COMPANY SYNOPSIS
Derwent Safety Centre Limited is a private limited company registered at Companies House, Cardiff,number 4658400, initially established in 1991 as DSC & Associates, health and safety consultantsproviding safety training and consultancy to a wide range of businesses involved mainly within thebuilding and construction industry.
We provide a wide range of services, from the writing of Health and Safety Plans and Policies, to themonitoring of site safety systems and conducting training courses. Our instructors/tutors are wellqualified and experienced and our health and safety advisory team hold membership of The Institutionof Occupational Safety & Health (IOSH) (from full corporate chartered safety and health practitioners andfellowship status to a minimum of Tech IOSH), with some also members of the British OccupationalHygiene Society and the Association for Project Safety.
In addition, in 2013 Derwent Safety Centre was awarded a Worksafe Consultant Membership Certificateas a Consultant Health and Safety & CDMC. This was successfully renewed in 2014 and again inFebruary 2015.
Derwent Safety Centre client base is very varied, ranging from small M & E contractors through housebuilders and painters to retail outlets.
Training can be arranged to accommodate small groups and provides an ideal opportunity to reinforcethe health and safety message. Affiliation to larger organisation, such as the B&ES and the CITB,enables us to deliver recognised, and in some cases, grant approved training.
Derwent Safety Centre is also committed to helping its Clients comply with Environmental legislation andqualified assistance is now available.

Robert Skinner BIOGRAPHY
Robert Skinner CMIOSH, RMaPS is the Director of Derwent Safety Centre Ltd, a health and safetyconsultancy business based in Derby, primarily dealing with the construction industry sector and its alliedtrades. Robert has worked in the Construction industry since leaving school and started his health andsafety career and consultancy business in 1991.He is also registered with the national OccupationalSafety and Heath Consultants Register (OSHCR) since its inception.
Robert is a past Chairman of the IOSH Consultancy Group, a past founder member of the Federationof Small Businesses Health and Safety Policy Committee, a member of the British Occupational HygieneSociety, a Registered member of The Association for Project Safety, Vice chair of the Building andEngineering Services Association Midlands Safety Group and a current committee member and pastChairman of the Midlands Construction Safety Association.
In addition Robert is a supporter of the Nottingham Branch of the Lighthouse Club, the nationalconstruction industry charity, which raises funds through events to support people working in the Industryand the dependants of people who have died following an accident.
His goal is to

Travelling Expenses
Option 1The ‘mileage as incurred rate’ recorded from the Derby office is charged at 0.50 per mile.
Option 2The ‘radius rate’ which is fixed dependant on the radius distance measured as a straight line from the Derbyoffice is as detailed below.

Site Visits
Regardless of the mileage option selected, the monthly Site Visit Rate is determined by frequency and theradius distance.
Charges
The Current Hourly Rate for a Chartered Safety and Health Practitioner is £75.00 per hour + expenses.Specialist e.g. Occupational Hygienists or Environmental Practitioners will be costed separately as required.

2015 Travelling Expenses, Monthly Site Visit Rates and Hourly Charges
• Should the duration of the visit be more than a day, and the daily mileage exceed mileage band‘F’, a charge of £98.00 may be levied to cover overnight accommodation.
• For visits involving a full day, and those within radius band ‘G’ or above, and where thetravelling time greatly increases the length of the day, a charge of £98.00 may be levied tocover overnight accommodation.
• When travelling to major cities i.e. London, Leeds, Manchester etc and where parking may notbe available, traffic congestion encountered, congestion charges or other restrictive limitationson car use levied, the preferred option of public transport will be taken.
• *Travelling charges to London/major cities will be based on standard open fares levied by thevarious train companies concerned.
• Additional fees for tolls, taxis, congestion charges or other restrictive charges on vehicle useapply, costs will be as incurred.
• Ths site visit rate is based on visits being undertaken on a regular, monthly basis andscheduled to suit Derwent Safety Centre & Associates’ diary.
• Pre-arranged attendance for meetings or any other purpose or at a time determined by theClient, including accident investigations, training or other specialist services will be charged atthe relevant hourly, daily or negotiated rates.
• All charges are subject to Value Added Tax at the prevailing rate(s).
Note: - One day equates to 7.5 Hours.

* Where public transport provides a safer and direct route to major cities, e.g. Glasgow, London,Bristol etc, then the fee charged will be equal to the standard fee levied by the train and/or air-line company, plus taxis/tube fares as required.
For visits involving more than the minimum two hours and falling within mileage band D where thetravelling time greatly increases the length of the day, a charge of £98.00 may be levied to coverovernight accommodation to ensure the driver is not under pressure to drive whilst fatigued.
Additional fees for air-lines, tolls, taxis or any congestion charges will be made as incurred.
The above site visit rates are based on visits being undertaken to suit Derwent Safety Centre &Associates’ schedule.
Pre-arranged or attendance at meetings or other times determined by the Client, including accidentinvestigations, training or other specialist services will be charged at the relevant hourly rates.

