Basic Assessment Report in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998), as amended, and the Environmental Impact Assessment Regulations, 2014 (Version 1)

Kindly note that: 1. This Basic Assessment Report is the standard report required by GDARD in terms of the EIA Regulations, 2014.

2. This application form is current as of 8 December 2014. It is the responsibility of the EAP to ascertain whether subsequent versions of the form

have been published or produced by the competent authority.

3. A draft Basic Assessment Report must be submitted, for purposes of comments within a period of thirty (30) days, to all State Departments administering a law relating to a matter likely to be affected by the activity to be undertaken.

4. A draft Basic Assessment Report (1 hard copy and two CD’s) must be submitted, for purposes of comments within a period of thirty (30) days, to a Competent Authority empowered in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998), as amended to consider and decide on the application.

5. Five (5) copies (3 hard copies and 2 CDs-PDF) of the final report and attachments must be handed in at offices of the relevant competent authority, as detailed below.

6. The report must be typed within the spaces provided in the form. The size of the spaces provided is not necessarily indicative of the amount of information to be provided. The report is in the form of a table that can extend itself as each space is filled with typing.

7. Selected boxes must be indicated by a cross and, when the form is completed electronically, must also be highlighted.

8. An incomplete report may lead to an application for environmental authorisation being refused.

9. Any report that does not contain a titled and dated full colour large scale layout plan of the proposed activities including a coherent legend, overlain with the sensitivities found on site may lead to an application for environmental authorisation being refused.

10. The use of “not applicable” in the report must be done with circumspection because if it is used in respect of material information that is required by the competent authority for assessing the application, it may result in the application for environmental authorisation being refused.

11. No faxed or e-mailed reports will be accepted. Only hand delivered or posted applications will be accepted.

12. Unless protected by law, and clearly indicated as such, all information filled in on this application will become public information on receipt by the competent authority. The applicant/EAP must provide any interested and affected party with the information contained in this application on request, during any stage of the application process.

13. Although pre-application meeting with the Competent Authority is optional, applicants are advised to have these meetings prior to submission of

Description of compliance

National Environmental Management Act No. 107 of 1998 (NEMA)

The National Environmental Management Act (Act No. 107 of 1998) (NEMA)

is the overarching framework for environmental legislation as well as the

Regulations for Environmental Impact Assessment. It sets out the principles

that serve as a general framework for environmental planning, as guidelines

by reference to which organs of state must exercise their functions and

guide other laws concerned with the protection or management of the

environment. The application takes into account the environmental and

socio-economic conditions in compliance with the NEMA principles.

The National Environmental Management: Biodiversity Act (Act 10 of 2004)

The Act provides for the management and conservation of South Africa’s biodiversity within the framework of the NEMA. Areas of high biodiversity need to be protected. The site has no important biodiversity features. Should any protected species be found on site, these will be managed in consultation with GDARD.

The National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008

No waste management license would be required for the construction or operational phases of the proposed activity. Only a limited amount of solid construction waste will be stored and handled on the site, before being hauled away and deposited at the nearest registered landfill site.

The National Water Act, 1998 (Act No. 36 of 1998)

The Act provides for the management of South Africa’s water resources. It aims to ensure that the Republic’s water resources are protected, used, developed, conserved and controlled. According to the Act, any proposed water uses must be specified and registered and/or licensed. Similarly, any modifications to drainage lines on site must be investigated in terms of water use requirements. The proposed development will not require any water licenses or permits

National Environmental Management: Air Quality Act, 2004 (Act 39 of 2004) (NEM: AQA)

During the construction phase, dust and the generation of noise can become a significant factor, especially to the surrounding landowners. However, if the development is well planned and the mitigating measures proposed in the EMPr are successfully implemented the proposed development’s contribution to air pollution and the generation of air pollution can become less significant

National Heritage Resources Act, 1999 (Act No. 45 of 1999 (NHRA)

The Act aims to promote the good management of the national heritage resources. According to the Act the South African Heritage Resources Agency (SAHRA) must be notified during the early planning phases of a project for any development that meet certain criteria. The Agency has been notified as required. Any artefacts uncovered during the construction phase will be reported to SAHRA as provided for in the EMPr.

