1. Validity This instruction defines the stipulations that have to be followed so ensure that shipments to Lux/Euromate and/or OBI Bau- und Heimwerkermärkte GmbH & Co – mentioned hereafter only as OBI stores - can take place and goods reach their destination without damage. It is a supplement to the Lux/Euromate International Sales contract (terms & conditions). It is valid independent of the shipping terms that Lux/Euromate and the supplier have agreed upon in the purchase order, i.e. for deliveries FCA, FOB or EXW. This instruction defines the requirements for packing of the goods and how the packing will be checked and tested before the merchandise will be accepted by Lux/Euromate.

1.1 Divergent regulations Instructions are generally valid for both companies. The expression Lux/Euromate defines the validity for Lux and/or Euromate. Divergent regulations are mentioned in point 14. These regulations do not abrogate the basic ones for both companies and only have to be considered additionally.

2. Notification of Delivery For shipments under incoterm EXW and FCA, destined to warehouses of LUX or Euromate, please handover form „Notify Of Delivery“ (attachment of order) latest 5 workdays before day of collection to our Import-Department (Fax 02196/764646 or e-Mail: [email protected] / [email protected]). For shipments under incoterm DDP and DAP, destined to warehouses of Euromate, please handover form „Notify Of Delivery“ (attachment of order) latest 5 workdays before day of delivery to our Import-Department (Fax 02196/764646 or e-Mail: [email protected] / [email protected]). For shipments under incoterm DDP and DAP, destined to warehouses of LUX, please handover form „Notify Of Delivery“ (attachment of order) latest 5 workdays before day of delivery to destined warehouse as shown in order.

2.1 Delivery free OBI store Please refer to the corresponding Lux/Euromate order document.

2.2 Delivery of spare parts and samples Please refer to the process as described in Annex 5. This process only applies for spare parts ordered by LUX or Euromate. Spare parts ordered by LUX/Euromate must have a shipping mark on three sides of the carton (Top, Front and Side) Example of shipping mark of a spare parts order:

Attention: Spare parts ordered by our service provider have to be delivered according to their individual shipping requirements. Annex 5 therefore does not apply for orders of our service provider.

2.3 Customs Clearance For incoterm EXW, FCA and FOB customs clearance will be arranged by LUX/Euromate. For incoterm DAP seller has to contact our Import Department for further instruction concerning customs clearance. Please inform your chosen forwarder accordingly. For incoterm DDP customs clearance has to be arranged by forwarder chosen by seller. According to ICC rules of Incoterms 2010 any VAT or other taxes payable upon import are for the seller’s account. However Euromate and LUX agree to accept to absorb VAT, though only by invoice (no advance payment or cash payment) of seller’s chosen forwarder. Please inform your chosen forwarder accordingly.

2.4 Delivery of Goods and Unloading at warehouses Lux and Euromate - For deliveries to warehouses of Lux and Euromate the articles are to be loaded in a way that allows unloading on the rear side of the truck using loading platforms. Unloading a truck on the side by the use of forklifts is not possible.

3. Shipping Instruction & Documents 3.1 Ocean Shipping Instruction For all cargo under incoterm FOB booking has to be placed with our nominated booking agent as shown on order. Please follow shipping instructions shown in Annex 7 „Ocean Shipping Guide“. 3.2 Documents For all ocean shipments of Lux / Euromate GmbH under incoterm FOB the following documents have to be presented and send to Lux / Euromate GmbH. For all shipments handled by our purchasing agent (Lux Shanghai Ltd or Euromate Ltd), the following documents have to be sent simultaneously to (Lux Shanghai Ltd or Euromate Ltd through the email: [email protected] within 5 working days from APLL FCR shipment onboard date. - master article number: master item must be mentiond with its total value as well as each single item with their values. KG EMIL-LUX-STR 1 42929 WERMELSKIRCHEN GERMANY Forwarder’s Cargo Receipt must show per each FCR: APLL Booking Number. Forwarder’s Cargo Receipt must show per each container: seal number, container size, container number, total gross weight, total net weight, total volume and total number of cartons. To prepare the implementation of the European 24 hours advance cargo security requests (Regulation 1875/2006), the European Commission has set up the guidelines for acceptable and non-acceptable plain language cargo descriptions. Descriptions must be precise enough for Customs services to be able to identify the goods. Under such kind of circumstances, we

