The insurance policy is concluded directly between the Buyer and the

Article 2 - Applicability of these General Terms and Conditions
These General Terms and Conditions apply exclusively to the present sale / purchase. By completing the Order,
the Buyer enters into an agreement with the Organizer and Buyer fully agrees to these General Terms and
Conditions and any additional conditions of the Organizer and / or Location thereafter. The Organizer is free to
make these additional conditions of admission known only at a later time, in so far as these conditions are in the
interest of the public order or safety of visitors, artists and / or employees at the Event.
If Buyer orders other products than Tickets (such as for example a hotel stay), then the general terms and
conditions of the relevant Service Provider (in this example that is the hotel) apply as well. The Service Provider's
general terms and conditions are handed over to the Buyer by the Service Provider and can be requested at any
time from the relevant Service Provider or Paylogic.
Insofar as these General Terms and Conditions conflict with other general terms and conditions, these General
Terms and Conditions will prevail.
Paylogic acts solely on behalf of the seller, as an intermediary / agent, and is explicitly not a party to the purchase
agreement that is established via the Paylogic System between Buyer and Organizer/Service Provider.
Article 3 - Establishment of the sales agreement and exclusion
of the right of withdrawal
The buyer unconditionally agrees with an irrevocable payment obligation based on the Order, to be paid to
Paylogic, acting as intermediary (agent) of the selling party.
Paylogic is expressly not a party to this Agreement and acts exclusively as an intermediary (commercial agent) of
the Organizer or Service Provider. The Agreement between the Buyer and the Organizer and / or Service Provider
is finally concluded as soon as Paylogic has received and processed the (authorization of) the payment. The
Buyer's right to receive a product only takes effect at the time the Order is processed and the Buyer has received
written confirmation from the Organizer, or from Paylogic on its behalf.
The right of withdrawal is explicitly excluded on the basis of article 6:230p(e) of the Dutch Civil Code.
This means that the Buyer does not have a cooling-off period of 14 days to cancel / return the Order free of
charge. Changes with regard to the Order can be requested through Paylogic's customer service, with the
provision that changes are actually possible and / or the presence of additional costs that Organizer, Service
Provider or Paylogic may charge to Buyer to make the change. Optionally, the Buyer can make use of the optional
(cancellation) insurance, insofar as the Insurer reimburses these costs (damage) on the basis of the policy
conditions. In such a case, the Buyer must contact the Insurer directly.
The Buyer is responsible for checking received products for accuracy (the so-called "duty of investigation" of the
Buyer). If there is an incorrect (non-compliant) delivery, for example in the
4/9
case of incorrect (ticket) information such as rank, place, Event or name of the ticket holder, the Buyer will receive
a new product at the first written request and without additional costs, provided that the Buyer returns the faulty
products and reports any errors in the product to Paylogic without unreasonable delay. Changing names
afterwards ("substitution") is explicitly excluded from the right to free adjustment.
Organizer and Service Provider reserve the right to refuse Orders at any time without giving reasons.
Article 4 - Prices and additional costs ("service fee")
The (nominal) prices of Tickets and / or Other Products may exclude additional service costs. Service fees are
charged to the Buyer as necessary costs for, among other things, administration, operation and maintenance
costs of the Paylogic platform or the Event, management of access controls, making available a customer service
and, if applicable, shipping costs for physical Tickets and / or Other Products.
These service costs are always stated in advance and clearly at the Order. Depending on the product, service
costs per product or per complete Order may be charged. Service costs can be changed at any time by the
Organizer, but never retrospectively i.e. after a product has been purchased already.
The prices for Tickets and / or Other Products may be higher than the prices printed by Paylogic on the Tickets in
connection with possible additional costs for, for example, reservation, payment and / or delivery. The legal VAT
rates apply.
Article 5 - Payment
When placing an Order, the Buyer undertakes to pay the corresponding total amount to Paylogic - which collects
these payments on behalf of the Organizer or Service Provider. The buyer receives a payment confirmation as
soon as the transaction has taken place correctly. The payment confirmation in itself does not explicitly serve as
a completed Order. There is only a completed Order or purchase as soon as the Buyer receives a written
notification from or on behalf of the Organizer. Until the moment of confirmation, the Buyer can not derive any
rights and / or force delivery. If a full payment has taken place but due to circumstances no delivery is possible,
the Buyer is entitled to repayment of the full purchase price, including any additional costs such as service costs
paid by the Buyer. The Organizer or Service Provider guarantees that the purchase price will be reversed to the
Buyer's contra account without unreasonable delay.
All Orders, regardless of their place of issue, are paid in Euros, unless stated otherwise on the relevant Sales
Channels.
