    (4) The Aut hority in considering t he applicat ionmay ask for further information including, if required,an envi ronmenta l impac t assessment , in accordancew ith th e procedure prescribed.

    (5) An y a p pl i ca t i o n w h i c h r e q u i r e s t h eprepara tion of an environment impact assessment sha llbe submit ted for publ ic comment in accordance withs e c t i o n 2 8 b e f o r e a n y C e r t i f i c a t e i s i s s u e d b y t h e

    Authority.

    36. (1) Af t e r c on s i d e r i n g a l l r e l ev a n t m a t t e r s ,i n c l u d i n g t h e c o m m e n t s o r r e p r e s e n t a t i o n s m a d eduring the public comment period, the Authority mayissue a Certificate subject to such terms and conditionsas i t thinks fit , including the requirement to undertakea ppropriat e mitiga tion mea sures.

    (2) Wh e r e t h e A u t h o r i t y r e f u s e s t o i s s u e aCertificate, i t shall provide to the applicant in writing

    its rea sons for such a ction.

    37. The Authority shall monitor the performance ofth e activity to ensure complia nce with a ny conditions inthe Certificate, and to confirm that the performance ofth e a ctivity is consistent w ith

    (a ) the description provided in the applicationfor a Certifica te; and

    (b) t h e i n f o r m a t i o n p r o v i d e d i n a n yenvironmenta l impact a ssessment .

    38. (1) Wh e r e a n a c t i v i t y d e s i g n a t e d u n d e rsubsection 35(1) constitutes a development requiringth e express gra nt of permission under t he Town a ndCountry P lan ning Act, t he developer sha ll deal directlyw i t h t h e e n t i t y r e s pon s i b le f or t ow n a n d c ou n t r y

    (3) I n a n y i n s t a n c e w h e r e t h e Au t h or i t ydetermines that an environmental impact assessmenti s r equ i r ed fo r a n ac t i v i t y a t any l o c a t i on , no o the re n t i t y s h a l l g r a n t a n y p e r m i t , l i c e n c e , o r o t h e rd o cu m e n t a r y a u t h o r is a t i on w i t h r e s pe ct t o s u cha c t i v i t y, u n t i l a C e r t i f i c a t e h a s b e e n i s s u e d b y t h eAuthority.

    39. Sections 35 to 38 inclusive sha ll not a pply t o(a ) any activity with respect to which, prior to

    the da te on w hich review und er this sectionfirst became applicable, all f inal approvalsn e c e s s a r y t o p r o c e e d a l r e a d y h a d b e e n

    ob t a i n e d f r om a l l ot h e r g o v er n m e n t a lentit ies requiring such a pprovals; an d(b) any activity with respect to which, prior to

    the e ffec t ive da te on which rev iew underthis section first became applicable, outlinep l a n n i n g p e r m i s s i o n o r f u l l p l a n n i n gpermiss ion under t he Town a nd C ount ryP lan ning Act ha d alrea dy been obta ined.

    40. Any f i na l de c i s i on b y t h e Au tho r i t y t o r e fu seissuance of a Certificate or to issue a certificate with

    conditions may be appealed to the Commission by theperson seeking such Cert ifica te.

    41. (1) The Auth ori ty m a y prescr ibe in a ccorda ncewith section 26 (e) the designation of a defined portionof the environment w ithin Trinida d a nd Toba go as a n

    environmentally sensitive area, or of any species ofliving plant or animal as an environmentally sensitivespecies, requir ing special protect ion to achieve theobject s of t his Act.

    (2) For the purpose of subsection (1), designa tionsha ll be ma de by Notice published in th e Gazette.

    42. In pursuance of section 41(1), the Notice shallinclude

    (a ) a comprehensive description of the area orspecies to be so designa ted;

    (b) the rea sons for such designat ion; a nd(c) t h e s p e c i f i c l i m i t a t i o n s o n u s e o f o r

    act ivi t ies within such area or with regardt o s u c h s p ec ie s w h i c h a r e r e q u i r e d t oa d e q u a t e l y p r o t e c t t h e i d e n t i f i e denvironmental concerns.

