    WARRANTY

    MONTABERT warrants each new Product(s) sold by him to the OEM to be free of defects in material and workmanship. The standard warranty period is twelve (12) months from initial operation or accumulation of 1500 drifter hours, whichever first occurs.

    Spare parts : Three (3) months from initial operation or six (6) months from date of shipment .

    Second hand equipment reconditioned by MONTABERT: the earlier of three (3) months from date of starting up, or six (6) months from date of shipment to OEM.

    MONTABERT will provide a new part or repaired part, at its discretion, in place of any part which is found upon its inspection to be defective in material or workmanship during the period described above. Such part will be repaired or replaced without charge to the end user during normal working hours at the place of business of the OEM authorised to sell the type of

    Product involved or other establishment authorised by MONTABERT. The OEM must show the proof of purchase (and purchase date) at the time of exercising warranty. This warranty does not apply to failures occurring as a result of abuse, misuse, negligent repairs, corrosion, erosion, normal wear and tear, alterations and modifications made to the Product without express written consent from MONTABERT, or failure to follow the recommended operating practices and maintenance procedures as provided in the Product's operating and maintenance publications. .

    MONTABERT EXCLUDES OTHER CONDITIONS, WARRANTIES OR REPRESENTATIONS OF ALL KINDS, EXPRESSED OR IMPLIED, STATUTORY OR OTHERWISE (EXCEPT THAT OF TITLE) INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS RELATING TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

    LIMITATION OF LIABILITY

    The remedies of the OEM set forth under the provisions of warranty outlined above are exclusive and the total liability of MONTABERT with respect to this sale or the Product and service furnished hereunder in connection with the performance or breach thereof, or from delivery, installation, repair or technical direction covered by or furnished under this sale, whether based on contract, warranty, negligence, indemnity, strict liability or otherwise shall not exceed the purchase price of the Product upon which such liability is based. MONTABERT shall in no event be liable to the OEM, any successors in interest or any beneficiary or assignee

    relating to this sale for any consequential, incidental, indirect, special or punitive damages arising out of this sale or by any breach thereof, or any defect in, or failure of, or malfunction of the Product under this sale, whether based upon loss of use, lost profits or revenue, interest, lost goodwill, work stoppage, impairment of other goods, loss by reason of shutdown or non-operation, increased expenses of operation or claims of user or customers of the user for service interruption whether or not such loss or damage is based on contract, warranty, negligence, indemnity, s tr ict l iabil i ty or otherwise .

    WHAT THE WARRANTY COVERS

    All failures which meet the criteria below can be considered for coverage under warranty and claim should be submitted to MONTABERT after the repair of the failures. The failures: A) Must occur within the published warranty period for

    the particular product (s). B) Must be the result of a recognisable defect within the

    part or/and the product. C) Must be the result of improper workmanship by

    MONTABERT

    The only warranty applicable to MONTABERT product(s) are those set forth in the general warranty conditions. No other warranty either expressed or implied will apply. In those instances where special warranties, or extensions of warranty are necessary for any reasons, such extensions have to be given in writing by the marketing manager or the after market manager. No other representative of the company has the authority to change the terms of the warranty.

    NON-WARRANTABLE ITEMS

    The following items can not be considered under warranty : A) Lubricating oil, grease, and anti-freeze. Hydraulic

    oil, lubricating oil and filter elements,. B) Replacement parts as the result of normal use or

    wear. As such, claims for accumulator diaphragms, seals, bushings, shank thrust and suspension parts will not be accepted beyond six (6) months from the starting up of the drifter.

    C) Failure of attachments not manufactured or supplied by MONTABERT.

    D) Failure or progressive damage resulting from the use of a non MONTABERT approved part.

    E) Failures resulting of improper application, operation and maintenance or repair practices. Warranty repair must be done by an authorized OEM dealer only

    F) Damage resulting from negligence or accidents.

    G) Towing, hauling, loading and unloading costs. Loss or damage caused by carrier.

    H) Repairs required as the result of improper handling, storage or protection by OEM.

