with guidance from the CSC.

25. The PMU team has constant for communication with the CSC and Contractor, for reviews/ comments on all environmental issues and submitted reports. Representatives of PMU staff, including Social Safeguard Specialist regularly conducted visits to the construction site. Monthly meetings were conducted with focus on project progress, technical problems, as well as environmental safeguard issues.

Relationship with borrower 26. ADB is the financing institution of the project. A Framework Financing Agreement (FFA)

was signed by the Republic of Uzbekistan and ADB on 18 March 2010 for the Investment Program. Loan agreement No: 2868-UZB was signed on August 30, 2012.

27. ADB oversees project sites regularly and gives clear instructions for the project sites improvements, including scope of safeguards environmental issues and progress of work. During this reporting period ADB representatives from URM and Head office conducted one visit to site for general inspection of works and progress. On 24th to 25th of May 2016, ADB mission visited the site with the purpose of reviewing the environmental safeguard implementation status on site. List of the visitors: Kwan Lue (Transport Portfolio Manager, ADB), Mrs. Keti Dgebuadze (National Environment Safeguard Consultant, ADB Georgia Resident Mission), Mrs. Feruza Insovalieva (National Environment Safeguard Specialist, ADB Uzbekistan Resident Mission), with participation of CSC and Contractor conducted coordination meeting in Camp Site. Progress of works and related problems were discussed.

28. Visitors conducted a meeting with the Contractor, reviewed all existing documentation

and reports of the Contractor and Consultant on site. The road, camp site, quarries and concrete batching plant have been visited and inspected. All objects and documentation have been found satisfactory and recommendations to improve implementation of environmental safeguard activities been provided.

29. On 25th of May 2016 training session for representatives of Contractor (Evrascon & Posco) and Consultant (Renardet & Sambo) was conducted on the issues of improving reporting procedures of the project and preparation for final environmental audit. Clear instructions given for improving environmental monitoring and management activities on site.

PART 2 – ENVIRONMENTAL MONITORING

30. After project launching environmental quality monitoring has been conducted on monthly basis. Details of environmental management during construction were discussed with environmental specialists of Contractor and Engineer during visits of Environmental consultant to the project site. As the works progressed, quality of air, water, and soil have been monitored.

31. Environmental Laws and Norms of the Republic of Uzbekistan through SNPC,

Sanitarian Epidemiological Station formed a base for environmental quality monitoring. 32. Monitoring performed by using indicators described in the EMP. The environmental

quality should be in compliance with relevant norms of Republic of Uzbekistan. The environmental monitoring results should be compared with environmental quality standards of Uzbekistan.

33. Water Quality Monitoring: Aside from the occasional rainfall and flash flooding, there is

no surface water over which the area the road passes. The shallow groundwater aquifer is >25m below the surface, is saline and polluted. Groundwater for human consumption is scarce in Buhara oblast, with only 22,000 up to 33,000 m3/day available (2008 data). Between 7,000 up to 10,000 m3/day have been allocated for industrial use in Bukhara. Thereby the water use for concrete production is seriously restricted. Even in case when neither surface, nor groundwater quality will be affected, the over-extraction of local groundwater during the construction period could have serious impacts.

34. Water for construction purposes is being used from the well near the camp site. Analysis

of water from the well demonstrated its technical suitability for usage in the crushing plant, for dust suppression on the territory of the camp and industrial area, plus - for watering the road during reconstruction. No monthly testing is required.

35. Water for concrete preparation is being taken from the well belonging to Gazli UMG,

situated within 3 km from road site, on the section km 340 of the A380 road. The water monitoring results from existing water sources have been carried out by local Bukhara regional Epidemiology laboratory. Laboratory test results were presented in previous reports. The results were positive and showing acceptability for consumption.

36. Air quality monitoring: According to the multi-year data set, intensity of dust-storms

with wind speeds of 80-100 kmh, increased in direction from Bukhara to Urgench. The average wind speed remains about 17 km/hr. Wind is very significant for air quality, since for majority time of the year project area has elevated level of dustiness due to the constant wind-related dust in the air

37. Aside from dust-storm induced air pollution, the air quality near the road is well enough

within the RoU standards since no industrial or commercial emission source exist anywhere and traffic is at low level. Contractor established an agreement with Bukhara Regional Committee for Nature Protection for the monthly measurement of air quality within the project area. Representatives of Bukhara regional Committee for Nature Protection conducted air quality monitoring on a monthly basis.

