(i) .. liS .. means lnspe<:tor of Schools oflhe respective block of the State.
(j) .. Neighbourhood'', subject to the provisions of part IV of these rules. shall mean a ward for an area under the Agartala Municipal Council or any Nagar Panchayat, or any Ont~n Panchayat or village of1TAADC or part thereof in a rural area as may be notified by the State Government from time to time under Section 6 of the Act.
(k). ''Pupil Progress Report" means record of the progress of the child based on comprehensive and continuous evaluation.
(1). "REPA" means Right to Education Protection Authority.
(m). "School mapping" means planning for location of schools for the purpose of se<::tion 6 of the Act to overcome social barriers and geographical distance.
(o). ''Walking distance" means the distance covered by a child from habitation to the school.
(2). All reference to ''foi'OlS'' in these Rules shall be construed as references to forms set out in Appendix l hereto.
(3). All other words and expressions used herein and not defined but defined in the Act. shall have the same meanings respectively assigned to them in the Act

3.(1) There shall be a School MI1!Ulgement Committee (hereinafter referred to as the
eommiuee) in every school other than an unaided school, to be constituted within a period
of six months from the date of notification of rules. which shall be reconstituted every three
years.
(2) The committee shall oonsis• of a minimum of 12 (nvclve) members excluding the
member convener and the nwnber of members in the committee shall in no ease exceed 24
(twenty four). The composition ofdtc committee shall be as under.-
Seventy five percent of the members oftbe School Management Committee shall be
from amongst parents or guarOians of children. As far as practicable, proportionate
representation shall be given to the parents of the students belonging to weaker sections and
disadvantaged groups.
The remaining twenty five percent of the strength of the Committee shall be from

a). One third members from amongst the elected members of the Local Authority. to be decided by the Local Authority:
b). One third members from amongst teachers from the school, to be selected by the teachers of the school:
c). ReLnaining one third from amongst students in the school. to be selected by the parents in the Comminoe.
(3). To manage its affair$, the School Management Committee shall elect a Chairperson and
Vice· Chairperson from among the parent nlembers. The Headmaster of the school or in his
absence the senior most teacher of the school nominated by the Inspector of Schools, shaH
be the e.'t-officio Member- Convener of the School Management Committee .The School
Management Committee shall meet at least once in a period of 02 months and the minutes
and decisions of the meeting shall be properly recorded and made available to the public.
(4). The School Management Committee shall, in addition to the functions specified in
clause (a) to (d) of Section 21(2) of the Act perform the following functions. for which it
may constitute smaller working groups frOm amongst its Members:
(a). Communicate in simple and creative ways to the population in the neighborhood of the school. the rights of the children as enunciated in the Act; and also the duties of the State Government. Local Authority. schools. parent and guardians;
b). Ensure the implementation of clauses (a) and (e) of se<:Hon 24 and section 28~
c). Monitor that t·eachers are not burdened with non-academic duties Olher than those specified in section 27;
d). Ensure the enrolment and continued attendance of all the children from the neighborhood in the school;
~). Monitor the maintenance of the norms and standards prescribed in the Schedule;
1). Bring to the {)(){ice of the. Local Authority any deviation from the rights of the children, in particular mental and physical harassment of children, denial of admission, and timely provisi011 of free entitlements as per section 3(2).
g). ldentify the needs, prepare a plan. and monitor the implementation of the provisions of Section 4.
h). Monitor the identification and enrollment of students, and facilities for learning by disabled children. and ensure their participation in, and completion of elementary education.
i}. Monitor the implementation of the Mid-Day Meal in the school.

