I. INTRODUCTION

A. Background

1. Government of Madhya Pradesh (GoMP) with a sector project loan funding from

Asian Development Bank (ADB) has proposed to implement Madhya Pradesh Urban

Services Improvement Project (MPUSIP), herein after referred as ‘the Project’. Madhya Pradesh Urban Development Company Limited (MPUDC) shall be the Implementing Agency

(IA) and the State Urban Development and Housing Department (UDHD) shall be the

executing agency for the Project. A project management unit (PMU) created under MPUDC

is implementing MPUSIP.

2. MPUSIP’s physical components include (a) improvements to water in 64 project

towns; and (b) sewage and storm water collection and treatment services proposed in two

(2) identified towns (Khajuraho, and Rajnagar).1 The project also includes an institutional

strengthening component and a project management and administrative support component.

3. MPUSIP will result in improved and sustainable urban services, improved institutional

and financial capacity of urban local bodies (ULBs) to deliver sustainable urban services.

The Project will also support the development and operationalization of Madhya Pradesh

Urban Development Company (MPUDC). The proposed project will be implemented over 10

years (2016-2026).

B. Scope of this Report

4 This land acquisition and resettlement due diligence report is prepared for the

proposed water supply subproject for Akoda Municipal Parishad, located in Bhind district,

under MPUSIP. Proposed components of the Akoda water supply subproject include

construction of water intake, water treatment plant, storage reservoir, transmission mains

and distribution system. The proposed subproject will provide metered water supply for

domestic, institutional and commercial users, including metered connections to each

household in the town. All municipal wards of the town will be covered under the project. The

total population of the town will thus be population of 13746 in Akoda (population as per

census 2011) and estimated population on which it is designed for the year 2048 is 20497 all

the municipal wards of the town are covered in the project

5. A due diligence process was conducted to examine the land acquisition and

resettlement issues in detail, in line with ADB SPS 2009. This report describes the findings

and provides copies of relevant documents, maps, minutes of meetings and photographs.

This land acquisition and resettlement due diligence report needs to be read along with the

Resettlement Framework prepared for MPUSIP.

6. Upon project implementation, the Social Safeguards Personnel at PMU, MPUDC will

be required to undertake a review of this due diligence report, prepare a confirmation letter

or report documenting any modifications for the subproject and submit to ADB; and receive a

‘no objection’ confirmation from ADB prior to start of construction in the subproject. 1.

II. POLICY FRAMEWORK, AND ENTITLEMENTS

7. The Resettlement Framework (RF) prepared for MPUSIP sets out the objectives,

principles, eligibility criteria and entitlements for APs, based on ADB SPS, 2009 and LARR

2013 as well as national and state laws for protection of street vendors. Until recently, all

activities related to rehabilitation and resettlement in the State of MP had been based on the

Madhya Pradesh Resettlement and Rehabilitation Policy, 2002 (MPRR) and National

Rehabilitation and Resettlement Policy, 2007 (NRRP-2007). GoMP adopted LARR 2013 on

3rd October, 2014 with some specifications for operationalizing its implementation in the

state2. Details of policies are in the Resettlement Framework for MPUSIP.

III. SUBPROJECT DESCRIPTION

8. Project area: Akoda Nagar Parishad has 15 administrative wards with an area of

29.58 Sq.km. As per 2011 Census Akoda is having population 13,746 persons and the gross

population density of town is 4.23 pph.

A. Existing Water Supply

9. Water supply in Akoda is primarily dependent on Ground water source. At present,

water is drawn from 3 municipal tube wells located across the town. Ground water is

constantly getting depleted and tube wells need to go deeper every year. An average ground

water table available in the town is around 20m (ie.60 feet). Besides bore wells, water is

extracted through 205 hand pumps and 6 open wells (for daily usage) located across the

town.

10. Presently ANP supplies 0.375 MLD including un-accounted for water (UFW) at the

rate of 30 litres water per capita per day (gross) through the piped water supply system.

Water is directly drawn from ground water sources and supplied to the households.