Occupational Health and Safety Act (No 85 of 1993)

The Act provides for the health and safety of persons at work and for the health and safety of persons in connection with the use of machinery; the protection of persons other than persons at work, against hazards to health and safety arising out of or in connection with the activities of persons at work. The EMPr provides for measures to ensure that objectives of the Act are met on this site.

EIA Regulations GN 983 (Listing Notice 1)

The proposed development constitutes an activity listed under GN R. 983 and GN R.985 and therefore a Basic Assessment Report process is being followed to obtain authorization from the GDARD.

Legislation, policy of guideline

Description of compliance

Gauteng Provincial Environmental Management Framework

The aim of the EMF is to guide the protection and enhancement of environmental assets and natural resources along with development patterns to ensure sustainable environmental management and development patterns within and around the Gauteng Province. The development site is located in Zone 4 of the EMF. The specific EMF requirements in this regard are that: no listed activities may be excluded from environmental assessment requirements in this zone. The proposed development is aligned with and is fully supportive of the objectives of the EMF.

Red List Plant Species Guidelines

The purpose of the guidelines is to promote the conservation of Red List

Plant Species in Gauteng, which are species that face risk of extinction in the

wild. By protecting Red List Plant Species, conservation of diverse

landscapes is promoted which forms part of the overall environmental

preservation of diverse ecosystems, habitats, communities, populations,

species and genes in Gauteng.

No red data species were encountered on site according to the ecological report.

Gauteng Noise Control Regulations, 1999

During the construction phase the impact of noise could be problematic, but such impacts are generally short term. One should note that practical mitigation measures for noise pollution are low, but certain measures can be implemented to mitigate the severity. These measures have been provided for in the EMPr

Gauteng Urban Edge 2008 / 2009

The site is within the urban edge as per the RSDF policy document.

Regional Spatial Development Framework for Region 4

The property falls within Region 4 as per the Regional Spatial Development Framework (RSDF) of Region 4. Region 4 consists of prominent land uses of strategic significance to the local as well as the broader urban environment of Tshwane. The RSDF confirms and encourages developments in these nodes. The proposed development is line with the objectives of the RSDF in this regard.

Tshwane Open Space Framework

The Tshwane Open Space Framework seeks to ensure inter-connected and managed network of open spaces supporting interactions between social, economic and ecological activities, sustaining and enhancing both ecological processes and human settlements within the city. The aim of the Tshwane Open Space Framework (TOSF) is to establish a thorough understanding on the intrinsic value of Open Space and to then develop a visionary roadmap towards the creation of an exceptional Open Space network for the city and its people. The development of land taking into consideration the sensitive features is supportive of the objectives of the framework.

3. ALTERNATIVES Describe the proposal and alternatives that are considered in this application.Alternatives should include a consideration of all possible means by which the purpose and need of the proposed activity could be accomplished. The determination of whether the site or activity (including different processes etc.) or both is appropriate needs to be informed by the specific circumstances of the activity and its environment.

The no-go option must in all cases be included in the assessment phase as the baseline against which the impacts of the other alternatives are assessed. Do not include the no go option into the alternative table below. Note: After receipt of this report the competent authority may also request the applicant to assess additional alternatives that could possibly accomplish the purpose and need of the proposed activity if it is clear that realistic alternatives have not been considered to a reasonable extent. Please describe the process followed to reach (decide on) the list of alternatives below

The process that was followed to conclude on the proposed development consisted for the following steps:

• Consideration of suitability and desirability of the site;

• Consideration of ecological and social-economic implications of the proposed development;

• Consideration of economic impacts on other similar developments in the vicinity of the site; and

• Consideration of possible development alternatives on the property. Key among such considerations was need for residential developments in the area. To this end there is generally planned extensive residential developments in the area and in the Region 4 especially in the vicinity of the application site. The need and desirability of the development that mainly informed the process followed to conclude on the location alternative include:

• Addressing housing backlog;

• Dealing with demand for new housing and providing various housing options; and

• Connecting Diepsloot with Olievenhoutbosch.

