Dear Fellow New Mexicans,The New Mexico Department of Transportation
and the State of New Mexico are embarking on
a new era in transportation safety. With funding
from the Federal Highway Administration, the
National Highway Traffic Safety Administration
and the State of New Mexico, we will develop
and implement New Mexico’s Comprehensive
Transportation Safety Plan – a collaboration to
reduce traffic injuries and fatalities. This plan
addresses the “four Es” of transportation safety
- Engineering, Education, Enforcement and
Emergency Medical Services. It will cover every
public road in New Mexico and is data driven to
put the most funding where the need is the
greatest.
To identify infrastructure needs, hazardous
locations, the severity of crashes in those
locations and where we can have the most
impact, we are including stakeholders from every
facet of New Mexico’s traffic safety community.
The NMDOT is working with all stakeholders to
not only look at the problems, but also to identify
strategies and help develop programs that will
have the greatest impact. Working together, we
can address the unique traffic safety problems
with infrastructure and behavioral solutions.
Governor Richardson’s Investment Partnership
expanded our thinking from highway
transportation to multimodal transportation and
“Mobility for Everyone”—to me that doesn’t just
mean providing new modes of transportation…it
means “SAFE” mobility for everyone. Now we
must call on “Everyone” in the coming months
to develop and implement New Mexico’s
Comprehensive Traffic Safety Plan and help us
achieve the safest transportation system
possible in New Mexico.

1. License Revocation Periods: The licenserevocation period for the criminal conviction isas follows:
a. One year for a first conviction—firstoffenders are now revoked for a year,regardless of whether or not they attendDWI school.
b. Two years for a second conviction
c. Three years for a third conviction
d. The remainder of the offender’s life for afourth or subsequent conviction, subject toa five year review in the district court.
2. License revocation for a criminal convictionbegins on the date the conviction becomesfinal and all rights to appeal have beenexhausted.
3. License revocation under implied consenthas been increased from 90 days to sixmonths for drivers 21 and over; and from sixmonths to one year for all under-21 drivers,regardless of whether or not they have beenpreviously convicted.
4. No more limited licenses for first timeDWI offenders. Limited licenses were alreadyprohibited for subsequent offenders.

Ignition Interlock: ANY convicted offendermust now obtain an ignition interlock license andhave an ignition interlock installed and operatingon all motor vehicles driven by offender, asfollows:
a. One year for a first conviction
b. Two years for a second conviction
c. Three years for a third conviction
d. Lifetime for a fourth or subsequentconviction, subject to a five year review inthe district court.
e. Juveniles will now have to contribute tothe interlock indigency fund (officially titledthe “Interlock Device Fund”). Juveniles willalso now be able to receive benefits fromthe Interlock Device Fund, if they are eligible.
6. Mandatory community service has beenadded for first (24-48 hours) and third (96hours) offenses.
7. TSB, MVD and DPS will collaborate on makingDWI arrest records and procedures standardamong all New Mexico state and local lawenforcement agencies, and all such agencies willbe required to use these records and procedures.
8. The Alcohol and Gaming Division will assemblea task force to study emerging technologieson age verification, and report its findings backto the appropriate legislative interim committee.

non-alcohol related fatalities in FY05. Thedata has been analyzed. There is nosingle reason or variable to explain thisincrease, rather, it appears that therewere small increases in several differentareas. There is an overall concern thatdiminishing resources for lawenforcement (specifically manpower) hasresulted in less visibility, especially onrural highways. In FY06, TSB will beweighing options to increase lawenforcement presence through additionalofficers dedicated to traffic safety issues.New Mexico will continue to monitor thisincrease and determine how best to placeour resources to positively impact thisconcern.

To assist states in carrying out their highway safety program, Congress provides annual grantsfor highway safety programs designed to reduce traffic crashes and resulting deaths, injuries, andproperty damage. A state may use these grant funds only for highway safety purposes and atleast 40% of these funds are to be used to address local traffic safety problems.
Although the TEA-21 authorization expired in FY04, Congress allowed the State highway safetyprogram offices to continue to operate under a continuing resolution for FY05. The continuing
New Mexico is a Strategic Evaluation State (SES) and therefore also receives 163 ImpairedDriving funds for additional law enforcement efforts and paid media (placed by NHTSA).
At least forty percent of funds were used to address local traffic safety problems.

resolution reauthorized the State and Community Highway Safety formula grant program tosupport State highway safety programs. In addition, there are incentive grants to states thatmeet certain requirements, including Sections 154, 157, 163, 164, 405, 410 and 411 of TEA 21.These grants support planning to identify and quantify highway safety problems, provide start up“seed” money for new programs, and give new direction to existing safety programs. The fundsare intended to catalyze innovative programs at the state and local level, and leverage commitmentsof state, local, and private resources.