    43. Any designat ion of a n environment a lly sensitivearea or environmentally sensitive species

    (a ) may permi t the wise use of such a rea orspecies and provide for the undertaking ofappropriate mitigation measures, but shallno t o therwise be deemed to au thor i se o rp e r m i t a n y a c t i v i t y n o t p r e v i o u s l ya u t h o r i s e d o r p e r m i t t e d w i t h r e s p e c t t osuch a rea or species; a nd

    (b) s h a l l o n l y r e q u i r e c o m p l i a n c e w i t h t h es p e c i f i c l i m i t a t i o n s o n u s e o r a c t i v i t i e sspecified in th e designa tion.

    44. Sections 41 to 43 shall not apply to any activity

    w ith respect to w hich, prior t o the da te of designa tion ofa n e n v i r o n m e n t a l l y s e n s i t i v e a r e a o renvironmentally sensitive species, all final approvalsnecessary to proceed had already been obtained from orf o r w h i c h a p p l i c a t i o n h a d b e e n m a d e t o a l lgovernmenta l entit ies requiring such a pprovals.

    45. For the purposes of sections 41 to 43 inclusive,the Authority shall co-ordinate with any governmentale n t i t i e s h a v i n g r e s p o n s i b i l i t y f o r p l a n n i n g a n dm a n a g e m en t i n s u ch a r e a s o r w i t h r e s p ect t o s u chspecies.

    46. Any fina l action designat ing an environmenta llysensitive area or environmentally sensitive speciessha ll be capa ble of a ppea l to the Commission.

    47. The Auth ority m a y, a s prescribed by r ule, requirea ny person w ho relea ses a pollutan t from a ny premiseso r v e h i c l e , o r w h o e n g a g e s i n t h e h a n d l i n g o f a n yhazardous substance, on a one-time or periodic basist o

    (a ) s a m p l e a n d a n a l y s e s u c h p o l l u t a n t o rh a z a r d o u s s u b s t a n c e , o r m a t e r i a l w h i c hh a s b e c o m e c o n t a m i n a t e d w i t h s u c hp ol l u t a n t o r h a z a r d ou s s u b s t a n c e, f orspecified const ituent s or cha ra cteristics;

    (b) install , use, and maintain such monitoringe q u i p m e n t , a n d i m p l e m e n t s u c henvironmental audit procedures, as may bespecif ied in any permit or l icence issuedpursuan t t o this Act;

    (c) es tab l i sh and main ta in records regard ings u c h s a m p l i n g , m o n i t o r i n g , a n denvironmenta l auditing a ctivities;

    (d ) es tab l i sh and main ta in records regard ingp o l l u t i o n c o n t r o l e q u i p m e n t o n t h ep r e m i s e s ( i n c l u d i n g r e c o r d s o n c o n t r o le q u i p m e n t p a r a m e t e r s , p r o d u c t i o nv a r i a b l e s a n d o t h e r i n d i r e c t d a t a w h e ndirect monitoring is not r equired);

    (e) s u b m i t r e p o r t s a n d c o m p l i a n c ecertifica tions; a nd

    48. (1) Where an a pplica tion is ma de under section

    50(3), 53(3), 57(4) or 60(2) for the grant of a permit orl i cence under sec t ion 50(1) , 53(1) , 57(1) o r 60(1) ,r e s p ec t i v el y, a n d t h e Au t h o r i t y r e q u i r e s f u r t h e ri n f or m a t i o n f or t h e p u r p os e of d e a l i n g w i t h t h eappl icat ion, the Authori ty may require the person toprovide results of resea rch or a na lysis to be underta kenby such person.

    (2)The Author i ty may, as p rescr ibed by ru le ,revoke, suspend, vary or cancel any provision in suchpermit or licence where the Authority determines such

    a ction is necessar y.

