    Dear Sir(s),

    Online Tenders are hereby invited by Director, Indian Institute Of Soil & Water Conservation,Dehradun on behalf of Secretary, Indian Council of Agricultural Research (ICAR), New Delhi for“Outsourcing of Contractual manpower to carry out office and agriculture relatedexperimental/field/farm activities” at INDIAN INSTITUTE OF SOIL & WATERCONSERVATION, RESEARCH CENTRE, Fernhill, Udhagamandalam as per scope ofwork for a period of one year which is extendable further one/more year subject tosatisfactory performance of the services and on mutual consent.

    1. The terms and conditions of the contract are those contained in the general conditions ofcontract applicable to the contracts placed by the IISWC as detailed in the tender forms and itsschedules. Please submit your rates in the tenders form if you are in a position to furnish therequisite services in accordance with the requirements stated in the scope of work.

    2. Each bidder should submit only one bid for this tender.

    3. The firm to whom contract will be awarded shall not transfer or sub-let the contract toother firm at any stage of contract.

    4. An Earnest Money Deposit (EMD) of Rs. 60,000/- (Rupees Sixty Thousand) only must bedeposited in the form of demand draft/pay order payable to “ICAR (Unit) CSWCRTI,Udhagamandalam” and a scanned copy of the same submitted alongwith Technical Bid.

    5. The original demand draft of EMD and Undertaking in Annexure-V only is to besubmitted in a sealed cover envelope superscribing “Technical Bid document of the E-Tender Bid of Outsourcing of contractual Manpower at ICAR (Unit), Udhagamandalam”by hand/speed/registered post to this office on or before schedule date and time of submissionof bid failing which the bid shall be treated as unresponsive and rejected. All otherdocuments should be scanned and uploaded alongwith Tender Bid.

  • 6. The EMD of unsuccessful bidder shall be returned on receipt of written request. In case thesuccessful bidder does not accept the offer, the EMD shall be forfeited. No interest on EMDshall be paid by the Institute to any bidder.

    7. Conditional bids shall not be considered. No overwriting or cutting is permitted in the tenderdocuments. Such bids will be out rightly rejected.

    8. The Tenderer is being permitted to give Tenders in consideration of the stipulations on his partthat after submitting his Tenders, he will not resile from his offer or modify the terms andconditions thereof. If the Tenderer fails to observe and comply with the foregoing stipulationsthe amount of EMD will be forfeited. In the event of the offer made by the tenderer not beingaccepted, the amount of EMD will be refunded to him after he has applied for the same in themanner prescribed by the IISWC.

    9. All Annexure/supporting document and tender form must have contain the seal of the firm andsignature of the authorized signatory.

    10. Tenders are liable to be ignored if complete information as required is not given therein or if theparticulars asked for in the schedules to the tenders are not fully filled in.

    11. The bidder must have successfully executed/completed similar service contract of“Supply of contractual manpower” during last three years as per details givenhereunder and shall compulsorily submit supporting documents in support of his claim:-

    a. Three similar completed service costing not less than Rs 6.40 lakhs each ORb. Two similar completed services costing not less than Rs 08.00 lakhs each ORc. One similar completed service costing not less than Rs.12.80 lakhs.

    12. If a tenderer does not accept the offer, after issue of letter of award by IISWC within 15 (fifteen)days, the offer shall be treated as deemed to be cancelled without any notice & earnest moneyshall be forfeited.

    13. In case of partnership firms, where no authority has been given to any partner to execute thecontract/ agreement concerning the business of the partnership, the tenders and all otherrelated document must be signed by every partner of the firm. A person signing the tender formor any other documents forming part of the contract on behalf of another shall be deemed towarranty that he has authority to do the same and if, on enquiry it appears that the persons sosigning had no authority to do so, the IISWC shall without prejudice to other civil and criminalremedies cancel the contract and hold the signatory liable for all costs and damages.

    14. The rates quoted by each firm for job/service contract in tenders be given both in words andfigure failing which the same is liable to be rejected. Tenders will be opened online by theauthorized officers. Bidders have two options to participate in tendering process at the time ofopening of Bids. Bidders can come at the place of opening of bids (electronically) as done inthe conventional tender process or he can visualize the process online without physically beingpresent at IISWC.

    15. The name and address of the representative who would be attending the meeting of openingof the tenders on the behalf of the firm should be indicated in the tender. Name and address ofpermanent representative of the tenderer, if any, may also be indicated.