During the past year, NMDOT Traffic SafetyBureau (TSB) programs reached every agegroup, from all geographic areas of New Mexicoand every ethnicity. From tots and adults whospout “You Drink, You Drive, You Lose!” and“Click It or Ticket” to seniors and youngmotorcyclists who attend classes to improvetheir driving skills, TSB impacts the lives of allNew Mexicans.
TSB’s top priorities for funding include ImpairedDriving, Traffic Records, and Occupant Protectionprojects. Law enforcement has a major role inall program areas and therefore are the highestpriority for funding. The TSB also provides fundingto a variety of different organizations includingstate agencies, nonprofit corporations andprivate contractors, experts in records, statistics,public information, health, and the judicialsystem. Each organization has a specific purposein assisting TSB in reducing motor vehicle relatedcrashes, injuries, and deaths. The following is alist of some of the larger TSB partners and theirspecific contributions to reducing death and injuryin New Mexico.

The Judicial Information Division of the A.O.C.continued to act as the hosting facility for theStatewide Traffic Records System (STRS) whileparticipating and contributing to a number ofSTRS initiatives in Federal Fiscal Year 2005.
Significant contributions were made by JID staffregarding the development and implementation
of the TraCS Electronic Citation Pilot, thedevelopment of a court “distribution” serverprototype, and the electronic transfer pilot ofcourt abstract data to the Motor Vehicle Division.
Under contract with TSB, the JudicialInformation Division of the AOC continued withthe development of the Ignition Interlock DataRepository and data integration/exchangeinitiatives to improve the quality, accuracy,integrity, consistency, and accessibility of ignitioninterlock data to state agencies, governmententities and other authorized users. This effortculminated in the completion of a successful pilotproject. The project was designed to assist theTraffic Safety Bureau in determining what typeand format of information would be useful topersonnel responsible for monitoring individualssentenced to use an ignition interlock device.This pilot took place in July 2005 with the SantaFe Magistrate Court and Santa Fe County DWIScreening and Assessment as participants. Plansfor FY06 include a transfer of the Ignition InterlockProject from the AOC to the NMDOT.
The Judicial Information Division continues tomaintain and operate the DWI Offender HistoryDatabase. This entails JID senior managementresponding to public, press, and justicecommunity questions regarding the use andaccuracy of the DWI data. The JID teamcontinues to generate custom reports formembers of the judiciary on a per request basis.One of the more interesting highlights this yearhas been the inclusion of the DWI OffenderHistory data into New Mexico’s criminal justiceinitiative.

Since 1973, MSF has set internationallyrecognized standards that promote the safetyof motorcyclists through rider education courses,operator licensing tests and public informationprograms.
In FY05, sponsored by TSB, MSF coordinatedthe New Mexico Motorcycle Safety Program andoffered training for all skill levels to insure thatriders had the skills to enjoy safe, responsiblemotorcycling. MSF offered 423 classes for basicand experienced riders to 3,622 students inAlbuquerque, Roswell, Clovis, Las Cruces,Artesia, Ruidoso, Alamogordo, Farmington andSanta Fe. MSF also participated in MotorcycleSafety Awareness Day and provided technicalassistance to New Mexico research, legislativeand licensing programs.

Safer is a private nonprofit organizationestablished in 1985 as part of a campaign todevelop, coordinate, and implement efforts topromote motor vehicle occupant protection inNew Mexico. Through law enforcement,marketing, media, education, and training, Safercoordinates and collaborates to increase publicsafety by means of harm reduction and injuryprevention programs. Safer’s varied partnershipsallow for outreach and coordination among thesmaller communities in the State. Safer alsoprovides services to Spanish-speaking familiesand tribal communities.
On behalf of TSB, Safer provides managementoversight in Operation DWI (ODWI); Operation
Buckle Down (OBD); Click It or Ticketmobilization; You Drink, You Drive, You LoseCrackdown; and the NHTSA Standardized ChildPassenger Safety Technician Training.
New Mexico contracts for the services of threeLaw Enforcement Liasions (LEL) through SAFER.These LEL, with a combined total of 75 years oflaw enforcement experience, oversee the coor-dination of the ODWI/OBD programs. As retiredlaw enforcement officers, they are uniquely quali-fied to handle the specialized needs of the lawenforcement sector. Coordination of the ODWI/OBD programs includes negotiating overtimeagreements with the 57 participating law en-forcement agencies; scheduling, providing, and/or coordinating training for these programs; pro-viding technical assistance to law enforcementagencies; providing checkpoint equipment; andworking with various law enforcement agenciesand organizations statewide to ensure programshave enforcement support.
During FY05, participating New Mexico lawenforcement agencies conducted 375 sobrietycheckpoints and 837 saturation patrols throughODWI. A total of 1,345 people were arrestedfor suspected drunk driving through theODWI program for the year.
During Operation Buckle Down (OBD), betweenOctober 1, 2004 and September 30, 2005, lawenforcement issued 16,675 seat belt citationsand 1,021 child restraint citations.
Although the primary objective of sobrietycheckpoints and saturation patrols is toapprehend suspected drunk drivers, theseproactive enforcement methods often result inan opportunity to apprehend individuals involvedin other criminal activity or violations.