would highly recommend to apply only acceptable cargo description on all documents, especially Forwarder’s Cargo Receipt (FCR). For your easy reference, please refer to the examples of acceptable and non-acceptable descriptions of goods in the below Annex 6. The Information shown in the Forwarder’s Cargo Receipt (FCR) must be consistent with the information of invoice and packing list. This is especially true for the number of packaging units/ cartons. Therefore, presented shortage declarations will not be accepted anymore by Lux / Euromate. If the FCR shows a different number of cartons than really loaded in the container and than the other shipping documents show, the supplier must ask the forwarder or shipping company for a correction of the manifest - at the latest two days after ETD (shipping date) so that the FCR is corrected to the effectively loaded number of boxes while the goods are shipped to the port of destination. Certificate of Origin GSP Form A, must state: - Consignee: Emil Lux GmbH & Co. KG or Euromate GmbH & its address - Means of Transport & Route : “on/after (Delivery or Sailing Date) from (Port of Loading, Country) to Germany via (Port of Discharge) by (sea or air)” - Declaration by the Exporter: - “Goods exported to (Germany)” - Euromate Article no. - Hong Kong Stay / Transshipment chop (if applicable) - Other information must be coherent with the information of other shipping documents GSP Form A must be presented for countries of origin belonging to European Union’s generalized system of preferences (see Annex 8: Form A - least developed countries (LDC) & Form A - other beneficiary countries (OBC)). Certificate of Origin, must state: - Consignee: Emil Lux GmbH & Co. KG or Euromate GmbH & its address - Country / region of destination: “(Germany)” - Euromate Article no. - Other information must be coherent with the information of other shipping documents Certificate of Origin must not be presented for countries of origin belonging to European Union’s generalized system of preferences (see Annex 8: Form A - least developed countries (LDC) & Form A - other beneficiary countries (OBC)). Fumigation Certificate – if applicable, must state: - Date and place of fumigation - Container no. - The fumigant and dosage - Fumigation system - Exposure period - Degassed process - Date and place of degassed process - removal of all according warning labels and re-opening of the air vents after container has been degassed - that each container that was fumigated or has gone through any chemical treatment has been separately sealed

Export License – (only for textile product according to EU-China textile agreement) - issued per each shipment, must state: - Consignee : Emil Lux GmbH & Co. KG or Euromate GmbH & its address - Order no. - Promotion no. (if any) - L/C no. (if any) - Euromate Article no. - Item description - Exact quantity - Number of product category Beneficiary Certificate, must state: - that the delivered goods are free from rights of third parties and that the sale in the Feder. Rep. of Germany neither acts in violation of the valid statutory provision nor of existing industrial property rights of third parties (copyright, patent right, design rights of the F.R.G.) and stating that all articles shipped under this L/C order comply to the laws and regulation of the countries in which they are intended to be sold (for countries see related P/O). Beneficiary Statement Emil Lux GmbH & Co. KG and EUROMATE GmbH only accept APLL Forwarder’s Cargo Receipt (FCR). Emil Lux GmbH & Co. KG or EUROMATE GmbH only settles the payment upon receipt of full set original documents and copy of APLL Forwarder’s Cargo Receipt (FCR) from supplier. It must state: a) that full set of original copy of documents have been faxed at the latest 5 working days after APLL FCR on board date to the following companies before dispatch of original shipping documents to Germany: LUX (Shanghai) Co., Ltd., by e-mail: [email protected] or by Fax no. 86-21-5262-4601 ext. 201-205 for verification (before dispatch) and EUROMATE GmbH Fax no. +49-2196-762655 (for all shipments). The relative courier receipt must be submitted accompany to this statement. All documents including Form A, certificate of origin and APLL Forwarder’s Cargo Receipt (FCR) must show coherent data (i.e. items, quantities etc.). b) that for LUX orders 3/3 and for Euromate orders 3/3 of the following documents - original invoice with copy of APLL Forwarder’s Cargo Receipt (FCR) with - packing list - original certificate of origin - original GSP China Form A - original export license (if applicable - original fumigation certificate or original beneficiary statement have been sent by Fedex, UPS or DHL within 10 calendar days after shipment date to EUROMATE GmbH or Emil Lux GmbH & Co. Beneficiary fumigation & packing statement The beneficiary fumigation & packing statement contains information if a container is fumigated or not and if applicable, which kind of wood packaging has been used. 4 possible statements do apply for this statement: a) in case container does not contain any pallets (solid wood or any other wooden pallet) statement shall be “no wooden pallets used” b) if non solid wooden packaging like for example plywood is used, in addition to the Benificiary fumigation & packing statement a “Non-wood Packing Declaration” has to be presented. Statement shall be “non wood packaging used” c) If untreated solid wood is used for packaging, statement shall be “solid untreated wood used for packaging” and “Container fumigated”. In addition a “Fumigation Certificate” is necessary d) If treated solid wood is used for packaging, statement shall be “treated solid wood used for packaging” , “pallets fumigated/heat treated and marked according to ISPM 15” and “Container not fumigated”. For this case a “Fumigation Certificate” is not necessary.

