Presentación
L a O ficina Española de Patentes y M arcas ostenta desde su
condición de organism o gestor de la propiedad industrial una
responsabilidad cada vez m ayor en el nuevo siglo en el que el
acceso y protección del conocim iento suponen ya los elem entos
claves de com petitividad.
L as actividades y los datos estadísticos recogidos en la presente
M em oria perm iten conocer la evolución en las dos vertientes:
protección y divulgación del conocim iento.
L a O EPM ha realizado im portantes esfuerzos en su labor de
R egistro de los títulos que protegen las propiedades inm ateriales,
bien la im agen corporativa de una em presa o sus servicios
y productos a través de signos distintivos o bien las innovaciones
técnicas a través de invenciones recogidas en las patentes y m odelos
de utilidad
C abe destacar un aum ento en el núm ero de solicitudes de patentes
de origen español en sus diferentes tipos: nacional, europea
e internacional tram itada a través del T ratado de C ooperación en
m ateria de patentes (PC T ). Ello ha supuesto un increm ento
en la carga de trabajo del D epartam ento de invenciones que ha sido
respondida con un aum ento en los rendim ientos concretado,
a pesar de todo, en una reducción subsiguiente en los plazos de
tram itación. A ello debe unirse la im plantación en el procedim iento
nacional de concesión del “exam en”con carácter general en todos
los sectores que perm itirá la obtención de títulos con m ás garantías,
lo que ha tenido que ser acom pañada de la correspondiente
inversión en form ación y adaptación de las estructuras.
En el área de signos, 2002 ha supuesto un año de preparación
y consolidación de un nuevo sistem a. D urante el prim er sem estre
se han acom etido las tareas de preparación para la introducción de la
L ey 17/2001 que acarrea im portantes innovaciones desde el punto
de vista procedim ental (m ulticlase, com unicación de parecidos…).
El segundo sem estre se ha centrado en la im plantación efectiva del
nuevo sistem a caracterizado por una redefinición de la función de la
O ficina que no im pedirá de oficio la inscripción de nuevos signos
por parecidos con otros registrados salvo que los titulares
de aquellos que pueden ser afectados por el solicitado se opongan.
Presentation
The Spanish Patent and Trademark
Office possesses, due to its condition
as the organism in charge of the
administration of industrial property,
a growing responsability in the new
century where the access to and the
protection of knowledge already entails
key elements of competitiveness.
The activities and stat istical data covered
in the present Report allow us to
discover this evolution from two points
of view: protection and disclosure of
knowledge.
The OEPM has realised im portant efforts
in its role as the Registry that records
certificates that protect im material
property, be it the corporate image ofa company or its services and products via
distinctive signs, or technical innovations
covered in patents and utility models.
It is worth highlighting an increase
in the number of patent applications
of a Spanish origin, in its different t ypes:
national, European and int ernational
processed through t he Patent
Cooperation Treaty (PCT). This has meant
an increase in the workload of the
Inventions Department, which has
responded with an increase
in productivity, attained despite
a subsequent reduction on the
processing periods. To this w e m ust add
the implem entation within the national
granting procedure of the “examination”
of a general nature in all the sectors,
which will allow for the attainment of
rights with more guarantees, which
has had to be accompanied with the
corresponding investment in training
and an adaptation of the structures
of th e Office.
In the field of Distinctive signs, 2002has been a year of preparation and
consolidation of a new system. During
the first semester the action undertaken
has been to prepare for the introduction
of Law 17/ 20 01, which involves
important innovations from a procedural
point of view (multi-class, notification
of sim ilar signs…). The second semester
has been centred on the effective
implementation of the new system,
characterised by a redefining of the
function of the Office, which will not
prevent ex officio the registration of new
signs that are similar to others already
registered, unless the holders of the
latter sign that may be affected by