38. During the reporting period, representatives of Bukhara Regional Committee for Nature Protection have conducted air quality monitoring on monthly basis. PART 3 – ENVIRONMENTAL MANAGEMENT

A. The environmental management system (EMS), updated environmental

management plan (EMP), and work plans

39. The IEE is an environmental statement of the RRF. While it is prepared by consultant,

the IEE follows commitment to ecologic safety rules of the RoU, and to implement the mitigation and monitoring actions, listed in the IEE by the proponent, its contractor and consultant.

40. In order to take seriously mitigation measures proposed in the lEE’s (EMiP) and

monitoring plans (EMoP), they are legally binding through inclusion in environmental clauses into the loan agreement between the RRF and the ADB, as well as the specifications of the contract- bid documents. This is achieved by integrating the EMP (EMiP and EMoP) into the contract specifications as a clause. References to the EMP made in the loan agreement between the RRF and ADB.

41. EMiP and EMoP are integral parts of the contract, their implementation is mandatory for

contractor. Environmental Management Plan (EMP) has been designed to avoid, reduce, or at least - minimize the adverse environmental impacts that could result from the activities during the implementation and first year operation of the project.

42. Site Specific Environmental Management (SSEMP) plan was not developed by

Contractor and updated EMP is used as the major document for managing and monitoring environmental activities on site. Taking into account that EMP defines concrete steps, which need to be taken by Contractor during project implementation period, also due to the lack of serious environmental violations development of SSEMP was not requested from Contractor.

Construction Period (Environmental Management Plan - EMP)

43. This section addressed conformance with the Project Environmental Management Plan (EMP) and other contractual obligations relating to the environment and health and safety issues.

44. Besides environmental management actions, EMP defines what kind of mitigation

measures have to be implemented by Contractor and how to conduct environmental monitoring during the road construction work. EMP defines place, time, parameters and responsibility of environmental monitoring.

45. The field works on monitoring of environmental management plan for this period was

carried out in project areas (road A-380 sections km 315 – km 355) as follows.

- Sections km 315 – km 355 of road A380 and the shoulders; - Road side quarries;

Status of updated EMPs for Road sections km 315 – km 355

46. As of the reporting period total progress in major items of works consist of the following:

- Earthworks – 80 km; - Base course – 80 km; - CTB (Cement Treated Base) – 80 km; - CCP (Cement Concrete Pavement) – 79,9 km.

40 km = 80 km of two lane pavement (40 km left hand side and 40 km right hand side). 47. During the inspection of the Road Construction Site and adjacent areas no major issues

of concerned were identified. Minimal issues of concerns were immediately reported and resolved accordingly. Construction works are carried out with optimal amount of construction equipment. All works are conducted within right of way and the land allotment for the construction works. Dust control measures are being implemented during hot and dry periods to avoid pollution of the air.

close to the road, along the whole stretch of 40 km. However, only 11 borrow pits were used by Contractor. Distance from road construction site to borrow area doesn’t exceed 100 meters. Materials from the borrow pits were used for the Embankment formation of the new road starting from315 km till 355 km. Requested Environmental Statements for all 30 borrow pits were obtained from Bukhara Regional Nature Protection Committee in November 2014.

49. Each borrow pit has permitted area of 2.8 hectares. Top soil on borrow pit areas is being removed in accordance with ecological rules. Each borrow pit is excavated up to 2.5 meters deep, & developed one after another (not simultaneously). Proper re-cultivation & conservation of the pit areas is included into work plans after completion of works. Removed topsoil is stored around perimeter of the borrow pits.

50. Environmental situation around the borrow pits area is considered to be stable. Borrow pit areas are situated close to the road that allows creating acceptable condition for implementation of environmental safety measures.

Plants are fully operational at current reporting period.

B. Site Inspection and audits 54. Mr. Sergey Karandaev, Environmental Safeguard Specialist of the CSC conducted

inspection visit at the road reconstruction site on a monthly basis. During his visits Contractor’s compliance with environmental Safeguard requirements have been inspected. All project sites used to be visited in order to carry out evaluation of environmental safety conditions. Coordination with regional State Nature Protection Committee was observed.

55. On 24 May 2015, ADB mission visited the site with the purpose to review environmental

safeguard implementation status on the site. Visitors conducted a meeting with the Contractor, & reviewed all existing documentation and reports of Contractor and Consultant on site. The camp, the quarries and concrete batching plant areas have been visited and inspected. Environmental conditions of site & documentation have been found satisfactory. Recommendations to improve implementation of the environmental safeguard activities been provided.