(3). Any money received b} the School Management Commiuee for the di$Charge of its

(6). The accounts referred to in elausc 0) to sui>-Rule (4) of Rule (3) should be signed by
the Chai!pOtSOn and Convener of lhe School Managem""t Committee and made available to

4.(1) The School Management Committee shall pn:p:ue a School Development Plan at
least three months before the end of the fmaneial year in which it is fio;t constituted

Additional financial roquimnent over the three years period. year· wise. in respect of (b) and (c) above, including additional requirement for providing special training facility specified in section 4, entitlcmenl.'l of choldren such as free text books and uniforms. and any other addibonal financial rcquimnent for fulfillinc lhe ~ibiloties oflhe ,.,noo1 under the Act.
(4) The School Development Plan should be signed by the Chairperson and Convener of the school Management Committee and submitted to the Local Authority befor.: the end of the financial year in which it is to he pr.:pared.

S. The School Managemen.t Committee either itself or with the Local Authority shall
identify ehildre•t requiring special training and organize such training. in lhe followin&
manner, namely:
a). Ensure that every chikt of age of .~ ix to rourt~en years are provided compulsory education in a "neighborhood reeo&nized school'' ti ll the completion of elementary education, that includes education fTom class l to class VIII.
b). The specia l training shall be based on specially designed. age appropriate learning material. approved by the Aeadenlic Authority specified in section 29 ( 1 ). The duration of the special training shaH be for a minimum period of three months. which may be extended, based on periodical assessment or learning progress, for a maximwn period not exceeding two years.
c). It shall be provided in classes hekl in the premises of the school, or through classes organized in safe residential facilities.
d). It shall be provided by teacherS working in the school. or by teachers specially appointed for the p\U"J)C)Sc.
e). for special training syllabus curriculum and evaluation method may be framed by the academic authority for dift'erent stagc-.s like

8. (I) The School Managemcol Committee oonstiluted under section 21 shall be the fi rst

(l) The State Government shall constitute School Tribunals at the State, District and

PART IV- DUTIES OF STATE GOVERNMENT. LOCAL AUTHORITY
Ar ea$ or limits for the purnose of section 6
tO.( I) The areas or limits of neighborhood within which a school has to be established by
the State Government shall be as under-
a). In respect of children in classes 1-V. a school shall be established within a walking distance of one km of the neighborhood.
b). In respect of children in classes VI - VIlla school shall be established within a walking distance of three kms of the neighborhood.
(2). Wherever required, the State Goverrunent shall upgrade existing schools with classes
1-V to include classes Vl·VIll. In rcspt.-ct ofS(:hOOlS, which start from class Vl onwards, the
State Government shall endeavor to add classes 1-V, wherever required.
(3). In areas with difficult terrain, risk of landslides, floods, lack of roads and in general,
danger for young children in the approach from their homes to the school. the State
Government /Local Authority shall locate the school in such a manner as to avoid such
dangers, by relaxation of the Jimits specified under sub-rule {1).
(4). For children from small hamlets, as identified by !he State Government or Local
Authority. where no school exists within the area or limits of neighborhood specified und.cr
sub-rule (I) above, the State Government or Local Authority shall make adequate
arrangements, and other facilities, for providing elementary education in a ~hool, in
relaxation of the limits specified under sub~ RuJe (I)
(5). In urban areas and areas with high population density, the State may consider
establishment of more than one neighborhood school, having regard to the number of
children in the ag.e group of 6-14 years in such areas in consultation with the Local
Authority. The IS shall notify the neighborhood schools(s) accordingly well in advance of
admission process.
(6). The Local Authority shall identity the neighborhood school(s) where children can be
admitted and make such information public for each habitation within its jurisdiction.

(7). In rcspecc of children with disabilities which prevent them from access to the
school. the State Government and Local Authority will endeavor to make appropriate
arrangemeJtts for them to attend school and complete elementary education.

