Federal officials named tothe Council may constitute no more than one-half of the total Councilmembe rship. In addition to the Chairman and the Council, the membership

of the Conference is composed of high-level officials designated from theprincipal departments and agencies of the Federal Government and privatelawyers, university faculty members, and others specially informed in lawand government. Members representing the private sector are appointed bythe Chairman, with the approval of the Council, for 2-year terms. TheChairman is the only full-time compensated member.

The entire membership is divided into committees, each assigned

a broad area of interest such as adjudication, administration,governmental processes, judicial review, regulation, or rulemaking. Themembership meeting in plenary session is calle d the Assembly of theConference, which by statute must meet at least once, and customarilymeets twice, each year.

Activities

Subjects for inquiry are developed by the Chairman and approvedby the Council. The committees, overseen by the Research Director withassistance from consultants, conduct thorough studies of these subjects,propose recommendations, and prepare supporting reports. Recommendationsare evaluated by the Council and, if ready for Assembly consideration, are

distributed to the membership with the supporting reports and placed onthe agenda of the next plenary session. The Assembly has complete authority to approve, amend, remand, or reject recommendations presented by thecommittees. The deliberations of the committees and Assembly are public.

The Chairman is authorized to encourage the departments andagencies to adopt the recommendations of the Conference and is required totransmit to the President and to Congress an annual report and interimreports concerning the activities of th e Conference, including reports onthe implementation of its recommendations.

Recommendations adopted by the Conference may call for newlegislation or for action on the part of affected agencies. A substantial

number of recommendations have been implemented and others are in theprocess of being implemented.

The Chairman may make independent inquiries into procedural matters,including matters proposed by individuals inside or outside the Government. Thepurpose of such inquiries is to determine whether the problems should be made thesubject of Conference study in the interest of developing fair and effective procedures for suchcases.

Upon the request of the head of a department or agency, theChairman is authorized to furnish advice and assistance on matters ofadministrative procedure. The Conference may collect information and

statistics from departments and agencies and p ublish such reports as itconsiders useful for evaluating and improving administrative processes.The Conference also serves as a forum for the interchange amongdepartments and agencies of information that may be useful in improvingadministrative practi ces and procedures.

The African Development Foundation assists and supports indigenous,community-based self-help organizations in their efforts to solve theirown development problems.

The African Development Foundation was established by theAfrican Development Foundation Act (22 U.S.C. 290h), as a nonprofit,Government corporation to support the self-help efforts of poor people inAfrican countries. The Foundation became operational in 1984 and is

governed by a seven-member Board of Directors, appointed by the Presidentwith the advice and consent of the Senate. By law, five Board members arefrom the private sector and two are from the Government.

The purposes of the Foundation are to:

-- strengthen the bonds of friendship and understanding betweenthe people of Africa and the United States;

-- support self-help development activities at the local leveldesigned to promote opportunities for community development;

The Central Intelligence Agency collects, evaluates, and disseminatesvital information on political, military, economic, scientific, and otherdevelopments abroad needed to safeguard national security.

The Central Intelligence Agency was established under theNational Security Council by the National Security Act of 1947, as amended(50 U.S.C. 401 et seq.). It now functions under that statute, ExecutiveOrder 12333 of December 4, 1981, and oth er laws, regulations, anddirectives.

The Director of Central Intelligence heads both the Intelligence

-- carries out or contracts for research, development, andprocurement of technical systems and devices relating to authorizedfunctions;

-- protects the security of its installations, activities,information, property, and employees by appropriate means, including such

investigations of applicants, employees, contractors, and other personswith similar associations with the Agen cy, as are necessary;

-- conducts such administrative and technical supportactivities within and outside the United States as are necessary toperform its functions, including procurement and essential cover andproprietary arrangements; and

-- performs such other functions and duties relating tointelligence that affect the national security as the National SecurityCouncil may from time to time direct.

The Commission on Civil Rights collects and studies information ondiscrimination or denials of equal protection of the laws because of race,color, religion, sex, age, handicap, national origin, or in theadministration of justice in such areas as voting rights, enforcement of

Federal civil rights laws, and equality of opportunity in education,employment, and housing.

The Commission on Civil Rights was first created by the CivilRights Act of 1957, as amended, and reestablished by the United StatesCommission on Civil Rights Act of 1983, as amended (42 U.S.C. 1975).

Activities

The Commission makes findings of fact but has no enforcementauthority. Findings and recommendations are submitted to the President andCongress, and many of the Commission's recommendations have been enacted,either by statute, Executive order, or regulation. The Commission

evaluates Federal laws and the effectiveness of Government equalopportunity programs. It also serves as a national clearinghouse for civilrights information.