    (3) Any conditions imposed in respect of a permit ,or a revocat ion, suspension, var ia t ion or cancel la t iontakes effect when notice is served on the holder of thepermit or such later t ime as the Authority may directin t he notice.

    (4) Any such revoca tion, suspension, va ria tion orcancellation of a permit or licence shall be capable ofappea l t o t he Comm is s io n by t h e pe rmi t o r l i c ence

    (2) The Authority sh a ll ca use a r egister of air a ndnoise pollutan ts to be maint a ined a s prescribed by r ule,w h i c h s h a l l c o n t a i n d a t a i d e n t i f y i n g t h e q u a n t i t y,c o n d i t i o n s o r c o n c e n t r a t i o n s r e l e v a n t t o t h eidentifica tion of each pollutan t.

    (3) The Auth ority sha ll develop an d implement a

    p r o g r a m m e f o r t h e m a n a g e m e n t o f s u c h p o l l u t i o nw h i ch s h a l l i n c lu d e t h e r e g is t r a t i on a n d f u r t h e rcharacterisation of significant sources of any ongoing orintermittent releases of air or noise pollutants into theenvironment.

    50. (1) The Auth ority ma y require and gra nt permitst o a u t h o r i s e a n y p r oce s s r e le a s i n g a i r p ol l u t a n t ssubject t o such t erms a nd conditions a s i t t hinks fit .

    (2) The t e rms a nd c ond i t i o n s o f a p e r m i t ma y

    r e l a t e t o t h e d e s i g n , c o n s t r u c t i o n , o p e r a t i o n ,m a i n t e n a n c e a n d m on i t o r in g o f t h e f a c i l i t y a n dprocesses releasing air pollutants.

    (3) A person sha ll apply to the Authority for th egra nt of an Air Pollution Permit in a ccordance with t heform a s determined by th e Auth ority.

    51. (1) N o p er s o n s h a l l r e l e a s e o r c a u s e t o b ereleased any air pollutant into the environment whichis in viola tion of any a pplica ble stan da rds, conditions or

    permit requirements under t his Act.(2) No person sha ll emit or ca use to be emitt ed

    a n y n o i s e g r e a t e r i n v o l u m e o r i n t e n s i t y t h a nprescr ibed in rules made under sect ion 26 or by anya pplica ble stan da rds, conditions or requirement s underth is Act.

    52. (1) The Auth or ity sha l l , a s soon a s p ra ct icab leaf te r the commencement o f th i s Act , inves t iga te theenvironment genera lly a nd such premises an d vehicles

    as it thinks necessary for the purposes of(a ) ascer ta ining the extent of water pol lut ion

    54. No person shall release or cause to be releasedany water pol lutant into the environment which is inv iol a t i on o f a ny a ppl i ca b l e s t a nd a rds , cond i t i ons o rpermit requirements under t his Act.

    55. (1) The Author ity sha l l, a s soon a s p rac t icab leaf te r the commencement o f th i s Act , inves t iga te theenvironment genera lly a nd such premises an d vehiclesas it thinks necessary for the purposes of

    (a ) a s c e r t a i n i n g t h e v ol u m e a n d n a t u r e o fwa stes which a re han dled a nd disposed intothe environment; a nd

    (b) identifying and characterising the differentca t egor i e s a nd t h e s i gn i f i ca n t s ou rces o fsuch w ast es.

    (2) The Auth ority sh a ll develop and implement a

    programme for the management of such wastes whichm a y i n c l u d e t h e r e g i s t r a t i o n a n d f u r t h e rcharacterisation of significant sources of wastes beingdisposed into the environment.

    56. The Authority shall as soon as practicable afterth e commencement of th is Act, submit t o the Minister ap rog ramme to de f i ne t h o s e was t e s w h i c h shou ld bedeemed hazardous wastes, to establish requirementsfor the handl ing and disposal of hazardous wastes , toestablish appropriate standards and design criteria for

    hazardous waste handl ing and disposal faci l i t ies , andto e s t ab l i sh l i c e ns in g an d p e r m i t t i ng r e qu i r e m en t sw ith respect to such w a stes.