4. Handing-over of goods / Safety of goods The consignor is responsible to ensure that goods are not damaged during transport. As per the most updated international transport regulations, this is valid even if the driver helps in loading. The supplier shall ensure that the goods are packed properly to avoid damage during transit and during loading/unloading operations. The supplier is responsible - also in case of FCA shipment - that the merchandise is handed over in a proper state to carrier that has been appointed for the transport by Lux/Euromate.

5. Pre Shipment Inspection / goods receipt For every delivery there will be a previous random inspection of the merchandise in relation to quantity and defects according to the Lux/Euromate QM-Process. Lux and/or Euromate will perform this or the service agent appointed by Lux /Euromate - in case of FCA or FOB incoterms at supplier’s premises by a PSI (Pre Shipment

Inspection) before loading - in case of CPT incoterms by random inspection in the OBI stores on the basis of the

accompanying documents and the delivered number of packing units. In case of CPT incoterms: If any quantity is incomplete or if any other defect is identified, the problem will be marked by Lux/Euromate or OBI store on the delivery note and will have to be confirmed through countersign by the delivering agent. If the freight forwarding agent refuses to accept the defects or the incomplete quantity, the entire consignment will be rejected and shipped back at the cost and consequences of the supplier. In case of non-conformance to the requirements of the Lux/Euromate Shipping & Packing Instruction, Lux/Euromate and/or the OBI-store reserve the right to refuse the goods and return them to the supplier. All major costs incurred will be charged to the supplier.

6. Detailed check-over-sampling In case of identified defects (for e.g. damages) and incomplete quantities (failure to the delivery conditions/Incoterms), Lux/Euromate and/or OBI store reserve the right to present such issues to the supplier via fax within 5 working days after the acceptance of the goods. This is also valid for detailed check-over / random sampling for deliveries to a Lux/Euromate warehouse or to a warehouse assigned by Lux/Euromate.

6.1 Rework for deliveries to Lux/Euromate in case of failure If failures in packing are detected during the incoming inspection at the Lux/Euromate warehouse or in the warehouse of a service provider appointed by Lux/Euromate, rework may become necessary, such as - attachment of new or additional labels to single units - attachment of new or additional shipping marks - repacking of export cartons due to wrong packaging units - repacking of pallets due to incorrect quantities on pallet and/or incorrect packing details then Lux/Euromate will send all relevant information to the supplier regarding the nonconformity to the order and Lux/Euromate Instructions. If the supplier is not able to perform the rework by himself in time, Lux/Euromate will appoint the rework to a service provider authorised by Lux/Euromate assuring commercially available prices. The costs for the rework will be charged back to the supplier plus 25% handling charge. Full documentation of invoices will be provided. If an improvement cannot be executed or executed in time, Lux/Euromate reserves the right to return good to the supplier. The costs for returning the goods will be charged back to the supplier. Cost rates for the performance of subsequent improvements at German warehouses is attached as Annex 1.

6.2 Rework for direct container deliveries If failures in packing are detected in direct container deliveries the arising costs will be charged by the recipient. Cost-rates have to be agreed separately between supplier and recipient. As an example of usual costs please see Annex 1. Costs for rework in other countries than Germany may vary from the mentioned ones.

9. Sales packing (Single unit, customer packaging)

9.1 General requirements Regardless of the type of packing the following requirements must be satisfied: - Packing material must offer a professional protection of products that allows delivery of the

goods without damage or any impairment of quality. - Corrugated board of cartons must be fit to withstand gross weight of the merchandise and

strain during transportation (including warehouse handling) and must be fit for stacking. - Sales packing should be designed in such a way that they will adequately protect the

goods during handling by sales staff and customers during retailing. - Products are to be packed in a clean, orderly, safe, secure and visually appealing way. - Product accessories, assembly instruction and instruction manual must be located in a

place where the customer can easily detect them during the unpacking of the product - Containers with liquids have to be secured to prevent leakage, in accordance with the laws

that regulate the road- and sea transport of liquids. - The packaging design and labeling of products containing hazardous substances/

substances of very high concern or hazardous materials have to comply with the related EU laws and regulations being effective at the date of shipment.

- The legal requirements with respect to dangerous goods are to be followed. In case of

dangerous materials, the statutory warning symbols are to be affixed on the item packing (as for the ADR / RID / IMO regulations).

