Registrationoftheleasewillcommencesoonafterreceiptoftherentalconsiderationandregistrationcosts.
11. REGISTRATIONCOST
TheLesseeisliablefortheregistrationcostofthisleaseattheDeedsOfficepayableondemand.
12. USE
Useofthehangarissubjecttothemanagementandsafetyrulesapplicablefromtimetotime
13. MAINTENANCEOFHANGAR
TheLesseeisresponsibleforthemaintenanceofhishangar.
14. BREACH
IftheLesseeisinbreachofanyoftheprovisionsofthisagreementtheLessormaytakewhateverstepsheshallbeentitledtoatlaworintermshereofinparticular:
(i) IftheLesseeismorethan2monthsinarrearswithlevypaymentsorotherpaymentsintermshereofhemaybedeniedaccesstotherunway/taxiway.
15. SAFETY
IftheLesseeactsinamannerthatplacesothertenantsatriskorbreachesanyruleorregulationhemaybedeniedaccesstotherunway/taxiwayafterreceivingtwowrittenwarnings.
16. RESALE
TheLesseemayatanytimeresell[let]thepremisesonconditionthattheleviesandotherpaymentsdueintermshereofareuptodate.
17. RENEWAL
Theleasewillberenewedforafurtherperiodof99yearsonpaymentbythenewlesseeofanamountof3%oftheleaseamount.
18. INDEMNITY
TheLesseeindemnifiestheLessoragainstanyclaimsarisingfromtheuseofthefacilities(hangar,runway,taxiwayetc.).
19. FUTUREDEVELOPMENTS
TheLesseeacceptsandacknowledgesthatfuturedevelopmentswilltakeplaceinphasesonthepropertyasperthesiteplanaswellasresidentialsitesthatwillbesubdividedonthebalanceofthepropertyandadjacent/adjoiningpropertiesandundertakesnottoopposeanysuchfuturedevelopment.
20. INSURANCE
TheLessorwillinsureallhangarsbuildingsagainstdamagetothestructureandthiscostispartofthelevy.
21. JURISDICTION
ThepartiesagreetothejurisdictionofthePretoriamagistrate’scourt.
22. WARRENTY
TheLessorwarrantsthattheLesseewillhavetheuseoftherunwayandtaxiwaysonportion914ofKnopjeslaagte385forthedurationoftheleaseperiod.
23. COMPLIANCEWITHLAWS/RULESANDREGULATIONS
TheLesseeshallduringtheperiodoftheleaseabidebyanygovernmentandlocalauthoritylaws,rulesandregulationsapplicablefromtimetotime.