    I) Down time or lost production costs. J) Cost of renting or leasing a back-up unit. K) Transportation expenses for obtaining replacement. L) Telephone or other communications expenses. M) Failure of attachments resulting of modification not

    having special approval from Montabert Engineering Department

    N) Failures resulting from improper setting of the equipment.

    O) Utilization on a carrier not approved by Montabert.

    WARRANTY PERIODS

    Purchase The warranty period to OEM starts at the time of delivery to user. The Warranty form has to be submitted by the OEM at the time of delivery. Rental The warranty period starts when the machine is put into rental. Should the machine be sold while on rental, only the remainder of the standard warranty applies. The Warranty form should be submitted by the OEM at the time of delivery. Demonstrations Warranty begins after one week of demonstration. Should the machine be still demonstrated, rented or purchased after the initial week, the warranty period begins. A special note has to be written in the warranty form mentioning that the product was in demonstration before and the number of operating hours.

    WARRANTY REGISTRATION PREPARATION

    OEM RESPONSIBILITY MONTABERT warrants its products to the authorised OEM. It is the OEM's responsibility to warrant the equipment to the end user. It is imperative that all parties recognise the importance of the warranty and what it specifically covers. The OEM is responsible for the after sale service and has to maintain an organisation with enough skilled people, tools, facilities and spares stock to be able to cover the territory and the equipment in operation.

    RECEIVING INSPECTION The purpose of the receiving inspection is to check over the product(s) for discrepancies, missing items or in transit damage. All discrepancies or missing items should be reported immediately to MONTABERT. Claims should be filed with the carrier for any in transit damage. It is the OEM's responsibility to properly store and maintain the MONTABERT equipment in his inventory.

    PROCEDURE AT THE TIME OF DELIVERY To insure customer satisfaction and proper registration of the warranty, a warranty registration form must be filled in when equipment is delivered to the customer.

    WARRANTY REGISTRATION FORM FormSup 2008/70 This is the formal warranty statement which can be used as proof of warranty if required. It is the OEM's responsibility to ensure that he has sufficient forms on hand. All new machines may need some final adjustments and set up. Such adjustments are the responsibility of the OEM. Particularly, prior to the installation on a carrier, it is compulsory to check that flow and pressure available at the circuit comply with MONTABERT specifications. Flow and pressure values checked during installation, must be registered on the warranty form. Failure to comply with these instructions could void the warranty.

    WARRANTY REGISTRATION PREPARATION

    1. Give complete drifter model. 2. Give complete drifter serial number. 3. Date of installation / start up (please write the month in capital letters). 4. Brand of carrier. 5. Model of carrier. 6. Indicate delivered percussion flow measured during circuit checking. 7. Indicate delivered rotation flow measured during circuit checking. 8. Indicate operating percussion pressure measured 9. Indicate operating rotation pressure limiter measured. 10. Indicate hydraulic oil temperature 11. Indicate drain pressure 12. Indicate operating back-pressure measured 13. OEM's name and complete address. 14. Owner/user trade name and complete address. 15. OEMs signature and stamp.

    ALL PRODUCTS

    First sheet (white) must be given to the customer. Second (yellow) has to be sent to MONTABERT technical support. Third sheet (green) has to be hold by the OEM with the commissioning check list (see annex 3).

    WARRANTY CLAIMS

    OEM RESPONSIBILITY The OEM upon completion of a warranty repair, will file a claim with Montabert, using the request form in accordance with Montaberts published practices.

    All warranty claims must be forwarded for the attention of the MONTABERT technical support in Saint -Priest. (Use file FORCAV010A)

    All warranty requests must be received by MONTABERT within 15 days after the repair work is completed. Claims not received within the time limit will not be considered.

    MONTABERT technical support will consider these claims, make sure of their validity (causes of failure, dates,...), and if so, the service will issue a credit note, or send part(s) at MONTABERT discretion. Incoterm DDU.

    PHOTOGRAPHS OF DEFECTIVE MATERIAL Good photographs showing the defective parts are required with the warranty claim, this should avoid the forwarding of the parts themselves.