9.6 Silica Gel With effect of 01.05.2009 the EU-Komission has limited the presence of Dimethylfumarat (CAS-Nr. 624-49-7) in products to a maximium of 0,1 mg/kg. As Silica Gel often has been equipped with Dimethylfumarat (DMF) which is known to prevent the development of mildew, this kind of Silica Gel is no longer allowed to be used. If silica gel is being used the package of this has to be marked as follows:

9.7 Marking of packing elements for articles that come under the German Ordinance of Food and Commodities Articles, which come under the German Ordinance of Food and Commodities, must show the name and address of the Euromate GmbH (seller) and/or Emil Lux GmbH & Co. KG. By way of an exception and only after confirmation with Lux/Euromate, the name and address of the supplier on the sales packing is allowed. Furthermore, the packing must show a suited instruction of the application of the article. The instruction must fulfil the following requirements:

9.8.1 Test procedure for products packed for stationary sale Generally, the test shall be performed for technical and sensitive products which are packed in sales or export cartons and which get distributed by stationary sales (no mail order). 9.8.1.5 ISTA Vibration Test and ISTA Compression Test The objective of the vibration test is to simulate the movements of the carton, which are expected during shipping and handling and to foresee if there is any risk of damage due to improper packing method, materials and placement. The objective of the compression test is to determine the behavior of packing materials under crushing loads, compressive stress and strain through a simulation of the container or warehouse environment and to evaluate the strength of the actual packing construction. Following tests have to be applied for all products:

9.9 Non-removable transparent seal for technical articles

9.9.1 Scope In order to indicate the integrity of the packing of an article the packing shall be sealed with non-removable transparent adhesive labels according to 9.9.2. All Electrical and/or mechanic articles and articles containing more than one piece require a non-removable seal. The articles requiring this seal are marked accordingly in the article pass. 10. Transport packing (export carton)

10.1 General requirements - Transport packing shall be designed for easy handling and safe and secure transportation,

shall allow formation of efficient load units and optimal utilisation of containers. Packing material must offer a professional protection of products which allows delivery of the goods without damage or any impairment of quality. Empty space in cartons has to be filled with air-filled cushions

- Dimension shall be suitable to be packed on Euro-pallets without excess length. Example:

600 x 400 export cartons (length x width) match with a 1200 x 800 mm Euro-pallet (length x width).

- Maximum weight of export carton shall not exceed 30 kg if the article’s weight itself doesn’t

reach this limit. - For cartons at least double wall-corrugated board has to be used. Cartons must be fit to

withstand gross weight of the merchandise as well as dynamic stress during transportation and in warehouse handling and it must be adequate that the cartons will arrive at OBI stores without damage or deformation.

- Transport packing must be suitable for stacking (see chapter 11.8). If necessary mark

packing with suitable stacking and handling instructions. - Sharp-edged or pointed objects shall not protrude the packing. - Transport packing must serve as a protection against illegal removal of single articles. - Transport packing must be closed tightly. If necessary push-in-covers have to be taped

with adhesive tape (no PVC). Minimum width of tape is 50 mm. - Adequate consideration of the special features of the goods: Goods susceptible to

humidity are to be packaged in such a way that freight forwarding services (transport, storage and reloading) will not allow moisture to penetrate and affect the goods.

- Containers with liquids have to be secured to prevent leakage, in accordance with the laws

that regulate the road- and sea transport of liquids. - The legal requirements with respect to dangerous goods are to be followed. In case of

dangerous materials, the statutory warning symbols are to be affixed on the item packing (as for the ADR / RID / IMO regulations).

- Materials must be suitable for recycling.

- Cartons shall comply to one of the international FEFCO-ASSCO-CODEs Information regarding the FEFCO-code at: www.fefco.org

- Cracked and ripped cartons are not acceptable and will be repacked at supplier’s cost.

- Every delivery that does not contain wooden packing materials needs to have a Non-wood packing declaration. Regarding this point please see Chapter 10.12

- Export cartons are not to be nailed. Should nailing be necessary due to the product

weight, the supplier needs to make sure that no additional risks can occur due to nails at the carton. This means that all nails are to be covered and protected at the inner side of the export carton, so that neiter personal injury nor scratch marks on the gift boxes occur.

10.7 Marking of additional Sales Packaging (Empty cartons) Additional sales packaging cartons must not be packed onto the pallet to avoid stock differences. The export cartons containing these empty cartons must be marked clearly visible on three sides with “Leerkartons / Empty Sales Packaging”.