5/9
Article 6 - Delivery
The Buyer chooses the method of delivery during the Order; digital or physical delivery may be possible. Any
additional costs for certain forms of delivery are stated beforehand in the total price of the Order. Buyer
irrevocably agrees with these costs through payment.
Article 7 - Property rights
Tickets delivered by or on behalf of Organizer remain the property of the Organizer. The Purchaser may not,
without prior (written) permission from Organizer, sell (re) sell tickets to third parties or provide them to third
parties in any other (commercial) manner, directly or indirectly, or make them available to third parties.
Organizer reserves the right to declare Tickets invalid if these conditions are not met, for example as in the case
of unauthorized resale. See also article 8 (Access and control).
Article 8 - Access and control
The Organizer can oblige the holder of a Ticket to personalize it. The Organizer has the right to check the identity
of ticket holders at the entrance (s) of the Event. Ticket holders must therefore have a valid identity card such as
driver's license, passport or ID card. Organizer reserves the right to refuse access if the personal data of the
holder of a Ticket does not match the information as stated on the Ticket, this to prevent any resale, fraud or
abuse. Buyer is fully responsible for entering the correct data during the personalization steps that may apply
after the purchase and is not entitled to (damage) compensation if data is incorrect or do not correspond with the
person’s identity.
Organizer is not responsible or liable for theft, fraud, (unlawful) copies and / or loss insofar as this can not
reasonably be charged to Organizer.
The Organizer reserves the right to deny access to ticket holders if they arrive outside the designated access
times.
Organizer has the right at all times to invalidate (a) sold Ticket (s) and / or deny access without the right to a
refund and / or compensation in the case of:
● unlawful (resell) sale,
● as the ticket holder can not or does not want to identify him/herself,
● in case of fraud,
● in other cases where entry constitutes a risk to public order or safety, at the discretion of the Organizer.
See also article 14 (Code of Conduct).
6/9
Article 9 - Cancellation /transfer of Event and refund
Due to circumstances, the Organizer or Service Provider may decide to cancel the Event or to move it to another
time, date and / or Location or to cancel a Other Product such as a hotel stay. Buyers will in these cases be
informed (in writing) by the Organizer or Service Provider, or on behalf of Organizer / Service Provider by Paylogic.
In the event of a final cancellation, Paylogic will refund the full purchase price including service costs to the
original Buyer on behalf of the Organizer / Service Provider, this on presentation of the Ticket and other necessary
(contact) information / proof which Paylogic requires from the Buyer. The Organizer / Service Provider or Paylogic
will actively inform Buyers about the way in which a refund can be submitted. Organizer / Service Provider
reserves the right to reject an application for a refund if the Buyer does not provide necessary information or does
not provide it in time.
In the event of the postponement or transfer of the Event, the final refund of Ticket (s) or exchange of Tickets will
be subject to the then applicable special terms and conditions of the Organizer. In principle, the Buyer will be
entitled to full restitution, unless the Organizer offers an equivalent alternative to which the Buyer agrees. Ticket
holders will always be informed in advance about the possibilities of refund or exchange of Tickets.
Only Organizer is responsible for making refunds. Paylogic can not and will not carry out any refunds without
prior instructions from the Organizer, and only after the Organizer has made the relevant refunds available to
Paylogic. Buyer explicitly acknowledges that Paylogic can never be held liable for restitution (see also Article
11 - Liability)
Article 10 - Special provisions for (hotel) accommodation and
transfers
The provisions of this article apply to all booked (hotel) overnight stays and / or transfers that are offered on the
Organizer sales channel, and in collaboration with the Service Provider. Paylogic is explicitly not a party to the
Agreement that is concluded between the Buyer and the Service Provider. The general terms and conditions of
the relevant Service Provider (s), including the conditions regarding cancellation apply. Insofar as the
aforementioned general terms and conditions conflict with these General Terms and Conditions, these General
Terms and Conditions prevail.
Reservations for (hotel) overnight stays and / or transfer (s) are explicitly not regarded as "Package travel"
within the meaning of the Package Travel Directive (EC 2015/2302). Buyers can not claim the rights and
obligations stated therein.
Organizer (or Paylogic) is not liable for a shortcoming in the fulfillment of a reservation insofar as this
shortcoming can not reasonably be attributed to Organizer (or Paylogic). The Buyer must address complaints and
/ or (damage) claims in such cases directly to the Service Provider. Buyer can contact Paylogic customer service
for other questions.
7/9
Reservations are recorded in the name of the Buyer. Buyer has no right of transfer to third parties ("substitution"),
unless otherwise stated in the general terms and conditions of the Service Provider or on the basis of leniency. It
may be that the Service Provider will charge extra for this.