    57. (1) Th e Au t h or i t y m a y r e q u i r e a n d g r a n t ap er m i t t o a u t h o r i s e a n y p er s o n s w a s t e d i s p os a lac t iv i t i es , o r l i cences fo r the opera t ion of any was tehandling facility, subject to such terms and conditionsas i t t h inks fi t .

    (2) The term s a nd conditions of a l icence underth i s s ec t i on may r e l a t e t o t h e de s ign , c ons t ru c t i on ,opera t ion , main tenance and moni tor ing of any was teha ndling fa cility.

    (3) The terms a nd condit ions of a permit und erthis sect ion may relate to a persons handl ing of anywas te .

    (4) A person sha ll apply to the Authority for th egra nt of such licence or permit a s prescribed by ru le.

    58. No person sh a ll ha ndle or dispose of a ny w a ste orhazardous waste in a manner which is in violat ion of

    any applicable licence, permit, standards, conditions orrequirement s under t his Act.

    59. The Authority shall, as soon as practicable afterthe commencement of this Act, submit to the Ministera programme for the designation of specific hazardous

    60. (1) Af t e r f i n a l d e s i g n a t i o n o f s u c h s p e c i f ichaza rdous subs t ances and t h e e s t ab l i shm e n t o f t heperformance s tandards and procedures under sect ion26, a person sha ll not ha ndle, or cause t o be ha ndled byany other person through contract, agreement or othera r r a n g e m en t , a n y h a z a r d o u s s u b s t a n c e ex ce pt i na ccorda nce w ith

    (a ) s u c h p e r f o r m a n c e s t a n d a r d s a n dprocedur es; or

    (b) a l i c e n c e o r p e r m i t g r a n t e d b y t h eAuthority.

    (2) A person sha ll apply to the Authority for th egra nt of a licence or permit a s prescribed by rule.

    61. (1) As s o on a s p r a ct i c a b l e a f t e r t h ec o m m e n c e m e n t o f t h i s A c t , a n d t h e r e a f t e r a sa p p r o p r i a t e , t h e A u t h o r i t y s h a l l i n v e s t i g a t e a n dd e s i g n a t e c a t e g o r i e s o f c i r c u m s t a n c e s i n v o l v i n g

    a ccidenta l spills or other releas es of polluta nt s, or otherincidents with respect to hazardous substances, whichm a y p r e s e n t a r i s k t o h u m a n h e a l t h o r t h eenvironment.

    (2) The de s i gna t i on o f such c a t ego r i e s by t h eAuthor i ty sha l l be submi t ted for publ ic comment ina ccorda nce wit h section 28.

    (3) After th e f inal designat ion of a ny ca tegoriesu n d e r t h i s s e ct i o n , a n y p e r s on i n c h a r g e of a n ypremises or vehicle shall, as soon as he has knowledge

    of a release or other incident referred to in this sectionassoc ia ted wi th such premises o r veh ic le , no t i fy theAuthority of such release or incident and provide to theAuthority

    (a ) a b r i e f d e s c r i p t i o n o f t h e r e l e a s e o rincident;

    (c) a d e s c r i p t i o n o f t h e r e s p o n s e m e a s u r e st a k en a n d t o b e t a k en t o a d d r e s s a n do t h e r w i s e m i t i g a t e d a m a g e s o rcont a mina tion resulting from th e release orincident.

    (4) The Auth ority sha ll investigat e a nd evalua tea ny such release or incident as i t t hinks fit , and ma y

    (a ) r e s p o n d t o t h e r e l e a s e o r i n c i d e n t a s

    authorised under section 25; and(b) d e v e l o p a n d i m p l e m e n t a p p r o p r i a t e

    e n v i r o n m e n t a l p r o g r a m m e s , s t a n d a r d s ,c o n d i t i o n s , p e r m i t s , l i c e n c e s o rr eq u ir em en t s d e s i g n e d t o a v o i d s u c hreleases or incidents in the future.