10.8 Batch identification All products delivered to Lux or Euromate must have a batch identification. In order to identify products for processing, balancing, storage and recalls, the batch identification code ensures quality tracking and feedback within the supply chain. All articles must show a clear detectable P/O No. Products which require a rating label must have the batch identification information printed on the rating label of the correlative product as shown in the example of figure A. This means that if an item consists of a cordless drill including a bit set, only the gift box (and in this case the rating label) has to display the P/O No., not every single part of the set. Explanation of the batch identification logic is shown in the green framed box. Also refer to point 9.3. Please note that there are two different types of rating labels as shown in Example A: one rating label for machines and one for all other items. Furthermore the batch identification must be present on the packaging such as giftboxes, packing bags or wherever a GTIN might be present as shown in figures B, C and D. The P/O No. must be shown per unit. As example, if an article will be delivered per set, the unit has to be marked on the gift box. If the article is a single tool (e.g. a fork spanner) without any giftbox or hang tag, the P/O No. has to be shown on the GTIN sticker. No further special sticker concerning the P/O No. will be necessary. Example A Type 1 shows the correct batch identification of rating labels for products which are specified in the machine directive 2006/42/EG. All other items must show the batch indentification as specified in Example A Type 2.

The printfile of a giftbox will be given to our suppliers before production and bears the GTIN but not the required P/O No. of the ordered product as shown in Figure B. In order to simplify batch identification our individual order No.has to be sticked by means of a label beneath the GTIN of the printed giftbox, packing bags or wherever a GTIN is present. Size of the label has to be 40 mm wide and 4 mm in height and fits into the provided space beneath the GTIN (Figure C). The font and size oft he P/O No. shall be stated in Arial/10 Pt. The costs for labelling the giftboxes with the P/O No. have to be borne by the supplier.

10.10 Stackability of export cartons Regardless of the type of cardboard box chosen, the following requirements must be satisfied: Corrugated board must respect gross weight, stacking ability, and strain during transportation (included warehouse handling) and must be of such way that the goods and the cartons will not reach the receiver damaged or misshapen (no detraction of quality). Cartons must be suitable for stacking in 20“/40“ Containers or HC Containers (High Cube Container) with a maximum height of 2,38 m respectively 2,68 m (HC). If necessary, mark package with proper stacking and handling instructions. The supplier is responsible to ensure the above-mentioned requirements by the use of suitable cardboard export cartons.

10.12 Loading of containers - Ensure easy loading and unloading of transport vehicles with standard mechanical

handling equipment such as wheelbarrows, forklifts etc. - If possible the cardboard boxes shall be packed into the container in an interleave way: Picture 4 - The supplier has to find the optimal loading of containers related to the

easyGO.load-tool with the responsible Merchandiser or Product Manager.

- Pallets / export cartons must be fixed inside of containers in a manner that allows no skid of the pallets / export cartons during transportation.

- In case of not completely loaded container it is the supplier’s responsibility to

assure that the goods will be packed in a way that prevents the goods from shifting within the container. Wedging with wooden packing material may do this. In case the supplier uses wooden packing material it has to be ensured that only FSC-certified wood will be used and that the regulations mentioned in 10.14 or 10.15 will be met.

- Container loaded with goods packed in cardboard boxes must be provided with an

appropriate amount of silica gel to ensure that the cartons will not macerate during transportation (sea freight).

- If silica gel is being used the package of this has to be marked according to chapter

9.7 of this instruction. - Only dry containers shall be used. Wet flooring is not allowed, as this will macerate

10.14 Wood containing packing materials In case the manufacturer is not based in the European Union (exception: Switzerland), it has to be avoided that any packing material is made of raw solid untreated wood. Preferred is the use of FSC-certified wood based products such as plywood or particle board or plastic materials. In case the supplier chooses to use wood based products for packaging the treatment of wood (fumigation and/or heat treatment) as it is mentioned in the next paragraph will not be necessary. All articles made of non-natural products will no longer be fumigated. This means that for these products the loading devices such as pallets and packing materials (e.g. wooden crates etc.) must either be conform with the IPPC-Norm or the use of natural products for transport packing must be fully abandoned.

Non-wood packing declaration The declaration belongs to the shipping documents and has to be filled in by the supplier. It has to be printed on company’s letterhead. One original form per container is mandatory. It is not sufficient to append only one declaration per delivery. As a master document Annex 3 has to be considered.

