Reason and purpose of adoption

REASON• Harmonization of legislation of the Republic of

Serbia with the IPPC Directive 96/61/ЕЕC

PURPOSE• prevent and reduce emissions pollution

substances into the environment • achieve the high level of prevention of the

environment • minimize use of raw and energy• simple control and strengthen the role of

inspection

Obligations and responsibilities

• Issue permit for one or more installation operated by the same operator

Operator obligations and responsibilities

Apply for permit/ reconsideration of issued permit

Act in compliance with conditions set by the permit Submit results to the competent authority Inform the competent authority about all changes in

operation, namely functioning of installation or an accident

Submit to the competent authority the annual report on execution of the activities

Inform the competent authority on planned change of operator

• For certain activities, BAT will apply on the basis of the special technical guides

I. Capacity Building Programme

• Capacity building for the environmental administration (state and local level) is a priority area.– An ambitions CB program, comprising

environmental administration of the Republic of Serbia, the Authonomous Province of Vojvodina and almoust 40 municipalities has been realized – 21-25 May 2005. in Novi Sad

• The CBP was designed on the pilot case scheme.

The first National BERCEN training-Minimum criteria….• in the Republic of Serbia on three levels

(republic, autonomous and municipal) work about 200 inspectors, it is necessary to train all inspectors according to the program of First national BERCEN seminar. – On the First national BERCEN seminar there were

33 participants present – 18 republic inspectors from Serbia and Montenegro, employees from other sectors of the Ministry for the Protection of Natural Resources and Environment and 6 inspectors from Autonomous province of Vojvodina.

The first National BERCEN training-Minimum criteria….

1. Recommendation of participants is to start the implementation of PROPOSAL OF EUROPEAN PARLIAMENT AND COUNCIL OF EUROPE – Minimal requests for inspection control of environmental protection in the regular work of republic inspection. The basis will be the check lists prepared for inspection oversight in Thermal-electric Plant Obrenovac, inspection oversight in the field and prepared reports on First national BERCEN seminar.

II. Development of BAT Guidance

• Pilot-projects in different kind of industries to know-how to make the platform for definition BAT standard

• Obligation of state to supply actual data and information about development of BAT in the world, for 31 kind of industrial activities

• In the process of translation BAT standard documents

Problems and Obstacles• Decentralization will slow implementation process

Municipalities are entitled to issue IPPC permitsRepublic level administration is responsible only for capital investment

• Capacity building – lack of number and educated stuff (Permiters do not have technical education or background)

• Isolation period – Out-dated or partly out-dated technology in existing IPPC installations

• Tremendous needs of investment in BAT• Not enough accreditation laboratories for measuring

emissions• the lack of resources for translation and adoption into

Serbian of BAT documents• limited capacity and resources for participation of industry

experts, state institutions in development of BAT documents