The Commodity Futures Trading Commission promotes healthy economic growth,protects the rights of customers, and ensures fairness and integrity inthe marketplace through regulation of futures trading. To this end, italso engages in the analysis of econo mic issues affected by or affectingfutures trading.

The Commodity Futures Trading Commission, the Federal regulatoryagency for futures trading, was established by the Commodity FuturesTrading Commission Act of 1974 (7 U.S.C. 4a). The Commission began

operation in April 1975, and its authority to regulate futures tradingwas renewed by Congress in 1978, 1982, 1986, and 1992.

The Commission consists of five Commissioners who are appointedby the President, with the advice and consent of the Senate. OneCommissioner is designated by the President to serve as Chairman. TheCommissioners serve staggered 5-year terms, an d by law no more than threeCommissioners can belong to the same political party.

The five major operating components that exist within theCommission are: the divisions of enforcement, economic analysis, tradingand markets, and the offices of the executive director and the generalcounsel.

Activities

The Commission regulates trading on the 11 U.S. futuresexchanges, which offer active futures and options contracts. It alsoregulates the activities of numerous commodity exchange members, publicbrokerage houses (futures commission merchants), Commission-registeredfutures industry salespeople and associated persons, commodity trading

advisers, and commodity pool operators. Some off-exchange transactionsinvolving instruments similar in nature to futures contracts also fallunder Commission ju risdiction.

The Commission's regulatory and enforcement efforts are designedto ensure that the futures trading process is fair and that it protectsboth the rights of customers and the financial integrity of themarketplace. It approves the rules under which an exchange proposes tooperate and monitors exchange enforcement of those rules. It reviews theterms of proposed futures contracts, and registers companies andindividuals who handle customer funds or give trading advice. TheCommission also protects the public by enforcing rules that require thatcustomer funds be kept in bank accounts separate from accounts maintained

by firms for their own use, and that such customer accounts be marked topresent market value at the close of trading each day.

Futures contracts for agricultural commodities were traded inthe United States for more than 100 years before futures trading wasdiversified to include trading in contracts for precious metals, rawmaterials, foreign currencies, financial inst ruments, commercial interestrates, and U.S. Government and mortgage securities. Contractdiversification has grown in exchange trading, in both traditional andnewer commodities.

The Defense Nuclear Facilities Safety Board reviews andevaluates the content and implementation of standards for defense nuclearfacilities of DOE; investigates any event or practice at these facilitieswhich may adversely affect public health and safety; and reviews andmonitors the design, construction, and operation of facilities. The Boardmakes recommendations to the Secretary of Energy concerning DOE defensenuclear facilities to ensure adequate protection of public health andsafety. In the event that any aspect of operations, practices, or

occurrences reviewed by the Board is determined to present an imminent orsevere threat to public health and safety, the Board transmits itsrecommendations directly to the President.

The Environmental Protection Agency protects and enhances our environmenttoday and for future generations to the fullest extent possible under thelaws enacted by Congress. The Agency's mission is to control and abatepollution in the areas of air, water , solid waste, pesticides, radiation,and toxic substances. Its mandate is to mount an integrated, coordinatedattack on environmental pollution in cooperation with State and localgovernments.

The Environmental Protection Agency was established in theexecutive branch as an independent agency pursuant to Reorganization PlanNo. 3 of 1970 (5 U.S.C. app.), effective December 2, 1970.

The Environmental Protection Agency was created to permitcoordinated and effective governmental action on behalf of theenvironment. It endeavors to abate and control pollution systematically,by proper integration of a variety of research, mon itoring, standardsetting, and enforcement activities. As a complement to its otheractivities, the Agency coordinates and supports research and antipollutionactivities by State and local governments, private and public groups,individuals, and education al institutions. It also reinforces effortsamong other Federal agencies with respect to the impact of theiroperations on the environment, and it is specifically charged withpublishing its determinations when those hold that a proposal isunsatisfactory from the standpoint of public health or welfare or

environmental quality. In all, the Environmental Protection Agency isdesigned to serve as the public's advocate for a livable environment.

Activities

Air and Radiation The air activities of the Agency include:

-- development of national programs, technical policies, andregulations for air pollution control;

Related activities include technical assistance to States andagencies having radiation protection programs, including radon mitigationprograms and a national surveillance and inspection program for measuringradiation levels in the environment.

WaterThe Agency's water quality activities represent a coordinated effortto restore the Nation's waters. The functions of this program include:

Solid Waste and Emergency ResponseThe Office of Solid Waste and Emergency Response provides policy,guidance, and direction for the Agency's hazardous waste and emergencyresponse programs. The functions of these programs include:

Prevention, Pesticides and Toxic SubstancesThe Office of Pesticides and Toxic Substances is responsible for:

-- developing national strategies for the control of toxicsubstances;

-- directing the pesticides and toxic substances enforcementactivities;

-- developing criteria for assessing chemical substances,

standards for test protocols for chemicals, rules and procedures forindustry reporting and regulations for the control of substances deemed tobe hazardous to man or the environment; and

-- evaluating and assessing the impact of existing chemicals,new chemicals, and chemicals with new uses to determine the hazard and, ifneeded, develop appropriate restrictions.

