F Health

Eligibility for Health Services Most international students are not entitled to publicly funded health services while

in New Zealand. If you receive medical treatment during your visit, you may be liable for the full costs of that

treatment. Full details on entitlements to publicly-funded health services are available through the Ministry of

Health, and can be viewed on their website at http://www.moh.govt.nz. The Accident Compensation Corporation

provides accident insurance for all New Zealand citizens, residents and temporary visitors to New Zealand, but

you may still be liable for all other medical and related costs. Further information can be viewed on the ACC

website at http://www.acc.co.nz It is a requirement of Immigration New Zealand that International students must

have appropriate and current medical and travel insurance while studying in New Zealand. Evidence of this must

be produced when the full fee is paid. Your insurance policy must be in English and compliant with Immigration

New Zealand’s requirements and be approved by Waitakere College. Waitakere College can arrange insurance

on your behalf with Unicare. Please see link for policy details https://www.uni-care.org

The cost of this will be included in your invoice. Please state clearly any medical condition or illness, physical or

Fees Refund Conditions for International Students Tuition Fees

If you withdraw from your course of study before the course completion date you may not be eligible for a refund of school fees. Conditions under which refunds are made are detailed below.

2. An application for refund of fees must be made in writing. Your parents must write to the Director of International Students explaining why you have withdrawn from the course and your reasons for seeking a refund. This must be done as soon as possible. If you delay your application, it may influence the costs applied by the College and any subsequent refund.

3. If your application is made before the start of your course e.g failure to obtain a study visa, your fees will be refunded less any costs already incurred by the school e.g.

costs already incurred during marketing and recruitment processes.

costs already budgeted and committed to the employment of teaching and support staff.

loss of anticipated profit factor (up to 30% of full tuition fee).

those items in 4.2 (below).

4.1 If your application is made after the start of your course, but before the start of the next semester your fees will be refunded less items listed in 3, 4.2 and those in 4.3 which apply; at a level consistent with the portion of the course which has been completed and/or those amounts, which have been committed by the College in anticipation of you completing the academic year.

4.2 Non recoverable costs which will not be included in any refund are:

Government levy where it has already been paid.

Agent commission (15% of tuition fee) where it has already been paid. Included in any refund will be any recoverable portion of GST payable on the total tuition fee.

4.3 The tuition fee is calculated on a basis which contributes fee money to various areas of school

operations. Schools receive similarly based funding from the Ministry of Education for students who are permanent residents.

The areas which are budgeted for are those outlined in 3 and 4.2 above together with:

ACC levy/staff professional development

School donation equivalent.

Supplementary funding equivalent [insurance, NESB (Non-English Speaking Background) factor].

Property, Assets and Operating (e.g. maintenance, power, heat, water, cleaning, capital works)

Core operational equivalent (per pupil funding of special education, careers, ICT provision.)

Notwithstanding items 3, 4.1, 4.2 and 4.3 above the College may exercise discretion where exceptional circumstances apply, e.g. including but not limited to personal bereavement, inability of the school to provide a course of study contracted, the College ceasing to be a signatory to the Code of Practice. Any such exceptional circumstances should be made known to the Director at the time of a student's withdrawal from the contract.

All contracts are for an initial period of twelve months unless otherwise stated.

If your application is made after the commencement of the second half of your course, you will not receive a refund (except in exceptional circumstances.)

6. No refund will be made to a student who is expelled or excluded from the College by the Board of

Trustees. 7. No refund will be made to a student enrolled at the school prior to the 1st of March who becomes

a permanent resident after the 1st of March (in any year). 8. A fuller explanation of the basis on which tuition fees are calculated is available on request.

School Trips Students are expected to pay for all school trips. Every effort is made to keep costs to a minimum and some trips will only be the cost of the bus, while others may include admission to an exhibit or place of interest related to study.

Camps Occasionally a student may take part in overnight trips or camps for subjects such as Geography, Sport or PE, which can range in price but may be several hundred dollars.

Competitions Students will occasionally have the opportunity to enter national competitions. Typically these are in Mathematics, Science, English, and Chemistry. These competitions will have their own entry fees.

Visa Renewal of student visa’s can cost up to $270.00

Immigration X-Rays Students may need x-rays which can cost up to $300

(approx.)

Homestay Terms and Conditions

The provision of homestay accommodation for international students attending Waitakere College (“School”) by

the homestay parents (“Host”) shall be on the following terms and conditions.

1. Waitakere College administers the payment on behalf of the student and agrees to pay the host family two weeks in advance an agreed upon amount.

2. A duly appointed representative of the International Department will have reasonable access to the

homestay for the purpose of visiting and monitoring the student.

3. The school must be informed of any matters concerning the student, including matters relating to the health, wellbeing or safety of the student such as accidents or behavioural concerns.

4. The Host agrees that the Student is to abide by school rules relating to international students as may be amended by the School from time to time.

