INSTRUCTIONS FOR ENLISTMENT OF CONTRACTORS IN M.C.D.

1 Title: - These instructions shall be called the instruction for Enlistment oContractors in M.C.D. shall come into force with immediate effect.

2 Repeal and Saving: - All previous instructions regarding enlistment/upgradation ocontractors in MCD existing before coming into force of these instruction arerepealed. However, the contractors already enlisted on the basis of rules hither toin force shall be treated to be enlist in their category and class with immediate

effect, for a period of four years, provided they deposit the enlistment fee asmentioned against each class in table-I, with MCD by 30.6.2008. In regard to alother matters and further future revalidation of their enlistment /revalidation, theyshall be governed by the present instructions.

3 And also, notwithstanding such repeal, application as listed below shall beprocessed on the basis of instructions for enlistment 2001 and amendments issuedfrom time to time and provisionally enlisted/revalidated if found fit subject toconditions that contactors so Enlisted/Revalidation will have to satisfy the criteria

as provided in instructions for enlistment 2008 within 18 months from the date ofeffect of instructions for enlistment/revalidations 2008 in respect of bankerscertificate, T & P and Engineering Establishment and within 24 months from thedate of effect of instructions for enlistment/revalidation 2008 in respect of work as

4.3 A contractor is permitted to have enlistment in more than one category and

under more than one enlistment authority but not in more than one class othe same category in MCD.

4.4 A Contractor is not permitted to have enlistment in more than one name.

4.5 A partner of a firm or a Director of a company enlisted as a contractorcannot be a partner/director in any other enlisted firm/company in MCD.

4.6 A contractor will not be enlisted if it was enlisted in any category or classearlier but had remained inactive in MCD during its previous enlistmenperiod.

5.0 Scope:- The enlistment of a contractor in MCD shall only entitle him to beconsidered for issue of tender papers subject to the conditions laid down in eachindividual Notice Inviting tenders. It shall not confer any right on him either to benecessarily issued the tender papers or for award of work.

6.0 Enlistment procedure:- The contractor shall have to submit the application in aprescribed from ( Annexure-I ) to the enlistment authority , complete with aldocuments as per Annexure-II.

7.0 The enlistment shall be valid for a period of four years. The enlistment canhowever, be revalidated in accordance with rules in this regard. Each revalidationshall be for a period of three years form the date of expiry of the previousenlistment/revalidation. The enlistment shall be open to review by the enlistmenauthority and liable to termination, suspension or any other such action at anytimeif considered necessary by the enlistment authority, after issue of show causenotice.

8.0 Categories & Classes: - The enlistment shall be done in the categories andclasses mentioned in Table-I.

9.0 Jurisdiction and Tendering Limits:- The jurisdiction in which contractors enlistedin various categories and classes shall be permitted to tender and the tenderinglimit upto which they shall be eligible to tender shall be as given in Table-I.

9.1 The contractor shall be governed by the provisions existing at a particulapoint of time irrespective of when he was enlisted.

10.0 Authorities for Enlistment: - Enlistment in different categories and classes shalbe done by different authorities. These are identified in Table-I.

11 0 Eligibility Criteria: The contractors shall have to satisfy the minimum eligibility

prescribed in Table-I. This fee is to be submitted alongwith application form to theenlistment authority.

13.0 Income Tax clearance: Deleted.

14.0 Electrical License:- The contractors of Electrical category shall have to producevalid electrical license from the competent authority in the name of the contractorThey shall keep valid license throughout the period of enlistment by getting irenewed at suitable intervals and submit an attested copy of the same to theenlistment authority after each renewal. In event of any discontinuity in validity oelectrical license of the contractor, its enlistment and authority to work with MCDwill also automatically cease to be valid. For applying for tender for a work in MCD

they shall have to possess valid electrical license of appropriate voltage issued byany State Govt. under clause 45 of compilation of rule of Indian Electricity Rule1956 or as amended from time to time.

15.0 Change in constitution of firm:- The contractor/firm shall not modify the existingpartnership or enter into any fresh partnership without the prior approval of theenlistment authority. Such proposal, if any, shall be submitted in advance giving fuldetails of the intended partnership/sole proprietorship along with the draf

partnership deed/affidavit and documents as per Annexure-VI. Any change instatus of the contractors as an Individual or in constitution of the firm without prioapproval of the enlistment authority will render the contractor/firm liable to beremoved from the approved list of contractors.

18.0 Review of approved List of contractors:- The contractor shall be required tosecure works of appropriate magnitude in MCD during the revalidation/enlistmenperiod. Contractors shall be liable to be weeded out for non-observance enlistmeninstructions. For this purpose the enlistment authority shall have the power toperiodically review the approved list of contractors.

19.0 Revalidation of enlistment:- The validity of initial enlistment of the contractor shalbe as given in Para 7.0 . It shall, however, be revalidated on merits, if desired bythe contractor. Only the contractor who has secured at least two works oappropriate magnitude (as applicable for enlistment in relevant class) in MCDduring the period of enlistment or last revalidation period of enlistment as the casemay be and at least one of them must have been completed 100% shall beconsidered for revalidation. If second work is not completed by more than 50% thedepartment will select one non MCD work out of the list furnished by the applicantfor inspection & consideration of revalidation.

The work completed/secured as an associate contractor of the maincontractor to whom a composite contract was/has been awarded shall also qualify

for consideration of revalidation.

19.1 Application for Revalidation.

19 1 1 The contractor shall apply for revalidation for his enlistment in the

b) no longer has adequate equipment, technical personnel or financiaresources; or

c) is litigious by nature ; ord) violates any important condition of contract; ore) or his staff misconducts or misbehaves with MCD officials; orf) buys tender forms but fails to submit his offer on maximum of two

occasions per calendar year; ore) is responsible for a conduct which may justify his demotion to a

lower class; org) any other reason which in view of enlisting authority is adequate fo

his demotion to a lower class.

23.2 Suspension of business :- The enlistment authority may suspendbusiness with a contractor for indefinite period or for a period as decided byenlisting authority, pending full enquiry into the allegation, if the enlistmenauthority is prima facie of the view that the contractor is guilty of an offencein relation to business dealings which, when established would result in hisremoval/banning business and it is not considered desirable to entrust newworks or continue business with the contractor.

23.3 Removal from the approved list:- The name of the contractor may beremoved from the approved list of contractors, by the enlisting authority, ihe;