11.(1) The Local Authority shall maintain a record of all children, in its jurisdiction,.
through a household survey, from their birth till they attain 14 years or complete the
elementary education.
(2). The record, referred to in sub-Rule (I). shall be updated every year.
(3). The record, referred to in sub-rule ro . shall be maintained transparently, in the
public domain, and used for the purpose of clause( e) of section 9
(4). The record, referred to in S"Ub-Rule (I) shall, in respect of every child, include a). Name. sex. date of birth, (Birth Certificate number), plaee of birth; b). Parents I guardi:~ns' names, address. occupation. e). Pre-primary sehooV Anpnwadi Centre that the ctlild :mends (up to age 6) d). Elementary school where the child is admitted; c:). Present address of the child: t). C lass in which che child is studying (for children between age 6-14), and if
education is discontinued in the: territorial jurisdiction of the Loca1 Authority, the cause of such discontinuance;
g). Whether the child beiOt\gs to the weaker section within the meaning of clause (e) ofsec:tton 2 of the: Act;
h}. Whether the child belongs to a disadvantaged group within the meaning .of clause (d) of section 2 of the Act;
i). Details of children requirin& special facilit ies/ residential facilities on account of habitations in sparsely populated area.
(S). The Local Authority shall ensure tllat the names of all children enrolled in the
schools Wlder its: jurisdiction are publicly displayed in each school.
(6). No school shall deny or delay issuing of the transfer certificate when requested by
the parent or guardian of the child. The school shall noc demand for payment of any kind
of fee for issuing a transfer certjficate. when the child leaves a school during the progress of
the academic year.

12.(b)(l ). The toll.d annual recurring expenditure incurred by the State Government,
whether from its own funds, or fWKls ptO\'ided by the Central Government or b) any Olhcr

schools. shall be the per child expenditure incurred by the State Government
2) The reimbursement shall be made in the following manner: i) A school envisaged in Section 2{nXiv) of the said Act. entitled to reimbursement. shaH notifY at the start of each academic year and on compk:tion of its .dmission procas, the number of students in the schoolapinst wbom the school is entitled to claim reimbursement;
ii) The State Government shall notify the amount to be reimbursed and the basis of fixation of such amount;
iii) The reimbursement shall be done by the District Education Offieer of the concemod district as per monthly suuements to be submitted by Schools u per the amount notified by the State Government as aforesnid.

a). The school is run by a society registered under tile Socielic:s Re&iStnltion Act. 1860( 21 of 1860), or n public trust constit\ltcd under any law for the time being in force~

(6) Schools which do noc confonn to the: norms. standards and conditions mentioned

conform to the nonns and standards and conditions mentioned in sub· Rule 0) m order to

(2}. The Right to Education Protection Authority (REPA) shall consist of three
members including the Chairperson who should be an eminent educationist with a
background of working in the field of promoting the rights or the children or was a lli&h

(3). The remaining two members shall be eminent persons with integrity. ability and
experience eith.er in the field of elementary education, child health. child psychology or
sociology. child development, child labour or juvenile justice.
(4). Out of the three members. at least one shall be a woman.
(S). The salary. allowances and other facilities to be provided to the Chairperson and
the members of the Authority shall be decided by the State Government.
(6). llle R.EPA shall enjoy aJI powers of the State Commission under the Commissi<>n
for Protection of Child Rights Act 2005 & rules framed there under.
(7), On constitution of the State Commission. all assets, records of REPA shall be
transfen-ed to the State Commission&: the REPA shall be dissolved

18.(1) The Commission or REPA as the case may be shaU set up a child help line,
accessible by SMS , telephone and letter .which wouJd a¢l as che forum for aggrieved

matu'le r lilac records her identity but does not disclose it;
(2) AU complaints co the help line should be monitored through a transparent 'alert and
action ' online mechanism by the State Commission for Protection of Child Rights,
State Advi.~ory Council for Chc nu_rrose of Section 34
19.(1) The Tripura State Advisory Coun.cil shall consi,st of a Chairperson and fourteen Members.
(2) The Minister in-charge of elementary education in the State Govt .. shall be che ex·
officio Chairperson of'th.e Council.
(3) Members of the Council. shall be appointed by the Scate Government
from amongst persons having knowledge and practical experience in the field of elementary
education and c.hild development. as under.
(a) Four members should be from amongst persons belonging to SCs Sls and Minorities.
