US Supreme Court Rejects Challenge ofColorado Marijuana LawsOn April 4th, the Supreme Courtrejected a conservative challengeto the cannabis legalizationlaws adopted in Colorado andelsewhere that permit adults to buy,or possess one ounce of cannabis.

By a 6-2 vote, the justices turnedaway a lawsuit brought byNebraska and Oklahoma, whosestate attorneys complained thatillegal cannabis was pouringinto their states as a result ofColorado’s liberalized laws.

“The state of Colorado authorizes,oversees, protects and profitsfrom a sprawling $100-million-per-month cannabis growing,processing and retailingorganization that exportedthousands of pounds of cannabisto some 36 states in 2014,” theysaid. “If this entity were basedsouth of our border, the federalgovernment would prosecute it asa drug cartel.”

They argued that Colorado’s lawviolates the federal ControlledSubstances Act, which treatscannabis as a dangerous drugand forbids its sale or use. Theprosecuting states urged theSupreme Court to take up theissue as an “original” matter anddeclare that Colorado’s law waspreempted by the federal drug laws.

Usually, the high court hearsappeals from lower-court rulings.But on rare occasions, the justices

are called upon to decide disputesbetween states. Typically, however,these “original” suits involvedisagreements over boundariesor the use of river water that flowsfrom one state to another.

The suit brought by Nebraskaand Oklahoma also implicitlychallenged the Obamaadministration for its refusal tointervene more directly in Colorado.

Since California’s voters in1996 authorized medical use

of cannabis, 22 other stateshave adopted similar measures.Colorado, Washington, Oregonand Alaska went further andallowed for the production and saleof cannabis for recreational use.

Supporters of the laws praisedthe court’s decision. “This is goodnews for legalization supporters,”said Tom Angell, chairman ofcannabis Majority. “This case, if itwent forward and the court ruled

the wrong way, had the potentialto roll back many of the gains ourmovement has achieved to date.”Faced with this state-by-staterebellion against an unchangingfederal drug law, the JusticeDepartment issued guidancetelling prosecutors to focus on“significant traffickers of illegaldrugs,” not on users of medicalcannabis.

Last year, the justices asked U.S.Solicitor Gen. Donald Verrilli toweigh in on the interstate legalbattle over cannabis, and inDecember, he urged the court toturn away the lawsuit. Nebraskaand Oklahoma have not suffered a“direct injury” from their neighborto the West, he said, and theyremain free to vigorously policecannabis in their states.

In response, the Nebraska andOklahoma state attorneys saidthe Justice Department has“turned its back” on enforcing

the federal law and is permittingit to be “dismantled by piecemealnullification.”

Justices Clarence Thomas andSamuel A. Alito Jr. dissentedMonday. “The plaintiff states havealleged significant harms to theirsovereign interests caused byanother state,” Thomas wrote. “Weshould let this complaint proceedfurther rather than denying leavewithout so much as a word ofexplanation.”

Cannabis Social ClubShut Down in Colorado Sprin

The Colorado Springs City Council voted 6-3 to bancannabis clubs in Colorado Springs. This means clubs willhave until 2024 to completely phase out. The ordinanceprohibits the opening of any Marijuana Consumption Club- defined as “an establishment, organization, association,club, teapad, or other similar entity or place where apurpose is to allow the consumption of marijuana, medicalmarijuana or marijuana product on the premises” - but isletting some clubs stay open.

There are approximately 15 existing clubs and of thoseonly facilities “lawfully operating” prior to the moratoriumbeginning September 22, 2015 will be grandfathered in.The compliant clubs will have to apply for licenses fromthe city and comply with a new set of zoning rules. These

guidelines include a mandatory ventilation ansystem, no sales, trades, reimbursements, eunder 21 is allowed entry, no on-site cultivatioclubs must remain out of operation between 7 a.m. The licensed clubs will then be forced todoors in March 2024.

There are currently two campaigns currently unundo this ordinance. A lawsuit has been filed incourt by nine companies and 14 individuals. Ta petition to force a referendum, which is essappeal to the Council to repeal the ban. If Counit will be sent to a public vote in a special elegroup spearheading this endeavor must colvalid signatures by April 21.

This is by far the strongest candy bar I’ve ever had. Ever ! Which isnot necessarily a bad thing. But if you’re new to edibles, it would bewise to avoid this specific bar like a plague. You don’t want to startwith a bad experience. If you have ample experience medicatingwith edibles, and have an idea of how much cannabis you cantolerate, then this bar is fantastic.

The bar comes very attractively wrapped. Well, because it lookslike money. It’s a very playful way of letting the consumer knowwhat to expect from ingesting it. The pertinent information is clearlyvisible. As someone who’s had their share of products with downto business medically astute packaging, it’s nice to see companiesgive you the same information in a more esthetically pleasing way.

With edibles this strong, I usually find it difficult to measure outhow much to eat consistently. Some bites seem to kick harderthan others from day-to-day. But with this 1000mg bar, it’s beenincredibly consistent. I know that I need between 20-30mg to get agood night sleep, and with this bar, I can calculate fairly consistentlyhow much to eat every night.

In2002, around February-March, he hadan extremely dark moment that involvesholding a 9mm pistol on the kitchen floorof his home, and considering suicide.He had just sold his tech companySeptember 1st, 2001, and 10 days later 9of his friends (3 of whom he lived with)died in the World Trade Center attacks.He was heading to New York on the trainwhen the tragedies occurred. He softlyrecollected, “Candidly, I should have been

there with them. I chickened out. I didn’twant to live in New York. I didn’t want tobe a Wall Street finance guy. I wanted tobe an entrepreneur and work for myself.”

