Fatehpur, Distt. Kangr4 H.P. was organized on 14.05.2013 at 11.00 AM by H'P' State Pollution control
Boa.j, Regional offrce Jassur as per notification No-So-1533 dated 14.09.2006. This public hearing
was organized by the H.p. State Pollution Control Board under the chairmanship of ADM Kangra at
Dharamshala according to prescribed process of public hearing. The attendance sheet of participants
present in the public nearing is enclosed (Annexure-I). In this public hearing SDM Jawali' Distt' Mining
Offrcer, panchayat pardhan of Riyali Panchayat & Residents of nearby Panchayats were present' First of
all Er. S.K.Dhiman, Regional offrcer, HPSPCB, Jassur welcomed the chairmarU offtcers and officials of
various Departments and public, thereafter started the process of Public Hearing' ADM Kangra at
Dharamshala requested the people present in the Environmental Public Hearing to express their views,
comments, suggestions and objections regarding this proposed Mining Lease without any fear and
pressure froq any comer. Then the brief description regarding this proposed Mining Area was given by
the representative of the Stone Crusher and their consultant IWs IDMA Laboratories' Panchkula'

He said that whether crusher o\4rners get benefited ornot, it may be known to crusher owners itself, butcommon people get lot of benefits. In the past tractorowners used to damage the areas nearby due tomining, but now they get the material from thiscrusher at cheaper rates. All the nearbypeople/contractors would not get the constructionmaterial at such cheaper rates anywhere else. Fewpeople would be having their objections, but whenthe flood arises, its natural and then nobody will beable to stop that, even the govemment. What's goingon is better and people are havins benefits overall.

He said that the Government's Mining policy is onlyfor giving benefits to the crusher owners andcontractors. Common people do not have anybenefits. Due to the floods the stream of.the river andwater in it gets changed as per the availability of theslope of the area. He said that they are not against thedevelopmental activities but it should not be in such amanner that for the betterment of one area the otherarea be destroyed.

He said that during August 2011, when flood camethen the destruction was of about 177 Hectares ofland and the compensation given was Rs.06,27,266.00, in which 52 affected people were givenRs. 1,14000.00. The affected area of Tehsil lndorawas 962 Hectares. The Mand region is having 3065motors md 44 govemment rigs for the irrigationfacilities, which are adversely affected because of theflow of edges of the river stream due to the stonecrusher. He informed that the Kisaan Sabha has
passed their resolution and requests the governmentto declare Mand area as no mining zone as theenvironment of this area is being effected due to theminine activities carried out bv the machineries.

He said that their main concem is about the waterdischarged by the BBMB from Pong Dam whichaflects the people a lot. In the past also floods cameand at that time there were no crushers in the regionand the mining was carried out at that time also.People from Punjab took the mineral from this area.Whether the crusher is benefiting or not it is adifferent issue, but they have provided theconstruction material free of cost to 50-60 people. Healso advised that if this river stream is channelizedthe problems get solved. The people think that thewater enters their land/trouses due to the crushers, butit is due to the water released in the river from thedam. Instead of closing the crushers the river streamis required to be channelized.

also not carried out inproper way, then alsowater gets its way alongthe village and the floodcondition arises.

He said that among 1000 people only 2 personsagreed upon the installations of crusher and 998 leftout wer€ always against the proposal. The crusherinstallation leads to the accidents, they dig out thedeep pits which lead to the occurrence of accidents ofmany people.

He said that all the views expressed in favor ofcrusher are political. People came from punjab andbought lands here and the paths meant for the waterflow were obstructed by filling soil/muck. Now,when the water come it goes into agricultural fieldsand definitely cause losses. It is very important tohave crushers and there is no idverse impact of it.Many social activities were done by the crusherowners in the local area. Last year also when water ofthe rivdr came into the fields, they have channelizedthe sffeam and protective measures were taken bythem. He stressed and said that the permission maylggranted to the crusher.