In addition impacts on the environment, socio-economic considerations and the provisions of Regional Spatial Development Framework for the area were considered. In terms of the RSDF (2018) the site is located in an area earmarked for mixed development. In term “Mixed use” refers to land uses such as offices/ commercial/ residential/ industrial/ retail/ entertainment/ institutional etc. It also refers to a mix of uses within a specific area (node or corridor). The advantage of mixed uses is that access and convenience are increased as transportation distances are decreased. In this context, although the primary objective of the project is housing provisioning, proximity to job opportunities becomes a major factor that is noted to contribute to the socio-economic sustainability of the communities. Thus, even though alternative locations were considered; proximity to job opportunities, access to major roads, demand for housing and associated backlog made the site the ideal location for the proposed residential development. Furthermore, although design and technological alternatives are relevant these alternatives have not been assessed at this stage as the best technology and designs will be decided upon closer to construction time. These will also include energy and water efficiency measures.

1 Proposal The proposal entails the development of residential township with associated infrastructure on Portion 115 of the farm Knopjeslaagte 385 JR. The property is situated in the jurisdiction area of the City of Tshwane Metropolitan Municipality (COT) within Region 4 of the CoT. Access to and egress from the residential development will be via a Right of Way servitude to the east of the property connecting to Summit Road. The proposed township will be known as Timsrand Extensions 2 &3. The property on which the development is proposed to take place is 21.4133 hectares in size and the proposed township will consist of approximately 19.659 Hectares.

In the event that no alternative(s) has/have been provided, a motivation must be included in the table below.

Given the location of the site, desirability, accessibility, and close proximity to other complementary land uses that mainly present potential for job opportunities, no location alternatives were considered. Furthermore, due to the fact that the site is owned by the applicant, no location alternatives have been considered. Although, development of industrial uses was considered for the site, the above factors led to a decision to focus on residential provision as the site abuts part of the Diepsloot residential node. To minimise the ecological liability of the development, the layout shall be such that the impacts are minimised, energy efficient options as well as water harvesting will be also considered.

6. LAYOUT OR ROUTE PLAN A detailed site or route (for linear activities) plan(s) must be prepared for each alternative site or alternative activity. It must be attached to this document. The site or route plans must indicate the following: ➢ the layout plan is printed in colour and is overlaid with a sensitivity map (if applicable); ➢ layout plan is of acceptable paper size and scale, e.g.

o A4 size for activities with development footprint of 10sqm to 5 hectares; o A3 size for activities with development footprint of ˃ 5 hectares to 20 hectares; o A3 = 1: 4000

➢ shapefiles of the activity must be included in the electronic submission on the CD’s; ➢ the property boundaries and Surveyor General numbers of all the properties within 50m of the site; ➢ the exact position of each element of the activity as well as any other structures on the site; ➢ the position of services, including electricity supply cables (indicate above or underground), water supply pipelines, boreholes, sewage pipelines,

septic tanks, storm water infrastructure; ➢ servitudes indicating the purpose of the servitude; ➢ sensitive environmental elements on and within 100m of the site or sites (including the relevant buffers as prescribed by the competent authority)

including (but not limited thereto): o Rivers and wetlands; o the 1:100 and 1:50 year flood line; o ridges; o cultural and historical features; o areas with indigenous vegetation (even if it is degraded or infested with alien species);

➢ Where a watercourse is located on the site at least one cross section of the water course must be included (to allow the position of the relevant buffer from the bank to be clearly indicated)

One species, namely Hypoxis hemerocallidea, was observed within the study area. This species is declining in Gauteng due to being harvested for medicinal purposes. The site falls within the remaining extent of the Egoli Granite Grassland vegetation type, which is considered to be an Endangered Ecosystem. The study area current impacts include dirt roads, rubbish dumping, a graveyard, illegal sand mining and alien species. This occurs on approximately 5.4 ha of the 21.6 ha study area. It was evident from the ground-truthing that the majority of the site is ecologically intact and comprised of indigenous secondary vegetation. The encroachment of Seriphium plumosum (bankrupt bush), was evident across the study area. The site has structural habitat types listed below.

• Degraded Grassland The Degraded Grassland has been subject to ecological degradation over a period of time due to roads, rubbish dumping and alien species. The species composition of this habitat consists mostly of alien species and weeds.

