EASA Technical Opinion
Published on 18 December 2015
Propose an operation centric concept in three categories:
“Open Category”
“Specific Category”
“Certified Category”
Developed in parallel with the change to the Basic Regulation
23/06/2016 EASA "Prototype" Rules and European approach drones - 20/06/16 4
Categories of Operation
OPEN:
Low risk
Competent Authority notified by
Member States; no-pre approval
envisaged
Limitations ( 25 kg; Visual line of sight (VLOS), Maximum Altitude, no
drone zones, limited drone zones)
Rules: no flight over crowds, pilot competence
Use of technology
Sub-categories including harmlesss
SPECIFIC
Increased risk
Approval based on Specific
Operation Risk assessment (SORA)
Standard scenarios
Approved by NAA possibly supported by accredited QE unless
approved operator with privilege
Manual of Operations mandatory to
obtain approval
A risk assessment approach allow to take into account new technologies
and operations
CERTIFIED
Regulatory regime similar to
manned aviation
Certified operations to be defined by
implementing rules
Pending criteria definition, EASA accepts application in its present
remit
Some systems (Datalink, Detect and Avoid, …) may receive an
independent approval

Prototype Rule Open & Specific Category
23/06/2016 6
EASA has committed to produce “prototype” rules by end of July:
Open Category
Specific Category
Proposals are tentative and will be presented to generate a debate
Scope:
Open: Operation of Unmanned Aircraft with an MTOM below 25 kg;
maximum height of 150 m and remaining visual line of sight, in areas
operation is permitted.
Specific: outside this limitation and not defined as certified

Definitions
Registration: Member States to set-up system in accordance with
high level requirement (e.g. contents, interoperability)
Geo-fencing: Member States to define areas with
limitations/authorisations in accordance with high level
requirements (e.g. format, interoperability)
Reporting: need to be proportionate and practical

Operational Rules Open Category
Pilot competence:
Competencies, learning objectives for safety, but no licence
Competencies learning objectives for security and privacy to be defined by Member States
Product conformity assessment and market oversight process and applicable
existing product directives
Essential product requirements Open Category including identification and geo
limitation
Procedures for Authorities
EASA "Prototype" Rules and European approach drones - 20/06/16
The approach for Open category
No authorisation required from aviation authorities
"Buy and Fly"
Safety is ensured through
Operations limitations and rules,
Maximum altitude and distance (VLOS),
no fly over crowd, safety distance, etc.
Pilot competence (e-learning)
Compliance with product requirements
limiting the performance of the drone (incl. mass),
imposing specific functionalities to reduce risks
(identification, geo-fencing, etc)
Awareness raising
Promote knowledge of the rules
Efficient enforcement
mandatory registration
