The Govt. of NCT of Delhi failed to constitute Animal Welfare Board, SPCAs and Infirmaries

As per section 35 of the Prevention of Cruelty to Animals Act, 1960 Infirmaries are not set up in
India nor functioning well like SPCA's are mandatory for each District as yet to be notified bythe State Government as per section 3 of the Prevention of Cruelty to Animals (Establishment
and Regulation of Societies for Prevention of Cruelty to Animals) Rules, 2001. Like wise State
Animal Welfare Board's are not set up nor functional as per the order of the Supreme Court ofIndia. Hence Miss Sukanya Kadyan, Director Events of OIPA in India served alert for allconcerned as attached.

DEVEL Deptt. has informed that (a) The file for reconstitutions of
Animal Welfare Board is under submission to the Chief Minister Office.
(b) As per recommendation of AWBI, infirmaries for animal welfare hasto be set up in each district of the state. It is submitted in state of Delhi
the Constitution of infirmaries in every district is not require being
smaller in area and having very less animal population in comparison toother states. The same has already been submitted as an affidavit in Writ
Petition(Civil) 440/2000 in Hon'ble Supreme Court of India titled Geeta
Seshamani Vs. UOI People for ethical treatment of animals Vs UOIothers. The Hon'ble L.G. Delhi has also agreed to the same Under the
Circumstances mentioned above, delhi has got a single infirmary for
animal welfare which is SPCA at Tees Hazari Delhi and is found to be
satisfactory catering to the need of the state on the subject.
The United Nation affiliated OIPA in Indiawww.oipa.orgdont agree with the HE the
President Secretariat, New Delhi because general elections have been declared and due to
code of conduct, present Govt. of NCT of Delhi can not constitute State Animal Welfare
Board, like wise Delhi SPCA failed to stop cruel animal transportation in Delhi, Infirmaries
required to handle animals including stray dogs, hence contempt of Honble Supreme Court
of India orders committed by the Govt. of NCT of Delhi, accused of misreporting the facts to
the President of India Secretariat, where as many NGOs were funded to sterilize the stray
dogs with huge budget provisions, since last many years.