• Egoli Grassland The Egoli Grassland habitat is characteristic of the regional vegetation type, which is considered to be secondary grassland. The species composition of this habitat consist of indigenous species, two alien invasive species are listed as Category 1b invaders and one Orange List plant species, H. hemerocallidea.

• Transformed The Transformed habitat identified showed limited ecological functionalityand was characterised mostly by alien species and weeds. Transformed areas include surrounding build up areas including houses and brick walls, as well as the sand mining area located towards the north of the study area. It does however seem that this area can be rehabilitated and species composition can be returned to that of a secondary grassland.

9. SOCIO-ECONOMIC CONTEXT Describe the existing social and economic characteristics of the area and the community condition as baseline information to assess the potential social, economic and community impacts.

The site falls within Region 4 of the City of Tshwane Metropolitan Municipality (Cot). Region 4 is located on the south-western portion of the Metropolitan Area. Region 4 boarders the area of jurisdiction of the City of Johannesburg Metropolitan Municipality, Ekurhuleni Metropolitan Municipality as well as Mogale City to the West. The property is situated on the most south-western point of Tshwane municipal boundary. The western boundary of the property also forms the border between City of Johannesburg and Cot. As a result of the property being located on the border between Johannesburg and Cot, it is influenced by socio-economic conditions and associated land development activities in both municipalities. In this context the site is located less than 2 Kilometers from Diepsloot which is a high density residential township located within in the Johannesburg Metropolitan Municipality.

On the other hand Olievenhoutbosch residential township is located approximately 6 Kilometers from the site. Olievenhoutbosch is a high density residential township in Cot that exhibits conditions of housing backlog typical in the Gauteng province. The proposed development of residential township will thus also be influenced by socioeconomic and associated housing conditions in Oleivenhoutbosch and the surrounding areas. The socio-economic conditions in both residential settlements are characterized by high levels of unemployment, abject poverty and inadequate housing and services, and high levels of crime. The housing situation is indicated to be dire and is associated with a high number of informal dwellings. The township application motivation memorandum document compiled for the township application process, in terms of Spatial Planning and Land Use Management Act (Act 16 of 2013), submitted to the Cot presents the socio-economic conditions related to housing as noted below: In Diepsloot there are 8000 RDP houses and the demand continue to outstrip supply. This leads to constant increase in the number of shacks to the extent that there are over 50, 000 shacks with more being built on a daily basis. To this end, the township application motivation memorandum compiled for the township application process further states that:

• “The intention is to create a humane development to help alleviate poverty and inequality in the area by means of creating sustainable, dignifying housing option in the Diepsloot area”; and

• “It is further the intention of the applicant to unlock the economic development potential of the area that can enhance the entirety of the community of the Diepslot area”.

The proposed development as a low income housing initiative will thus, at a basic level, alleviate the housing pressure in Diepsloot and Olievenhoutbsch.

The site is located outside the urban development boundary. This boundary is however located to the western border of the site as indicated in figure 6 above. Furthermore, the CoT Regional Spatial Development Framework (2018) earmarks the area where the site is located for Mixed Use Development. This is presented in figure 7 below. Mixed use refers to land uses such as offices, commercial, residential and industrial. Advantages of mixed use viz. convenience and access are increased as a result of transportation distances being decreased.

10. CULTURAL/HISTORICAL FEATURES Please be advised that if section 38 of the National Heritage Resources Act 25 of 1999 is applicable to your proposal or alternatives, then you are requested to furnish this Department with written comment from the South African Heritage Resource Agency (SAHRA) – Attach comment in appropriate annexure 38. Briefly explain the findings of the specialist if one was already appointed:

An isolated quartzite flake was identified on the northern portion of the site. This stone age artefact was found to be out of context and concluded to be insignificant. From the Heritage Impact Assessment Report it was further concluded that no other archeological sites or material of significance were recorded on the property. Also, there is a cemetery located on the southern portion of the site The cemetery consists of approximately 80 graves of varied shapes, styles and sizes. To mitigate the potential impacts on the cemetery it was recommended that the graves be preserved in situ with a 30m buffer.

possible between the “no go” option and the proposal. With limited information, it is concluded that these socio-economic conditions are dire and hence the need and desirability of the project. It is also assumed that all the specialist studies and findings are correct.