    16. 10% of the total value of the contract Performance Security Deposit only in the shape ofdemand draft in favour of “ICAR (Unit) CSWCRTI, Udhagamandalam”is to be depositedby the selected agency/ successful tenderer only after receiving a communication from theICAR - IISWC. In the event of non-deposition of the same, the earnest money will be forfeitedand contract shall be cancelled. The performance security shall be returned to the firm after

  • completion of contract period (including extendable period, if any) + 60 days. No interest onperformance security deposit and earnest money deposit shall be paid by the IISWC to thetenderer.

    17. The Contractor shall be reimbursed minimum wages fixed and revised by theState/Central Govt. (whichever is higher) for agriculture sector from time to time for thefollowing category of works/job alongwith all statutory payments like EPF, ESI etc. andGST/TDS/taxes thereon as per prevailing rates for each manpower deployed for the workin addition to service charge quoted by the firm in its financial bid.

    18. The details of works/jobs to be attended by contractual work will be mentioned inthe work order to be issued by the Institute on quarterly/monthly basis as perrequirement.

    19. Firm have to quote only the Service Charges per person per month in Rupees to be leviedby them for providing the services in the prescribed financial bid format (BOQ). Thecriteria for selection for firm shall be the lowest (L-1) service charge quoted by the firm.In case of more than one successful lowest bidders (L-1), the criteria for selection shallbe the highest turn over during the last 03 years put together. In case more than one bidhaving the same turn over, then the selection criteria shall be the maximum experience ingovernment department.

    20. The firm shall make payment of above amount to the concerned contractual manpowerand deposit all statutory payments paid by the Institute to the firm to the concernedauthority without fail.

    21. The Contractor shall abide by all the laws of land including labour laws, PF, Income Tax, GST,ESI or any other extra taxes levied by Govt., welfare measure of its employees and all otherobligation that is being instructed in such cases and are not essentially enumerated anddefined herein. Any such bounded duty shall be the exclusive responsibility of the serviceprovider and it shall not involve Head,ICAR-IISWC, Udhagamandalam in anyway whatsoever.Compliance of these provisions shall be ensured at the times of making monthly payments.

    22. Firm will not charge placement charges or any other account from the manpower deployed withthe IISWC. The contract is liable to be terminated, security deposit forfeited and theContractor/Firm will be blacklisted if, at a later stage, reports are received that theContractor/Contracting Firm has charged the manpower on such account.

    23. In accordance with O.M. No. 29(1)/2014-PPD dated 28.01.2014 of Department of Expenditure,Ministry of Finance, bids quoting “Nil‟ consideration/service charges shall be treated asunresponsive and will not be considered. The rates quoted for service charges Rs.1 or lessthan Re.1/- (one) shall also be treated as Nil.

    24. The firm shall make the wages to the deployed contractual manpower before 7th of everyfollowing month through NEFT/RTGS. After payment of wages, the Contractor shall raisethe monthly bill for reimbursement of payment alongwith a copy of NEFT/RTGS throughwhich wages are deposited into the bank account of deployed manpower, copy ofElectronic Challan Receipt of EPF and ESI contribution deposited by the firm in respectof each deployed manpower as well as copy of GST challan etc. deposited by theContractor/Agency to the concerned authorities. The payment shall be released only afterreceipt of above documents alongwith bill.

    25. The areas of minimum wages as and when due on issue of orders of revision ofminimum wages by the appropriate authority shall be paid by the firm in the bankaccount of concerned manpower through NEFT/RTGS and thereafter charge it in thesubsequent bill alongwith proof of payment to the manpower and other charges of EPF,ESI etc.

  • 26. Decision of the Head, IISWC, Udhagamandalam shall be final for any aspect of the contractand binding to all parties. Disputes arising, if any, on the contract will be settled at his level bymutual consultation and in case of failure in settlement dispute shall be referred to the solearbitrator to be appointed by the Head, ICAR-IISWC, Udhagamandalam. The decision of thesole arbitrator so appointed shall be final and binding on the parties. Arbitration proceedingshall be governed by the Arbitration & Conciliation Act, 1996 as amended from time to time.

    27. Acceptance of offer of successful bidder by the Institute will be communicated byfax/speed/registered post or any other form of communication.

    28. Head, ICAR-IISWC, Udhagamandalam reserves the right to accept or reject any or alltenders and to modify the terms and conditions of the contract as mentioned in this tenderdocument, at its discretion, in the interest of the job work/public interest.