Additional activities include:

-- controlling and regulating pesticides and reducing their useto ensure human safety and protection of environmental quality;

-- establishing tolerance levels for pesticides that occur inor on food;

-- monitoring pesticide residue levels in food, humans, andnontarget fish and wildlife and their environments; and

-- investigating pesticide accidents.

Research and Development

The Office of Research and Development is responsible for a nationalresearch program in pursuit of technological controls of all forms ofpollution. It directly supervises the research activities of the Agency'snational laborato ries and gives technical policy direction to thoselaboratories that support the program responsibilities of the regionaloffices. Close coordination of the various research programs is designedto yield a synthesis of knowledge from the biological, physi cal, andsocial sciences that can be interpreted in terms of total human and

General functions include management of selected demonstrationprograms, planning for Agency environmental quality monitoring programs,coordination of Agency monitoring efforts with those of other Federalagencies, the States, and other public bodies, and dissemination of Agencyresearch, development, and demonstration results.

The Agency's 10 regional offices represent its commitment to thedevelopment of strong local programs for pollution abatement. The RegionalAdministrators are the Agency's principal representatives in the regionsin contacts and relationships wi th Federal, State, interstate and localagencies; industry; academic institutions; and other public and privategroups. They are responsible for accomplishing, within their regions, thenational program objectives established by the Agency. The Equal Employment Opportunity Commission eliminates discriminationbased on race, color, religion, sex, national origin, disability, or agein hiring, promoting, firing, setting wages, testing, training,apprenticeship, and all other terms and conditio ns of employment. TheCommission conducts investigations of alleged discrimination; makesdeterminations based on gathered evidence; attempts conciliation whendiscrimination has taken place; files lawsuits; and conducts voluntaryassistance programs for employers, unions, and community organizations.The Commission also has oversight responsibility for all compliance andenforcement activities relating to equal employment opportunity amongFederal employees and applicants, including discrimination against

The Equal Employment Opportunity Commission (EEOC) was createdby Title VII of the Civil Rights Act of 1964 (42 U.S.C. 2000e-4), andbecame operational July 2, 1965. Title VII was amended by the EqualEmployment Opportunity Act of 1972, the Preg nancy Discrimination Act of1978, and the Civil Rights Act of 1991.

Executive Order 12067 of June 30, 1978, abolished the EqualEmployment Opportunity Coordinating Council and transferred its duties tothe Commission with responsibility for providing coherence and directionto the Government's equal employment o pportunity efforts. This Executiveorder requires that strong uniform enforcement standards be appliedthroughout the Government, and it encourages the development ofstandardized data collection procedures and joint training programs, thesharing of enfo rcement-related data among agencies, and the developmentof uniform methods and priorities for complaint and compliance reviews.

Reorganization Plan No. 1 of 1978 (5 U.S.C. app.) effectiveJanuary 1, 1979, transferred Federal equal employment functions from theCivil Service Commission to the EEOC. Authorities for transferred

functions include:

-- section 717 of Title VII of the Civil Rights Act of 1964 (42U.S.C. 2000e-16), which prohibits discrimination in employment in theFederal Government on the basis of race, color, religion, sex, or nationalorigin;

-- Executive Order 11478 of August 8, 1969, which sets forththe U.S. policy of providing for equal employment opportunity in theFederal Government through affirmative action programs in Federaldepartments and agencies;

-- the Equal Pay Act of 1963 (29 U.S.C. 206) in the Federal

sector;

-- section 15 of the Age Discrimination in Employment Act of1967, as amended (29 U.S.C. 621) in the Federal sector; and

-- section 501 of the Rehabilitation Act of 1973 (29 U.S.C.791), which pertains to employment discrimination against individuals withdisabilities in the Federal Government.

On July 1, 1979, responsibility for enforcement -- in privateindustry as well as in State and local governments -- of the Equal Pay Actof 1963 and the Age Discrimination in Employment Act of 1967 wastransferred from the Department of Labor to the Commission. The former act

prohibits sex-based pay differences where substantially equal workperformed in the same establishment under similar working conditionsrequires equal skill, effort, and responsibility; and the latter prohibitsemployment d iscrimination against workers or applicants 40 years of ageor older. In addition to employers, the age discrimination act coversactivities of employment agencies, and both acts cover activities of labororganizations.