As already informed,the old river course as diverted time to time havebeen developed by the people and have createdprivate land over there by filling in muck/soil, andwhen water/floods carne, nobody asks BBMBregarding the release of water, but everybody saysclose the crushers.

stations to be careful regarding the release of waterfrom the dam.He said that there are advantages of this crusher
because the checkdam constructed by them helps
their children to reach school on time because earlierthey had to wait near the river. He thanked the
crusher owners for this.He said that nobody has given the main reason for the
floods in the area. This is due to the water released
from the dam and also due to the contribution fromthe tributaries of the Beas River downstream of the
dam. If the crusher owners doing mining from the
river bed, it is good for the local people as due to thisthe bed level goes down and help channelizing the
river and reduce the risk of the flood and there willbe no damage to the Mand area. The crusher is
required as they require the material to fulfill their
basic construction needs. The material when required
by the poor people is provided free of cost by the
crusher owners. The river is required to be
channelized in proper manner.

no flood conditions?4. In Delhi, people are having their houses adjoining to railway
tracks, then doei any earthquake came at their houses due to the
movement of the trains?

People came from Punjab and bought lands here and the paths meant
for itre water flow were obstructed by filling soil/muck. Now, when
the water come it goes into agricultural fields and definitely cause
losses. It is very important to have crushers and there is no adverse
impact of it. Many social activities were done by the crusher ownefs
in ihe local area. Last year also when water of the river came into
the fields, they hdve channelized the stream and protective measures
were taken by them. He stressed and said that the permission may be
sranted to the crusher.

He said his landis adjoining to the crusher. As the mining will increase, the waterlevel will go down. As already informed, the old river course asdiverted time to time have been developed by the people and havecreated private land over there by filling in muck/soil, and whenwater/floods came, nobody asks BBMB regarding the release ofwater, bu! everybody says close the crushers

18. Thakur Gian Chand He requested the committee to consider the vGws of Smr Sashichaudhary. He told that in India there are important places such asIndia Gate in the capital of the country New Delhi where the waterof the river Yamuna used to touch this place, but after adoptingmany protective measures (channelization), no water/flood comesthere and it was protected. Houses were constructed in past also, butwhen they will dig pits up to 60 feet the floods will defrnitely comeand losses will be there.

He said that 300-400 vehicles have got employrnentJeople arejealous of the crushers and these are old crushers in this area and notnew. There is a dam in the upstream and river in the downstream,whenever the water is discharged by the BBMB authorities, it isnever informed to the local people in advance which lead to floodsituations. In past also when crushers were not there, the floodsituation was there due to this problem. 300 vehicles mean thataround 2000 people get employmint. He stressed that they want theglgshefs to be operated and the river stream should be channelized.

I raised the objections regarding the bridge constructed with crores drupees. Ex- Pradhan issued NOC after indulging in comrption andthe loses of it were faced by the villages of nearby areas in August2011. The location of this area is in 2 to l0 mtr slope and the Beasriver is diverted towards this side due to the mining by the crusherownefs with the JCB. In the past this bridge was at one side and theriver stream was on the other side, people used to travel in boats.Regarding the terrace place it is submitted that it is not a terraceplace but it is Beas river. The JCB is used to dig 5-g Meters and thisis done under the shelter of the departments. This has also beenpublished in news papers many times. He alleged that the fineimposed against illegal mining is very less. The vehicles areoverloaded and the material is not covered during transportation.The industry is operated day & night. The mining.activities arecarried out by heavy machinery. No plantation is carried out by theindustry and neither water sprinkling is carried out. No road hasbeen provided by the unit. He informed that BBMB have acertificate to release 30,000 cusecs of water downstream from thedam without any information. Before the monsoon the intimation isgiven to the local people and the local police stations to be careful
lggqding the release of water from the dam.
He said that there are advantages of this crusher because the
checkdam constructed by them helps their children to reach school
on time because earlier they had to wait near the river. He thankedthe crusher owners for this.

He said that nobody has given the main reason for the floods in the
area. This is due to the water released from the dam and also due tothe contribution from the tributaries of the Beas River downstream
of the dam. If the crusher owners doing mining from the river bed, itis good for the local people as due to this the bed level goes down
and help channelizing the river and reduce the risk ofthe flood and
there will be no damage to the Mand area. The crusher is required as
they require the material to fulfill their basic construction needs. The
material when required by the poor people is provided free of cost
by the crusher owners. The river is required to be channelized in