3. 4. CUMULATIVE IMPACTS

Cumulative impacts refer to the incremental impacts resulting from the implementation of an activity on a common resource which are added to the impacts of other past, present or reasonably foreseeable future activities. The potential cumulative impacts of the township both during construction and occupation by considering the effects of the development have been considered relative to the;

- The biophysical environment; and - Socio-economic conditions

The biophysical environment The general environmental conditions of the site especially vegetation coverage consists mainly of a disturbed secondary grassland. The vegetation type found on the site is Egoli Granite Grassland. Also, there is existence of one Orange List plant species on site that emphasizes the ecological significance of the site. These ecologically sensitive features however do not render the site undevelopable. The specialist ecological report states that the existence of Orange List plant species on site does not result in there being a fatal flaw for the proposed development. The site is also infested with alien invasive plant species and has been historically disturbed through agricultural activities. There is also evidence of illegal waste dumping and illegal sand mining on site. In terms of the EMF, the site is located in Zone 4 which emphasizes the need to undertake necessary environmental investigations and acquire appropriate authorizations from the competent authority for any proposed development. In light of the above overall cumulative impacts of the project on the biophysical environment are concluded to be low to medium. Securing of the site, and implementation of mitigation measures that include removal of alien vegetation and clearing of illegally dumped waste, as a result of the development, will also have an overall positive impact on the surrounding environment. This is also due to the fact that the site is

one of the visibly disturbed properties in the area compared to other undeveloped sites. This is probably as a result of the property being easily accessible as it is traversed by a major road viz Mnandi Road and bordered by Summit Road on the South-eastern tip. From the intersection of Mnadi Road and Summit Road, pedestrian access to other sites located to the east of Summit Road is mostly via this property. Securing the site through fencing, as part of the development, may lead to restricted access to these other undeveloped properties and have a cumulative positive impact on their environmental protection status. Socio-economic condition The proposed development is for establishment of a high density residential development. The construction phase of the project will result in job creation opportunities, albeit temporary, and associated poverty reduction. This is generally a positive socio-economic impact that will be experienced in the short to medium term. Long term positive impacts of the proposed development are associated with the provisioning of affordable housing and job opportunities related to management and maintenance operations of the security residential estate. The cumulative impacts in this regard are worth highlighting. Economic development in the area This development will add to the market confidence for economic development in the area. This will thus contribute to the realisation of the objectives of spatial planning and development frameworks for COJ and CoT for the area. This development also serves as a pioneer for other similar developments aimed at addressing housing backlog in these parts of COJ and CoT. Risks The significance of positive impacts is further highlighted by the risk of land invasion for such undeveloped sites that are located in close proximity to high density residential townships that already have high number of informal settlements. If land invasions occurs on site, the cumulative positive impacts of the development will not be realized. The biophysical and socio-economic negative impacts will be increased.

5. ENVIRONMENTAL IMPACT STATEMENT Taking the assessment of potential impacts into account, please provide an environmental impact statement that sums up the impact that the proposal and its alternatives may have on the environment after the management and mitigation of impacts have been taken into account with specific reference to types of impact, duration of impacts, likelihood of potential impacts actually occurring and the significance of impacts.

Proposal The short term environmental impacts of the activity include increased construction vehicles, erosion, possible dust, and noise pollution and employment opportunities during the construction phase. The study area is located within the ecologically significant Egoli Granite Grassland type. The site is however extensively disturbed. As a result of the level of disturbance on the property, despite the site being located within this ecologically significant grassland type, the overall impacts on the vegetation is considered to be medium to low. This is the case in comparison to properties located on the east that are less impacted. Thus the impacts of loss of the Egoli Granite Grassland vegetation type and its habitat on the site is relatively less significant in relation to these other properties. Mitigation measures proposed to be implemented as part of the development will contribute to curbing the resultant environmental degradation in these other properties. This is in terms of alien vegetation clearing and illegally dumped waste removal. Thus, the resultant habitat’s destruction will be complemented by positive impacts especially in the minimally disturbed adjacent and neighboring properties.