The Americans with Disabilities Act of 1990 (ADA) (42 U.S.C.12101 et seq.) was approved on July 26, 1990. Title I of the act has beenenforced by EEOC since July 26, 1992, for employers with 25 or more

employees; and will become effective on Ju ly 26, 1994, for employers with15 or more employees. Title I governs private employers, State and localgovernments, employment agencies, labor organizations, and jointlabor-management committees. The act prohibits employment discriminationagainst qual ified individuals with disabilities and requires thatemployers make reasonable accommodations for such qualified individuals ifit would not create undue hardship.

The Civil Rights Act of 1991 reversed parts of several U.S.Supreme Court rulings and provided for compensatory and punitive damagesfor intentional discrimination under Title VII of that act and the ADA.

The Commission operates through 50 field offices, each of whichprocesses charges.

Activities

Enforcement

The Commission's field offices receive charges of job discrimination underTitle VII, the ADA, the Equal Pay Act of 1963, and the Age Discrimination

in Employment Act of 1967. Field offices may initiate investigations tofind violations of the acts. Members of the Commission also may initiatecharges alleging that a violation of Title VII or the ADA has occurred.Section 501 of the Rehabilitation Act of 1973 covers Federal employees andapplicants only.

Charges Under Title VII

Title VII prohibits employment discrimination based on race, color,religion, sex, or national origin by private employers, State and localgovernments, and educational institutions with 15 or more employees, or bythe Federal Gove rnment, private and public employment agencies, labororganizations, and joint labor-management committees for apprenticeship

and training.

Charges of Title VII violations outside of the Federal sectormust be filed with the Commission within 180 days of the alleged violation(or up to 300 days in a State or locality in which a fair employmentpractices agency is located), and the C ommission is responsible fornotifying persons so charged within 10 days of the receipt of a newcharge. Before investigation, charges must be deferred for 60 days to aState or local fair employment practices agency in States andmunicipalities where the re is a fair employment practices law coveringthe alleged discrimination. The deferral period is 120 days if the agencyhas been operating less than 1 year. Under worksharing agreements executedbetween the Commission and State and local fair employment practices

agencies, the Commission routinely will assume jurisdiction over certaincharges of discrimination and proceed with its investigation rather thanwait for the expiration of the deferral period.

If there is reasonable cause to believe the charge is true, thedistrict, area, or local office attempts to remedy the alleged unlawfulpractices through informal methods of conciliation, conference, andpersuasion. If an acceptable conciliation agreement is not secured, thecase is submitted to the Commission for possible litigation. If litigationis approved, the Commission will bring suit in an appropriate Federaldistrict court.

Under Title VII, the Attorney General brings suit when a Stateor local government, or political subdivision is involved. If theCommission or the Attorney General does not approve litigation or if afinding of no reasonable cause is made, at th e conclusion of theadministrative procedures (or earlier at the request of the chargingparty) a Notice of Right-to-Sue is issued that allows the charging partyto proceed within 90 days in a Federal district court. In appropriate

cases, the Commission m ay intervene in such civil action if the case isof general public interest. The investigation and conciliation of chargeshaving an industrywide or national impact are coordinated or conducted bySystemic Investigations and Individual Compliance Programs , Office ofProgram Operations.

Under the provisions of Title VII, section 706(f)(2), as amendedby section 4 of the Equal Employment Opportunity Act of 1972 (42 U.S.C.2000e-5), if it is concluded after a preliminary investigation that promptjudicial action is necessary to c arry out the purposes of the act, theCommission or the Attorney General, in a case involving a State or localgovernment, governmental agency or political subdivision, may bring anaction for appropriate temporary or preliminary relief pending final disp

osition of a charge.

Americans with Disabilities Act Charges

The Americans with Disabilities Act of 1990 specifically incorporates thepowers, remedies, and procedures contained in Title VII of the CivilRights Act of 1964. Employment discrimination charges based on disabilit ymay be filed at any of the Commission's field offices. The Commission willinvestigate and attempt to conciliate the charges using the sameprocedures it uses to investigate and conciliate charges filed under TitleVII. The litigation procedures under t his title apply to charges filedunder the act.

Age Discrimination in Employment or Equal Pay Act Charges and Complaints

The age discrimination in employment and equal pay acts cover mostemployees and job applicants in private industry and Federal, State, andlocal governments.

An age discrimination charge must be filed with the Commissionwithin 180 days of the alleged violation or, in a case where the allegeddiscriminatory action took place in a State which has its own agediscrimination law and authority administer ing that law, within 300 daysof the alleged violation or 30 days after the receipt of a notice oftermination of State proceedings, whichever is earlier. A lawsuit must befiled within 2 years of the discriminatory act or 3 years in cases of a

willful vi olation of the law. Under the Civil Rights Act of 1991, alawsuit must be filed within 90 days of the plaintiff's receipt of noticeof final action. The Commission will attempt to eliminate the unlawfulpractice through informal methods of conciliation, c onference, andpersuasion. A lawsuit may be brought by the Commission if conciliationfails, or individuals may file suit on their own behalf 90 days afterfiling a charge with the Commission and the appropriate State agency.Should the Commission take le gal action, an individual covered by suchaction may not file a private suit. If an individual files a complaint ofage discrimination, his or her name will be kept confidential, but theindividual filing the complaint may not bring a private suit unless he or

she elects to file a charge first in accordance with the aboverequirements.