    29. Successful Bidder/tenderer will have to enter into a detailed contract agreement with IISWC onnon- judicial stamp paper of Rs. 100/- (One hundred only) for work as per the specimenattached with the tender document.

    30. All disputed shall be within the jurisdiction of Udhagamandalam Court.31. The following document/vouchers are essentially required to be uploaded alongwith

    the Technical Bid in following manner:-i. Scanned copy of complete set of tender document duly affix seal of the firm and signature of

    authorized signatory.ii. Scanned copy of Earnest Money Deposit (EMD)iii. Scanned copies of Income Tax Registration (PAN Card), GST Registration Certificates.iv. Scanned copies of valid EPF and ESI Registration Certificate(s) issued by the appropriate

    authority.v. Scanned copy of valid Licence under the Contract Labour (Registration & Abolition) Act,

    1970.vi. Scanned copy of valid registration certificate issued by NSIC/MSME, if applicable for

    exemption of EMD.vii. Scanned copy of Annexure-IV duly completed in all respect.viii. An Undertaking (Annexure-V) as per attached Format duly attested by Notary on a non-

    judicial stamp paper of value of Rs.100/- (Rupees One Hundred Only) regarding their non-blacklisting by any of the Govt. Departments, Public Sector Undertakings and/or by CentralVigilance Commission during the last three years and there is no legal/criminal pending orcontemplated against firm.

    ix. Scanned copy of Technical bid format duly filled in all respect in Annexure-VI-Part-A.x. Scanned copies of proofs in support of minimum last three year's continuous experience of

    the firm in the field of supplying contractual manpower in Central Govt. establishments/autonomous bodies/corporations / reputed public or private organizations, with all details inAnnexure-VI-Part-B in chronological order and scanned copies of the certificate/workorders etc. issued by the organizations where the tenderer has provided the services duringlast three years.

    xi. Scanned copy of Audited Balance Sheet of the firm for last 3 (three) financial years 2016-17,2017-18 & 2018-19) by the Chartered Accountant.

    xii. Scanned copy of bank account details/First page of Bank Passbook containing all details ofthe firm, account number etc.

    xiii. Scanned copy of an authority letter for seeking reference from the bidder’s bankers, ifrequired.

    32. The firm shall submit the hard copy (original document) of only Demand Draft ofEMD (Sl.No.31.ii) and Undertaking (31.x) to the Institute in a sealed coverenvelope superscribing “Documents of E-tender regarding Hiring of ContractualManpower” by hand/speed/registered post on or before the last date and time ofsubmission of tender bid failing which the bidding shall be treated andunresponsive and rejected.

  • LIQUIDATED DAMAGES CLAUSES : -1. In case of non-satisfactory work noticed by the Competent Authority, IISWC, an amount

    equivalent to the total amount payable on account of concerned contractual manpower(s) ofthat particular day/month will be levied as liquidated damages apart from penalty as decidedby the Head, IISWC, Udhagamandalam.

    2. Any misconduct/misbehavior on the part of the manpower deployed by the agency will not betolerated and such persons will have to be replaced immediately.

    Notwithstanding anything above, the Head, IISWC, Udhagamandalam reserves the right toaccepted or reject any or all tenders in whole or in part without assigning reasons therefore.The decision of Head, IISWC, Udhagamandalam shall be final and binding on thecontractor/agency in respect of any clause covered under the Contract.

    General Terms & Conditions

    Besides the terms & conditions mentioned in Annexure-II, the contract shall be further governedwith the following terms & conditions:-

    1. The present requirement of contractual manpower is given in Annexure-I, which can beincreased or decreased. The actual requirement will be communicated to the firm onmonthly/quarterly/six monthly/annual basis as per requirement in due course of time.

    2. The selected agency shall provide efficient manpower for the work as per the charter of dutyand terms and conditions mentioned in the tender document or assigned by the competentauthority during contract period.

    3. The agency shall employ good, reliable & robust contractual manpower and of clean recordto carry out the job contract. In case any of the contractual manpower so engaged by theagency is not found suitable by the IISWC, the IISWC shall have the right to ask for itsreplacement without giving any reason thereof and the agency shall on receipt of oral orwritten communication in this regard will have to replace such persons immediately.

    4. All the contractual manpower deployed will perform their duty in proper office decorum andwill maintain a smart turn out. The agency shall, at its own cost, provide identity cards to thecontractual manpower.

