Drainage Strategy means the Stormy Waler Solutions Drainage Stralegy dated 2 February2009 or such other strategy approved by Melbourne Waler and Council.

Development Plan means the plan prepared by Taylors (Job No. 9725) dated 24 January2012 and approved by Council on 21 February 2012 with reference to the ConceptDevelopment Plan, or such other development plan approved by Council.

Encumbered land means all land within the Subject Land and shown on the DevelopmentPlan"as required for the Wetland System, areas set aside for drainage reserves and thoseparts of the open space areas burdened by pipeline easements.

Concept Development Plan means the plan referred 10in the DP012 prepared by SMECUrban (Ref: 106008) dated 27 February 2009 with the framework for the proposeddevelopment of the land subject to the DP012 or such other plan as approved by Councilfrom time 10 ti"1e.

Bora Wen means the well installed on Ihe Subject Land near the Fuel Depot. The locationof the Bore Well. identified as a 'monitoring bore', is shown on the Concept DevelopmentPlan.

Development means the future development and subdivision of the Subject Land for.resIdential purposes that Is approved by Council.

In this Agreement unless the context admits otherwise:

Developer means Monomeath Development Victoria Pty Lid ACN 124865630, RlckloneHomes Ply ltd ACN 052 229 893. Stirling Trading Pty ltd ACN 050 135343 and HawthornDevelopments (Vic) ply ltd ACN 096 383 247. The Deveioper mayor may not be theOwner.

G.2 to achieve and advance the objectives of planning in Victoria and the objectives ofthe Planning Scheme in respect of the Subject Land.

Interpretation

Wetland System means the area set aside for the purposes of a wetland. The location ofthe wetlands is Identified on the Development Plan as Wetland'.

Statement of Compliance means a Statement of Compiianee under the Subdivision Act1988.

Plan of Subdivision means a plan of subdivision of the Subject Land which is not aprocedural plan but a plan that upon registration creates an additional lot which can bedisposed of separately and Is Intended to be used lor a dwelling or can be re.subdivided.

Planning Scheme means the Cardinla Planning Scheme and any other planning schemethat applies 10the Subject Land. •

Proposed Local Road means the local road required to be constructed in accordance withthe Planning Scheme extending from Rossiter Road through Lot 2 on LP208879 (170Rossiter Road) ilnklng to the western boundary of Lot 1 on P208879 (190 Rossiter Road)and Lo115, P9030 (216-218 Rossiter Road) to provide access to the Long Lots.

Subject land means the land situated at Rossiter Road and Sybella Avenue. Koo Wee Rupbeing the land referred to in Schedule 2 to this Agreement and any reference to the SubjectLand includes any lot created by the subdivision of the Subject Land or any part of it.

'Owner means the person registered or entitled from time to time to be registered asproprietor of an estate In fee sImple of the Subject Land or any part of it and includes amortgagee-in-possess 10n.

Sensitive Use means a residential use, child care centre, a pre.school centre or a primaryschool.

Mortgagee means the person registered or entitled from I1meto lime to be registered asmortgagee of the Subject Land or any part 01it.

Party or Parties means the parties to this Agreement.

Pipeline Safety Management Study means ReviSion A of the study undertaken by PeterTuft & Associates dated t1 June 20t1 or such other study approved by Melbourne Waler.ESSO and Council. -

Land Adjacent to the Fuel Depot means any lot. road or reserve adjoining the Fuel Depot.

Long Lots means ths lois referred 10In SChedule 1 to Ihis Agreement.

Fuel Depot means the fuel depot located on land situated at 52.54 Sybella Avenue, KooWee Rup being the land referred to in CertiflClltes of Title Volume 8303 Folios 020 and 021.The location of the Fuel Depot is shown on the Concept Development Plan.

3.13 all Encumbered Land must be transferred to Council or Melbourne Water, at the full cost ofthe Owner, by vesting the Encumbered Land in Council or Melbourne Water through theregistration of a Plan of Subdivision by the Registrar of Titles; and

3.14 the transfer of the Encumbered Land will not be credtted as a public open space contributionfor the development of the Subject Land. .

3.12.1 In accordance with the road construction plans and specifications approved byCouncil; and

The Owner warrants that apart from the Owner and any other person who has consented inwriting to this Agreement. no other person has any interest. either legal or equitable, in theSubject Lend which may be affected by this Agreement.

Without limiting or restricting the respective powers to enter Into this Agreement and. Insofaras it can be so treated, this Agreement is made as a deed in accordance with section 173 ofthe Act.

The Owner agrees to Indemnify and keep indemnified Council and Melbourne Water fromand against all costs, expenses. losses or damages that it may sustain. Incur. suffer or be orbecome liable for or In respect of any suit, action, proceeding, judgment. or claim brought byany person arising from or referrable to the Development, Ihe Agreement or any non-compliance with the Agreement .

Prior to this Agreement being recorded on the Certificate of Title of the Subject Land, theOwner must pay to Council and to Melboume Water, Council's and Melbourne Water's costsand expenses (including legal expenses) of preparing, drafting, finalising, signing, recordingand enforcing this Agreement.

CARDINIA SHIRE COUNCIL

The Design Guidelines are in place to create visual quality of the built form and produce an integrated

streetscape. The Design Guidelines will apply to all residential lots within the Estate.