During ODWI sobriety checkpoints andsaturation patrols in FY05, law enforcementmade 1,348 arrests, issued 20,663 citationsand 1,059 written warnings for violations otherthan DWI. During OBD activities in FY05, lawenforcement officers made 743 arrests,issued 12,869 citations, and wrote 1,234warnings for violations other than those relatedto seat belt or child restraint use.
Safer’s Injury Prevention Resource Center(IPRC) has established a 20-year record ofdesigning innovative occupant protectionprograms and building partnerships with othertraffic safety advocates. Safer utilizes printmaterial, public education, enforcement, training,and advocacy to increase occupant protection.Safer also supports collaborations with theNHTSA, the NMDOT, TSB, the Bureau of IndianAffairs, all levels of law enforcement, the media,SAFE KIDS communities, DWI Councils, EMSregional offices, the University of New Mexico,and the Department of Health Injury PreventionEMS Bureau.
The primary components of Safer’s IPRC aretraffic safety and injury prevention materials -brochures, posters, and promotional items. Asan educational service, the IPRC stocks materialsrelating to the foremost traffic safety issues,including DWI, occupant protection, andgraduated teen licensing. Representatives fromevery sector, including law enforcement,educators, parents, and other injury preventionadvocates, regularly request items from theIPRC. During an average year, the IPRC fills over500 orders and distributes more than 800,000items.
Through funding from TSB and the Bureau ofIndian Affairs, Safer provides trainings related to
child passenger safety. Programs currentlyoffered include the NHTSA Standardized ChildPassenger Safety (CPS) Technical Training,Operation Kids, the New Mexico Car SeatDistribution Training, and comprehensivepresentations tailored for specific organizations.
The NHTSA Standardized CPS Technical Trainingis a 32-hour course for child passenger safetyadvocates. Successful completion of the trainingresults in a two-year CPS certification from theNHTSA. The Operation Kids workshop is a six-hour training intended for law enforcementofficers interested in child passenger safety. TheNew Mexico Car Seat Distribution Programtraining provides the staff at each distributionsite with information on how to assist child safetyseat recipients in the proper installation and useof their new child safety seat. The goal of eachof these trainings is to prevent and reducechildhood injury and death related to misuse ofchild safety seats and other restraint devices.
Safer also holds more than 30 car seat clinicsper year in communities throughout theState. Certified technicians educate parents onthe correct use and installation of child safetyseats. The clinics are a free public service availableto everyone in the community.

SLD provides breath alcohol and drugrecognition testing and training and conductsmore than 5000 toxicology investigations peryear for use in impaired driver prosecutions.

SLD placed special emphasis on training forofficers in FY05. In order to accomplish this, SLDhired and trained three new scientists for theirImplied Consent Section (expanding the programby two) and a part-time Breathalyzer trainer.As a result of the additional staff, SLD was ableto train more than 500 law enforcement officers.
SLD staff attended conferences and trainingsessions on a variety of topics related to DUIand forensic toxicology issues including: medicalconditions and their impact on DUI investigations,ophthalmology issues and visual impairment, andsigns and symptoms used by drug recognitionexperts (DRE). SLD staff also received trainingin drug interactions and pharmacy procedures,constitutional issues and defense challenges tobreath-alcohol testing, breath and blood alcoholanalysis and instrumentation, psychomotor(physical and mental) effects of alcohol, andpresentation of expert testimony on breathalcohol instruments and breath test data.
Toxicology Bureau members also attended theAgilent Technologies GC/MSD ChemStation andInstrument Operation Course (a machine andsoftware that processes a sample fromintroduction to final report.) To round out theirtraining, all members of the Toxicology Bureauattended an in-house ChemStation softwareupdate and training in Albuquerque.
In FY05, SLD conducted more than 15 outreachseminars in Rio Rancho and at the University ofNew Mexico, training 511 law enforcementofficers and one defense attorney in theoperation of a Breathalyzer, how to conductbreath alcohol testing and the effect of drugs ondriving.