    5. The Agency shall provide name and mobile number of its authorized representative forcommunication for contract related complaints at any time of work.

    6. The deployed contractual manpower shall be strictly punctual while reporting for duty andattend office as per prescribed office timing of IISWC.

    7. The agency shall employ reliable persons with good physique and health in the age groupof 21 to 50 years. As and when it is felt that there is a requirement of retired personshaving experience in the job specified in Scope of work in ICAR Institutes/State AgriculturalUniversities, such demand shall be raised in quarterly work order specifying actual demand.In cases of retired employees EPF and ESI shall not be paid by the Institute.

    8. The agency to whom work is awarded shall maintain attendance register of contractualmanpower and submit its bill for each manpower as per actual number of attendance in eachmonth.

    9. The manpower provided shall maintain secrecy and discipline in the premises of IISWC. Theattire of the manpower should be formal and decent and not in violation of office decorum.Any deviation will be viewed seriously and liable to penalty as deemed fit by the Institute.

    10. Contractor shall keep a complaint register with his representative, and it shall be open toverification by the authorized officer of IISWC for the purpose. All complaints should beimmediately attended to by the Agency.

    11. Contractor or his workers shall not misuse the premises allotted to them for any purposeother than for which the contract is awarded.

    12. Contractor shall replace immediately any of its contractual manpower who is foundunacceptable to IISWC because of conflict of interest, incompetence, improper conduct etc.upon receiving a notice from IISWC.

  • 13. No association/trade union activities will be allowed by the manpower supplied by theagency.

    14. The contract is terminable with one month notice from Institute side. If the contractor wantsto terminate the contract voluntarily or otherwise, it may require to give a notice of atleastthree months failing which the amount of performance security deposit including any otherdues arises for making alternate arrangement till the new contract is assigned to the otherparty will be recovered from the contractor.

    15. The contractual manpower deployed by the contractor shall not be entitled to and have noclaim for any absorption in the regular/otherwise capacity in Institute as the contract is purelyon job contract.

    16. The monthly attendance sheet of all the contractual manpower should be attached by thecontractor with its monthly bill.

    17. In case service provider fails to make any statutory payment or wages to the contractualmanpower, the IISWC shall have the right to realize this amount from the performancesecurity deposit/monthly payable amount to the Contractor and deposit to the concernedauthorities or to the concerned contractual manpower.

    18. The contractual manpower so provided by the agency under this contract will not be theemployees of the Institute and there will be no employer-employee relationship between theInstitute and the persons so engaged by the contractor in the aforesaid services. They shallbe employees of the contractor for all purposes.

    19. The contractor will discharge all his legal obligations in respect of the workers/ supervisors tobe employed/deployed by him for the execution of the work in respect of their wages andservice conditions and shall also comply with all the rules and regulations, provisions of lawin force that may be applicable to them from time to time.

    20. The contractor shall indemnify and keep indemnified the Institute from any claims, loss ordamages that may be caused to it on account of any failure to comply with the obligationsunder various laws. In case of any dispute, the decision of the Head, IISWC,Udhagamandalam shall be final and binding on the contractor.

    21. Income tax/TDS in respect of contractor will be deducted as per rules/rates applicable fromtime to time from the monthly bill raised by the firm.

    22. IISWC reserves the right to discontinue the contract at any time, if the services are foundunsatisfactory, by giving a show-cause to be replied within a week and also has the right toaward the contract to any other agency at the risk and cost of current agency and excessexpenditure incurred on account of this can be recovered from Security Deposit or pendingbills or by raising a separate claim.

    23. The contractor shall be solely responsible for the redressal of grievances/resolution ofdispute related to contractual manpower deployed and Institute shall in no way beresponsible for settlement of such issues whatsoever.

    24. The contractor will maintain all required records of the contractual manpower such asname, father’s name, age, educational certificates, photograph, permanent address,telephone numbers, copies of voter/aadhar card etc. and will also ensure the verification ofthe antecedents from appropriate authority/police. The firm may provide such record as andwhen called for by Institute.

    25. The contractual manpower deployed by the firm shall be under the direct control andsupervision of the contractor/ agency. However, they shall comply with the oral and writteninstructions related to their work given by the officer(s) under whose control such manpoweris deployed. They will be bound by office timings, duty, work locations etc. as decided by theIISWC.

  • 26. Institute shall not be responsible any loss of life or any of property of the contractualmanpower for whatsoever reason during their deployment by the firm at IISWC,Institute/working site.