5. The Host agrees that the student is not to drive or own a car.

6. The host will undertake to uphold the requirements of the Code of Practice as outlined in the attached Homestay Policy for Hosting International Students and in particular a) be aware of the student’s whereabouts at all times b) to inform the school if students wish to stay with a friend and to check that the accommodation

is suitable by phoning and checking that a responsible adult will be available to supervise students

c) to contact the International Students office to confirm any legitimate absences due to sickness. This should be done on the morning of the absence

d) to enable a student who is sick to have access to a doctor e) Provide 3 meals per day plus snacks

7. The host is liable for all costs, expenses and outgoings incurred as a result of providing a homestay to the student. Examples of such costs might be: a family outing to a restaurant, transport costs.

8. If a homestay feels a student’s behaviour is not acceptable to the host family, the Director of International Students must be advised immediately.

9. Either party may terminate the homestay arrangement without the need to provide reasons. Two weeks notice is required.

The school may remove the student from the homestay immediately if:

9.1 in the school’s reasonable opinion the safety or the wellbeing of the student is in doubt.

9.2 in the school’s reasonable opinion the homestay is affecting the student’s behaviour or academic performance.

10. All information provided in respect of the host, student, or other matters of confidential nature relating to the homestay accommodation, will be kept confidential, except disclosure of information:

10.1 to the student or prospective student, the parents and/or guardian during the application process or in the interests of student well being

10.2 to any professional person where in the school’s opinion it is in the interests of the student to provide information

10.3 pursuant to any statutory or other legal duty. The host has the right to request access to any personal information held by the school about them and to require corrections

11. The school will be informed if the structure of the personnel in the home is changed.

11.1 When another adult (age 18 or over) comes to reside in the home the school is informed prior to arrival. 11.2 The school is informed of other International Students from other secondary schools living in the home.

12. In compliance with the Code of Practice for Pastoral Care of International students, all adults (18 years and over) living in the house, or having regular close contact with the student, is required to submit to a Police Check.

13. The hosts’ rights and obligations under these terms and conditions may not be assigned without prior written agreement of the school.

14. The host confirms that all information relevant to their suitability to host a student has been disclosed to the school’s representative.

15. The school upon written notification to the host may vary these terms and conditions.

TUITION AGREEMENT

This Agreement shall be signed on behalf of the Student by the parents of the Student.

School: Waitakere College (“the School”) Student: (“the Student”)

1. The School shall provide tuition to the Student in accordance with the New Zealand Education (Pastoral Care

of International Students) Code of Practice 2016 The Education Code 2016 and the laws of New Zealand in

return for an annual fee.

2. The Student shall comply with the rules and policies of the School and with the reasonable instructions of the

teachers of the School.

3. The parents or guardians of the Student (the “Parents”) authorise staff of the School to:

3.1 receive information from any person, authority or corporate body concerning the Student including, but not

limited to, medical, educational and welfare information;

3.2 receive financial information relating to the Student including bank account details, debt and/or income of the

Student;

3.3 provide consents in respect of any activity carried out and authorised by the School;

3.4 provide necessary consents on the Student’s behalf in the event of a medical emergency where it is not

reasonably practicable to contact the Parents.

4. The Parents irrevocably authorise the Principal of the School to advise the Student’s homestay hosts of all

matters and information required to be provided to parents of any student under the laws of New Zealand. The

Parents irrevocably authorise the School to obtain information regarding the Student from the homestay hosts.

The Parents agree to appoint the homestay hosts as their agents in New Zealand to receive such information in

substitution for the Parents.

5. The Parents agree to provide the School with academic, medical or other information relating to the wellbeing

of the Student as may be requested from time to time by the School.

6. The School shall use its best endeavours to ensure the safety, health and wellbeing of the Student but shall

not be liable for any damage or harm caused to the Student or the Student’s property.

7. In any event, the School’s liability in relation to the supply of tuition services to the Student is limited to the

amount of fees paid by the Student for the provision of the services in respect of which liability arises.

8. Nothing in this agreement limits any rights the Parents and/or Student may have under the Consumer

Guarantees Act 1993.

9. Either party may terminate this agreement at any time upon two weeks’ written notice being given to the other

party. If the agreement is terminated the refunds conditions for international students shall apply. (“refunds

policy”).

10. It is acknowledged that all relevant provisions of the Education Act 1989 shall apply to the Student in New

Zealand. Any decision under these provisions to expel or suspend the Student for a specified period shall

terminate this agreement and the refunds policy shall apply. The Parents shall have no claim in damages or for

any compensation if this agreement is terminated in these circumstances.

11. Neither party is liable to the other for failing to meet its obligations under this agreement to the extent that

the failure was caused by an act of God or other circumstances beyond its reasonable control.

12. Notices given under this agreement must be in writing and given to the addresses set out in the application

forms. Those sent by post shall be deemed to have been received five working days after posting.

