Section 1 – ObjectiveThe objective of the Superior Contracting Services, LLC (SCS) Safety Orientation Program is to comply with the Occupational Safety and Health Administration’s (OSHA) Standards and to minimize employee injury. Our policy is to take a proactive approach to employee safety through quality hiring, job hazard analysis, administrative controls, training and PPE. We take pride in our projects and our employees. This program is designed to provide an overview of SCS’s safety rules, guidelines and policies.

Section 2 – ScopeThe policies of this program cover all SCS employees. All new hires will be required to read this program at the time of their employee orientation. Employees will then be asked to acknowledge receipt and their understanding of its contents, by signing an acknowledgement form. This signed acknowledgement form will become a permanent part of the employee’s personnel file.

Section 3 – PoliciesWorking safely and promoting safety is expected of each employee during their employment at SCS. Any employee that willfully disregards safety regulations, policies and/or procedures, or that bypasses or attempts to bypass safety features on equipment will face disciplinary action up to and including termination.

3.1 Disciplinary Action PolicySCS personnel and lower-tier subcontractor employees shall be subject to the following progressive disciplinary policy:

1. First Offense: Verbal Warning

2. Second Offense: Written warning

3. Third Offense: Suspension or termination depending on the severity of the unsafe or carless act.

SCS reserves the right to have anyone removed from site for the first life threatening violation.

3.2 TrainingAll employees shall receive proper training for their work areas or jobs. Employees are expected to “actively participate” in their training to the fullest extent possible. Training could be in many possible forms such as videos, on-the-job training, classroom instruction, demonstrations, study/quizzes, etc. Employees requiring certification for specific jobs or duties will be given the necessary training and will be required to maintain valid certification, as long as required, for their job assignment.

3.3 Safety MeetingsAn effective safety and health program requires the cooperation of both the employer and employees. Safety meetings and training sessions will be held as needed to ensure new or updated safety information is provided to all employees in a timely manner. Employees must attend all meetings as required by their immediate supervisor.

3.4 Basic Safety Rules • Employees should know how to properly perform their assigned task. If unsure, they should contact their

supervisor or foreman immediately before continuing any work.

• A task specific, “Job Safety Analysis” shall be conducted prior to the start of every job. Employees should assess processes, work areas and equipment before beginning work to identify any hazards. Corrective action must be taken to eliminate / mitigate any potential hazards.

• Tool rooms and storage areas should be kept clean and organized. Walkways, paths and emergency egress routes are to remain unobstructed. Demolition work areas are to be demarcated and kept free and clear of debris to the extent feasible. Practice good housekeeping.

• Use tools and equipment for their intended purpose only.

• All tools and equipment should be properly cleaned and stored after use.

• Machinery, tools, material or equipment which are unsafe or not in proper working order must be identified as unsafe by tagging or locking the controls to render them inoperable or be physically removed from the site

• Spills or other causes of a wet surface should be immediately cleaned-up and dried to prevent slips and falls.

• Proper lifting techniques should be used at all times.

• Participate in the, “Stretch and Flex Program”, prior to and periodically throughout the shift.

• Proper use and care of Personal Protective Equipment is mandatory. Employees must use their personal protective equipment as required by law, including but not limited to, head, hearing, eye, hand, foot, and fall protection devices. All necessary equipment will be provided by SCS at no charge to the employee. NOTE: Worn out or damaged PPE will be replaced at no cost. Otherwise, employees will be charged for replacement PPE.

• Employees should wear appropriate clothing for their job. Shirts with sleeves, work pants (jeans or khakis), and sturdy work boots. High visibility outer garments shall be worn when working around heavy equipment or near vehicle traffic. All jewelry and rings must be removed before working in, on and around equipment.

• Hard hats and safety glasses are required by all personnel, at all times, while in construction zones.

• Gloves are required when handling any material. Select the proper glove for the task. i.e. cut resistant gloves where laceration hazards exist; burning gloves for torch cutting or welding activities; and rubber gloves when handling chemicals.

• Employees may take lunch breaks only during designated times and must eat in the area assigned for this while on the job site. There will be no smoking, eating, or drinking while in the work area.

• Personnel will not quit work before the time designated for the conclusion of the work shift. There will be sufficient time allocated for employees to wash up and change out of work clothes.

• Employees must report to work each regularly scheduled work day. Continued absenteeism is a violation of these rules. NOTE: that a, “no call/no show” for three consecutive days is considered job abandonment and voluntary termination.

• All personnel are required to comply with SCS’s Drug and Alcohol Program as a condition of employment. Violation of any portion of this Policy may be cause for immediate discharge. (See section 8)

• Personnel must comply with both verbal and written instructions from a supervisor or foreman.

• While on the job site, personnel must comply with OSHA Standards and each of the safety procedures required by the SCS safety program.

• All personal work injuries and near misses must be reported to a supervisor or foreman immediately.

• All unsafe conditions or unsafe acts must be reported immediately to a supervisor.

• Employees will not engage in malicious horseplay, practical jokes, or mischief while on the job site or Company property.