A lawsuit under the Equal Pay Act of 1963 may be filed by theCommission or by the complainant. There are no prerequisites to individualactions under this law. Wages may be recovered for a period of up to 2years prior to the filing of a suit, except in the case of willfulviolation, where 3 years' backpay may be recovered. The name of the

individual filing the complaint may be kept confidential at theadministrative level.

Complaints Against the Federal Government

On April 10, 1992, the Commission published new Federal sector processingregulations codified at 29 CFR 1614, effective October 1, 1992. Federalemployees or job applicants who want to file complaints of job discrimination based on race, color, national origin, sex, religion, age, orphysical or mental disability must first consult an equal employmentopportunity counselor within their agency within 45 calendar days of thealleged discriminatory event or the effe ctive date of the allegeddiscriminatory personnel action. If the complaint cannot be resolved

informally, the person may file a formal complaint within 15 calendar daysafter the date of receipt of the notice of the right to file a complaint.

An accepted complaint is investigated by the agency and there isa right to a hearing before an EEOC administrative judge before the agencyissues its final decision. An individual who wishes to file a complaintunder the Equal Pay Act of 1963 m ust now follow these procedures. Anindividual may also elect to file suit under the Equal Pay Act of 1963without prior resort to the agency or to the Commission.

A complaint under the Age Discrimination in Employment Act of1967 against a Federal agency or department must be filed with the head ofthe agency, director of equal employment opportunity, head of a field

installation, or such other officials as the agency may designate.Federal-sector age discrimination complainants may bypass theadministrative complaint process and file a civil action directly in aU.S. district court by first notifying the Commission within 180 calendardays of the alleged discriminatory act and thereafter waiting 30 calendardays before filing suit.

Federal employees may file appeals of final agency decisions ordecisions of an arbitrator or the Federal Labor Relations Authority withthe Commission's Office of Federal Operations at any time up to 30calendar days after receipt of the agency notice of final decision. Apetition for review of a Merit Systems Protection Board decision may befiled within 30 days of the date that the Board decision becomes final. A

request for reopening and reconsideration of any decision of theCommission shou ld be made in writing within 30 days of receipt of suchdecision. Office of Federal Operations decisions are issued in writing tothe complainant, complainant's representative, and the agency. The Officemonitors and ensures compliance by Federal agencies with Commission ordersand appellate decisions, and provides technical assistance and training toother Federal agencies.

Other Activities The Commission actively promotes voluntary compliancewith equal employment opportunity statutes through a variety ofeducational and technical assistance activities. A distinct activity of

the Commission is the Voluntary Assistance Progr am. This outreach programis designed to provide educational and technical assistance to small andmidsize employers and unions -- through 1-day seminars on equal employmentopportunity laws -- about their rights and obligations under all thestatutes tha t the Commission enforces.

Another activity initiated by the Commission is the ExpandedPresence Program, which is designed to make the Commission accessible in

areas identified as underserved by Commission offices. The districtoffices send contact teams to these sites o n a rotating basis to provideinformation to the public regarding their rights and responsibilitiesunder the laws enforced by the Commission.

The Commission also provides assistance and guidance to Federalagencies in processing complaints and in resolving disputes. In additionto conducting on-site consultations, EEOC co-hosts an annual FederalDispute Resolution Conference which pro vides a forum for Federal agenciesto meet and exchange ideas on resolving disputes.

Through its Educational Technical Assistance and TrainingRevolving Fund, the Commission is also able to provide its constituency

with advanced and specialized technical assistance. Fees charged forRevolving Fund products are not to exceed the cost of producing thematerials of services provided; however, they are to bear a directrelationship to the cost of providing such outreach and are to be imposedon a uniform basis.

The Commission participates in the development of the employmentdiscrimination law through the issuance of guidelines, publication ofsignificant Commission decisions, and involvement in litigation broughtunder Title VII, the Equal Pay Act of 1963, the Age Discrimination inEmployment Act of 1967, and the Americans with Disabilities Act of 1990.

The Commission has direct liaison with Federal, State, and local

governments; employers and union organizations; trade associations; civilrights organizations; and other agencies and organizations concerned withemployment of minority group mem bers and women. The Commission engages inand contributes to the cost of research and other mutual interest projectswith State and local agencies charged with the administration of fairemployment practices laws. Furthermore, the Commission enters into contracts and worksharing agreements with State and local agencies in orderto avoid duplication of effort by identifying specific charges to beinvestigated by the respective agencies.

