Basic Assessment Report in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998), as amended, and the Environmental Impact Assessment Regulations, 2014 (Version 1)
Kindly note that: 1. This Basic Assessment Report is the standard report required by GDARD in terms of the EIA Regulations, 2014.
2. This application form is current as of 8 December 2014. It is the responsibility of the EAP to ascertain whether subsequent versions
of the form have been published or produced by the competent authority.
3. A draft Basic Assessment Report must be submitted, for purposes of comments within a period of thirty (30) days, to all State Departments administering a law relating to a matter likely to be affected by the activity to be undertaken.
4. A draft Basic Assessment Report (1 hard copy and two CD’s) must be submitted, for purposes of comments within a period of thirty (30) days, to a Competent Authority empowered in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998), as amended to consider and decide on the application.
5. Five (5) copies (3 hard copies and 2 CDs-PDF) of the final report and attachments must be handed in at offices of the relevant competent authority, as detailed below.
6. The report must be typed within the spaces provided in the form. The size of the spaces provided is not necessarily indicative of the amount of information to be provided. The report is in the form of a table that can extend itself as each space is filled with typing.
7. Selected boxes must be indicated by a cross and, when the form is completed electronically, must also be highlighted.
8. An incomplete report may lead to an application for environmental authorisation being refused.
9. Any report that does not contain a titled and dated full colour large scale layout plan of the proposed activities including a coherent legend, overlain with the sensitivities found on site may lead to an application for environmental authorisation being refused.
10. The use of “not applicable” in the report must be done with circumspection because if it is used in respect of material information that is required by the competent authority for assessing the application, it may result in the application for environmental authorisation being refused.
11. No faxed or e-mailed reports will be accepted. Only hand delivered or posted applications will be accepted.
12. Unless protected by law, and clearly indicated as such, all information filled in on this application will become public information on receipt by the competent authority. The applicant/EAP must provide any interested and affected party with the information contained in this application on request, during any stage of the application process.
13. Although pre-application meeting with the Competent Authority is optional, applicants are advised to have these meetings prior to
submission of application to seek guidance from the Competent Authority. National Environmental Management Act No. 107 of 1998 (NEMA)
The National Environmental Management Act (Act No. 107 of 1998)
(NEMA) is the overarching framework for environmental legislation as
well as the Regulations for Environmental Impact Assessment. It sets out
the principles that serve as a general framework for environmental
planning, as guidelines by reference to which organs of state must
exercise their functions and guide other laws concerned with the
protection or management of the environment. The application takes into
account the environmental and socio-economic conditions in compliance
with the NEMA principles.
The National Environmental Management: Biodiversity Act (Act 10 of 2004)
The Act provides for the management and conservation of South Africa’s biodiversity within the framework of the NEMA. Areas of high biodiversity need to be protected. Should any protected plants be found on site, these will be managed in consultation with GDARD
The National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008
No waste management license would be required for the construction or operational phases of the proposed activity. Only a limited amount of solid construction waste will be stored and handled on the site, before being hauled away and dumped at the nearest registered landfill site.
National Environmental Management: Air Quality Act, 2004 (Act 39 of 2004) (NEM: AQA)
During the construction phase, dust and the generation of noise can become a significant factor, especially to the surrounding landowners. However, if the development is well planned and the mitigating measures proposed in the EMPr are successfully implemented the proposed development’s contribution to air pollution and the generation of air pollution can become less significant
National Heritage Resources Act, 1999 (Act No. 45 of 1999 (NHRA)
The Act aims to promote the good management of the national heritage resources. According to the Act the South African Heritage Resources Agency (SAHRA) must be notified during the early planning phases of a project for any development that meet certain criteria. The Agency has been notified as required. Any artefacts uncovered during the construction phase will be reported to SAHRA as provided for in the EMPr.
Occupational Health and Safety Act (No 85 of 1993)
The Act provides for the health and safety of persons at work and for the health and safety of persons in connection with the use of machinery; the protection of persons other than persons at work, against hazards to health and safety arising out of or in connection with the activities of persons at work. The EMPr provides for measures to ensure that objectives of the Act are met on this site
EIA Regulations GN 983 (Listing Notice 1) and EIA Regulations GN 985 (Listing Notice 3)
The proposed development constitutes an activity listed under GN R. 983 and GN R. 985 and therefore a Basic Assessment Report process is being followed to obtain authorization from the GDARD.