13. This agreement contains all of the terms, representations and warranties made between the parties and

supersedes all prior discussions and agreements covering the subject matter of this agreement.

14. This agreement shall be construed and take effect as a contract made in New Zealand and will be governed

by New Zealand law, and the Student and Parents submit to the exclusive jurisdiction of the New Zealand

courts.

15. The Parents and the Student acknowledge that:

(a) personal information of the Parents and/or Student collected or held by the School is provided and may be

held, used and disclosed to enable the School to process the application for tuition, provide tuition and

homestay services to the Student, provide to the Student and/or Parents advice or information concerning

products and services the School believes may be of interest to the Student and/or Parents and to enable the

School to communicate with the Student and/or Parents for any purpose;

(b) all personal information provided to the School is collected and will be held by the School at: 42 Rathgar Rd,

Henderson, Auckland.

(c) if the Student/Parents fail to provide any information requested in the application for tuition, the School may

be unable to process the application;

(d) the Student/Parents have the right under the Privacy Act 1993 to obtain access to and request corrections of

any personal information held by the School concerning them.

16. The Student’s level of English (assessed on arrival in NZ) and academic record will be taken into account

when determining acceptance and course placement. The Parents accept the right of the School to make a

change of course if this is seen to be in the best interests of the Student. Some subjects may not be available if

students start school after the beginning of the school year.

17. It is understood that the Student will attend regularly. The Parents and designated caregiver guarantee the

good behaviour and regular attendance of the Student. Waitakere College reserves the right to terminate this

agreement and inform Immigration NZ if the Student fails to comply with Ministry of Education attendance

requirements.

18. It is understood that this contract is current until the end of the school year in which the Student enrols and

may be renewed yearly subject to the satisfactory performance and attendance of the Student. The issuing of an

invoice for a new period of tuition, and the receipt of fees for that period will be understood by both parties to

constitute renewal of this contract for the period for which tuition fees have been paid.

19. The student and parents will accept and abide by the school’s decision regarding accommodation suitability,

and rules regarding accommodation. Should Waitakere College have any concerns regarding the welfare of the

child they may relocate the child to a home approved by Waitakere College or may refer the matter to the

relevant child welfare authorities or any other appropriate agency in New Zealand. Waitakere College will advise

the parent immediately if such a situation occurs. In the event that the student’s behaviour in the home is

considered unacceptable by the host family and the school, and if another suitable homestay cannot be found,

the school reserves the right to terminate this agreement. Please see the Terms & Conditions of Homestay

Accommodation.

20. This Agreement is subject to the Student being placed in accommodation that is approved by the School.

The School will make every reasonable attempt to provide approved accommodation for the Student and the

Student agrees to comply with all expectations and conditions for living in School approved accommodation.

21. The student and parents accept and agree that whilst enrolled as an international student at Waitakere

College the student will neither own nor drive a car.

22. The parents give permission for the student to take part in activities outside the classroom that have been

arranged by the school, activities undertaken with the homestay family and tours run by organisations

specifically for International Students.

23. Students are not permitted to travel independently and unsupervised outside the Auckland area while

holding a Student Visa for Waitakere College.

24. The same school and homestay policies and rules apply to all international students, regardless of age (over

or under 18 yrs) while holding a visa for Waitakere College.

25. Should any significant physical or mental health concerns arise while the student is at Waitakere College,

the school will contact the parents as soon as possible to work towards a resolution. The school reserves the

option of returning the student safely to the parents should this be deemed necessary.

26. If the student is involved in criminal activity, the school will contact the parents as soon as possible. The

school reserves the right to terminate the student’s tuition if appropriate.

The parents agree:

We have disclosed to the college all special educational and health needs of the student prior to the signing of

this agreement. We give the college permission to make a decision on the advice of a medical practitioner, in a

medical emergency.

We acknowledge that this agreement may be terminated by the School if the enrolment of the Student is

based upon any false declaration or information provided by us or the Student. We have read and understood

the terms set out in this agreement including the attached schedules and agree to them.

We have read and understood the Accommodation Procedures and agree to accept the terms set out.

We consent to provision of access to the internet.

We consent to use of photographs of our student in school publications and website, if required.

We agree to inform the school in writing of our plan for the care of our child from the last date of their

enrolment at Waitakere College until they return home. This plan will include all flight and travel details and

information on who will be responsible for their care during this period.

I agree to indemnify Waitakere College from any costs expenses or claims suffered as a result of any

unacceptable behaviour by my son or daughter while in homestay. It is expected that the student will pay for

any such damage.

TRIP AND ACTIVITY AUTHORISATION

Whilst at Waitakere College, students may have opportunities to go on school trips. These may be

day trips or overnight trips. These trips may include water based activities such as swimming,

kayaking, jet boating, snorkelling as well as tramping, mountain biking, and others.

While in New Zealand, many students like to participate in extreme sports.