10.15 Directive 2004/102/EC for wood packing material The use of solid wood shall be avoided. If raw untreated wood is being used as packing material it has to comply with the ISPM No. 15 standard by IPPC and with the whole procedure of treating and marking of packing materials affected by this. The pallets have to be marked like this: AA – BB - CCDDDD The markings has to be placed on two opposite sides of the packaging so that they are easily visible and legible. The colors red and orange have not to be used for the markings since these colors are used internationally for the labelling of dangerous goods. The supplier ensures that the measures were taken according to ISPM No. 15 if raw untreated wood is being used. For further information please see: https://www.ippc.int In case the supplier chose to use solid wood it has to be confirmed by the responsible Merchandiser or Product Manager. For deliveries containing treated solid wood the supplier needs to append the certificate of the chosen treatment. The Non-wood-declaration is not applicable in this case.

10.16 Requirements for fumigation of containers Containers which have been fumigated must have a "Fumigation Certificate". Fumigation might be necessary due to product and/or packing requirements (please see also chapter 10.14) All certificates must be part of the shipping documents (as described in chapter 3) and must show that containers have also been degassed and all relevant warning signs have been removed. Typical products for the need of fumigation are:

• textiles, shoes, leather articles • Rattan • Bamboo • Wicker • Ceramics with natural material, e.g. rattan, seagrass, water hyacinth, palm etc. • Items made of material, e.g. straw, seagrass, water hyacinth, palm, coconut, maize etc.

Further information, especially regarding the acceptable fumigation substances are to be taken from the actual Hazardous Substances Ordinance, relevant chapter for fumigation of containers is mainly annex 1, Nr. 4.

11. Pallets

11.1 Requirements of pallets Picture 6 - Goods delivered by truck shall be packed on pallets. For deliveries with incoterm DDU, DDP Goods can be packed on re-usable europallets or one-way pallets (according to below mentioned technical specification). Europallets will be exchanged by the warehouse directly. A subsequent exchange or charging will not be accepted. For deliveries with incoterm FCA, EXW Is the place of collection located in Germany or Austria, goods have to be packed on re-usable europallets which will be exchanged by our transport agent directly. 11.3 Packing of pallets - Products must be packed compact on the pallet so that the products on the pallet cannot

move against each other. - Export cartons resp. the merchandise must be fixed on the pallet in a manner, which

allows safe transportation and safe handling of the pallet: loading, unloading, handling with a forklift.

- The load shall not exceed the overall dimension of the pallet to an excessive amount. - Packed pallets must not be top-heavy. Goods have to be packed equally in order to

distribute a counterbalanced weight. - In case bulky goods or goods without export cartons have to be shipped on pallets (e.g.

pottery, furniture, glassware), the goods must be prevented from damage during transportation by additional packing by means of corrugated carton, wooden spacers etc. Furthermore, the load must be tight up to the pallet by means of securing tapes.

- Packing of pallet must provide protection against atmospheric exposure and staining, in general by the use of PE film, including the top surface.

- See chapter 10.4 for shipping mark for pallets without export cartons. In special cases a shipping mark is required for pallets packed with sales packing (e.g. tiles). Please consider the order documents for special requirements.

11.4 No articles with open top (only applicable for Euromate articles) Articles, which can be filled with water - either have to be stacked upside down - or must have a top cover. Plastic film is not sufficient! This requirement is due to the fire prevention regulation at the POS (Point of Sale). In case of fire those articles would absorb the water from sprinkler and water spray fire-extinguishing installation. Thus the sprinkler installation would become ineffective. 11.5 Maximum height and maximum weight of pallets The maximum or preferred height is stated in the purchase order. The standard height for packed pallets is 2,20 m including pallet. Pallets higher than 2.20 m will be repacked at the cost of the supplier or may even be sent back to the supplier. The packed pallets must not exceed the maximum weight of 1200 kg. The maximum weight of export cartons must not exceed 30 kg, except for articles with product specific reasons. For articles heavier than 30 kg with a packing unit >1 the packing unit is to be devided if applicable. Should the weight exceed 75kg, the article must be packed on a pallet.

11.6 Stretch- and shrink film - Each pallet has to be wrapped with PE-film whereof the shrink-film-system is preferred. - The thickness of the stretch film must be between 15 µ and 17 µ (0,015 mm – 0,017 mm);

the shrink film must have a minimum thickness of 75 µ (0,075 mm). - The packed pallet must be wrapped with stretch film at least 3 times. It is necessary to

shrink the goods together with the base of the pallet to ensure sufficient stiffness (see picture below).