the application formulate an opposition.
The OEPM, however, will notify the
above holders whose rights may come
into conflict with the sign that intends
to be registered. It thus facilitates and
makes more flexible the entry into the
market of news signs and, consequently,of new products or services, without a
loss in security for the holders of earlier
trademarks.
From a normative point of view, it is
also necessary to highlight the important
changes in the field of patents, law
which has been modified by the Law on
the legal protection of Biotechnological
Inventions, and in the f ield of Designs
with the approval of a new bill
pertaining to a law that will substitute
the current legislation, that dates back more than 7 0 years.
From an international perspective, there
exist no doubts that the year 2002 has
been conditioned by the semester of the
Spanish Presidency of the Union. The
Office has actively participated in the
dossier corresponding to the community
patent, and in the Accord on same that
was approved in March. 2002 has also
been a year of intense activity in the
OEPM so as to prepare itself to be in
a condition to commence in the year
20 03 its activity as an International Preliminary Examining Authority.
But together with the protection of the
identity and innovations, the OEPM
in the year 200 2 has continued
to penetrate further in the task
of disclosing the technology contained
in the industrial property t itles. Access
to the patent documents that principally
contain technology not disclosed in any
other manner, or other titles, finds its
key element on the Internet.
Symptomatic is the increase in the number of visits, around 15 million. Also
symptomatic, the introduction of new
services including a new sector in the
Technological Surveillance Bulletins,
reinforcing the information on normative
or including more information on
patents. The proliferation of activities
with t he Autonomous Comm unities,
Conferences, Seminars, Courses and the
insertion of publicity in t he press also
follow this line of action.
I trust that the more detailed description
that is carried out in the present Report can give a more complete picture of all
this.
L a O EPM , eso si, avisará a los titulares anteriores cuyo derecho
pueda entrar en conflicto con el que pretende ser registrado. Se
posibilita y flexibiliza así el acceso al m ercado de nuevos signos
y consiguientem ente de nuevos productos o servicios sin pérdida
de garantías para los titulares de m arcas anteriores.
T am bién desde el punto de vista norm ativo deben resaltarse
las im portantes novedades en m ateria de patentes, cuya ley
ha quedado m odificada por la L ey de protección Jurídica de las
Invenciones Biotecnológicas, y en m ateria de D iseño con la
aprobación de un nuevo proyecto de ley que sustituirá la legislación
vigente que data de m ás de 70 años.
D esde la óptica internacional no cabe duda de que 2002
ha quedado condicionada por el sem estre de la Presidencia

Pero junto a la protección de la identidad y las innovaciones la
O EPM en 2002 ha seguido profundizando en las tareas de
divulgación de la tecnología contenida en los títulos de propiedad
industrial. El acceso a los docum entos de patentes que contienen
m ayoritariam ente tecnología no divulgada de otras form as o a otros
títulos tiene su elem ento clave en Internet. Es sintom ático el aum ento
en el núm ero de accesos que ha rondado los 15 m illones. Y tam bién
es sintom ática la introducción de nuevos servicios incluyendo un
nuevo sector en los Boletines de V igilancia T ecnológica, potenciando
la inform ación sobre norm ativa o incluyendo m ás inform ación sobre
patentes. L a proliferación de actividades con C om unidades
A utónom as, Jornadas, Sem inarios, C ursos y la inserción
de publicidad en prensa van tam bién en esta línea.

1. Actividad registral de la OEPM. Evolución de indicadores
En el siguiente cuadro aparecen reflejadas las variaciones
experim entadas en el año 2002 con respecto al 2001 en las
resoluciones y solicitudes de las distintas m odalidades
de P ropiedad Industrial.
C abe destacar un crecim iento en el núm ero de solicitudes
de patentes de origen español tanto nacionales, europeas com o
internacionales (PC T ).
Junto a ello, destaca un descenso en el núm ero de solicitudes
de m arcas, lo que puede estar influido por la introducción del
sistem a m ulticlase con la entrada en vigor de la nueva L ey 17/2001
de 7 de diciem bre, de M arcas.