“The world as I knew it was over. I thoughtmy life was going to be carefree. Nowthere were 7 women without husbands,and 11 children without fathers,” Tripp said.

Fast forward a few months later, “Mywife was in love with another man. Thatjust shook me to my core. I was alreadydealing with more emotion than anyperson should have to. I had no escape,living in a state where I knew no one, otherthan his soon to be ex-wife and children.”

Tripp acknowledges that with how he wasfeeling at the time, a gun should neverhave been in the mix. He was ashamedabout that moment for years. Even thoughhe describes himself as a coward in thatmoment, he takes suicide seriously andsays of others going through depression,“You don’t know what that person is goingthrough.”

He picked himself up and moved on,while supressing his feelings with drugsand alcohol. He says that it was risky forhim to admit that to a crowd of 6,000,at the conference where he first told thecautionary tale. There’s a perception ofTripp being a “Willy Wonka of Weed”type character, where he is perceived asinvincible and infallible, while he says thatis just not the case.

Tripp's younger brother, a cannabisenthusiast introduced him to cannabis.Since his brother managed to stay out oftrouble, and it was then Tripp figured thatmaybe his little brother was smarter thanhe was.

“Alcohol is a depressant. I had a prettyhealthy relationship with alcohol, I getangry, those emotions are generallydeep seeded or from your childhoodor whatever pisses you off. It’s easierto control when under the influence ofcannabis as opposed to alcohol or Godforbid some stronger drug. I use marijuanatoday to control my emotions. If anyone isever on that floor, [they can look at me

and say] if that turkey can do it, so can I!,”Tripp said.

The experience that he shared is onethat many can relate to, and it certainlyhumanizes the persona the public knowshim as. Last year, Tripp and Dixie werefeatured as part of the cast of Pot Barons,a cable television show about the legalemerging cannabis industry in Colorado.Not only was it a risky proposition to airtheir operation on national television,Tripp was terrified they were going toname the series “Marijuana Morons” andcast him as the lead.

was to be involved in the series, andsays that it was incredibly rewarding toreach a demographic that was probablynot acutely aware of what is going on incannabis.

However, Tripp confided to me that hisdad said, “What are you some kind ofasshole? Every Time they show you,you’re drinking Tequila and smokingcigars!”

While some acting and editing may havebeen involved, Tripp says, “Doesn’t meanwe weren’t silly on occasion! Neverthelessresponsible journalist that took trueinterest, Jerry Cohen, was passionateabout this plant, wanting to present it inthe most positive light.”

Pot Barons portrayed some of theaftermath of 2014’s Colorado regulationchanges. With California being the world’s 8thlargest economy on the planet, Trippoptimistically thinks that California willlearn from Colorado and potentiallydo a better job. “Stealing from one isplagiarism, borrowing from many isresearch. Hopefully they use only the bestaspects from each state. When you’refirst you don’t have that luxury. It’s scaryto be a pioneer,“ Tripp said.

When asked how special interest mayplay a role in California’s regulations,Tripp said, “Cannabis has become bigbusiness. There are a lot of peoplepulling in multiple directions. I’m proudof Colorado. But it will not be like thefirst time. People will probably unfairlyprofit initially. Regardless, we are makingprogress, with a plant that’s been marredby black market stigma.”

I get calls from various start upcompanies asking me how theycan keep their label “clean” andensure that their product has nopreservatives, is all natural and usesfresh local ingredients—oh and theyalso want it to be affordable andshelf stable too!

Everyone wants their product to hitall the current trend buttons (natural,clean label, locally sourced, GMOFree, Organic) - but sometimes youhave to compromise in order to ensurethat you are creating somethingthat is both safe and affordable. Italso helps to understand that justbecause something sounds like it is

not natural, doesn’t mean that it isn’t!Let's begin with mold inhibitors. Ifyou are a baked goods manufacturerand plan to last on the shelf, yourproducts will need to containsomething to keep the fuzzy stuffoff your brownies. Luckily, thereare a wide variety of both naturaland synthetic solutions. Potassiumsorbate for example is a great yeastand mold inhibitor that is inexpensiveand works in a wide variety of pH’sand food bases. This is not one ofthe natural choices, but it does the

job! Sodium benzoate is also cheap,synthetic and keeps the bad bacteriaat bay! As a more natural optioncalled cultured dextrose (sold locallyby Mezonni Foods), is a cleaner

label bacteria inhibitor that is createdvia fermentation of milk and sugarwith probiotic organisms and worksin a wide variety of applications likesalad dressings and cured meats,soups and dairy products. It will bepricier than the synthetic options,but allows you to maintain a “natural”statement on your label (assumingall other ingredients are naturalas well). Of course, it is always anoption to cook you product. Cannedfoods and jarred shelf stablesauces often just rely on heat asthe preservation method. However.any thermal process would have tobe approved by the FDA and localhealth inspector. Another option forpreservation salt or sugar, thesealso inhibit bacteria by lowering the

water activity of the product.

What about avorings? No one inthe specialty food industry wants toput articial avor in their productsand that is understandable, but keepin mind natural avors are moreexpensive and less concentratedthan articial, so to get the desiredavor impact you will have to use moreof them. For instance, if you wantedto avor a lemon cake, you may onlyneed .2% articial avoring, but itwill take 2 to 3% to achieve the sameeffect using natural avors. So, whatcan you do? The answer is WONF(with other natural avors), a specicblend of avors similar to what youare looking for, but at a slightlylower cost. Also, be sure to talk to