- The goods must be covered with film from all sites including the top surface of the pallet in

order to provide sufficient protection against dust, humidity etc. - For self-stabilising goods such as cartons etc. stretch film is sufficient. - For unstable goods, for example monobloc chairs, tables, or pallet packed with different

goods shrink film / stretch film packing in connection with securing tapes must be used. Picture 12

12. Providing changeovers In order to simplify the delivery process for the supplier and Lux/Euromate, the service agent appointed for the transport may, in case of large volumes, place empty containers ready on the premises of the supplier. The service agent will position these changeovers as per the instructions of the supplier.

13. Regulations governed by law Packing units or additional packing elements exceeding the following limits are prohibited to put into circulation: The accumulated limit of the concentration of heavy metals (lead, cadmium, mercury and chromium VI) is 100 ppm. General limit for dioxine: 5μg / kg

14. Divergent Regulations for Lux

14.1 Requirements of pallets - The pallets being used for deliveries connected to Lux orders the supplier has to consider

a maximum weight of 800 kg. - The maximum height depends on the articles. The normal maximum height of pallets shall

be 1,05 m incl. pallet.

14.2 Delivery in boxes - In case of delivery in Lux-boxes the supplier has to ensure a maximum weight of 27.5 kg

per Lux box. - The articles must not poke out of the boxes. - The boxes have to be marked identically as sales packaging - If boxes are delivered on pallets the maximum number of boxes per pallet is 16.

14.3 No articles with closed top Please also see chapter 11.4 No top-covers such as cardboard, plastic hoods, shrink film are allowed for use on Lux articles.

14.4 Delivery of goods and Unloading - The articles are to be loaded in a way that allows unloading on the rear side of the truck

using loading platforms. Unloading a truck on the side by the use of forklifts is not possible. - The discharge of goods at Emil Lux GmbH & Co. KG in Wermelskirchen has to be

executed by the carrier independently. The equipment for the discharge will be provided by Emil Lux GmbH & Co. KG if necessary. This procedure is valid for ALL deliveries other than containers and self-collected goods.

- Suppliers must inform their service provider (carrier) accordingly about the above mentioned procedure.

15. Miscellaneous Lux/Euromate reserves the right to change certain organisational activities such as lifting, delivery cycles, etc. giving sufficient notice and without having any bearing on the validity of these instructions. This is also valid in case of goods deliveries to other warehouses designated by Lux/Euromate or loading/unloading points. Any other agreements must be in writing.

4) Customs Clearance Please use above nominated service providers in case of incoterm FCA or FOB. Please note that all occuring local charges at airport of departure have to be absorbed by seller. For incoterm DAP your chosen forwarder has to contact our Import Department for further instruction concerning customs clearance . For incoterm DDP customs clearance has to be arranged by forwarder chosen by seller. According to ICC rules of Incoterms 2010 any VAT or other taxes payable upon import are for the seller’s account. However Euromate and LUX agree to accept to absorb VAT, though only by invoice (no advance payment or cash payment) of seller’s chosen forwarder. Please inform your chosen forwarder accordingly.

1) Shipping/ Delivery instruction – Ocean Shipments:

1.1) General instruction for Ocean Shipments: All cargo must be booked with APL Logistics at least 17 days before latest ETD as specified in our purchase order. 21 days before latest ETD you will get a booking reminder by e-mail from APL Logistics if a booking is missing. Upon receipt of the booking, our logistics partner will then release the S/O = shipping order to you within 24 hours (also known as D/O = delivery order - note a copy in appendix – D/O), when your booking is accepted. You must submit a complete booking to APL Logistics before they can check your booking. If your booking does not match our purchase order your booking will not accepted by APL Logistics without prior approval of Lux/ Euromate. APL Logistics will not accept any booking if purchase order details (PO #, Position # and Article #) is not available. Furthermore your booking will be rejected if:

cargo is booked for a vessel sailing weeks before latest ETD or booked quantity exceeds ordered quantity

as mentioned in our purchase order. If it becomes impossible to book according to the specifications in the purchase order, it is your responsibility to contact Lux/Euromate for an extension prior booking to APL Logistics. APL Logistics will issue a Forwarder's Cargo Receipt (FCR-note a copy in appendix - FCR) to you, upon

acceptance of your cargo at APL Logistics or delivery of laden container to container yard (CY) or delivery of cargo for LCL shipment to container freight station (CFS),

payment of all local charges to APL Logistics and handover of packing list to APL Logistics.