    PART VI

    C OM PLI ANCE AND E NFORCEMENT

    62. F o r t h e p u r p o s e s o f t h i s P a r t a n d P a r t V I I I ,environmental requirement means the requirementupon a person to

    (a ) c o m p l y w i t h t h e p r o c e d u r e s f o r t h er e g i s t r a t i o n o f s o u r c e s f r o m w h i c hp o l l u t a n t s m a y b e r e l e a s e d i n t o t h eenvironment;

    (b) comply with the procedures and s tandardswith respect to permits or licences requiredf o r a n y p e r s o n t o i n s t a l l o r o p e r a t e a n yprocess or source from w hich polluta nt s w illbe or may continue to be released into theenvironment;

    (c) provide in a t imely manner complete anda ccu r a t e i n f or m a t i on i n a n y r e q u i r e dsubmiss ion to o r communica t ion wi th the

    (g) comply with the conditions and mitigationmeasur es in an y such certifica te;

    (h ) comply with the procedures and s tandardswi th respec t to the per iod ic o r con t inua lm o n i t o r i n g o f p o l l u t i o n o r r e l e a s e s o fpol lutants or condi t ions required under apermit or licence;

    (i ) p rov i de t ime ly a n d acc u r a t e n o t i f i c a t i onw i t h r e s p e c t t o a n a c c i d e n t a l o ru n a u t h o r i s ed r e l e a s e of a p ol l u t a n t , o rother incident with respect to a hazardoussubstance;

    (j ) control the release of pollutants in such amanner as to comply wi th any permi t o rlicence granted under section 50(1), 53(1),57(1) or 60(1);

    (k ) submit timely payment of required fees or

    charges paya ble to the Auth ority; a nd(l ) c o m p l y w i t h a l l o t h e r p r o c e d u r e s ,

    s ta ndards , p rogrammes a nd requirementsin such a manner as may be prescribed byrule or regulation.

    63. (1) Where the Auth ority reasona bly believes tha t

    a p e r s o n i s i n v i o l a t i o n o f a n e n v i r o n m e n t a lrequirement , the Authority sh a ll serve a w ritt en noticeof viola tion (hereina fter called Notice) on such personi n a f o r m d e t e r m i n e d b y t h e B o a r d , w h i c h s h a l linclude

    (a ) a r e q u es t t h a t t h e p er s on m a k e s uchm o d i fi ca t i o n s t o t h e a c t i v i t y w i t h i n aspecified time, as may be required to allow th e cont inua tion of th e activity; or

    (b) a n i n v i t a t i o n t o t h e p e r s o n t o m a k er e p r e s e n t a t i o n s t o t h e A u t h o r i t yc on c er n i n g t h e m a t t e r s s p e ci f i ed i n t h eNotice w ith in a specified t ime.

    (2) Where a ma tt er specified in th e Notice ma yb e s a t i s f a c t o r i l y e x p l a i n e d o r o t h e r w i s e r e s o l v e dbetween the person a nd t he Authority

    (a ) t h e Au t h or i t y m a y c a n c el t h e N ot i c e ordismiss the matters specified in the Notice;or

    (a ) appea l s t he Adm in i s t r a t i ve O r d e r t o t h eCommission;

    (b) reaches an agreement wi th the Author i tywhich is reduced in writing into a ConsentAgreement; or

    (c) o b t a i n s a n e x t e n s i o n o f t i m e f r o m t h eAuth ority wh ich is confirmed in w riting.