C. Non-compliance notices and corrective actions 56. During visits of Environmental Safeguard Specialist of the Engineer several instructions

to eliminate shortcomings and non-compliances have been issued. In majority cases corrective actions were implemented by the Contractor.

Avoidance of uncontrolled discharge of water.

Contractor should not allow discharge of water from the well to the terrain, which can lead to salinization of the soil. As protection measures Contractor is recommended to organize collector pool. Had to be implemented by December 2015. The reason for delay is that temporary measures were not accepted by Engineer. Due to slow down of activities, Contractor couldn’t find additional resources and equipment to fulfill the task on time.

Temporary collector pool was prepared by Contractor. However the collector didn’t comply with requirements, also it has to be maintained on daily basis to avoid overflow. New deadline is end of July 2016.

D. Actions taken to reflect the ADB Mission findings during the reporting period 57. During the visit on 24 – 25May 2016, mission revealed poor environmental management

of the batching plant and improper use of washing areas therein. Cement sludge was seen at some places, and settling basins were not being used. Waste barrels with mixed waste were disorderly disposed near the settling tank without roofing and signs.

58. Consultant was requested to issue non-compliance notice to Contractor for implementing corrective actions for the identified shortcomings, batching plant to be cleaned up and surface graveled. Proper drainage system to be made and wastewater channeled to the settling tank. Also instructions were given to improve reporting procedures of the Contractor and the Consultant. The deadline for eliminating identified shortcoming was set to end of June 2016.

59. It was requested to start preparation for the final environmental audit by filling up environmental checklist, and template was provided by the ADB Mission representative. Report preparation works already started.

E. Grievance Redress Mechanism 60. According with IEE RRF established a grievance redress mechanism (GRM) to receive,

facilitate and resolve grievances of the affected people concerning environmental safeguards at the project section. The grievance redress mechanism will be scaled to reduce risks and negative impacts of the project.

61. The RRF’s PMU, in cooperation with the Administration of Buharaviloyet and impacted

rayons, established Grievance Redress Committees (GRCs) at both levels. At viloyat level this Committee comprised of Hakim representatives, representative of the RRF and a member of the Viloyat Environmental Department. One member of the committee is identified as the contacting point for any received grievance claim. At the rayon level it is consisted of government officials and two non-governmental members.

62. Grievances can be filed in writing form or orally with the GRC’s rayon-level contact

person. The committee hasonly15 working days to respond with resolution. If unsatisfied with the decision the complainant will be able to resubmit the grievance with the oblast GRC for final resolution, and at the same time submit a copy of the letter to the ADB project officer in charge. The oblast GRC will have a further 15 days to provide a decision, and if no ruling is forthcoming the grievance will be automatically decided in favor of the complainant and all compensation will be provided.

63. The Project has employed the existing Government Grievance Redress Mechanism.

The focal Points (GFP) have been established at the district mayor’s offices to coordinate and address all compliances and concerns arising from the project. The contact details are:

64. The Grievance Focal Point, who will maintain registration of all complaints, will keep

track of grievance status and inform Director of PMU. S/he will receive assistance and support of members of the Committee, in case of grievances filed by the affected peoples. The GFP will track complaints received, actions undertaken and the status of resolution. However, until the current report preparation (January 2016), there was no official filing of any grievance.

PART 4 – CONCLUSION AND RECOMMENDATIONS

A. Conclusion 65. No serious environmental issues were identified during the reporting period. Major

construction works carried out accordingly and already completed. Accommodation, office facilities and production areas, such as crushing and concrete batching plant installations are fully operational.

66. Contractor is taking necessary steps in implementation of EMP requirements. Permits

from local authorities are being obtained. Some issues remain to be solved and addressed by Contractor accordingly.

67. Implementation of monitoring activities from Contractor has to be implemented and

conducted regularly as indicated and required in EMP. Instructions of the Consultant’s Environment Specialist have to be followed.

68. Training of technical staff of Contractor & Engineer on environmental compliance

management and reporting conducted with assistance of RRF. Some training was organized with participation of rayon level environmental inspectors of GosComPriroda

69. Contractor has to start preparation for Final Environmental Audit as the project

completion is expected by end of September 2016. 70. The final environmental monitoring report is expected to be submitted to RRF and ADB

inSeptember2016.

Asphalt slabs collected at the borrow pit at Km. 353, RHS. Contractor is planning to establish mobile

crashing plant to crash the asphalt slabs and use it for filler shoulders.
