Disciplinary Cases – Thomas Campbell, Assistant Gen eral Counsel Finno, Tony License #: EC13002831 Case #: 2010-022475 Mr. Finno was present and sworn in by the court reporter. Mr. Finno was charged with violation of 489.533(1)(m)4 F.S., financial mismanagement or misconduct. MOTION: Mr. Botknecht made a motion to impose a fine of $5,000 and costs of $278.03 2 years of probation and suspension until fines and costs are paid. SECOND: Mr. Flaherty. Motion passed unanimously. MOTION: Mr. Botknecht made a motion to amend and stay the suspension for 1 year to pay fines and costs, probation to begin immediately and will be tolled during the suspension. SECOND: Mr. Hoffmann. APPLICATION REVIEW –Benjamin Smith, Vice Chairman Additional Business Applications See attachment for a list of applicants that were present during this portion of the meeting: The Court Reporter swore in, as a group, the applicants and those persons providing testimony on behalf of the applicant. During the review each applicant and their respective designees were interviewed in turn and answered general questions concerning the business entity they wished to qualify and direct questions concerning their understanding of their responsibilities and obligations as primary qualifying agent. Mr. Smith asked of the second business applicants collectively as a group: ��“Do you understand that you will be legally responsible for every job undertaken by this business?” ��Do you understand that you will be financially responsible for every job undertaken by this business?” ��Do you understand that you are required to approve the work done on every job undertaken by this business?” ��Do you understand that your license is dependent upon how seriously you take these responsibilities?” Each applicant answered affirmatively to each of the preceding questions. MOTION: Mr. Botknecht made a motion to reverse the denial and approve the application and require Mr. Gancedo to attend 1 meeting within the next year where disciplinary cases are heard. SECOND: Mr. Flaherty. Motion passed unanimously. Mr. Chinchor appointed Mr. Botknecht as the new Chairman of the Probation Committee. LEGISLATIVE REPORT Mr. Flaherty reported that SB 54 was proposed again this year related to Journeymen. RULES REPORT Mr. Chinchor appointed Mr. Botknecht as the Rules Liason on and Financial Liason. Ms. Loucks presented the rules report, she noted the rule 61G6-8.001 related to fees had been noticed for development and asked the Board to vote on the proposed language.

61G6-8.001 Fees

The following fees are prescribed by the Board: (1) No change

(2) The initial application fee for licensure by endorsement as a certified unlimited electrical, alarm system or specialty contractor by endorsement or certification of a registered contractor shall be two hundred dollars ($200.00).

(3) through (8) No change

(9) Delinquent Fee. If licensee becomes delinquent, an applicant must elect for active or inactive status, and a fifty dollar ($50.00) delinquent fee will be charged.

(10) through (13) No change

(14) The initial application fee for licensure by second entity as certified unlimited electrical contractor or alarm system contractor shall be two hundred fifty dollars ($250.00).

(15) Pursuant to Section 455.2281, F.S., in addition to all other fees collected from each licensee, there shall be a five dollar ($5.00) fee collected at the request of the Department, both upon initial licensure and license renewal for the purpose of combatting unlicensed activity.

Motion passed unanimously. The Board determined the proposed rule did not have an adverse financial impact in excess of $200,000 and a Statement of Estimated Regulatory Costs was not required. FINANCIAL BUDGET LIAISON REPORT – Clarence K. Tibbs Ms. Chastain provided the financial report to the Board for their review. UNLICENSED ACTIVITY (ULA) REPORT – Paul Sandefer None. EXAMINATION REPORT – Kenneth Hoffmann The Board reviewed the July and August 2013 examination results. Mr. Hoffman requested that Alex Bosque with the Bureau of Education and Testing be invited to the November meeting to discuss how exams are reviewed when evaluating them for the purpose of endorsement. The Board asked to have a report of exam results that did not include the Construction results. ENDORSEMENT REPORT No changes. RATIFICATION OF APPLICATIONS The lists will be attached to the minutes and are hereby incorporated by reference. MOTION: Mr. Bramlett made a motion to ratify the Continuing Education Committee and Initial Application Review results. SECOND: Mr. Flaherty. Motion passed unanimously. The Board determined each application to qualify a municipality would be handled on an individual basis due to issues providing financial information and financial responsibility. PROSECUTING ATTORNEY’S REPORT – Elizabeth Henderson , Esq., Assistant General Counsel Ms. Henderson directed the Board’s attention to the details of the report which was distributed to the members. EXECUTIVE DIRECTOR’S REPORT – Juanita Chastain Mr. Biggins directed the Board’s attention to the enforcement report and the proposed meeting dates which were provided for their information. CHAIRPERSON’S COMMENTS – Kenneth Hoffmann Mr. Chinchor requested an invitation be extended to Secretary Lawson to attend the November Board meeting. Mr. Chinchor appointed Mr. Cannava to the Continuing Education Committee and removed Mr. Hoffmann from that committee. Mr. Chinchor appointed Mr. Hoffmann to the Probable Cause Panel. Adjournment.