    66. (1) For t he purposes of sections 65 an d 81(5) (d ) ,

    t h e Au t h o r i t y o r t h e C o m m i s s ion m a y m a k e a na dministra tive civil a ssessment of

    (a ) compensation for actual costs incurred bythe Authority to respond to environmentalcondi t ions or other c i rcumstances ar is ingo u t o f t h e v i o l a t i on r e f er e n c ed i n t h eAdministra tive Order;

    (b) c o m p e n s a t i o n f o r d a m a g e s t o t h eenvironment associated with publ ic landsor holdings which arise out of the violationreferenced in the Administrative Order;

    (c) d a m a g e s f o r a n y e c o n o m i c b e n e f i t o ramount saved by a person through failureto comply wi th appl icab le env i ronmenta lrequirements; and

    (d ) d a m a g e s f or t h e f a i l u r e of a p er s o n t oc om p l y w i t h a p pl i ca b l e en v i r o n m e n t a lr equ i r em e n t s , i n an amo u n t de t e rmi n edpursua nt to subsections (2) a nd (3).

    (2) In determining the amount of any da ma ges tob e a s s e s s e d u n d e r s u b s e c t i o n s (1 ) (c) a n d (d ) , t h eAuth ority or the C ommission sh a ll ta ke into account

    (a ) t h e n a t u r e , c i r c u m s t a n c e s , e x t e n t a n dgra vity of the violat ion;

    (b) a ny h istory of prior violat ions; a nd

    (c) the degree of willfulness or culpabili ty incommitt ing the violat ion a nd a ny good fait heffort s t o co-opera te w ith th e Auth ority.

    (3) Th e t o t a l a m o u n t o f a n y d a m a g e s u n d ersubs ection (1) (d ) , sha ll not exceed

(1) Contr ibut ions to the Fund ma y be designatedf o r s p e c i f i c p r o j e c t s o r m a d e s u b j e c t t o s p e c i f i ccondi t ions, in which case such contr ibut ions shal l bep r e s e r v e d a n d u t i l i s e d s o l e l y f o r t h e d e s i g n a t e dp u r p o s e . I n a l l o t h e r i n s t a n c e s , t h e t r u s t e e s a r ea uth orised to pa y for an y of the follow ing ma tt ers out of

    the general resources of the Fund(a ) the opera t ing expenses o f the Author i ty,

    (b) t h e c a p i t a l e x p e n s e s , i n c l u d i n gmaintenance and insurance of the propertyunder the administration and control of theAuthority;

    (3) In t he event conditions att a ched to finan cialassistance or other support for specific programmes orac t iv i t i es requ i re tha t such ass i s tance or suppor t bep r o c e s s e d o t h e r w i s e t h a n t h r o u g h t h e F u n d , t h eAuth ority sha ll

    (a ) m a i n t a i n a p r op er a u d i t e d a c cou n t i n gsystem; a nd

    (b) disclose such matters in i ts annual reporta s requir ed under section 14.

    (5) All monies collected by th e Authority by w a y

    80. (1) The Boa rd ma y, by resolution, ma ke rules forthe system of accounting for the finances of the Fund,cons i s ten t wi th the bes t commerc ia l account ing andfinancial s tandards.

    82. (1) The Commiss ion sh a ll be comprised of a full-t ime Chai rman, and f ive o ther members inc lud ing aDeputy Chairman each of whom may be appointed toserve in a full-t ime, part-t ime or periodic capacity asma y be req uired t o fulfill th e objects of this Act.

    (2) The Chai rma n a nd Deputy C hai rma n of theCommission sh a ll each be an a tt orney-a t-law of not lesstha n ten years s ta nding, and sha l l be appointed by thePresident.

    (3) The members of the Commission, oth er tha nt h e C h a i r m a n a n d D e pu t y C h a i r m a n , s h a l l bea ppointed by t he P resident from a mong such persons a sa ppear t o the P resident to be qualified by virtue of theirknowledge of, or experience in environmental issues,engineering, th e na tur a l sciences or the socia l sciences.

    (4) Al l members o f the Commiss ion sha l l ho ldo ff i ce u n d e r s u c h r e q u i r e m e n t s a n d co n d i t i on s o fservice and for such term, not less th a n t hree yea rs, asmay be determined by the President and set for th inth e terms of reference at the t ime of th eir a ppointment ,and shall be eligible for reappointment.