Patentes de Invención
D urante el año 2002 el núm ero de solicitudes de patentes de origen
español, experim entaron increm entos tanto a nivel nacional com o
europeo e internacional (PC T ).
El núm ero de solicitudes nacionales realizadas por residentes
en E spaña, alcanzó el núm ero de 2.763, lo que supone
un increm ento del 9,51% respecto al año 2001.
El núm ero de solicitudes europeas de origen español
experim entó un increm ento del 3,61% , pasando de 582 en 2001
a 603 en 2002.
L a variación m ás sustancial la experim entaron las solicitudes
internacionales (PC T ) de origen español, siendo 513 en 2001
y 624 en 2002, lo que supone un increm ento del 21,63% .

be necessary to add the requests
for Complementary Protection
Certificates for medicines and plant protection products, which during the
year 2002 reached the number of 36,
having decreased 26,53% with respects
to the previous year.
This category of protection is created
to compensate the loss of the useful life
of the invention, due to the complex
authorisation procedures suffered
by such a products, considerably
reducing the useful life of the protection
conferred by the patents.
During the year, 2,026 national patent cases were resolved, with the following

Esta m odalidad de protección se crea para com pensar por la pérdida
de la vida útil de la invención, debido a los com plejos procedim ientos
de autorización que sufren tales productos, reduciéndose
considerablem ente la vida útil de la protección conferida por las
patentes.

debido en parte a la introducción en el procedim iento de concesión
de patentes de la fase ulterior de “exam en”, lo que alarga el

En lo referente al núm ero de Patentes Europeas concedidas, que se
han hecho válidas en España —previo depósito de traducción al
español—, fue de 17.541.
A sí m ism o se recibieron 184 peticiones de protección provisional
de solicitudes europeas publicadas m ediante la aportación de la
correspondiente traducción de las reivindicaciones.

meant the realisation of 722 IBIS.
During the year 20 02 a total of 2,216 State of the Art Reports were elaborated
as part of the general granting
procedure, of w hich 2,202 were
published together with the application
and made available to the public for
observations by interested third parties;
and in accordance w ith Transitional
Provision Ten of t he Patent Law, 3 State
of the Art Reports were elaborated
on patent s already granted. The
remaining 11 reports were published
subsequently to the publication of the
corresponding patent application.
With regards to the Patent Technological
Reports, there was an increase of 3.29%

de la T écnica, dentro del procedim iento general de concesión,
de los cuales 2.202 fueron publicados junto a la solicitud y puestos
a disposición del público para observaciones de terceros; y conform e
a la disposición transitoria 10ª de la ley de patentes, se realizaron
3 Inform es sobre el Estado de la T écnica a patentes ya concedidas.
L os 11 Inform es restantes, se publicaron con posterioridad a la
publicación de la correspondiente solicitud de patente.
En lo que se refiere a los Inform es T ecnológicos de Patentes,
experim entaron un increm ento del 3,29% respecto al año anterior
realizándose 345 Inform es.
En el año 2002 se generalizó el Procedim iento de E xam en Previo
a todos los sectores, realizándose 17 inform es de este tipo.

de solicitudes experim entó un descenso tal y com o se refleja
en el gráfico adjunto.
L a entrada en vigor el día 31 de julio de 2002 de la L ey
17/2001 de 7 de diciem bre, de M arcas, con la introducción
del sistem a m ulticlase, repercutió sobre el núm ero de
solicitudes de m arcas al poder acum ular una solicitud varias
clases, frente al sistem a anterior de una solicitud por clase. A sí
m ism o dicha L ey elim ina la m odalidad registral de R ótulo de
Establecim iento, lo que contribuyó al descenso del núm ero
de solicitudes de los m ism os.