It then proceeds to Managementof Police Traffic Services (MPTS), designed fortraffic commanders and supervisors. TheExecutive Forum, which explains the value oftraffic law enforcement to the lead executivesof an agency, completes the three-class training.All classes provide essential information foridentifying traffic crash problems and solutions,a point highlighted in the Fall 2003 Traffic SafetyDigest.
T.A.C.T. trained 497 students in Police TrafficServices during FY05. Classes offered includedManagement of Police Traffic Services,Standardized Field Sobriety Testing (refresher andinstructor), DWI Checkpoint Training, CrashInvestigation, Radar/Lidar Instructor, PoliceOfficer as Prosecutor and Selective TrafficEnforcement Programs.
T.A.C.T. created a system to track all PoliceTraffic Services (PTS) training and began trackingall law enforcement officers statewide. Every lawenforcement department in New Mexico wascontacted by T.A.C.T. They will continue to usethis record keeping system developed to gatherinformation and document training for all lawenforcement officer that are PTS trained. Thiscomprehensive centralized record system hasbeen coordinated with the New Mexico LawEnforcement Training Center (NMLETC). T.A.C.T.instructors are certified with the NMLETC and

have an expertise in their specific area ofinstruction.

COSAP continued its efforts to reduce drunkdriving and other risky alcohol-related behaviorsamong its students through the UNM DesignatedDrivers Do It for Their Friends program, socialnorms correction modules, and peer educationand outreach activities. COSAP trained peer
health educators to deliver presentations onBinge Drinking and The Effects of Alcohol andOther Drugs on Sexuality. This training waspresented to 1,395 students and otherinformation on the subject was provided toanother 3,821 students and members of theuniversity community through 21 outreachpresentations.
For the third consecutive year, every incomingfirst-year student participated in a small groupsocial norms correction program. COSAP trainedstudent leaders assigned to the New StudentOrientation program to conduct a social normsmodule reaching more than 2,400 students. Theremainder of incoming first-year students (221)received an expanded presentation delivered byCOSAP that merged the social norms correctioncomponent with the binge drinking presentation.
COSAP also attended heath fairs, provided DWIand alcohol-related materials to student affairspersonnel at UNM Valencia, Taos, Gallup, andLos Alamos branch campuses and conductedsurveys on high risk drinking.
Core Alcohol and Drug Survey results fromFY05 showed that students reporting that theydrove under the influence of alcohol or drugswere down from 43.8 percent in 2002 to 39.7percent in 2005. An overwhelming majority ofstudents (95.7%) indicated their friends woulddisapprove of them driving after drinking, with71.6 percent of respondents identifying theirreaction as one of strong disapproval. Seventysix percent of students reported “I’m going todrive.” as a very important reason for limiting orexcluding any intake of alcohol, with 15.2percent indicating it was important, 5.1 percentsaid it was somewhat important, and less than4 percent thought it wasn’t at all important. is an indicator that the anti-drunk drivingmessage is reaching students and changing theirbehavior.
A new question added to the survey on theuse of designated drivers and cabs found thatusing alternatives to driving under the influenceis becoming normative behavior among UNMstudents who drink alcohol. Seventy two percentof students understood the importance of notdriving under the influence and routinelyemployed measures to avoid this behavior.That’s the good news. The bad news is thatalmost 15 percent of students who drankreported rarely or never using a designated driveror cab, and 13.1 percent reported using adesignated driver or cab some of the time. Thesestudents represent a “prevention challenge”.During the next academic year, COSAP plans toconduct focus groups to develop effectivestrategies to combat this high-risk behavior.
COSAP won the grand prize in the annualCollege and University Drinking and DrivingPrevention Competition for the year 2005.

DGR maintains a comprehensive traffic crashdatabase for the State of New Mexico. TheNMDOT’s Transportation Statistics Bureau isresponsible for the initial compilation andprocessing of this data, which is then finalizedand analyzed by DGR. TSB has funded DGR forover twenty years to maintain and analyze theNew Mexico traffic crash database.
In FY05, DGR finalized crash data for 2003and 2004. They processed monthly fatalities logdata and reported it on their web site - http://www.unm.edu/~dgrint/dgr.html.
DGR finished a rewrite of the programs thatread the crash file, streamlining the process andallowing the crash file to be read directly fromthe state mainframe, enabling DGR to createanalysis files in a single program. DGR alsodeveloped a new process for reporting thedifferences between the fatalities log and thecrash file.
DGR processed driver master files, includingthe DWI Citation Tracking System (DWI CTS)file in October, January, April and July due to ahigh demand for quarterly data on DWI arrests.The July master driver was used to producecounts of licensed drivers for use in analysis andreporting. DGR processed the HighwayPerformance Monitoring System (HPMS) file,providing updates of the Vehicle Miles data, andupdated population data from the US CensusBureau.
DGR finalized and printed the 2003 rural andurban problem identification and communityreport publications and prepared the 2004standard annual reports (Crash Report, DWIReport and Alcohol Crash Map.)
In any year, much of DGR’s efforts are devotedto the production of special reports and analysisand FY05 was no exception. DGR providedinformation for over 100 special requests fromTSB, other state agencies, individuals, lawenforcement and the media. DGR alsoparticipated with the State Traffic RecordsCoordinating Committee and several otherinitiatives and provided data for the New MexicoHighway Safety Plan, as well as expertise in theprocess of updating it.
DGR maintained their Geographical InformationSystems (GIS) capabilities and continued to