Reservations for hotel stays and / or transfers are in principle non-refundable, for example when the Buyer
cancels, an Event is canceled or an Event is moved to another location and / or date, unless otherwise stated in
the general terms and conditions of the Service Provider or on the grounds of leniency.
Buyer will receive all relevant information regarding the reservation, including arrival (check-in) and departure
(check-out) times. The Service Provider reserves the right to change arrival and departure times in all
reasonableness. Buyer will be informed of any changes in such cases in advance.
In some cases, Buyer must pay a deposit to the Service Provider. This deposit can be requested in advance - via
Paylogic - or afterwards by the Service Provider himself. This deposit will be refunded to the Buyer once it has
been established that there are no (partial) deductions.
Article 11 - Liability
Paylogic is not a party to the Agreement between Buyer and Organizer and / or Service Provider, but only acts
as an intermediary (commercial agent) of the Organizer or Service Provider via a technical integration.
Paylogic is not liable for any form of (in) direct damage and / or refund that is the result of non-compliance by
the Organizer or Service Provider towards the Buyer. For example, Paylogic is not liable for relocation or
cancellation of Events as a result of the Organizer's bankruptcy. Buyers will make damages known to Paylogic,
which Paylogic will pass on to the Organizer and / or Service Provider. Buyers can contact Paylogic customer
service for this.
Organizer and / or Service Provider is not liable for refund, (in) direct damage and / or reimbursement of
expenses of the Buyer insofar as the Event is canceled or moved by or on behalf of the Organizer as a result of
force majeure. In any case, there is force majeure in the event of terrorism (threat), war, sabotage, strikes,
storms, floods, police and / or municipal directions and other unforeseen circumstances as a result of which
compliance with the Agreement can no longer reasonably be expected from Organizer or Service Provider.
Organizer or Service Provider is not liable for any damage resulting from death, injury, accident, injury, loss,
damage, or theft, unless there is intent or gross negligence by the Organizer and / or Service Provider.
Organizer (or Paylogic) accepts no liability whatsoever for loss or damage of Tickets by the Buyer, for whatever
reason, insofar Organizer (or Paylogic) cannot reasonably be held responsible for this. From the moment the
Ticket is made available to the Buyer, the Buyer bears the risk of loss, theft, damage or misuse.
8/9
8/9
Article 12 - Privacy and processing of personal data
The Organizer reserves the right at all times to make image and / or sound recordings of the Event. The Buyer
declares to be familiar with and agrees with the foregoing and hereby waives the right to oppose the use of his /
her portrait / likeness in the context of the publication and reproduction of said recordings.
The Organizer and Service Provider reserves the right to use the Buyer's personal details and to share these with
third parties insofar as this is necessary for the performance of the purchase agreement. Personal data is not
used for other (commercial) purposes or shared with third parties, unless this is explicitly stated and Buyer has
agreed that his / her personal data may be processed as such.
Paylogic acts on behalf of Organizer as a processor within the meaning of the General Data Protection Regulation
("GDPR"). Paylogic is authorized as such to process personal details of Buyers on behalf of the Organizer and / or
Service Provider within the framework of the Agreement. Paylogic processes the personal data of the buyer in
accordance with applicable laws and regulations and in accordance with its own Privacy Statement which has
been made available to the Buyer prior to the purchase and can be consulted online via www.paylogic.nl. Paylogic
does not use personal data for its own (commercial) purposes, unless Buyer gives explicit permission for this.
The GDPR offers Buyers, among other things, the right of information, anonymisation and oblivion of their
personal details as known to Organizer, Service Provider and its processor (s). Buyers must address a (written)
request to the Organizer, Service Provider or Paylogic.
Article 13 - Intellectual Property Rights
All rights of intellectual property with regard to the name, the logo, and any text and (advertising) music of the
Event as well as the business formula used by the Organizer are vested in Organizer, Service Provider and / or
Paylogic. The Buyer is not permitted to make these directly or indirectly publicly available and / or to copy them or
to use them in any other way or to join them, except with the prior written consent of the entitled party.
Article 14 - Rules of conduct Organizer and location holder
The Buyer must at all times comply with the rules of conduct applicable to the Event by the Organizer (and
Location).
The Organizer, the Location owner, the security personnel and / or the police are entitled to search the Buyer prior
to the Event for possession of unauthorized objects / assets and to confiscate them, possibly in accordance with
article 27 of the Code of Criminal Procedure. The organizer, Location holder, security personnel and / or police
reserve the right to refuse the access thereafter. Confiscated objects will be returned to the owner after the Event
has ended, insofar as there are legally prohibited items or substances.
