33 • Spain: Council Members and Directors appointed at the new Spanish Authority On 9 September 2013, the members of the Council of the new Spanish Authority - Comisión Nacional de los Mercados y de la Competencia (CNMC) (see arcle in this ECN Brief) have been appointed: the President is Mr José María Marín Quemada, the Vice-President Ms María Fernández Pérez and the eight Council members are: Ms Idoia Zenarruzatbeia, Ms María Orz, Mr Fernando Torremocha, Mr Benigno Valdés, Mr Eduardo García Malla, Mr José María Guinart, Ms Clolde de la Higuera and Mr Diego Rodríguez. On 9 October 2013, the CNMC Council decided on the assignment of its members to the Compeon Chamber and the Sectoral Regulatory Supervision Chamber. Ms Idoia Zenarruzatbeia, Ms María Orz, Mr Fernando Torremocha and Mr Benigno Valdés have been assigned to the Compeon Chamber. Mr Eduardo García Malla, Mr José María Guinart, Ms Clolde de la Higuera and Mr Diego Rodríguez have been assigned to the Regulatory Supervision Chamber. The CNMC Council has appointed State Aorney Mr Tomás Suárez-Inclán as Secretary of the Council, Ms Beatriz De Armas as General Secretary, Mr Eduardo Prieto Kessler as Director of Compeon as well as the following Directors: Ms Alejandra de Iturriaga Gandini as Director of Telecommunicaons and Audiovisuals, Mr Fernando Hernández Jiménez-Casquet as Director of Energy, Mr Ángel Chamorro Pérez as Director of Transports and Postal Services and Mr Antonio Maudes Guérrez as Director of the Compeon Advocacy Department.   • • Denmark: Scandlines – Commitments to remove a Prohibition against Resale of Cargo TicketsOn 27 October 2010, the Competition Council adopted a decision which renders legally binding the commitments offered by Scandlines to remove a prohibition against the resale of ferry (Cargo? Could you clarify if it concerns ferry or cargo?) tickets, in order to address competition concerns that this could infringe Article 101 TFEU and section 6 of the Danish Competition Act. This decision is based on Section 16a of the Danish Competition Act.

    Under the commitments Scandlines must removes immediately the prohibition of the resale of cargo tickets and inform its customers about the change in its trade conditions. This will have the same effect as if the case were closed with an injunction.

    Scandlines is part of the Scandlines Group which is one of Europe’s largest ferry operators.

    The case stemmed from a complaint from a major freight forwarding operator. During the investigation, Scandlines confirmed that the prohibition of the resale of tickets was part of its standard trade conditions for freight. The company stated however that the prohibition had not been enforced and expressed that it were willing to remove the prohibition immediately from its contractual terms(?).

    Scandlines completely prohibited the resale of tickets and could thus prevent smaller operators from obtaining favourable discounts, since they did not have enough volume to achieve the highest discounts on their own and were prevented from entering into grouped (?) purchases with other smaller players. Such cooperation could have increased the competitiveness of smaller operators in relation to the larger operators, who are eligible for? the highest discounts. The discounts for Scandlines’ customers amounted annually, in some categories, up to 50%. The Danish Competition and Consumer Authority was therefore concerned that this prohibition could be in breach of Article 101 TFEU and section 6 of the Danish Competition Act.

    Article 102 TFEU and section 11 of the Danish Competition Act. For the latter, Scandlines would have to hold a dominant position on the relevant market. Since the case was solved by commitments, the Danish Competition and Consumer Authority has not made a final assessment as to whether the prohibition on the resale of tickets infringed EU or national competition law.