1.3) APL Logistics Internet Application: To assist you with the various information flows, our logistics partner APL Logistics has created a web based applications platform for all shipments. One of the applications is the Booking Manager that allows you to book your shipments with APL Logistics via web 24 hours 7 days a week. The booking, authorization and documentation (D/O) will become more effective. Please contact your local APL Logistics representative to learn more about Booking Manager. At time of booking you have to advise / update at least the mandatory booking details that a) matches our purchase order or b) is required to arrange vessel sailing:

1.4) Factory Container Loads for Ocean Shipments: If you have enough cargo to load full containers (FCL) APL Logistics will accept your booking if you a) have the facility to load full container at your factory and b) when you reach the minimum acceptable loads per container as follows: CONTAINER SIZE FACTORY LOADED CONTAINERS MINIMUM MAXIMUM 40' HIGH CUBE DRY 60 CBM 22 TONS 40' STANDARD DRY 50 CBM 22 TONS 20' DRY 19 CBM 22 TONS

Light load containers have to be special authorized by Lux/Euromate. We advise APL Logistics to arrange the container shipments with our nominated ocean carrier’s or NVOCC’s. APL Logistics will forward the empty container pickup details to you. It is in your obligation to pickup the container from CY (Container Yard), check the condition of the container, to check if container (inside & outside) is in good condition. If the container is not in an appropriate condition you immediately have contact your APL Logistics representative to complain and arrange new container. It is also in your obligation to load the container in an appropriate manner and ensure that cargo can be transported without any risk of damage. It is required that FCL container is load per port of discharge/destination per company. ATTENTION: It is absolutely forbidden to load Lux and Euromate cargo in same container! After container loading you have to deliver laden container before CY cut off (date/time). If you can not catch CY cut off you have to contact your APL Logistics representative much in advance to either check how the planned vessel sailing can be met or to rearrange container vessel schedule.

Please avoid last minute delivery!

1.5) APL Logistics consolidation for Ocean Shipments: If you don’t have enough cargo to load full containers (FCL) then you may have to deliver your cargo to APL Logistics container freight station (CFS) for consolidation. You need to deliver cargo in good/clean condition with proper carton marking and label together with APL Logistics Delivery Notice to APL Logistics CFS. Cargo delivery address and cut-off date/time will be specified on the Cargo Delivery Notice.

If actual cargo delivery is different from booking information, you have to inform APL Logistics at least 24 hours before cargo delivery. APL Logistics will update system & resend accurate Delivery Notice to you after rechecking all requirements and may reconfirm with Lux/Euromate. You should bring the accurate Delivery Notice with your actual cargo delivery otherwise your cargo may not be accepted! You are required to deliver the cargo pre-sorted and segregated in this sequence: 1 Lux or Euromate 2 Port of Discharge/Destination 3 Purchase Order 4 Article (Style) APL Logistics will not sort and segregate the cargo unless you or Lux/Euromate provides written confirmation and agrees to reimburse APL Logistics for all charges incurred per local tariff rates.

Please avoid last minute and/or short delivery!

1.6) CFS Ocean Shipments: If you don’t have enough cargo to load full containers (FCL) then you may have to deliver your cargo to our nominated NVOCC’s container freight station (CFS) for less then container load (LCL) shipment. You need to deliver cargo with APL Logistics Delivery Notice incl. NVOCC’s reference #. Cargo delivery address and cut-off date/time will be specified on the Cargo Delivery Notice. If actual cargo delivery is different from booking information, you have to inform APL Logistics at least 24 hours before cargo delivery. APL Logistics will update system & resend accurate Delivery Notice to you after rechecking all requirements and may reconfirm with Lux/Euromate. You should bring the accurate Delivery Notice with your actual cargo delivery otherwise your cargo may not be accepted! The NVOCC’s will not sort and segregate the cargo unless you or Lux/Euromate provides written confirmation and agrees to reimburse the NVOCC’s for all charges incurred per local tariff rates.

Please avoid last minute and/or short delivery!

1.7) Non Performance: If you can not met the required conditions of our purchase order like quantity, dates, etc. you have to contact Lux/Euromate to rearrange our purchase order before you can book the cargo shipment with APL Logsitics. If your booking has been confirmed and you note that you can not meet the required conditions of our purchase order you immediately have to contact your APL Logistics representative for changing your booking. If you can not meet the cut off date/times for FCL and CFS shipments you have to inform your APL Logistics representative at least 24 hours before cut off date/time. Otherwise you will be kept responsible for all charges caused by your non performance.

1.8) Documentation: It is required that you send a copy of packing list to APL Logistics at least 3 working days after vessel sailing.

1.9) FCR: APL Logistics will release Original Forwarder’s Cargo Receipt (FCR) to you upon document submission subject to the following conditions:

APLL will not issue an FCR if above conditions are not met! Please contact your APL Logistics representative to get a copy of the effective local charges list for your location!