    REPLACEMENT PARTS The replacement or repair of a part under warranty does not extend the warranty of the original product. If the occasion should arise where an approved MONTABERT replacement part which was procured and installed by an official MONTABERT OEM at customer expenses should fail, the company will consider request for warranty adjustments on the failed parts. The company's participation will be limited to participating in the cost of the part only and for a term not to exceed the period covered by the parts warranty.

    EXCEPTIONS In very exceptional cases, MONTABERT might accept for claims outside standard warranty limits, such cases will be considered on individual basis and cost sharing principles

    MODIFICATION CAMPAIGN In the case of the replacement / modification of a specific part (updating) on a specific range of product(s), the OEM might be requested to perform this job on the product(s) in operation in its area. In such a case he would be advised in writing with details of all necessary procedures involved, work to be performed, parts or components procurement and fees allowance for labour.

    REIMBURSEMENT APPROVED CLAIMS - Reimbursement to the distributor on approved claim will be by credit memorandum. PARTS purchased from MONTABERT to perform the warranty repair will be credited at the OEM net price valid at the repair date.

    LOCAL PURCHASES Outsides purchases required in performing a warranty repair and approved by MONTABERT will be accepted at the OEM's cost. Such expenses must be supported by a copy of the invoices covering these purchases. Subsequent failures on these purchases and any associated consequential damages will not be covered under warranty

    WARRANTY REQUEST PREPARATION

    All warranty requests shall be submitted on form FORCAV010A and should include the following information

    1. Your claim number. 2. Complete drifter model. 3. Drifter serial number. 4. Date of installation / start up. 5. Date of failure. 6. Date of repair. 7. Date of claim submission. 8. For MONTABERT use only. 9. OEM name. 10. Customer name. 11. Number of operating hours on the machine. 12. Number of operating hours on the part if it was previously replaced. 13. Replacement parts order N. 14. Carrier model. 15. Percussion flow 16. Percussion pressure. 17. Rotation pressure. 18. Rotation flow. 19. Relief valve setting pressure second way. 20. Indicate drain pressure 21. Indicate bit diameter 22. Indicate air pressurisation. 23. A brief explanation of the probable cause of failure and what action had been taken to prevent future

    reoccurrence.

    A good photograph of the failed part must be submitted with the claim. The photograph must show the defect clearly.

    24. Give quantities of MONTABERT parts that were used in the warranty repair. Should parts having been replaced at this time due to normal use and wear, such parts are not to be included with the list of warranty parts, but have to be charged to the customer.

    DISPOSAL FOR DEFECTIVE PARTS All parts for which a warranty claim has been issued must be stored until the claim has been settled. Each part shall be tagged for identification and stored so as to avoid future damage, should the part be requested for examination. Warranty will not be considered for parts damaged during storage or shipment

    RETURN OF DEFECTIVE PARTS No part should be returned without having received such instructions. If needed MONTABERT will give instructions for the return of the parts, with a return number

    The parts will have to be tagged as follow a) OEM name and address b) quantity of parts c) part number d) return number

    All shipping crates must be marked on the outside with the return number

    The OEM will return the material to the following address:

    All material must be returned freight prepaid incoterm DDU.

    Parts must be returned within two (2) months from date of request. After this deadline, MONTABERT reserves the right to cancel the warranty claim.

    FINAL DESTINATION OF PARTS. Warranties accepted. Parts become

    MONTABERTs property. Warranties refused or partly accepted. Parts

    remain the property of the OEM who has 15 days after the mention of the warranty claim refusal to inform MONTABERTs technical support dept of his decision : whether the parts should be scrapped by MONTABERT or returned to the OEM at his expenses. After this deadline, the parts will be automatically scrapped.

    CONTESTED CLAIMS PROCEDURE All partially paid or rejected warranty claims contested by the OEM must be contested in writing and sent to the technical support department in Saint-Priest. This must be done within fifteen (15) days from the date of the claim refusal otherwise the claim will not be eligible for re-examination