11. There is only one existing Over Head Tank (OHT) for storage with a total capacity of

75,000 gallon (ie.340KL) with 12m staging height is located in Ward No.12. The area located

around OHT, water is supplied in that wards only. In rest of the wards, water is directly

supplied through pipes using bore well without any storage or filtration. These results in

uneven pressure across the network and some of the localities ward no.15 have reported

low pressure of water supply.

12. The entire Akoda is being supplied from ground water source and has coverage of

79% of town area by distribution system. Water supply hours in Akoda are 4 hours in

morning and 4 hours in evening. The present distribution system was laid in 1986 with AC

pipes and thereafter it was increased based on requirement and demand. At present the

town has around 12 Km length of distribution system of AC, GI pipes having 38 to 250 mm

diameters.

13. The water is being supplied from OHSR and some of the tube wells are directly

connected to the system. Akoda nagar parishad has one tractor mounted water tanker

having a capacity of 3000liters will be used to supply at the locations where piped water

supply is not there. The town presently has approximately 600 individual water connections.

B. Proposed Water supply system

14. The primary objectives of the proposed water supply subproject include: (i) service improvements to achieve safe and sustainable water services both in

terms of services to residents and cost recovery

(ii) conservation of precious water resources. The project envisages providing

100 percent coverage of population with continuous, pressurized and safe

drinking water services and achieving increased cost recovery progressively

by expanding the coverage and increasing operating efficiency.

15. Proposed components of subproject includes:

1. Construction of Weir across the Sindh river.

2. construction of Intake well on Sindh River at downstream of bridge near Khera

Shyampura village .It is situated at a distance of 16 Km from Akoda towards Lahar.

3. proposed WTP of 1.90 MLD for ultimate water demand near Khera Shyampura

village

4. Clear Water sump for 60 KL capacity within WTP complex. 5. 1 OHTs of 315 KLL Capacity at ward 8 near tube well.. 6. Laying of rising main of length 16 km. 7. Laying of distribution network of length 38,298m

IV. FIELD WORK AND CONSULTATIONS

A. Field visits

16 Consultations were undertaken with key stakeholders in line with ADB’s requirements pertaining to environment and social considerations. Tools used for consultation were

stakeholder meetings and focus group discussions (FGD). Consultant has carried out

extensive consultations with affected communities, municipalities and stakeholders,

including individual face to face interviews and public consultations.

17 The major stakeholders are:

a. The municipality, its elected members and staff who will be required to oversee

the construction of the distribution networks and WTP as well as be directly

responsible for the maintenance of the installations

b. Local residents who will take initiative to connect their houses with the water

distribution line.

c. Local business persons and traders

d. School and College Students

e. Opinion makers who are intimately acquainted with and well regarded by the

community who need to be enlisted in spreading environmental awareness within

the community as well as in conveying the benefits of the project.

18. Field visits were made to all proposed sites and pipeline alignments and the

potential impacts and mitigation measures discussed with stakeholders. These consultations

helped identify the felt needs/concerns and apprehensions of the communities related to the

project and priorities of concerned stakeholders. Discussions were held with people residing

at and/or having businesses at/near the proposed subproject locations. Consultations

revealed that people are aware of the problems of the existing water supply system in the

city and are willing to cooperate in the proposed project. The field visits and interactions

helped ascertain that no further survey and inventories are required. Table 1 provides a

summary of consultations and discussions held. Appendix 2 provides the picture of

stakeholders and community members consulted.

V. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS

19. No land acquisition or resettlement impacts are expected for any of the proposed civil

works for Akoda water supply subproject. The proposed Weir on Sindh river near Khera

shyampura village, the permission for construction to be taken from Water resource

department.

20. No impact on downstream user by the construction of weir & intake well on Sindh

river is anticipated

21. During site visit it was observed that there are four natural streams join Sindh River

with in the 5 km in downstream from the proposed intake location. Out of four, three streams

join from left side and one stream join Sindh River from right side with respect to direction of

flow of the river. All these streams are the natural drains that carry the runoff generated by

the rainfall in this area. There is no industry or town situated in this reach of the river, only

few agricultural fields are found, survey done they use river water for one crop only, for

Kharif crop they use their own source. As the top level of weir is much lower than the HFL of

the Sindh River it will not hinder any downstream user. Hence water will continue to overflow

and no downstream impacts are anticipated due to construction of weir and intake.

