    PRINCIPAL BUILDING AGREEMENT

    The agreement shall be the JBCC Series 2000 PrincipalBuilding Agreement prepared by the Joint Building ContractCommittee, 4th Edition Code 2101 March 2004 (includingState provisions).

    PRELIMINARIES

    The preliminaries shall be the JBCC Series 2000Preliminaries prepared by the Joint Building ContractsCommittee, 3rd Edition Code 2103 January 2003 and shall bedeemed to be incorporated herein.

    FULL INTENT AND MEANING OF CLAUSES

    Tenderers shall be deemed to have referred to theaforementioned documents for the full intent and meaning ofeach clause. These clauses are hereinafter referred to by theheading and clause number only.

    Where standard clauses or alternatives are not entirelyapplicable to this contract documents, such modifications,corrections or supplements as will apply are given under eachrelevant clause heading.

    Where any item is not relevant to this specific contract suchitem is marked N/A (signifying "not applicable").

    PRICING OF CLAUSES

    Tenderers are referred to the abovementioned documents forthe full intent and meaning of each clause thereof (hereinafterreferred to by heading and clause number only). Tenderersshall allow apposite each clause for any cost involved withcomplying with such clause. Any clauses left unpriced shall bedeemed to be covered by rates and prices elsewhereincorporated throughout these bills of quantities.

    Should 'Alternative A', as set out within clause 10.3 hereinafter,be used for the adjustment of preliminaries then each itempriced is to be allocated to one or more categories by theinsertion of the letter "F", "V" or "T", as the case may be,against the price in the "Quantity" column. These letters shallindicate the relevant categories as follows :

    "F" - Denotes a fixed amount which shall not be varied

    Without limiting the generality of the provisions of clause 7.0 ofthe agreement, the contractors attention is drawn to theprovisions of the Construction Regulations, 2003 issued interms of the Occupational Health and Safety Act, 1993 in whichit is specifically stated that the employer shall prepare adocumented health and safety specification for the works andthat the employer shall ensure that the contractor has madeprovision for the cost of health and safety measures during theexecution of the works. The principal agent shall, on behalf ofthe employer, issue such health and safety specification andthe contractor shall price opposite this item for compliancewith the act and the regulations and the provisions of theforementioned health and safety specification, provided suchprovisions are reasonable in terms of the act and theregulations.The Contractor's compliance with Ocupational Health andSafety Act shall be the principal agent's responsibility.

    Extension of time shall only be considered when work is on thecritical path of the contract programme, which the contractorshall clearly identify, for the works affected.

    Any delays to minor portions of the works will only attractextensions of time to those areas and not the entire project.

    It is recorded that only the quantity surveyor is empowered torule whether any instruction issued constitutes an additionalcost and to resolve cost aspects of any nature pertaining to thiscontract.

    SECTION C : SPECIFIC PRELIMINARIES

    SUPPLEMENTARY DOCUMENTATION

    Shop drawings

    The term "shop drawings" shall mean drawings, diagrams,illustrations, schedules, performance charts, brochures,operating manuals and other data which are prepared by thecontractor or any subcontractor, manufacturer, supplier ordistributor and which illustrate some portion of the works.

    The contractor shall, at his own expense, prepare and submittwo prints of shop drawings of all fabricated work, working orsetting out drawings, shop details and schedules to thearchitect for approval by the architect, the relative consultingengineer and/or the principal agent as is appropriate and suchwork shall not be performed by the contractor until suchapproval has been given.

    The contractor shall present a complete schedule showing thesequence of submission of shop drawings, includingsubmission dates, for all trades and the scheduled dates forapproval of all drawings. This schedule shall take into accountthat the architect and the relative consulting engineer and theprincipal agent each reserve a two weeks check period foreach discipline from the date of the receipt of all shop drawingsand/or catalogue data.

    All submissions shall be on dates as indicated in the aboveschedule and sufficiently in advance to permitthe contractor to meet fabrication deadlines; no claim forextensions to the contract period will begranted to the contractor by reason of his failure in this respect.

    The contractor shall submit four copies of catalogues and datafor approval. The contractor shall check all submissions forconformity with the contract drawings and specifications andcorrect any errors, omissions or deviations before theirtransmission to the principal agent.

    All submissions shall bear the contractor's dated stamp ofapproval as evidence that they have been so checked andcorrected by the contractor. Any drawings, schedule orcatalogue submitted without this stamp will not be consideredby the principal agent and will be returned.

    When the principal agent advises the contractor that shopdrawings have been approved, he shall immediately submit tothe architect the original transparencies of such drawings sothat the architect's stamp of approval may be appendedthereto. Thereafter the contractor shall furnish to the architectfour prints of the approved shop drawings, setting out drawingsand schedules. The contractor shall also furnish to the worksas many prints of the approved shop drawings and schedulesas may be required. No work shall be performed from anyshop drawings and/or catalogues not stamped with thearchitect's approval.

    The contractor shall be responsible for ensuring that alldimensions conform to the dimensions of built work.

    The architect's approval of any document or drawing shall not inany way vary his contractual or delictual obligations andliabilities to the employer or any other party, nor does it varythe contractual or delictual obligations and liabilities of the partysubmitting such document or drawing for approval.

