Whereas Sh. Abbul Husain, the then Prinicipal, GETTI Ferozpur Namak (Mewat) nowposted at Govt. Girls Sr. Sec. School Punhana (Mewat) was charge sheeted under rule-7 ofHaryana Civil Services (P&A) Rule 1987 vide order No. 5/58-10 HRG-I (1) dated 18.08.2010,where in the following charges were leveled against him:-

Whereas Sh. Abbul Husain submitted his reply to the charge sheet on 13.09.2010and refutted all the charges levelled against him, but his reply was not found satisfactory.Therefore, Sh. V.P. Batra, IAS (Retd) was appointed as an Inquiry Officer. The InquiryOfficer submitted his report on 03.06.2011 concluding that the charges against Sh. AbbulHusain have not been substantiated except ingredients (iii) (iv) & (v). Accordingly, inpursuance of Rule 7(6) of Haryana Civil Services (Punishment and Appeal) Rules, 1987,after disagreeing with inquiry report, a copy of dissenting note was sent to the saidemployee for making representation, if any, within a period of one month vide letter dated21.09.2011. Representation regarding dissenting note was received on 05.12.2011.

After careful consideration of the charge sheet, enquiry report and representationsubmitted regarding dissenting note, it does not seem to be a case of imposing any majorpenalty. I do feel that punishment of "censure" for his conduct is sufficient to meet the endof justice.

Shri Balwan Singh, Principal, Govt. Senior Secondary School Kuttabadh(Sirsa) was chargesheeted vide order No. 5/64-2009-HRG-I(1)/2064 dated06.09.2010 under Rule 7 of Haryana Civil Services (Punishment and Appeal)Rules, 1987 on the following charges: -

That according to report of District Education Officer, Sirsa, ShriBalwan Singh ahs misappropriated school fund amounting toRs.4,08,000/- and has not furnished the details of expendituresamounting to Rs.3,27,000/- incurred by him.That Shri Balwan Singh took on rent 100 thalis for the children undermid-day meal scheme at double the rent without any quotation in thisbehalf. Moreover, he paid rent for 150 thalis on double rate.That Shri Balwan Singh despite there being ban on guest teacherappointed Smt. Surminder Kaur as Science Teacher on guest facultybasis on 19.08.2008.That Shri Balwan Singh has shown himself on duty on 05.11.2007,10.01.2008, 11.01.2008, 07.04.2008, 19.05.2008, 26.05.2008,02.08.2008, 27.04.2009, 30.04.2009 and 29.05.2009 for attendingmeeting of District Education Officer. Some of the columns ofattendance register were blank.That Shri Balwan Singh was found absent from the school duty on04.05.2009, 05.05.2009, 14.05.2009, 15.05.2009, 18.05.2009 to28.05.2009, 27.07.2009, 28.07.2009 to 29.07.2009 in surprisechecking by the District Education Officer.That Shri Balwan Singh has signed blank school leaving certificate ofMiddle Section (6-8) from Serial No. 660590 to 660592 and in SeniorSecondary Section (+1 and +2) from Serial No. 607806 and 607807and has signed in advance. This shows he was not regular inattendance.That Shri Balwan Singh has issued unsigned office order dated30.11.2007, 02.02.2008, 02.04.2008, 01.07.2008, 10.03.2009,02.04.2009 and 04.04.2009. It is clear from these facts that he wasnot present in the school on these dates otherwise he could havesigned these orders.That Shri Balwan Singh found office order issued by some otherteachers in the order book on 02.04.2008, 12.03.2009 and08.04.2009 whereas no other teacher is authorized to issue order inthe order book. It makes clear that he was not in the school on thesedates.

He replied to the said chargesheet on 27.12.2010 and finding the sameas unsatisfactory, Shri R. C. Sharma, HCS (Retd.) was appointed as regularinquiry officer vide order dated 04.04.2011 who vide his report dated29.09.2011 has proved the charges to the extent that the incumbent neitherhas not shown any proof nor given any account of the money withdrawn fromschool funds. Moreover, it is clear from the reply of the chargesheet thatappointment of Smt. Surminder Kaur, Science Teacher (Guest Faculty) hasbeen made inspite of the fact that result of her B.Ed. examinations was notdeclared. Thereafter, after agreeing with the report of regular enquiry officer, acommunication alongwith the copy of the enquiry report was sent to the saidincumbent on 16.11.2011 to submit representation within one month. The saidincumbent has sent his representation dated 19.12.2011, in which hesubmitted that all the allegations levelled against him were vague andambiguous. He also submitted that the proceedings have been taken out ex-parte. He stated that maintenance of cash book, to keep the vouchers in propercustody and to keep the proper account of muster roll payment was theexclusive responsibility of the dealing assistant and he prayed that he hasbecome a victim of circumstances created by the dealing assistant of theschool. He further stated that the appointment of Science Teacher on guest

faculty basis, despite the ban, has been made as directed verbally by DistrictEducation Officer Sirsa. He cited various Apex Court and Punjab and HaryanaHigh Court rulings in his representation.

I have gone through the chargesheet, reply thereof, report of regularinquiry officer, representation of the incumbent in consequence thereof,submissions made therein various ruling quoted therein and connectedprovisions of Haryana Civil Services (Punishment and Appeal) Rules, 1987. It isclear that enquiry officer has proved all the charges against the incumbent.Further, the said incumbent cannot throw the responsibility of maintenance ofcash book, to keep the vouchers in proper custody and to keep the properaccount of muster roll payment upon the dealing assistant exclusively. Beingsupervisory officer, the incumbent is primarily responsible to keep properaccounting procedure as prescribed in financial rules. Appointment of guestteacher as science master inspite of specific ban reflects upon the integrity ofthe incumbent.

Taking an overall view of the matter, a penalty of stoppage of two gradeincrements with cumulative effect is inflicted upon Shri Balwan Singh,Principal, Govt. Senior Secondary School Kuttabadh (Sirsa) as provided in Rule4(i)(v-A) of Haryana Civil Services (Punishment and Appeal) Rules, 1987.