The Commission is also a major publisher of data on theemployment status of minorities and women. Through six employment surveys(EEO-1 through EEO-6) covering private employers, apprenticeship programs,

labor unions, State and local government s, elementary and secondaryschools, and colleges and universities, the Commission tabulates andstores data on the ethnic, racial, and sex composition of employees at alljob levels within the reported groups.

Research information thus collected is shared with selectedFederal agencies, such as the Department of Health and Human Services, theDepartment of Labor, and others. It is also made available, in appropriateform, for public use.

The Export-Import Bank of the United States facilitates and aids infinancing exports of U.S. goods and services. The Bank has implemented avariety of programs to meet the needs of the U.S. exporting community.These programs take the form of direct lend ing or the issuance ofguarantees and insurance so that exporters and private banks can extendappropriate financing without taking undue risks.

The Export-Import Bank of Washington was authorized in 1934 as abanking corporation organized under the laws of the District of Columbia

by Executive Order 6581 of February 2, 1934. The Bank was continued as anagency of the United States by ac ts of Congress in 1935, 1937, 1939, and1940. It was made an independent agency of the U.S. Government by theExport-Import Bank Act of 1945 (12 U.S.C. 635), subsequently amended in1947 to reincorporate the Bank under Federal charter. The name was changed to Export-Import Bank of the United States (Eximbank) by the act ofMarch 13, 1968 (12 U.S.C. 635 note).

The principal legislation governing the Bank's operations is theExport-Import Bank Act of 1945, as amended.

The mission of the Bank is to help American exporters meetgovernment-supported competition from other countries and to correctmarket imperfections so that commercial export financing can take place.

The Export-Import Bank will consider aiding in the exportfinancing of U.S. goods and services when there is a reasonable assuranceof repayment. Eximbank is not to compete with private financing, butsupplement it when adequate funds are not av ailable in the privatesector.

Activities

The Bank is authorized to have outstanding at any one timedollar loans, guarantees, and insurance in aggregate amount not in excessof $75 billion. The Bank also is authorized to have a capital stock of $1billion and to borrow from the United States Treasury up to $6 billionoutstanding at any one time. Subsidy costs of the Bank's programs areappropriated on an annual basis.

Eximbank operates a loan program and a guarantee program forboth medium- and long-term export transactions. Both programs, providingup to 85-percent financing, operate on the basis of preliminary and finalcommitments and are open to any respo nsible party. Eximbank loans also

carry the minimum interest rate allowed by the Organization for EconomicCooperation and Development. All fee schedules are based on risk.

Eximbank acts to reduce the risks of buyer default for Americanexporters under a variety of insurance programs. Eximbank's policiesinsure against risks of default in export transactions and are availablein a variety of insurance plans that ar e tailored to the special needs ofdifferent types of exporters and financial institutions.

The Bank's other programs are designed primarily to benefitsmall business exporters, including the Working Capital Guarantee Program,a loan guarantee program designed to provide eligible exporters withaccess to working capital loans from comm ercial lenders. There is also an

Engineering Multiplier Program, which provides financing in support ofproject-related design services or feasibility studies with potential forgenerating further procurement of American exports.

The Farm Credit Administration is responsible for ensuring the safe andsound operation of the banks, associations, affiliated serviceorganizations, and other entities that collectively comprise what is knownas the Farm Credit System, and for protecting the interests of the publicand those who borrow from Farm Credit institutions or invest in FarmCredit securities.

The Farm Credit Administration was established as an independentfinancial regulatory agency in the executive branch of the FederalGovernment by the Farm Credit Act of 1971 (12 U.S.C. 2241 et seq.). The

Administration carries out its responsibi lities by conductingexaminations of the various Farm Credit lending institutions, which areFarm Credit Banks, Banks for Cooperatives, the National Bank forCooperatives, Federal Land Bank Associations, Production CreditAssociations, Agricultural Credit Associations, and Federal Land CreditAssociations. It also examines the service organizations owned by the FarmCredit lending institutions, as well as the National Consumer CooperativeBank (also known as the National Cooperative Bank (NCB)) and its su

bsidiaries, including the NCB Development Corporation.

Management of the agency is vested in the Farm CreditAdministration Board, whose three full-time members are appointed to6-year terms by the President, with the advice and consent of the Senate.One member of the Board is designated by the Pre sident as Chairman andserves as the Administration's chief executive officer. The Board isresponsible for approving rules and regulations, providing for theexamination and regulation of and reporting by Farm Credit institutions,and establishing the po licies under which the Administration operates.Board meetings are regularly held on the second Thursday of the month andare subject to the Government in the Sunshine Act. Public announcements ofthese meetings are published in the Federal Register.