explore new ways to provide geographic analysisand display. As a result of the expanded GIScapabilities, coverage now includes all cities andtowns in NM with a population greater than4,000.
Although the NMDOT now maintains TSB’s website, the DGR updates and enhances the TrafficCrash Data pages on servers at UNM, which areaccessed through a link from TSB’s main page.

In 1995, the UNM Department of EmergencyMedicine consolidated its injury activities into theCenter for Injury Prevention Research andEducation (CIPRE) to unify its injury preventionefforts and expand its research and educationactivities.
With funding from TSB, CIPRE encouragespedestrian activities such as bicycling, walking,running, and horseback riding. While theseactivities provide health, economic, andenvironmental benefits, they also increasepedestrian exposure to traffic and traffic crashes.To reduce New Mexico’s pedestrian fatality rate,CIPRE is working to identify and address theneeds of these at-risk populations throughseveral types of community based programs.These programs include: walkable communities,public awareness campaigns, and collaborativeefforts with other bicycle and pedestrian safetypartners.
Community based programs for pedestriansafety focus on working with communitymembers to identify and address specific local
pedestrian problems. Solutions fall into five majorcategories: education through local schools andtribal programs, engineering changes, increasedpolice patrol and ride services near bars,responsible server education for liquor servers,and use of detox/rehab facilities.
Pedestrian Safety Seed Grant funds were madeavailable to communities to implement projectsat the local level. TSB allocated $52,000 for thePedestrian Safety Seed Grant Program in FY05to target areas at increased risk, primarily inurban communities and adjacent tribal areas.
CIPRE works with the Statewide WalkabilityAdvocacy Group (SWAG) to oversee thedevelopment of local WAGs in 11 communitiesaround the state. SWAG provides crash dataanalysis and technical assistance to WAGs onpedestrian safety. Objectives of local WAGs areto develop:
1. a local, broad-based coalition to promotepedestrian safety and walkability.
2. a local slideshow based upon a modeldeveloped by the statewide WAG.
3. a strategic plan that includes a PedestrianSafety Road Show for promotion ofwalkability and pedestrian safety among localdecision makers and the public.
4. the knowledge and training to implementcommunity change in the area of pedestriansafety and walkability.
After two years in the Walkable CommunitiesProgram, communities are qualified to apply forfunds through the Pedestrian Safety Seed GrantProgram.

Administered by CIPRE and funded by TSB, theUrban Pedestrian Law Enforcement Pilot Studyhas three primary objectives:
1. to train law enforcement officers on howto conduct pedestrian “decoy” operations,
2. to implement pedestrian “decoy”operations in areas identified as high-risk forpedestrian injuries, and
3. to evaluate the effectiveness of theoperations in terms of injury reduction andmotorist yielding to pedestrian behavior.
“Decoy” operations were conducted inAlbuquerque, which accounts for nearly 50% ofall pedestrian crashes in New Mexico. A “decoy”operation consists of a uniform or undercoverofficer attempting to cross the street at amarked crosswalk and observing motoristcompliance. If the motorist does not comply bystopping or yielding to the pedestrian, theuniform or undercover officer notifies other lawenforcement officers located down the streetto stop the motorist and issue an appropriatecitation. These high visibility enforcementcampaigns are aimed at reducing the number ofturn-conflict related pedestrian crashes.
In FY05, New Mexico participated in a nationalstudy to evaluate the effectiveness of these lawenforcement efforts. Educational handoutstargeting pedestrians and motorists were alsodeveloped by CIPRE for distribution during theselaw enforcement operations.
CIPRE conducts public awareness campaignsthrough news conferences, writing letters to theeditor, speaking at public meetings andresponding to media requests for informationand interviews. It also serves as an informal
clearinghouse for information on pedestriansafety.
CIPRE conducts pedestrian safety eventsincluding International Walk to School Day. Thepurpose of this annual event is to address a criticalaspect of pedestrian safety – children at risk –through media attention on pedestrian needsand issues. During FY05, 14 communities in NewMexico participated. TSB provides materials forevents including informational handouts, coloringbooks, and retro-reflective safety bracelets forchild pedestrians and bicyclists. TSB sponsorsthe Pedestrian Advisory Group, which includesmembers from CIPRE. This group of researchers,data analysts, traffic safety personnel, engineers,planners, medical personnel, pedestrian activistsand public works staff meet quarterly to adviseand provide resources for the development ofpedestrian safety projects.