In terms of heritage impact assessment, there are archeological artefacts on site and a cemetery. The impact of the proposed development on these is considered low. This given the fact that the archeological artefact is of no significance. On the other hand, proposed mitigation measures for the cemetery are in situ preservation and establishment of a 30m buffer. As result the overall impact associated with the artefact are non-existence. In terms of the cemetery the impacts are positive. This is because the cemetery site will be more secured and less prone to adverse activities that include vandalism and overall distraction of graves. Socio-economic impact assessment of the prosed development overall point to the realization of positive impacts. The significance of these are high in terms of contributing to addressing the persistent housing backlog. Also the socio-economic impacts in the form job opportunities availability especially during construction phase of the proposal are considered to be high. The reports conclude that from an ecological perspective the site is suitable for development as proposed. Negative impacts especially associated with the construction phase and operational phases can be mitigated. The ecological risks associated with the development are medium. The positive impacts (short and long term) include the following: • A general improved aesthetics and outlook of the site;

• Increased job opportunities in the area; and • Contributing to development objectives and land use zoning as per the prescripts of the CoTs’ Region 4

SDF. The implementation of mitigation measures identified above and in the attached EMPr is expected to result in the minimization the negative impacts to acceptable levels. The overall environmental and socio-economic benefits associated with the proposed development far outweigh the short term negative impacts that may result from the development. If the recommendations in the EMPr are implemented and monitored, then the proposed development as outlined will not have negative impacts on society and the environment. No-go (compulsory)

The no-go option will result in the application site staying in its current state. The site is characterized by some level of infestation of alien invasive plant species as well as substantial amounts of waste dumped on the property. If left undeveloped, there is the possibility of further infestation of invasive alien plant species and continued illegal activities mainly waste dumping and sand mining leading further disturbance of the site. Also the potential for degradation on other nearby sites will increase. Furthermore, there is risk of land invasions that is heightened if the site remains undeveloped.

Short term environmental impacts of the project during the construction phase include increased traffic, dust, noise and surface water contamination. There is potential for increased traffic, noise and groundwater contamination during operation phase. The socio-economic impacts have been largely been positive and include realising the developmental objectives of the regional Spatial Development Frame Work for Region A and the sub-area 1 where the site is located. In order to mitigate the potential noise and visual nuisance on adjacent residential areas, proper siting and design of the infrastructure within the site is required. The overall environmental and socio-economic impact associated with the proposed development is considered to be acceptable.

7. SPATIAL DEVELOPMENT TOOLS Indicate the application of any spatial development tool protocols on the proposed development and the outcome thereof.

Gauteng Provincial Environmental Management Framework The development site is also located within Zone 4 of the EMF. The process to follow required authorisations for the development is thus in line with the EMF.

Red List Plant Species Guidelines

• No Red Listed plant species were found on the site. Orange List plant species were found on site.

Gauteng Noise Control Regulations, 1999

• The Regulations control noise pollution. According to the Regulations, the acceptable noise levels in a residential area situated within an urban area is 55dBA and the maximum acceptable noise levels in a rural area is 45dBA.

• Within the construction phase of the proposed activity, the impact of noise could be problematic, but such impacts are generally short term. One should note that practical mitigation measures for noise pollution are low, but certain measures can be implemented to mitigate the severity.

Gauteng Urban Edge 2008 / 2009

• The study area falls within the urban edge and therefore is suited to urban development.

Regional Spatial Development Framework (RSDF)- The development site is located outside Urban Development Zone. While this is the case the CoT Region 4 RSDF indicates that the area where the site is located is earmarked for mixed use wherein intensive urban development of different types are encouraged.

9. THE NEEDS AND DESIREBILITY OF THE PROPOSED DEVELOPMENT (as per notice 792 of 2012, or the updated version of this guideline)

The proposal is for the development of a high-density residential township to further the development potential of the Diepsloot area. This is in response to recent changes in the RSDF and the development potential in the area. There is generally an increase in residential demand in the area. The proposed township can be seen as the linkage between the Diepsloot community and the envisioned development potential for Tshwane. The proposed development will also present an opportunity for alleviating housing backlog experienced in Diepsloot and Oleinvenhoutbosch areas. The primary objective of the proposed development is therefore to contribute to addressing housing backlog. Secondary benefits include establishment of job opportunities and unlocking the area for more developments in line with the objectives of the CoT RSDF.