    27. In case of breach of any terms and conditions attached to this contract, the security depositof the contracting agency will be liable to be forfeited by the Institute besides termination ofcontract.

    28. The terms and conditions as stipulated in the tender document and enclosed herewith shallbe automatically part of the agreement which shall be executed between IISWC and thesuccessful bidder/contracting agency.

    29. Service charges, to be quoted by the Bidder, shall remain firm/unchanged during the entirecontract/extended period and no request, on whatsoever ground, shall be considered for anyincrease in the service charges.

    30. If any information/documents as desired in the tender document is not provided/attachedwith the tender document, the tender bid shall be treated as unresponsive and will berejected.

    31. All pages of tender document should be serially numbered and containing seal of the firmand signature of the authorized signatory.

    1. Minimum wages prescribed by theGovt. of India/ Tamil Nadu State,whichever is higher and revisedfrom time to time as per terms &condition No.17 of Annexure-II ineach category of Skilled, Semi-skilled & Un-skilled manpower.

    The firm shall pay the prescribed minimum wages/revised rates of minimum wages to the contractualmanpower through NEFT/RTGS and thereafter charge itin the monthly bill by submitting a copy of payment madeto the contractual manpower. A proof of NEFT/RGTSetc. has to be enclosed with bill.

    2. EPF as per prevailing rates The firm may charge the EPF in its monthly bill anddeposit the same as per rules in the EPF account ofdeployed contractual manpower and submit copies ofchallan/receipt alongwith next month’s bill alongwithUnique ID of each contractual manpower deployed by it.

    3. ESI as per prevailing rates The firm may charge the ESI in its monthly bill anddeposit the same as per rules in the ESI account/office ofESI and submit copies of challan/receipt alongwith nextmonth’s bill alongwith Unique ID of each contractualmanpower.

    4. Service charge The firm may charge service charges in its monthlybill as per the rates quoted by the firm in its financialbid.

    5. GST/TDS as per prevailing rate The firm may charge GST in its monthly bill as perprevailing rates on the consolidated amount as givenabove and deposit the same in concerned governmentoffice and submit a copy of its receipt/challan alongwithnext bill.

    DRAFT SPECIMEN AGREEMENT

    NOW IT IS HEREBY AGREED by and between the parties hereto as follows :-

    1. This agreement shall come into force w.e.f. …………..(date)…………… and will remain in forcefor a period for one year or the period of contract if extended on mutual consent but can beterminated by IISWC RC Udhagamandalam by giving one calendar months notice in writing of itsintentions to terminate the agreement.

    2. The firm shall be responsible for annual job work contract for providing Man power Services(nature of job)................ at ICAR-IISWC, Research Centre, Fernhill PO, Udhagamandalam.

    3. The firm will provide full particulars of every worker deployed by it for providing the services andgate security purposes and get their character and antecedents verified from the police authorities.

    4. All personnel posted at premises shall at all times and for all purposes be deemed to beemployees of the firm and the IISWC RC Udhagamandalam shall have no liability on this account inany manner.

    5. That the Firm shall ensure that all persons deployed at IISWC RC Udhagamandalam premisesare of good character, well behaved and otherwise competent and qualified to perform the work forwhich they are deployed.

    6. The IISWC RC Udhagamandalam shall have the right to ask for the removal from its premisesany personnel considered by them to be incompetent, disorderly or any other reason and suchperson shall not again be deployed without the consent of the IISWC RC Udhagamandalam .

    7. The manpower deployed by the agency should work as per the working days and timings of theIISWC RC Udhagamandalam and the working shift for which contract is awarded. No extra wageswill be paid for attending office on weekends, holidays and late -sitting.

    8. Wages to be paid to the contractual manpower will be as per Minimum Wages prescribed byGovt. of Indian/Govt. of Udhagamandalam whichever is higher. Current wages etc. shall be as perAnnexure-IV-A of the tender document.

    9. Monthly consolidated charges for job/ work contract for providing ....................services at IISWCRC Udhagamandalam is as per terms and conditions specified and scope of work as per Annexure-…………in the tender document including all the taxes viz. GST and other taxes as applicable willbe paid to the firm by the Institute. The firm will raise a bill of this amount as per terms & conditionsof the tender document and the payment released by the Institute in the form of crossed chequepayment/online payment/RTGS whatever is feasible to the firm subject to satisfactory performance/ delivery of contracted job / work/ services. Copies of documents such as deposit challan alongwith

  • list of persons showing deposit of ESIC, EPF, GST with the concerned agencies are also to bedeposited with the bill.10. The deduction of income tax from the bills of the agency will be made at source as per ratesapplicable from time to time.