training, writing and publishing to support thedevelopment of public policy and law. Foundedin 1969 as the public service arm of the lawschool, IPL has a long history of collaborationwith TSB.
Traffic Safety Law Center
During FY05, IPL provided training to new DriverEducation and DWI Schools Instructors withclassroom curriculum, behind the wheel andteaching techniques classes. IPL facilitated a 12-hour Recertification Training for Driving Safetyand Driver Education instructors and DWI Schoolfacilitators, and provided DWI School facilitatortraining for new instructors. IPL also distributedinformation describing the waiver of trainingprocess. IPL offered training and networking

opportunities for both law enforcement andprofessional prosecutors at the ProsecutorsTraining Conference.
In an effort to reduce fatalities and injuries dueto motorcycle crashes, IPL, working with SandiaMotorsports, held Motorcycle Safety AwarenessDay as part of the three-day Sandia Classicvintage motorcycle races. All 3372 attendeeswere given entry wristbands and an agenda withanti-DWI and motorcycle safety informationregarding training, gear and safe riding strategies.Attendees also had an opportunity to pick upadditional materials at the IPL tent, view anantique motorcycle collection and enjoyentertainment for both children and adults. IPLadvertised the event on radio and in print,brought in the star of the classic motorcyclemovie On Any Sunday to encourage attendanceand showed the movie as part of theentertainment. The press conference featuredproclamations from the Mayor of Albuquerqueand the Governor of New Mexico, a MADDpresenter and the Chief of the Traffic SafetyBureau. Participating safety partners included theMotorcycle Safety Foundation, Safer NewMexico Now, and the Brain Injury Association ofNew Mexico.
IPL provided coordination and oversight for theCommunity Driving While Impaired Program(CDWI). CDWI is a statewide programsponsored by TSB. Of the 33 counties in NewMexico, 31 receive CDWI funding, totaling nearly$900,000. In order to be eligible for funding,each county must develop a plan on how tobest use these resources to fight DWI in theircommunities. Allocated funds can be used in anyof four categories: enforcement, prevention,offender programs, and public information and
education. The majority of counties place theirmonies in enforcement. However, severalcounties have created successful programs suchas Rio Arriba County’s “Cruise Don’t Booze Night”program which targets teens between 16 and19. The CDWI program has helped manycommunities throughout the state spread DWIawareness through media, prevention, andenforcement programs which would have beendifficult without the funds provided through thisprogram.
As part of its oversight responsibilities for theCDWI program, IPL reviewed requests anddocuments for reimbursement, implementednew agreements for each community, closedout the previous year’s agreements and traveledto communities to provide technical support andtraining. IPL also hosted the Annual CDWIConference and provided information on newand continuing programs to CDWI coordinators,as well as an overview of CDWI financialprocedures. During a press conference at thecompletion of the FY05 conference, GovernorRichardson praised the hard work and dedicationof CDWI coordinators and staff.
IPL staff facilitated the MADD Public PolicyInstitute in Santa Fe and worked with MADD onspeaker coordination. Conference highlightsincluded a session at the Roundhouse andmeeting Governor Richardson and MADDPresident Wendy Hamilton.
IPL staff processed 389 applications for licensesand certificates for driving while impaired, drivereducation, and driving safety schools as well asinterlock providers and installers in FY05. Thebreakdown of licenses and certificates issued inFY05 is as follows:
IPL monitoring staff visited 207 program sites for TSB.Each visit required completing a quality assurancechecklist with the licensee to confirm programcompliance. Monitors submitted reports to the licensingagents at IPL, who notified licensees of the results ofthe visits. The breakdown of FY05 visits is as follows:

IPL hosted a conference for ignition interlockproviders in Albuquerque. More than 60providers attended, including representativesfrom all approved manufacturers, some comingfrom as far away as Canada. IPL developed theconference agenda in consultation with TSB staffto address issues identified during 2004’s ignitioninterlock licensing program. Conferencepresenters included representatives fromGovernor Richardson’s DWI Task Force, theNew Mexico Motor Vehicle Division, Departmentof Finance and Administration, AdministrativeOffice of the Courts, Department of Public Safetyand IPL staff.
IPL also provides printed materials and webinformation for the NMDOT. IPL writes anddistributes the Traffic Safety News, a monthlynewsletter, featuring current traffic safetyinformation, news, statistics and events. Fullcolor versions of the newsletter are availableon IPL’s Traffic Safety Law Center and NMDOTweb sites.
The Traffic Safety Law Center web site containstraffic safety reference materials and links tosites of interest to the traffic safety community.IPL updated and printed the Under 21 Penaltiesand the High Cost of DWI posters, an updatedProtect Your License brochure and designed,printed and distributed a poster featuring NewMexico’s new felony DWI law. At the beginningof the 2004-05 school year, IPL mailed materialsto every high school in the state. IPL alsoresponded to special requests from TSB, otherstate agencies, individuals, law enforcement andthe media.

Center of New Mexico, was established under afederal grant in 1991 to provide education andtraining to judges, administrators and other staffof the New Mexico judicial branch.
In 1993, the New Mexico Legislatureestablished JEC within the Institute of Public Lawat the UNM School of Law, and provided statefunding for its operation. Working with theguidance of the Judicial Education and TrainingAdvisory Committee, JEC produces about twodozen educational programs annually, includingannual conferences, regional seminars,teleconferences broadcast by satellite, andspecial interest seminars. JEC has also developedinteractive training on its web site for judges andclerks. JEC developed and maintains benchbooksfor limited jurisdiction courts. Additionally, JECprovided DWI training to all newly appointedmagistrate judges and produced a publictelevision documentary on New Mexico’s limitedjurisdiction courts.
During FY05, work completed by JEC for TSBfell into five major areas: municipal courts,magistrate and other courts, evaluation,benchbook, and distance learning and onlinetraining.
JEC met with the education committee for themunicipal court judges and prepared DWI-relatedprogramming for their June annual conference.Judges were trained in search and seizure,evidence, sentencing, and changes in DWI law.Both judges and court staff heard presentationsfrom the Motor Vehicle Division on various issuesrelating to DWI reporting and the new interlockdevice requirements.
JEC reviewed and compiled evaluations fromDWI-related presentations at the MagistrateJudges Conference conducted during FY04. JEC
updated and published scripts and checklists formagistrate and metropolitan court judgesapplicable to DWI cases and planned andexecuted the 2005 Magistrate Courts AnnualConference, attended by 260 clerks and 70judges. Topics for clerks included ethics, legislativeissues, data standards, landlord/tenantprocedures, advanced criminal procedures,interlock law requirements, dealing with difficultdefendants, and tips for helping non-Englishspeaking customers, legal research and courtsecurity. Topics for judges included ethics, civiland criminal law and procedure, jury trials,alternative sentencing, commercial driverslicenses, domestic violence and stressmanagement. A portion of the judges trainingdemonstrated the use of the published and onlineresources available to the courts on DWI. DWItraining was then presented to the entire groupof magistrate judges, including a session on hardcore drunk driving presented by the CenturyCouncil.
The first phase of JEC’s project to evaluate itseducational offerings for New Mexico magistratecourts has been completed. Consultant TomLanghorne conducted 13 confidential focus groupinterviews of magistrate judges and court staffthroughout the state to gain information on theireducational needs and the extent to which JECis fulfilling them. The next phase will be distributionof a confidential survey by mail to all magistratejudges and staff. JEC appreciates the time andattention many judges and staff have devotedto this project and encourages full participationin the mail surveys. The result will be acomprehensive assessment of JEC’s servicesalong with recommendations for improvement.
JEC monitored developments in DWI statutesand case law and revised, published and