1. Our aim
Derwent Safety Centre Ltd (trading as DSC & Associates) will endeavour to provide ourClients with relevant and suitable Health and Safety advice in a personal and professionalmanner.
2. Definitions
a) Client : is defined as the entity or person who has requested and/or contractedDerwent Safety Centre Ltd to supply a service.
b) Consultant : is Derwent Safety Centre Ltd (trading as DSC & Associates).
c) Report(s) : generic risk and COSHH assessment, method statements, project or task specific risk assessments and method statements, construction phase plans (includingtraffic management plans), project inductions, site inspections and audits.
d) Agreement : the agreed arrangements between the Client and the Consultant.
3. Charges and expenses
Our charges and expenses will be calculated by either:
a) a set figure quoted for an agreed amount of work calculated on the level of inputrequired by the Client to ensure a satisfactory outcome;
or
b) reference to the time actually spent by the consultant and other Derwent SafetyCentre staff in respect of any work undertaken on behalf of the Client. This will includeattendance at meetings, the perusal and work on existing documents, the preparationof new documents, correspondence, travelling time and travel expenses.
Our fees will be as per the agreement.
4. Payment arrangements
The invoices of the Consultant become due upon receipt.
All charges are subject to Value Added Tax notwithstanding any exempt goods.

The Consultant reserves the right to levy a late payment surcharge on any outstandinginvoices not settled within 30 days at an amount of at least a rate of 8% over and above theprevailing base rate at Barclays Bank plc together with all reasonably and associated costsincurred, in the collection of any late payments/debts due by the Client to the Consultant.
The Consultant reserves the right and will suspend further service provision where it believespayment(s) to be unduly delayed. The Client will be notified in writing whereby theConsultant intends to withhold services.
Any claim or dispute by the Client as to the level of service or the amount(s) invoiced needsto be brought to the attention the Consultant within ten days of the Report provided orfollowing receipt of any invoice.
The Consultant will not accept any claim for damage to goods delivered unless notifiedimmediately upon receipt. Where goods are required to be insured or logged during deliveryand acceptance, special cover will be arranged with The Post Office or couriers and chargeslevied accordingly.
5. Communication between you and us
Our aim is to offer all our clients an efficient and effective service at all times. Should therebe any aspect of our service with which you are unhappy, please raise your concerns inwriting to Mrs A Skinner, Company Secretary.
6. Provision of reports
6.1 Notwithstanding any other provision of this agreement, neither party’s liability under or inconnection with this agreement shall be excluded or limited to the extent that such exclusionor limitation is not otherwise permitted by law.
Subject to this, the Consultant will not be liable to you for any direct loss including loss orprofit or contracts or any indirect or consequential loss including without limitation economicloss, loss of turnover, business or goodwill arising under or in connection with the agreement,whether in contract, tort (including negligence), breach of statutory duty or otherwise; andthe total liability of the Consultant to you in respect of all other losses arising under or inconnection with the agreement, whether in contract, tort (including negligence), breach ofstatutory duty or otherwise, will not exceed an amount equal to the annual fees payable byyou under the contract in relation to the Services giving rise to the liability. This limitation ofthe Consultant’s liability will survive termination of the agreement.
6.2 Where the Consultant provides Reports, whether specific or generic, then it is the soleresponsibility of the Client/user of the document to ensure that the document is suitable andsufficient to control the works or tasks which they are undertaking or for which they areresponsible. The Consultant cannot guarantee that every activity undertaken will be legallycompliant as the Consultant may not have the information in all circumstances to identify allpossible hazards and even where the hazards may be the same, the control measuresadopted by the Client for whom the Client is responsible may be different from thosespecified in the Reports or associated documents to meet the particular conditions of therelevant workplace.

6.3 It is the Client’s responsibility to ensure controls are implemented and that Reports providedby the Consultant are sufficient to cover activities undertaken by personnel under theircontrol and the control measures are suitable and sufficient.
6.4 Where generic documents have been provided by the Consultant to the Client they arecompiled to cover the core activities or higher risk operations undertaken by the Client. TheClient will need to amend them accordingly to suit conditions/activities encountered on eachproject and further develop safe systems/method statements as required. It is the Client’sresponsibility to identify and manage any specific hazards or circumstances not covered bythe Reports/guides supplied.
6.5 The Client should be aware and remember that any risk assessment and/or safe system ofwork such as a method statement will only be effective if the Client and its workforce or otherpeople for whom it is responsible act upon it. The Client must follow through with any actionsrequired and review it on a regular basis.
6.6 Reports, with the exception of site safety reports recorded on NCR forms, will be providedin an electronic industry recognised standard format, secured with password protection toprevent alteration by unauthorised persons, unless paper copies or other formats have beenagreed prior to work commencing.
7. Terms and conditions
The Consultant’s terms supersede and override any and all contractual terms and conditionsof the other party howsoever and whenever communicated.