22. Intake Well and WTP is proposed on Sindh river on the way to Khera Shyampura

village. WTP land is in possession of Revenue department, as process of land transfer to

ULB is under process. The permission from Water Resource Department for construction of

Intake well to be taken, making sure that its conditions for granting of NOC are met. All other

sites are owned by GoMP, hence only transfer is required from the Revenue Department.

23. In Akoda town raw water abstraction will be done from weir through intake well on

Sindh River to WTP, then treated and supplied to the town. The proposed water treatment

plant (WTP) will be constructed on land belonging to Government of Madhya Pradesh. The

land has been in the Revenue Department’s possession form many years and was not

acquired in anticipation of ADB funded MPUSIP.

24. The raw water rising main of length 350m from Intake well to WTP will be laid within

the road RoW of PWD road. The clear water rising mains of length 16 km will be laid within

the road RoW of PWD/ nagar parishad road from WTP to OHT as sufficient RoW is

available.

25. The site for the proposed OHT is near pump no 4 ward no. 8 in Akoda and the land

belongs to Nagar Parishad.

26. New distribution pipelines (38298m) are proposed to be laid within existing road

ROWs. Proposed pipe diameters range between 75 mm and 280 mm. Pipe laying activity on

roads in the most of the area will be at the centre of the road, to avoid IR impacts including

temporary economic impacts to shops and businesses.

27. Measures will be taken to minimize excavation, disturbance to pedestrians and avoid

income loss to businesses, while minimizing road reconstruction costs. Temporary impacts

to traffic/ access to shops and residences due to digging of pits for trenchless pipe laying are

possible during construction; however, these will be mitigated by ensuring access to

properties through provision of pedestrian planks, provision of adequate signage, and careful

traffic management.

28. The weekly market day will be avoided for construction. Only mobile vendors will be

shifted to a nearby location during the period of construction and assistance to shift will be

provided by the contactor. No income loss is anticipated.

29. In case temporary shifting of vendors with temporary structures is necessary, such

shifting will be undertaken on a weekly holiday, to avoid income loss on the day(s) of

shifting. The vendors will be assisted to shift and will be able to continue plying their trade

during the construction period at the alternative location.

30. House Service connections: Providing house service connection tapping from a distribution main/ sub-main including one tapping saddles, elbows, and service pipe from tapping point to the chamber near property boundary or inside the property boundary. The work shall include excavation, road restoration, etc.. The town is having total number of

household’s 1907 .At initial phase of project considered 70% of household for water connections with domestic meters i.e. 1340 nos in this project. 31. Among linear component, laying of Clear Water Feeder Mains for the water supply project is proposed to be laid mostly within the existing State Highway No 2 and the (PWD) roads RoW. The common feeder mains carry clear water from the WTP to the OHT of the town.

VI. CONCLUSIONS

32. No significant IR impacts are assessed at identified sites for sub-project components, as adequate vacant land is available for the proposed facilities, within the compounds of government lands. The weir is proposed on sindh river near khera shyampura village, the permission of construction from WRD is under process. The site for new WTP & Intake well at Akoda was owned by MP Government. Intake well is constructed on Sindh River and NOC for that is under approval. The sites for proposed OHT (near tube well at ward 8) existing OHT is there its on government land its under possession of Akoda Nagar parishad. For linear components (pipe laying) are proposed along government road ROWs. Temporary disruption to road users, pedestrians and community members will be avoided In the most congested zones of Akoda with proper traffic management with the help of local police and officials. Safety measures are taken during construction time to avoid injuries. Inconveniences to the public are mitigated during construction by the contractor through simple measures such as provision of planks for pedestrian access to shops with effective traffic management. A budgetary provision is made for costs likely to be incurred for updating of this DDR.

A. Next Steps

33. The DDR needs to be updated with the following information:

NOC from Water Resource Department for proposed Weir and Intake well on

Sindh River to be taken. ULB has applied for the same.

NOC from Revenue department for proposed WTP to be taken.ULB has applied

for the same.

In addition to the above, in order to improve the quality of consultations, local

community organizers will be appointed for Project under package; record of

consultations held with local communities and other stakeholders to be included in

updated/final DDR.