distributed updated material for the DWIBenchbook to all New Mexico judges who handleDWI cases.
JEC completed a detailed outline and flow chartand developed an enhancement for the DWIvirtual trial. Work was also done on developingand constructing a database necessary to createthe second phase of the DWI virtual trial, as wellas an upgrade to the first trial. Several new itemsof interest for New Mexico judges were addedto the DUI online resource library.
JEC met with Judicial Information Division (JID)staff to discuss the new JID statewide videoconferencing system. JEC held three videoconferences on statutory and case lawdevelopments in DWI in July and August. Courtswith high-speed internet access were linked, andmagistrate and municipal court judges and stafffrom courts without high-speed internet accessparticipated either by attending a session at anearby court with access, or by phoning in overa GSD trunk line. A prosecuting and defenseattorney presented their perspectives on newDWI legislation and case law in each program.This new form of delivering updates betweenannual conferences worked well, with completesupport from the JID.
403 Demonstration ProjectComprehensive Impaired DrivingProgram
In September 2004, NHTSA awarded the NewMexico Department of Transportation TrafficSafety Bureau funds to develop a ComprehensiveImpaired Driving Program. New Mexico vied with19 other states for this Section 403Demonstration Project Grant and will receive
approximately $2.6 million for this program inFY05, FY06, and FY07.
NM’s Comprehensive Impaired Driving (ID)Program has three major components:
1. Development and implementation of a LawEnforcement Plan, to include full-timededicated ID law enforcement;
2. development and implementation of anannual Media Plan to coincide NMDOT mediaefforts with law enforcement activity; and
3. development and implementation of athree-year ID Work Plan, in conjunction witha multi-agency DWI Leadership Team.
A full-time program manager oversees theimplementation of the ID Program.
Accomplishments
In FY 2005, TSB completed the following tasks,listed next by component:
Law Enforcement
Contracts were implemented with five countiesat highest risk for DWI to hire two full-time,dedicated DWI law enforcement officers. Acontract with the Navajo Nation is pending thatwill support two DWI officers in the NM portionof the Navajo Nation.
A contract was implemented with a creativedesign media consultant to develop newmessages for the ID Program, and to designand distribute media kits to local communities.
A contract was implemented with an outreachcoordinator to develop earned media plans forthe five counties and the Navajo Nation. Thecoordinator assists locally with plan

implementation and coordinated communityefforts.
A Law Enforcement Work Plan was completedthat outlines an oversight process, planning andcoordination, enhanced enforcement, highvisibility techniques, resources, training, andevaluation.
A quarterly planning process for lawenforcement was developed, and a web-basedmonthly activity reporting process wascompleted.
Media
A Media and Marketing Communications Planwas developed and implemented by the NMDOT/TSB. The Plan outlines how media efforts willcoincide with high-enforcement operations, suchas Super Blitz and the National Mobilization.
DWI Leadership Team
A multi-agency DWI Leadership Team wasconvened in August and met monthly throughoutthe remainder of 2005. The Team, co-chairedby the Governor’s DWI Coordinator and the TSBBureau Chief, coordinates agency efforts incompleting tasks outlined in the three-year IDWork Plan.
As part of the ID Work Plan, NMDOT helpssupport a full-time Traffic Safety ResourceProsecutor to provide training to prosecutors andcourt personnel, and to provide technicalassistance in DWI cases.

NMBA is a nonprofit corporation chartered bythe State of New Mexico in 1954. It membershipincludes radio and television stations, as well as
other community members with a stakein broadcasting throughout NewMexico. Committed to public service, the NMBAworks closely with many agencies within stategovernment and the Governor’s Office to helpdisseminate valuable information to the public,such as Amber Alerts to help locate missingchildren believed to have been abducted.
TSB funded the NMBA to provide media trainingfor law enforcement, community coordinatorsand local government officials involved in trafficsafety. Through NMBA two-day mediaworkshops, public information officers are betterable to present a traffic safety message that willhave an impact on the public. Using role playingand media panels, participants are taught skillsto give their interaction with the media a moreprofessional quality.
In FY05, the NMBA trained 146 participants atsites in Albuquerque, Rio Rancho, Las Cruces,Clovis and Farmington. Since 2001, 718 peoplehave developed better communication skills andlearned to work more effectively with the mediaas a result of this course.

Section 157IG funding to increase lawenforcement and paid media for the NationalClick It or Ticket campaign in May 2005. TSBwas awarded funding and asked NHTSA to keepthe paid media portion, which was placed by aNHTSA contractor on behalf of the State. As aresult, the State was able to maintain a highseatbelt usage rate (89.5%) for FY 2005.

forward to continuing projects such as theSection 403 Impaired Driving DemonstrationGrant and improving the Standard FieldSobriety Testing Program in FY 2006.
The Traffic Safety Bureau will continue to takethe lead on reducing death and injury due tomotor vehicle crashes in New Mexico.
Several major initiatives that will take shapein 2006 are:
1. the new ignition interlock law for allconvicted DWI offenders,
2. the Department of Public Safety’s mobilestrike unit designed to reduce the availabilityof alcohol to our young people,
3. the Drunkbuster’s hotline which will allowall New Mexicans to become part of thesolution by reporting suspected drunkdrivers, and
4. the completion of a ComprehensiveTransportation Safety Plan that will bringtogether new partners to assist in reducingall types of vehicle crashes.
These programs combined with newinitiatives such as:
1. replicating the San Juan County modelof combined incarceration, treatment, andaftercare;
2. amending the Liquor Control Actregulat ions holding irresponsibleestablishments accountable; and
3. allowing for more flexibility with lawenforcement funding to assist with keepingmore officers out in the field;
will all contribute to making New Mexico asafer place to walk, ride, and drive.