    (5) Notw i ths ta nding tha t h i s t e rm of off ice has

    expired, any member of the Commission may, with thepermission of th e P resident a cting on t he a dvice of th eChai rman of the Commiss ion , con t inue in o ff ice fo rsuch a period after the expiry of his term, as may benecessary to deliver judgment, or t o do any oth er th ingin relation to proceedings that were commenced beforesuch m ember prior to t he expiry of his t erm of office.

    (6) Any member of the Commission ma y, at a nyt ime by not ice in wri t ing to the President , res ign hisoffice.

    (7) The P res iden t m a y remove f rom off ice an ymember of the Commission for inability, misbehaviouror on the ground of any employment or interest whichis incompatible with the functions of a member of theCommission.

    (8) Where a ny m ember of the Commiss ion is ill,or otherw ise unable to a ct, or w here his office is va ca nt ,the President may appoint a person to act in the steadof such member during his i l lness or incapabi l i ty orunt il the office is filled, a s th e ca se ma y be.

    83.     84. (1) Th e j u r i s d i c t i o n a n d p ow e r s o f t h eCommission may be exercised by the Chairman or theDeputy Chairman and two other members selected bythe Chairman or Deputy Chairman, for the purpose ofa ny case or proceeding which ma y be brought before

    th e Commission.(2) N o t w i t h s t a n d i n g s u b s e c t i on (1 ), t h e

    jurisdiction of the Commission may be exercised withrespect to

    (a ) a n y m a t t e r , b y t h e C h a i r m a n o r D e p u t yChai rman s i t t ing a lone or wi th one o thermember if t he par ties consent th ereto;

    (b) any matter of practice or procedure that iscontested by the par t ies , by the Chairmanor D eputy C ha irman or a ny member of theCommission who is an attorney-at-law andi s a s s i g n e d f o r t h a t p u r p o s e b y t h eCha irma n of the Commission; and

    (12) In a ny ma t t e r before the Commission , theCommission may order that wri t ten arguments and acita tion of aut horities be submitt ed to th e Commissionin addi t ion to o r wi th the consen t o f the par t i es , inplace of a n oral h earing.

    (13) The decision of th e Comm ission sh a ll be th a tof the majority of the members present, but the opinionof the presiding member shal l prevai l on any matterarising in the course of any proceedings which, in hisopinion, is a q uestion of la w.

    (14) Th e d e c i s i on o f t h e C o m m i s s i o n i n a n yproceedings sha ll be delivered by th e presiding membera n d a n y m e m b e r m a y p r o v i d e a c o n c u r r i n g o rdissent ing opinion t o the decision of th e Commission.

    (15) Th e C o m m i s s i o n m a y, s u b j e ct t o t h eapproval of the President, make rules not inconsistentwith this Act governing the carrying on of i ts businessand t he p r ac t i c e and p roce d u r e i n c onne c t i on w i t happeals to the Commission and other proceedings, andthe regula t ing of any mat te rs re la t ing to the cos t o fproceedings before t he C ommission.

    (16) The presiding mem ber ma y, subject t o th erules of th e Commission a nd t o this Act, determine t he

    p r o c e d u r e t o b e f o l l o w e d i n a n y a p p e a l o r o t h e rproceedings.

    (17) Where by a ny w ritt en law there is conferredon the Commission jurisdiction which was previouslye x e r c i s e d b y a n o t h e r c o u r t , t r i b u n a l , a u t h o r i t y o r

    person (hereinafter called the former tribunal), then

    subject to section 85 and to any rules made under thissection

    (b) the decisions of the Commission in relationto such exercise ar e enforcea ble in t he sa mewa y a s those of the former tribuna l; a nd

    (c) t h e e f f e c t o f t h i n g s d o n e i n o r f o r t h epurpose of that jurisdiction by the formertribuna l sha ll be preserved.

    (18) Th e C o m m i s s i o n m a y h e a r a n y c a s e o rp r o c e e d i n g i n c a m e r a w h e r e s u c h p r o c e d u r e i sreasonably required to protect the interests of a partyto t he cas e or proceeding.