The lending institutions of the Farm Credit System wereestablished to provide adequate and dependable credit and closely relatedservices to farmers, ranchers, and producers or harvesters of aquaticproducts; persons engaged in providing on-the -farm services; ruralhomeowners; and associations of farmers, ranchers, and producers orharvesters of aquatic products, or federations of such associations thatoperate on a cooperative basis and are engaged in marketing, processing,supply, or business service functions for the benefit of their members.Initially capitalized by the United States Government, the Farm Creditlending institutions are organized as cooperatives and are completelyowned by their borrowers. The loan funds provided to borrower s by theseinstitutions are obtained primarily through the sale of securities to

investors in the Nation's capital markets.

The Agricultural Credit Act of 1987, as amended (12 U.S.C.2279aa-1), established the Federal Agricultural Mortgage Corporation(commonly known as ``Farmer Mac''). The Corporation, designated as part ofthe Farm Credit System, is a federally ch artered instrumentality of theUnited States and promotes the development of a secondary market foragricultural real estate and rural housing loans. Farmer Mac also providesguarantees for the timely payment of principal and interest on securities,repre senting interests in or obligations backed by pools of agriculturalreal estate loans. The Administration is responsible for the examinationand regulation of Farmer Mac to ensure the safety and soundness of itsoperations.

The Administration administers regulations under which FarmCredit institutions operate. These regulations implement the Farm CreditAct of 1971, as amended, and have the force and effect of law. Similar toother Federal regulators of financial institutions, the Administration'sauthorities include the power to issue cease-and-desist orders, to levycivil monetary penalties, to remove officers and directors of Farm Creditinstitutions, and to establish financial and operating reporting requirements. Although it is prohibited from participation in routine management oroperations of Farm Credit institutions, the Administration is authorizedto become involved in these institutions' management and operations when

the Farm Credit Act or its regulat ions have been violated, when taking anaction to correct an unsafe or unsound practice, or when assuming a formalconservatorship over an institution.

The Administration does not operate on funds appropriated byCongress. Its income is derived from assessments collected from theinstitutions it regulates and examines. In addition to the headquartersoffice located in McLean, VA, the Administra tion maintains 8 field

offices. They are located in Albany, NY; Aurora, CO; Bloomington, MN;Irving, TX; Marietta, GA; Oklahoma City, OK; Sacramento, CA; and St.Louis, MO.

The Federal Communications Commission regulates interstate and foreign

communications by radio, television, wire, satellite, and cable. It isresponsible for the orderly development and operation of broadcastservices and the provision of rapid, efficient nationwide and worldwidetelephone and telegraph services at reasonable rates. Its responsibilitiesalso include the use of communications for promoting safety of life andproperty and for strengthening the national defense.

The Federal Communications Commission was created by theCommunications Act of 1934 (47 U.S.C. 151 et seq.) to regulate interstateand foreign communications by wire and radio in the public interest. Itwas assigned additional regulatory jurisdi ction under the provisions of

the Communications Satellite Act of 1962 (47 U.S.C. 701-744). The scope ofits regulation includes radio and television broadcasting; telephone,telegraph, and cable television operation; two-way radio and radiooperators; an d satellite communication.

The Commission is composed of five members, who are appointed bythe President with the advice and consent of the Senate. One of themembers is designated by the President as Chairman.

In administering the programs necessary to carry out itsregulatory responsibility, the Commission is assisted by a General Counselwho, in addition to regular duties, represents the Commission before theUnited States Courts of Appeals; a Manag ing Director; a Director ofPublic Affairs; a Director of Legislative Affairs; a Director ofInternational Communications, who ensures that the coordination andintegration of the Commission's international policy activities areuniform and consistent, as sumes the principal role for representing theCommission in international fora, and serves as the general focus forcoordinating and directing international activities; an Inspector General,who is responsible for coordinating and conducting all audits an dinvestigations relating to the programs and operations of the agency; a

Chief Engineer; a Chief of Plans and Policy; and the Chiefs of fivebureaus, to whom certain licensing and grant authority has been delegated.

To assist the Commission in exercising its responsibility in theadjudicatory process, there is a Review Board to review initial decisionsand write decisions and an Adjudication Division in the Office of theGeneral Counsel to assist the Commis sion and individual Commissioners inthe disposition of matters arising in cases of adjudication (as defined inthe Administrative Procedure Act (5 U.S.C. note prec. 551)) that have beendesignated for hearings. There also is a corps of administrative lawjudges, qualified and appointed pursuant to the requirements of theAdministrative Procedure Act, who conduct evidentiary adjudicatoryhearings and write initial decisions.