    11. In case of dispute between the parties, the matter shall be referred to the sole arbitratorappointed by the Secretary, ICAR. The decision of the sole arbitrator shall be final and binding inany respect of any dispute between the parties. Arbitration proceeding shall be governed by theArbitration & Conciliation Act, 1996 as amended from time to time.

    12. That the firm shall provide uniform to its Security Personnel and will issue identity card to eachof the workers engaged for entry in IISWC RC Udhagamandalam premises.

    13. That the firm shall ensure the successful implementation of the terms and conditions of theagreement by proper control and supervision of the work.

    14. That in case the firm fails to perform any of the terms and conditions of this agreement orcommits any breach of the contract, IISWC RC Udhagamandalam shall cancel the contract.

    15. That the firm agrees to discharge all their legal obligations in respect of their workers in respectof their wages and services conditions and shall also comply with all the rules and regulations andprovisions of law in force that may be applicable to them from time to time, viz. obligations underContract labour (Regulation & Abolition) Act. 1970, Employees Compensation Act, 1923, EPF, ESI& MP Act, 1952 etc. Firm agrees to indemnify and keep indemnified the IISWC on account of anyfailure to comply with the obligations under various laws or damage to IISWC due to acts/omissionsof Firm.

    16. It is also agreed that under no circumstances, the employees/ workmen of the firm shall betreated, regarded or considered or deemed to be the employees of the ICAR-IISWC RCUdhagamandalam and the firm alone shall be responsible for their remuneration, wages and otherbenefits etc. Firm shall indemnify and keep indemnified the ICAR- IISWC RC Udhagamandalamagainst any claim that it may have to meet towards the employees/ workmen of the firm. Firm'semployees/workmen shall have no claim to absorption/ regularization.

    17. The contract is subject to the conditions that the firm shall comply with all the laws and bye-lawsof Central Govt./ State Govt. as applicable relating to this contract.

    18. In case of any loss or damage to the property of the Institute which is attributable to the firm, thefull damages will be recovered from the firm as decided by Institute.

    19. The firm shall not transfer its right or sub- contract to anyone else.

    20. The firm or its workers shall not misuse the premises allotted to them for any purpose other thanfor which contract is awarded.

    21. The firm shall devote its full attention in service to ensure highest quality in all aspects anddischarge its obligations under the contract with trust, diligence and honesty.

    22. Compensation to the workers in case of any accident, loss of life during discharge of their dutiesshall be borne by the firm and not by Institute in any manner.

    23. There may be frequent surprise checking by an Officer. Shortcomings, if any, pointed out by himshall be rectified by the contractor within 24 hours of its bringing to his notice.

    24. The firm shall provide a Co-ordinator for immediate interaction with the organization.

  • 25. The terms and conditions as stipulated in the tender documents and enclosed herewith, shall bepart of the agreement.

    27. The Service charges quoted by the Bidder, shall remain firm/unchanged during the entirecontract and no request, on whatsoever ground, shall be considered for any increase in the servicecharges.

    LIQUIDATED DAMAGES CLAUSES : -

    1. In case of non-satisfactory work noticed by the Competent Authority, IISWC, an amountequivalent to the total amount payable on account of concerned contractual manpower(s) of thatparticular day/month will be levied as liquidated damages apart from penalty as decided by theHead, IISWC, Udhagamandalam.

    2. The Firm will not charge placement charges and /or on any other account from theguards/manpower deployed at the ICAR-IISWC, Research Centre, Udhagamandalam. The contractis liable to be terminated, security deposit forfeited and the Contractor/Firm will be blacklisted if, at alater stage, reports are received that the Contractor/Contracting Firm has charged theguards/manpower on any account.

    3. Any misconduct/misbehavior on the part of the manpower deployed by the agency will not betolerated and such persons will have to be replaced immediately.

    Not with-standing anything above, the Head, ICAR-IISWC, Research Centre,Udhagamandalam reserves the right to reject any or all tenders in whole or in part without assigningreasons therefore. The decision of Head, ICAR-IISWC, RC Udhagamandalam shall be final andbinding on the contractor/agency in respect of any clause covered under the Contract.