    85. (1) This sec t ion a pplies to every a ppea l t o theCommission und er this Act or a ny other w ritt en law.

    (2) The appeal sha ll be inst itut ed by fil ing wit hth e Registra r of the Commission a notice of a ppeal a ndserving a copy thereof on the secretary of the Authorityor oth er respondent .

    (3) Any a ppeal institut ed under this section shallbe filed within twenty-eight days of the service on theperson seeking to appeal the decision of the Authorityor other respondent, or within such other t ime as maybe prescribed by rules made under section 84(15).

    (2) In a ppeals involving th e Authority, there sha llbe a presumption of regularity with regard to findingsof fact by the Authority, and such findings shall not ber e v e r s e d u n l e s s t h e a p p e l l a n t a f f i r m a t i v e l yd e m on s t r a t e s t h a t t h e r e i s n o su b s t a n t i a l e v id e n cesupporting such findings of fact.

    (3) S ubject t o subsec t ion (4), th e Commis s ion

    87.     of section 85.

    (9) The onus of proving th a t the a llegat ions of thecomplaint are well-founded is on the complainant.

    (10) The Commission may dispose of a complaint

    by (a ) dismissing it ;

    provision of this Act or any other law may be evaded orviolat ed, commits a n offence and is l iable, on sum ma ryc on v i c t i on , t o a f i n e of t e n t h o u s a n d d o l la r s a n dimprisonment for six months.

    95. (1) Where any member of the B oar d, as w ell asa ny Trust ee for t he Fu nd, employee of th e Auth ority orEnvi ronmenta l Off ice r, has any ac tua l o r reasonablyperceived interest in a matter which would otherwisecome before such individua l as pa rt of th e considera tion

    or other action to be taken by the Authority, whethersuch interest is direct or indirect or arises because of apo t en t i a l f i nanc i a l i n t e r e s t o r a n immed ia t e f ami l yrelationship, such member of the Board, employee orEnvironmental Officer shall declare the nature of suchinterest a t th e first pra ctica ble opportun ity.

    (2) In a ny insta nce wh ich a rises under subsection( 1 ) , s u c h m e m b e r o f t h e B o a r d , e m p l o y e e o rE n v i r o n m e n t a l O f f i c e r s h a l l n o t v o t e o r o t h e r w i s eparticipate in the decision-making process, or attempt

    to influence in any way the decision or action taken ort o be t aken by t he Au tho r i t y, w i th r e s p ec t t o suchmatter.

    (3) I f a ny a ct ion ha s a l ready been ta ken by theBoard or the Authority before such interest has been

    96. (1) Th e M i n i s t e r m a y m a k e r e g u l a t i on sprescribing ma tt ers required or permitted by th is Act tobe prescribed, or necessary or convenient for carrying

    out or giving effect to t his Act.(2) With out limiting t he generalit y of subsection

    (1), th e Minister sh a ll ha ve pow er to prescribe

    (a ) the amount of charges and fees payable tot h e A u t h o r i t y f o r o r i n r e l a t i o n t oappl ica t ions , l i cences , permi t s o r fo r theprovisions of services or ma teria ls providedby th e Authority t o any person;

    (b) t h e a m oun t o f a ny o the r c ha rge s o r f e e swhich may be specified in any programmedeve loped by the Author i ty to encouragep r o t e c t i o n a n d c o n s e r v a t i o n o f t h eenvironment;

    (c) the manner of implementing pol ic ies andprogram mes r eferred to in section 16(1) (b) .

    (3) Regulations under t his section ma y prescribespecific offences under this Act and provide that anyp e r s o n c o m m i t t i n g s u c h a n o f f e n c e i s l i a b l e , o nsummary conviction, to a fine of not more than twenty

    thousand dol lars and imprisonment of not more thanone year.

    97. All acts and things done or omit ted to be doneunder the Environmental Management Act, 1995 (thef or m e r Act ) s h a l l , n ot w i t h s t a n d i n g a n y l a w t o t h e