rationalisation and reorganisation
of the work that was habitually being
performed. Amongst these new
functions it is worth mentioning
the request for official fees, which
constitutes a novelty with respects
to the previous situation; for the
subsequent publication in t he BOPI
(Official Industrial Property Bulletin)
of the notification of the filing of a
Contentious-Administrat ive Appeal with
respects to a distinctive sign, or for the
publication in th e BOPI at th e request
of the appealing party of the ruling in
a Contentious-Administrat ive Appeal in this same field.
The most notable fact, in relation with
the Coordination activities with the
Justice Administrat ion during the year
2002, has been the growing complexity
of the mandates received from the
Courts and Tribunals and, where
appropriate, of the petitions made by
individuals. It is worth highlighting that
said growing com plexity has led, on
many occasions during the year 2002,
to it being necessary for the issuance
of legal reports on the way of complying
with the legal mandate, or carrying out
interested annotations at the request
of a party. This situation has prin cipally
arisen in relation with the possible
guarantees to be constituted regarding
industrial property rights, in relation with
the possibility of the constitution
of an embargo over patent licences,
and oth ers.
On the other hand, and with regards
to the ex officio cancellations of
provisional registrations of an embargo due to the conclusion of the term
established by the Mortgage Law,
entries have been cancelled in relation
with around 465 cases that affect an
average of 10 registrations per case,
which implies an increase of around
17% with respects to the cancellations
carried out during the year 20 01 .
2. Relaciones con la Administración de Justicia
L a entrada en vigor de la nueva L ey de M arcas ha establecido
nuevas tareas que han determ inado la adaptación, racionalización
y reorganización de trabajo que habitualm ente se venía
realizando. Entre estas nuevas funciones cabe destacar la petición
de tasas, que constituye una novedad con relación a la situación
anterior; para la posterior publicación en el B O PI del anuncio
de la interposición de R ecurso C ontencioso A dm inistrativo
en m ateria de signos distintivos o para la publicación en el B O PI
a instancia del recurrente del fallo de un R ecurso C ontencioso
A dm inistrativo en la m ism a m ateria.
El dato m ás destacable en lo que se refiere a las actividades de
C oordinación con la A dm inistración de Justicia durante el año
2002, ha sido la creciente com plejidad de los m andatos recibidos
de Juzgados y T ribunales y , en su caso, de las peticiones
realizadas por los particulares. Es de destacar que esa creciente
com plejidad ha determ inado que en num erosas ocasiones,
durante el año 2002, haya sido necesaria la em isión de
dictám enes jurídicos sobre la form a de cum plim entar el m andato
judicial o de realizar las anotaciones interesadas a instancia
de parte. Esta situación se ha producido fundam entalm ente en
relación a las posibles garantías a constituir sobre los derechos
de propiedad industrial, en relación a la posibilidad de
constitución de em bargos sobre licencias de patentes y otras.
Por otro lado y en lo que se refiere a las cancelaciones de oficio
de anotaciones preventivas de em bargo por transcurso del plazo
establecido en la L ey H ipotecaria, se ha producido la cancelación
de asientos en relación a alrededor de 465 asuntos que afectan
a una m edia de 10 registros por expediente, lo cual supone un
increm ento de alrededor del 17% respecto de las cancelaciones
realizadas durante el año 2001.

3 .1.1 . Spanish Presidency of the European Union
Spain presided, during the first semester of 20 02 , the Counci l of
the European Union. With respects
to the Spanish Patent and Trademark
Office (OEPM), its Director presided
the m eetings of the “Working Group
on Intellectual Property, Patents”,
principally centred on the Bill for the
Regulations of the Community Patent.
On the 21 st of May the Council of the
Internal Market approved a document
that was considered the foundations
for future work.
Furthermore, th e OEPM presided th e
comm unity coordination meetings that
took place in the dif ferent Comm ittees
in International Organisms, like, for
example, in the World Intellectual
Property Organisation (WIPO) and,
concretely, in the Standing Comm