Legislation, policy of guideline Description of compliance
Gauteng Provincial Environmental Management Framework
The aim of the EMF is to guide the protection and enhancement of environmental assets and natural resources along with development patterns to ensure sustainable environmental management and development patterns within and around the Gauteng Province. The development site is located in Zone 1 of the EMF which aims to promote development infill, densification and concentration of urban development within the urban development zones as defined in the Gauteng Spatial Development Framework (GSDF). The proposed development is aligned with and is fully supportive of the objectives of the EMF.
Red List Plant Species Guidelines The purpose of the guidelines is to promote the conservation of Red List
Plant Species in Gauteng, which are species that face risk of extinction in
the wild. By protecting Red List Plant Species, conservation of diverse
landscapes is promoted which forms part of the overall environmental
preservation of diverse ecosystems, habitats, communities, populations,
species and genes in Gauteng.
Gauteng Noise Control Regulations, 1999
During the construction phase the impact of noise could be problematic, but such impacts are generally short term. One should note that practical mitigation measures for noise pollution are low, but certain measures can be implemented to mitigate the severity. These measures have been provided for in the EMPr
Gauteng Urban Edge 2008 / 2009
In terms of the RSDF policy document, as adopted by the City of Ekurhuleni Metropolitan Municipality, the property is situated well within the R21 corridor and the defined Urban Development Boundary.
Ekurhuleni Biodiversity and open space strategy
The EBOS serves as a strategy for biodiversity and opens space in the area and is supported by a range of implementation policies which are integral to the Spatial Development Frameworks. The site does not fall within or affect any of the key areas (open spaces and corridors) identified on the EBOS.
Ekurhuleni Metropolitan Municipality Environmental Policy
The policy aims at ensuring a safe and healthy environment for those living and working within the EMM and that infrastructure and development incorporate environmental considerations. The site is already disturbed and therefore no environmental sensitivities will be compromised.
Ekurhuleni Metropolitan Municipality Environmental Policy
The purpose of a bioregional plan is to inform land-use planning environmental assessment and authorizations and natural resource management, by a range of sectors whose policies and decisions impact on biodiversity. This is done by providing a map of biodiversity priority areas including Critical Biodiversity Areas and Ecological Support Areas, with accompanying land-use planning and decision making guidelines. According to the Bioregional Plan, the site falls within an agricultural area with no remaining natural areas. Therefore, the development supports the utilization of areas which do not have critical environmental resources which is aligned with the objectives of the plan.

3. ALTERNATIVES
Describe the proposal and alternatives that are considered in this application. Alternatives should include a consideration of all possible means by which the purpose and need of the proposed activity could be accomplished. The determination of whether the site or activity (including different processes etc.) or both is appropriate needs to be informed by the specific circumstances of the activity and its environment.

Given the location of the site, availability of services within is easy reach thereby making it easy to connect and service the township and the site is currently degraded and therefore the past existing environmental sensitivities will not affect the proposed development, no locational alternatives have been considered. Further, the housing typology selected will complement the general development of the area while ensuring densification within the area. While consideration was given to develop a ‘Residential 1 township, this option was discarded as it does not take into account government’s inclusionary policy and would not have provided affordable housing in the area. As part of the development; energy efficient options as well as water harvesting will be considered.

The study area is located in close proximity to west of Esther Park Phase 1 and the proposed site will be accessed through Parkland Drive. This will provide direct access to the proposed development site. Pls mention the underpass from Phase 1 to Phase 2
Access to Phase 1 will be gained off Modderfontein Road (R25) in the form of marginal (Left-in, Left-out) access and off Parkland Drive (M88) in the form of a signalized full junction. The proposed marginal (left-in, left-out) access will be provided at a distance of approximately 210 m to the west of the Modderfontein Road (R25)/Parkland Drive junction. This access will not only serve the proposed development but will also link with Parkland Drive via a proposed internal link road.

According to the Ecological Assessment compiled by the Inkuthanzo Holdings the site consists of secondary grassland, a koppie and the wetland with residential and industrial developments surrounding it. Degradation has taken place. The levels of impact on the site vary considerably with major contribution to this being human activities such as excavations, vegetation clearance, buildings, dumping of waste, street vagrants, uncontrolled fires, etc.

The state of the vegetation and species diversity as well as the degree of connectivity with surrounding open space id very poor due to disturbance which increases over time. At the time of the site visit, it was also evident that the remaining patches of grassland vegetation and rocky outcrops were heavily impacted. Most of the site consists of secondary Hyparrhenia hirta grassland, cleared area. The unchannelled wetland has been heavily impacted on by the development of the Gautrain line.

9. SOCIO-ECONOMIC CONTEXT Describe the existing social and economic characteristics of the area and the community condition as baseline information to assess the potential social, economic and community impacts.
According to the draft Regional Spatial Development Framework, the site is located in Region B situated within the north-western section of the EMM. The City of Tshwane forms the northern boundary and the City of Johannesburg forms the western boundary of Region B. The region is made up of the areas of Tembisa, a portion of Kempton Park, Edenvale, Bedfordview, Olifantsfontein/ Clayville and Bredell Agricultural holdings. The Region is favourably located in the Economic Activity and Employment Area of the Gauteng Province. In terms of the metropolitan vision, the region will see major urban growth due to the proximity to the airport and its expected growth as an Aerotropolis. In 2012, the region had a population of 690 000 people at a sparse density of 1 540 people /km². The population which accounted for 22% of the EMM population is projected to increase to more than 784000 by 2020. According to the RSDF, the finance sector is the largest contributor to the economy in Region B with the manufacturing and community services sector in second place. However, the construction sector has the

