NOTICE TO PARENTS
COMPLIANCE WITH ASBESTOS HAZARD EMERGENCY RESPONSE ACT
In accordance with EPA regulations, the following schools have been inspected for friable (easily crumbled) materials which contain asbestos. The schools are East Elementary, North Elementary, W.T. Chipman Middle School and Lake Forest High School. Friable asbestos-containing materials may cause health problems.
On October 22, 1986, President Reagan signed into law the Asbestos Hazard Emergency Response Act (AHERA, Public Law 99-519). The law required EPA to develop regulations which provide a comprehensive framework for addressing asbestos problems in public and private elementary and secondary schools. On October 30, 1987, EPA published the Asbestos-Containing Materials in Schools Rule (40 CFR Part 764 Subpart E). This Rule requires all public and private elementary and secondary schools to inspect for friable and non-friable asbestos, develop asbestos management plans that address hazards in school buildings, and implement response actions in a timely fashion.
To carry out the above activities, involving inspections, management plans, and response actions, schools must use accredited persons. On February 3, 1994, EPA revised the Model Accreditation Plan (40 CFR Part 763) required by AHERA, which specifies training, examination, and other requirements for persons who inspect, develop management plans, and design or conduct response actions in schools. The Revised Model Accreditation Plan became effective on October 4, 1994.
The Lake Forest School District, as well as most public and parochial schools in the State of Delaware have been inspected by Batta Environmental Associates, Inc. Delaware Industrial Park, 6 Garfield Way, Newark, Delaware 19713-3540 and from their Georgetown office located at the Georgetown Professional Park, Suite 201, 600 DuPont Highway, Georgetown, Delaware 19947 (Project Number BEA G38498A). A copy of the AHERA Management Plan is on file in the Main Office of each school and in the Supervisor, Buildings and Grounds office located at 5423 Killens Pond Road, Felton, Delaware 19943.
AHERA regulations require notification of all school employees and parent/teacher organizations regarding the filing of a management plan.