    If the submissions differ from the requirements of the contract,the contractor shall make specific mention of each differencein his letter of transmission with a request for substitution,together with his reasons for same, in order that, if acceptable,suitable action may be taken by the principal agent. Otherwisethe contractor will not be relieved of the responsibility forexecuting the work in accordance with the requirements of thecontract documents.

    Corrections of shop drawings by the principal agent shall notchange the scope of work. Should any such correction beconsidered to constitute a change of scope of work, thecontractor shall notify the principal agent in writing within notmore than seven calendar days of such change and shall notproceed with the fabrication until so authorized by the principalagent. Claims for change of scope made after performance ofthe work constituting the claimed change of scope will not beconsidered.

    Unless otherwise agreed with the principal agent, shopdrawings shall be prepared to show all details of installation,including reticulation, fixing, etc of all components andassemblies, or if the c o n t r a c t o r desires to deviate from thedesign and these drawings shall be all in accordance with theabove procedures and at the contractor's expense.     As built drawings

    A The position of construction breaks and the extent of individualconcrete pours are to be recorded by the contractor on thestructural engineer's drawings and are to be submitted to theprincipal agent and the structural engineer for their records. Item

    C At the end of each week the contractor shall provide theprincipal agent with a written record, in schedule form,reflecting the number and description of tradesmen andlabourers employed by him and all subcontractors on theworks each day. Item

    Interim payments for unfixed materials

    A Before including the value of any unfixed materials and goodsin his valuation for each interim certificate the principal agentwill require a certificate of ownership and a cession of rights infavour of the employer from the contractor and/or each andevery subcontractor. Item

    B The additional costs of overtime work shall be for theemployer's account only when prior written agreement theretois given by the principal agent. Item

    C As the windows are fixed they shall be glazed and prepared sothat each window can be tested for watertightness with watersprayed on by means of a 20mm hosepipe using adequatepressure.     Warranty for design and materials

    A The contractor warrants and undertakes in favour of theemployer that:

    Insofar as the works or any part of the works has been or willbe designed by him, he will exercise reasonable, due andproper skill and care in such design.

    Insofar as any part of the materials and goods for the workshas been or will be selected by him, he will exercise due andproper skill and care in such selection of materials and goods.

    He is suitably qualified and competent to carry out such designwork and selection of materials and goods.

    He shall comply with and satisfy any performance specificationor requirements insofar as such performance specification orrequirements are included or referred to in the sub-contract. Item

    Guarantees

    The contractor shall obtain written guarantees where calledfor, addressed to the employer, from the firms supplying thematerials or doing the work and deliver such guarantees to theprincipal agent.

    The guarantees shall state that workmanship, materials andinstallation are guaranteed for a specified period reckoned fromthe date of practical completion of the works and that anydefects in the workmanship, materials and installation that mayarise during that period shall be made good at the expense ofthe firm doing the work upon written notice from the principalagent or the employer to do so.     Cost of tests

    The costs of making, storing and testing of concrete test cubesas required under Clause 7 "Tests" of SABS 1200 G shallinclude the cost of providing cube moulds necessary for thepurpose, for testing costs and for submitting reports on thetests to the Architect. The testing shall be undertaken by anindependent firm or institution nominated by the Contractor tothe approval of the Architect (Test cubes are measuredseparately)

    Formwork

    Descriptions of formwork shall be deemed to include use andwaste only (except where described as "left in" or "permanent"),for fitting together in the required forms, wedging, plumbing andfixing to true angles and surfaces as necessary to ensure easyrelease during stripping and for reconditioning as necessarybefore re-use.     Copper pipes

    Pipes shall be hard drawn and half-hard pipes of the classstated. Class 0 (thin walled hard drawn) pipes shall not bebent. Class 1 (thin walled half-hard), class 2 (half-hard) andclass 3 (heavy walled half-hard) pipes shall only be bent withbenders with inner and outer formers.     Fixing of pipes

    Reducing fittings

    Design Responsibility

    The contractor shall be responsible for the design of theinternal plumbing reticulation. The contractor will submit shopdrawings for approval to Davis Langdon Farrow Laing forapproval by the engineer/architect within two weeks after thedate of tender closing. Appointment of the successfull tendererwill be subject to approval of the internal plumbing reticulation.The contractor shall commence manufacturing only afterwritten approval of shop drawings from the engineer/architect.

    The following is to be taken into consideration in thedesign and subsequent pricing of the internal plumbingand drainage reticulation:

    Soil Drainage

    Soil drainage points has been allowed as indicated on thearchitect's drawings. The contractor is to allow for the locationof point left by other on main drainage pipe, connection thereto,new pipework and fittings, junctions, bends, excavation,backfilling, etc to this point.

    All sanitary waste pipework shall be uPVC. Where pipeworkpass under buildings they shall be encased in concrete. Fittingsto waste pipes shall be standard uPVC pipe fittings andadequate rodding eyes are to be allowed.

    Water Supplies

    Connection shall be made at point left by other as indicated onthe site plan and the contractor is to allow for the location of thispipe and connection of all new pipework.

    The contractor to allow for one external masterbox with astopvalve and a domestic watermeter.

    All pipework to be class II copper pipe with compression fittingsunder ground and solvent welded fittings above ground.

    The contractor is to ensure that a balanced water system isachieved.

    The contractor are to allow for minimum 5 no. external taps.