fastest growth rate and is followed by the finance and transport sector. The trade sector recorded the largest employment figures in 2012 with a total of 32 400 or 21.5% of the total employment followed by the finance sector, with a total of 27 400 (18.2%). The mining sector with 616 (0.4%) employed the least number of people in Region B, just less than the electricity sector with 938 (0.6%) people employed. Although the agriculture sector currently contributes the least to the region’s economic growth, it is a sector which envelopes significant opportunities for future growth and development in the region. However, because of the location of the site (R21 corridor and earmarked for mixed use development including commercial and industrial uses) the site is expected to be developed in line with these provisions and therefore contribute to economic development and provided related employment opportunities.

The following alternative energy sources can be considered: Biomass This option was rejected because the fuel required for producing electricity is not locally available, the distance between the source of biomass and the power plant must be short for economic viability. Gas This option will be considered if Egoli Gas pipeline is available and/or if the energy spent in processing the gas and transporting it to site does not affect the viability of this development. Coal fired generation This option was rejected because of the distance from the coal fields and because pollution is not allowed in this area. Solar Use of solar power for water heating and outside lighting will be encouraged this development.

4. CUMULATIVE IMPACTS

There might be potential impacts for flora and fauna on the proposed development area, such as loss destruction and/or eradication of threatened near-threatened and declining plant species, Impact on late-successional/untransformed (Primary) plant communities of particular scientific, conservation or educational value, Impact on sensitive ecological systems; wetlands and drainage lines and isolated outcrops with bush clump formation.
5. ENVIRONMENTAL IMPACT STATEMENT Taking the assessment of potential impacts into account, please provide an environmental impact statement that sums up the impact that the proposal and its alternatives may have on the environment after the management and mitigation of impacts have been taken into account with specific reference to types of impact, duration of impacts, likelihood of potential impacts actually occurring and the significance of impacts.
Proposal
The short term environmental impacts of the activity include increased construction vehicles, possible dust, noise pollution and employment opportunities during the construction phase. Long term employment, sustained economic development that enhances the provincial and municipal, potential increase in traffic, loss destruction and/or eradication/on eradication of threatened, near-threatened and declining plant species is some of the key impacts resulting from the implementation of the activity. The implementation of mitigation measures identified above and in the attached EMPr is expected to result in the mitigation of the negative impacts to acceptable levels. The overall environmental and socio-economic benefits associated with the proposed development far outweigh the short and long term negative impacts that may result from the development. If the recommendations in the EMPr are implemented and monitored, then the proposed development as outlined will not have negative impacts on society and the environment.

The ‘no-go’ option will mean that current activities (agriculture) continue on site. While this will lead to retention of agricultural land in the short-medium term, the environmental economic consequences in the immediate to long would be negative. The development is needed, desirable and it is recommended that it be allowed to proceed.

9. THE NEEDS AND DESIREBILITY OF THE PROPOSED DEVELOPMENT (as per notice 792 of 2012, or the updated version of this guideline)
Needs as well as Desirability as per the Town Planning memo. The development concept of the subject property is high density (76 units/ha) residential with a height of 4
storeys. As mentioned the subject property is located to the West and adjacent to the existing Esther Park
Extension 1 township and to the East of the existing Founders Hill industrial development. The proposed
development of the property for high density residential uses will fit in with the nature of the larger urban
area and when assessing the site specific characteristics that is applicable to the subject property it becomes
clear that the subject proposed development concept is both desirable and needed.
When assessing the surrounding urban environment, it is evident that the area to the east of the subject
property is predominately residential in nature ( Esther Park Extension 1 and 13) and the area to the west
and south caters for industrial uses (Founders Hill Industrial Park, etc) The specific land uses and surrounding
zoning has been addressed in the first part of the memorandum and along with the master road planning
network that was also illustrated it provides the spatial perspective that confirms the use of the property as
envisaged by this application is correct.
As indicated the divide that is created by the Gautrain rail line gives form to the layout of Esther Park Extension
38. The proposed K115 and PWV3 roads provides a clear buffer between the proposed township. Effectively
then Esther Park 38 is located and connected only to the existing residential Esther Park township to the east.
Esther Park Extension 1 is predominantly residential 1 stands with a small central medium/high density
residential development and Esther Park Extension 13 is a medium/high residential township. Considering
the housing typology of the surrounding area the position of a higher density residential development on the
subject property will enhance the urban residential perspective of the area and will provide a housing type
that is not available in the area.
The nature of the subject property is currently underdevelopment and vacant. The development of the
property will provide a much needed spatial upliftment for the existing residential area surrounding the
proposed township is older in nature and the construction of the proposed development will breathe new
life into Esther Park community.