• Fighting or attempting bodily injury to another employee or Company visitor while on the jobsite or Company property is not permitted.

• Unauthorized use of, or willful neglect in the care and/or use of Company property is not permitted.

• The carrying of concealed weapons on the jobsite or Company property is expressly forbidden.

• Falsifying Company records and/or reports will not be tolerated.

• Only the person who tags out or locks out equipment is allowed to remove such a tag or lock from the equipment.

• All scrap metal generated from a jobsite shall be returned directly to SCS’s warehouse. SCS has a ZERO tolerance theft policy. Anyone caught stealing will be terminated upon discovery.

• SCS maintains a smoke-and-tobacco-free jobsite. Smoking or use of other tobacco products is NOT permitted on the jobsite or in SCS owned or leased vehicles. Employees may only smoke outside in designated areas during breaks. Do not leave cigarette butts or other traces of litter.

• The use of cell phones or similar electronic devices are prohibited during working hours. The distraction presents a safety hazard. They may only be used for work related calls and during emergency situations. Otherwise, they should only be used at breaks.

Section 4 – ResponsibilitiesTo maintain a safe work environment, everyone must take an active role. SCS’s responsibilities include providing the necessary resources (money, equipment, employees, etc.) to ensure all employees are able to perform their duties safely. It is then up to the employees to do their part. A multi-stream flow of communication is vital to keep everyone informed of safety rules, needs and changes.

4.1 Management • All management personnel should lead by example. Safety rules should not only be enforced, but also

followed.

• Management is ultimately responsible for all safety issues and the compliance of this and other SCS safety policies by employees.

• Management should be very active in the relaying of information to foremen and employees from outside contractors, suppliers, and management.

• Management shall maintain all necessary records as required.

• Oversee Multi-Employer Worksite requirements. (See Section 5)

4.2 Supervisors and Foremen • Supervisors and Foremen will meet the required qualifications to be considered a “competent person”.

They will be capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous or dangerous to employees and have authorization to take prompt corrective measures to eliminate them.

• Supervisors and Foremen must be thoroughly knowledgeable in all areas of safety.

• Supervisors and Foremen will make frequent and regular inspections of the job sites, materials, and equipment.

• Supervisors and Foremen shall have the authority to shutdown equipment for any safety reason.

• Supervisors and Foreman should know the cause, severity and cost associated with all accidents.

• Supervisors and Foremen must provide specific training as needed to new employees. Additionally, new training should be provided to all employees whenever a process is changed or new equipment is introduced.

• Supervisors and Foremen must communicate with management and employees, ensuring all necessary safety information is presented and understood by everyone.

4.3 Employees • All employees are responsible for complying with SCS’s rules and procedures. (See section 3.4)

• Employees are responsible for having a safety attitude and developing safe work habits.

• Employees must report any accident or near miss to their immediate supervisor.

• Employees must report any unsafe equipment or unsafe work conditions to their supervisor.

• Employees need to be aware of the many different types of equipment that are utilized at the worksite. Such equipment might include forklifts, aerial lifts, skid steers, walk behind saws, cranes, excavators, etc. Specific training on every piece of workplace equipment may not be required for everyone, but every employee should be cognizant of the characteristics and movements of the equipment. Only employees qualified by training or experience will be allowed to operate equipment and machinery.

Section 5 – Multi-Employer WorksitesSCS is consistently engaged in Multi-Employer Worksites. Management personnel will be responsible for working with other on-site employers to create a safe and healthy work environment. This will entail the use of safety pre-planning activities to understand each employer’s legal liabilities, safety duties and responsibilities at the Multi-Employer Worksite. A two-step process will be utilized to achieve these steps.

• Define the types of employers that will be at the worksite. OSHA categorizes employers into four groups: Controlling, Creating, Exposing, and Correcting. Employers can be classified and cited for more than one type.

• Determine employer’s obligations for the categories they fall under.

Section 6 – Emergency ProceduresSCS is dedicated to the protection of its employees from emergencies. Employees should know what to do in an emergency.

6.1 Emergency Evacuation • When employees detect an emergency that requires an evacuation, such as a fire or hazardous release,

they should activate the nearest fire alarm, exit the building, proceed to the muster point and call 911.

• Emergency evacuation routes and muster points will be designated and reviewed with the crew at the beginning of each project.

• On jobsites where the alarm system is not active, air horns will be provided. Three long blasts of the air horn signals emergency evacuation.

• The supervisor or foreman will account for employees at the muster point by reviewing the daily sign-in-sheet.

• No SCS employee will re-enter the building without the permission from the responding emergency personnel and the Safety Manager.

6.2 Medical EmergenciesFirst aid can prevent death or additional injuries if properly administered. All medical treatment provided by SCS will follow the directives of the American Red Cross. Employees should never attempt to perform any first aid for which they are not properly trained. Employees should know the location of all first aid kits, the location of any first aid stations (eye wash or emergency shower) and who is First Aid /CPR/AED trained at the worksite. One First Aid /CPR/AED certified employee will be assigned to each project. This is typically, the SCS foreman or supervisor. Employees should call 911 immediately in case of an emergency and notify their immediate supervisor or foreman as soon as possible. Employees must follow the rules and regulations as stated in the company’s Bloodborne Pathogens Program.