Activities

Mass Media

The Mass Media Bureau administers the regulatory program for the followingservices: amplitude modulation (AM); frequency modulation (FM);television; low-power TV; translators; instructional TV and relatedbroadcast auxiliary services; and dir ect broadcast satellite. The Bureauissues construction permits, operating licenses, and renewals or transfersof such broadcast licenses except for broadcast auxiliary services. TheBureau also oversees compliance by broadcasters with statutes and Commission policies.

Common Carrier Communications

The Common Carrier Bureau administers the regulatory program forinterstate and international common carrier communications by telephone,telegraph, radio, and satellite. Common carriers include companies,organizations, or i ndividuals providing communications services to thepublic for hire, who must serve all who wish to use them at establishedrates. In providing interstate and foreign communications services, common

carriers may employ landline wire or electrical or optic al cablefacilities, point-to-point microwave radio (signals relayed by stationsspaced at given intervals), land mobile radio (two-way telephone orone-way signaling communications between base and mobile units), cellularsystems, or satellite systems. C ommunications services between the UnitedStates and overseas points by common carriers are provided by ocean cable,high frequency radio, and satellite communications.

Private Radio Communications

The Private Radio Bureau regulates the use of the radio spectrum tofulfill the communications needs of businesses, State and localgovernments, aircraft, ships, and individuals. Over 3 million licenseesuse radio to promote s afety of life and property, to increaseproductivity, and to advance the science of telecommunications. ThePrivate Radio Bureau regulates and licenses two broad groups of radioservices: the land mobile and microwave radio services, and the specialradio services. Land mobile and microwave radio services are used bypublic safety entities (police, fire, local government), industrial

entities (businesses of all types, including public utilities), and landtransportation entities (buses, railroads, taxicab s). Special radioservices include the aviation service, the marine service, the Alaskafixed service, the amateur services, and the personal radio services(citizens' band, radio control, interactive video and data service, andgeneral mobile). While tw o personal radio services, citizens (CB) andradio control (R/C), are regulated, licenses are not required. The Bureaualso implements the compulsory provisions of laws and treaties coveringthe use of radio for the safety of life and property at sea and in theair.

The commercial and amateur radio operator programs are administered by thePrivate Radio Bureau.

Cable Services Communications

The Cable Services Bureau develops, recommends, and administers policiesand programs for the regulation of cable television systems. The Bureauadvises and recommends to the Commission, or acts for the Commission underdeleg ated authority, in matters pertaining to the regulation anddevelopment of cable television.

With its three divisions -- Consumer Protection, Competition,and Policy and Rules -- the Cable Services Bureau has the following dutiesand responsibilities:

-- to investigate complaints and answer general inquiries fromthe public;

-- to plan and develop proposed rulemakings and conductcomprehensive studies and analyses (legal, social, and economic) ofvarious petitions for policy or rule changes;

-- to process applications for authorizations in the cabletelevision relay service;

-- to participate in hearings before Administrative Law Judges,the Review Board, and the Commission;

-- to conduct studies and compile data relating to the cableindustry for the Commission to develop and maintain an adequate regulatory

program;

-- to collaborate and coordinate with State and localauthorities in matters involving cable television systems;

-- to advise and assist the public, other government agencies,and industry groups on cable television regulation and related matters;

-- to oversee the direction of Bureau-wide administrativeprograms, including personnel management and equipment facilities supportservices; and

-- to oversee the development and implementation of Bureau-wide

management programs, including budget estimates and justifications andmanagement analysis studies.

Engineering and Technology

The Office of Engineering and Technology administers the Table ofFrequency Allocations which specifies the frequency ranges that can beutilized by various radio services. The Office also administers theExperimental Radio Serv ice and the Equipment Authorization Program. TheExperimental Radio Service permits the public to experiment with new usesof radio frequencies. This allows development of radio equipment andexploration of new radio techniques prior to licensing under ot herregulatory programs. The Equipment Authorization Program includes several

specific procedures by which the agency approves radio equipment as aprerequisite to importation, marketing, or use. The procedures range fromCommission testing of an equipmen t sample for compliance with applicablestandards, through FCC review of applications and accompanying testreports submitted by the applicants, to a self-authorization procedurewhereby a manufacturer certifies that the product complies with thestandard s.

Compliance

Much of the investigative and enforcement work of the Commission iscarried out by its field staff. The Field Operations Bureau has 6 regionaloffices and 35 field offices. It also operates a nationwide fleet ofmobile radio direction-finding v ehicles for technical enforcementpurposes. The field staff, in effect, are the Commission's ``eyes andears'' in detecting radio violations and enforcing rules and regulations.Continuous surveillance of the radio spectrum is maintained to detectunlicen sed operation and activities or nonconforming transmissions, andto furnish radio bearings on ships and planes in distress. The FieldOperations Bureau also administers public service programs aimed ateducating Commission licensees, industry, and the gen eral public to