The Design Guidelines encourage a variety of styles and designs that will be harmonious, whilst not

being onerous by stifling creativity in design. A range of building materials, colours and siting solutions

may be used to result in distinctive character for each home. A standard solution for every allotment

is not encouraged. The Design Guidelines may be revised from time to time at the discretion of the

Responsible Authority.

1.2 Allowable Land

The Design Guidelines prohibits relocatable homes. All materials to construct any dwelling or

outbuildings are to be new materials. These are mandatory requirements and will not be varied under

any circumstance.

2.0 DEFINITIONIn these Design Guidelines:

2.1 'Building Envelope' means the area designated within each lot where a building or part of a buildingmust be located.

2.2 'Street frontage' means the front boundary of an allotment that abuts the road.

2.3 'Plan of Subdivision' means the relevant plan of subdivision for a particular lot.

2.4 'Corner Lot' means a lot which abuts a road or reserve on two or more sides. (Excluding reservesprimarily intended as walkways, utility purposes and less than 10m in width)

3.0 TERMINATION3.1 Restriction of Building Envelope

The restriction relating to the building envelopes will cease to apply to any lot affected after the issue

of a Certificate of Occupancy under the Building regulations 2006 or similar legislation for the whole

of a dwelling on a lot to which the building envelope applies.

3.2 Restriction of Design Guidelines

All the conditions of these Design Guidelines shall terminate 15 years from the Registration of the Plan

of Subdivision for that particular stage of the subdivision.

4.2 Porches, porticos, verandahs, pergolas & balconies that are less than 3.6m above natural ground andeaves, fascias and gutters are permitted to encroach outside the building envelopes and must be inaccordance with the restrictions on the Plan of Subdivision.

4.3 In accordance with Part 2 of the restriction on the Plan of Subdivision, walls on boundaries arepermittedand must be constructed in accordance with regulation 415 (Walls on Boundaries) in Part 4of the building regulations.

5.0 FACADE DESIGN REQUIREMENTS5.1 All dwelling fa"ades must address the principal street and have direct access to the street as per the

Building Envelope Plan.

5.2 Entries must be covered and clearly identifiable. Suggested entry features include: Porch, Pergola,Verandah and Balconies.

5.3 A minimum of one habitable roomwindows located on the front fa"ade.

5.4 All dwellings must have eaves with a minimum depth of 300mm to all facades.

5.5 Eaves are required to return a minimum 3m to all non-corner lots.

5.6 Eaves are required to return the length of the second frontage for corner lots.

5.7 A minimum of at least 2 separate materials must be used on the fa"ade. Suggested fa"ade materialsinclude: Brick, Render, Cladding and Stone.

5.8 Full face brickwork is not permitted

6.0 CORNER/RESERVE LOTS6.1 A dwelling on a corner lot must primarily face the boundary with the greater required setback.

6.2 Consideration should be given to side street elevation or reserve visible to the public.

6.3 Both single and double storey dwellings on corners/reserve must incorporating feature elements thataddress both frontages and, that wraps around to provide an appropriate feature for a minimum of4m.

6.4 At least one habitable room window must face the corners/reserve, matching those used on the frontfacade. If the dwelling is double storey at least one habitable room window must be provided at eachlevel.

6.5 Materials used on the front fa~ade are required to return along the side street/reserve elevation. Thisincludes eaves.

6.6 Blankwalls facing the side streeUreserveare not permitted.

Canyou change how the property is used, or the buildings on it?

All land is subject to a planning scheme, run by the local council. How the property is zoned and anyoverlays that may apply, will determine how the land can be used. This may restrict such things aswhether you can build on vacant land or how you can alter or develop the land and its buildings overtime.

The local council can give you advice about the planning scheme, as well as details of any otherrestrictions that may apply, such as design guidelines or bushfire safety design. There may also berestrictions - known as encumbrances - on the property's title, which prevent you from developingthe property. You can find out about encumbrances by looking at the section 32 statement.

Are there any proposed or granted planning permits?

The local council can advise you if there are any proposed or issued planning permits for anyproperties close by. Significant developments in your area may change the local 'character'(predominant style of the area) and may increase noise or traffic near the property.

Safety

Is the building safe to live in?

Building laws are in place to ensure building safety. Professional building inspections can help youassess the property for electrical safety, possible illegal building work, adequate pool or spa fencingand the presence of asbestos, termites, or other potential hazards.

Building permits

Have any buildings or retaining walls on the property been altered, or do you planto alter them?

There are laws and regulations about how buildings and retaining walls are constructed, which youmay wish to investigate to ensure any completed or proposed building work is approved. The localcouncil may be able to give you information about any building permits issued for recent buildingworks done to the property, and what you must do to plan new work. You can also commission aprivate building surveyor's assessment.

Are any recent building or renovation works covered by insurance?

Ask the vendor if there is any owner-builder insurance or builder's warranty to cover defects in thework done to the property.

The contract of sale and section 32 statement contain important information about the property, soyou should request to see these and read them thoroughly. Many people engage a lawyer orconveyancer to help them understand the contracts and ensure the sale goes through correctly. Ifyou intend to hire a professional, you should consider speaking to them before you commit to thesale. There are also important rules about the way private sales and auctions are conducted.