6.3 Fire ProtectionFire can be represented by a simple equation: Fire = Ignition Source + Fuel + Oxygen. Without any one of these three elements, a fire cannot start. Likewise, during a fire, if you take away any one of these three elements, you can successfully put out a fire. It is our company’s intent to prevent these three elements from reacting to produce a fire.

At the time of a fire, employees should know if evacuation is necessary and what their role is in carrying out the plan. In cases where the fire is large, total and immediate evacuation of all employees is necessary. In smaller fires or fires in the incipient stage, portable fire extinguishers can be used to combat the fire.

The following steps should be followed when responding to incipient stage fire:

• Sound the fire alarm and call the fire department, if appropriate.

• Identify a safe evacuation path before approaching the fire. Do not allow the fire, heat, or smoke to come between you and your evacuation path.

• Select the appropriate type of fire extinguisher.

• Discharge the extinguisher within its effective range using the P.A.S.S. technique (pull, aim, squeeze, sweep).

• Back away from an extinguished fire in case it flames up again.

• Evacuate immediately if the extinguisher is empty and the fire is not out.

• Evacuate immediately if the fire progresses beyond the incipient stage.

Section 7 – RecordkeepingAs required by OSHA, SCS maintains records on all work-related fatalities, injuries and illnesses. To ensure we comply fully with the law, employees need to report any and all accidents or near misses to their immediate supervisor or foreman. By keeping accurate records, we can provide a safer work area for all employees.

Section 8 – Alcohol, Tobacco and Drug UseBecause SCS is concerned about Workplace safety, it is committed to a drug- and alcohol-free workplace. It is our company substance abuse policy to let employees and applicants know clearly that alcohol or other drug use on the job, or anywhere it affects job performance, is strictly prohibited.

The company reserves the right and authority to suspend, terminate, or otherwise discipline an employee for: violating company policy, testing positive for drugs or alcohol, or refusing to submit to a test. SCS is free to utilize some or all of the following components to assure an alcohol and drug-free workplace.

• Pre-employment testing may be utilized at certain job sites. When used, it is a condition of employment. An offer for employment will not be tendered if the test is positive or if the applicant does not submit to testing.

• Random drug testing is also performed and continued employment is contingent upon a negative/clean test result.

• Post-accident testing is used to assist in determining the true cause of accidents or injuries. Post-accident testing must be performed immediately following an accident involving any type of injury requiring off-site medical treatment or property damage. Testing must be performed for all workers who are involved in the incident.

• Reasonable Cause testing can and will be utilized when a supervisor or foreman determines that an employee’s conduct sustains a reasonable suspicion that the employee is impaired by drugs or alcohol.

The use of alcohol and drugs is strictly forbidden before work or on company premises. Tobacco use is allowed only in designated areas and only on break periods. Employees must inform their supervisor or foreman of any prescribed medicine use required by a physician. Prescribed medication must not impair employee’s ability to work safely. For additional information please refer to SCS’s Drug and Alcohol Program.

Section 9 – Hazard Communication As an employer engaged in a business where chemicals are either used or produced for use or distribution or where its workers have the potential for contact with chemicals in their workplace, SCS will ensure that the hazards of all chemicals found in the workplace will be evaluated, and that information concerning these hazards will be transmitted to all affected employees.

The purpose of SCS’s Hazard Communication Program is to inform our employees, by means of labels, safety data sheets and training, of the physical and health hazards to which they may be exposed. The Hazard Communication Training that will be provided to all SCS personnel, is outlined in Section 4-1 of the Safety Manual. This training meets or exceeds the requirements of OSHA’s Hazard Communication Standard, 29 CFR 1910.1200. Whenever a new chemical hazard is introduced or an old hazard changes, additional training is provided.

Effective information and training is a critical part of the Hazard Communication Program. We train our employees to read and understand the information on labels and SDSs, determine how the information can be obtained and used in their own work areas, and understand the risks of exposure to the chemicals in their work areas, as well as ways to protect themselves. Our goal is to ensure employees know that they are exposed to hazardous chemicals, have the skills to read and use labels and SDSs, and understand how to appropriately follow the protective measures we have established.

ACKNOWLEDGEMENT FORMBy signing below, I acknowledge that I have been properly orientated and have received a copy of SCS’s Safety Orientation Program / Handbook. I have read and understand this document and know what is expected of me. Additionally, I understand that a violation of the Basic Safety Rules listed in section 3.3 are grounds for disciplinary action up to and including termination.

I also understand, that as a part of this program, I may be tested for chemical substance abuse. If required to be tested, I hereby consent to such testing, and I authorize the medical provider to release the results of this testing to SCS and to release SCS and its MRO from any liability they might otherwise have for conducting such testing, test results, or making employ¬ment decisions based upon the results of such testing.
