In Matter of A-R-C-G, the Board of Immigration
Appeals surprised many immigration attorneys by
ruling that domestic violence can be a basis for
granting asylum to immigrants.
Although the decision only applies to “married
women In Guatemala who are unable to leave their
relationship,” its impact will be far greater.
After a 20-year battle, immigrant women will
finally have an opportunity to show the abuse
they’ve suffered rises to the level of persecution
under asylum law.

The U.S. government, though not admitting any
wrongdoing, has reached a settlement with the ACLU,
which will allow some immigrants, previously deported,
to return and fight their cases.
The lawsuit alleged federal agents had used
intimidation, threats, and misinformation to persuade
immigrants into signing fast-track “voluntary return”
deportation agreements. Many deportees were longtime
residents with no criminal convictions, and did not know
they were entitled to seek relief at immigration court.
The agreement only covers Southern California
immigrants between the years of 2009 – 2013. It is
likely, however, some of the procedural reforms
will be implemented nationwide.

To the public, the concept of an independent
judiciary seems commonplace. Immigration courts
are an exception.
According to Judge Dana Leigh Marks, president of
the National Association of Immigration Judges, the
immigration court system should be separated from
the control of Justice Department and operated
independently of federal law enforcement.
“Our goal is to serve as a neutral court,” Marks
asserts, “but paradoxically we are housed in a law
enforcement agency.”

Here’s The News
Allegations have surfaced regarding corruption and
distortion inside United States Customs and Border
Protection (CBP) offices.
28 people have died in violent clashes with U.S.
Customs and Border Protection since 2010. Despite
public outrage, no agent or officer has faced criminal
charges to date.
According to a whistleblower complaint filed by
James F. Tomsheck, the agency’s former Chief of
Internal Affairs, at least a quarter of the 28 deaths
were “highly suspect” and raise questions whether
the use of lethal force was appropriate.

Recently, an alleged Honduran human smuggler
went public with inside secrets about his
“profession.” How much of this news story is true?
That’s a million dollar question.
The smuggler said he brings six people to the United
States every month, earning a total of $6,000.
Overall, minors are charged $5,000 each. All the
smuggler has to do is get them to the border — a
four-day trek. He calls human smuggling, the
biggest and best business that could have been
created.

Children
New research shows that about 23 percent of
immigrants deported between July 1, 2010, and
September 31, 2012 had U.S. citizen children. This
equals about 200,000 individuals.
Based on earlier studies, this means approximately
300,000 U.S. citizen children have been separated
from their immigrant parent during this two-year
period.
Overall, studies indicate nearly 4.5 million U.S.
citizen children have at least one parent who is
undocumented and therefore vulnerable to
deportation.

Here’s The News
Around 600 women and children from Central
America arrested by immigration officials in Texas
for illegally crossing the southern border are being
held in the Artesia, New Mexico detention facility.
At least five women from Honduras, detained at
Artesia, have claimed their government was
encouraging them not to seek U.S. legal counsel and
to voluntarily consent to deportation.
In return, they said the consulate officers said the
Honduran president was promising them jobs and a
bonus upon their return.

Trapped between a rock and a hard place, Obama
has to choose between protecting Democrats facing
re-election and protecting immigrant families from
enforced separation.
The president’s dilemma was caused by his own delay
in not acting sooner and taking executive steps in
support of immigration reform.
For immigrants, another delay will reinforce the
president’s hypocrisy on immigration reform.

The drama over President Obama's promise to issue
executive orders on immigration is not just about
politics. For a lot of people, it is an intensely
personal matter.
Even if the president takes positive actions, such
actions will be temporary. Some, if not all, will
expire when he leaves office in two years.
Given such uncertainty, many undocumented
immigrants may decide to remain in the shadows
rather than risk their futures by seeking temporary
benefits and disclosing their status.

Generally speaking, it is hard to believe in the
findings of political polls.
However, I think the trend shown in this poll is likely
correct, even if the percentages are off.
Given the large amount of sensationalistic news
surrounding the Central American immigrant
children, a decrease of public support for
immigration reform was inevitable.
