COMES NOW, Running Foxes Petroleum Corporation, a/k/a Running Foxes Petroleum,
Inc. (“Running Foxes”), acting by and through its attorneys, Lear & Lear, PLLC, and pursuant to
Utah Code Ann. §§40-6-5(3)(c), 40-6-5(5), 40-6-7(1) and 59-5-102(7), and Utah Admin. Code
Rules R649-3-37 and R649-5-1 et seq., and hereby respectfully requests the Board of Oil, Gas
and Mining (the “Board”) to enter an order: (1) conditionally approving the conversion of the
TXO 14-3 Well (the “14-3 Well”) to a Class II injection well for waterflood enhanced recovery;
and (2) approving waterflood operations in the Dakota D-1 Sandstones, defined for purposes of
this cause as:

The stratigraphic equivalent of the interval between 1, 518 feet and 1, 530 feet as
shown on the Dual Induction Log of the TXO 14-2 Well, located 300 feet FSL
and 820 feet FWL in the SW¼SW¼ of Section 14, T20S, R23E, SLM,
(the “Subject Formation”), within the SW¼SW¼ of Section 14, Township 20 South, Range 23
East, SLM (the “Project Area”), and certifying the waterflood operations within the Project Area
as an “Enhanced Recovery Project.”
In support of this request, Running Foxes respectfully states and represents:
1. Running Foxes is a Colorado corporation with its principal place of business in
Centennial, Colorado. Running Foxes is duly qualified to conduct business in the State of Utah,
and is fully and appropriately bonded with all relevant Federal and State of Utah agencies.
2. The oil and gas within the Project Area is owned by the United States of America
and is subject to United States Oil and Gas Lease UTU-44440 (the “Lease”) administered by the
Bureau of Land Management. Running Foxes is the current Lessee under the Lease and the sole
owner of the operating rights in the Subject Formation and the Project Area. There are no other
production interest owners in the Lease as to the Subject Formation and Project Area other than
the United States and Running Foxes.
3. There currently are three (3) oil wells located within the Project Area, all operated
by Running Foxes:
a) The TXO 14-1 (the “14-1 Well”), located 820 feet FSL and 660 feet FWL in the
SW¼SW¼ of subject Section 14, is a currently producing oil well in the Subject
Formation;

b) The TXO 14-2 Well (the “14-2” Well), located 300 feet FSL and 820 feet FWL in
the SW¼SW¼ of subject Section 14, is a currently shut-in oil well but with
perforated intervals in the Subject Formation; and
c) The 14-3 Well, located 275 feet FSL and 420 feet FWL in the SW¼SW¼ of
Section 14, has always been and currently remains a shut-in oil well.
The Wells were drilled by Running Foxes’ predecessor in title in accordance with the Board’s
Order entered in Cause No. 102-16B entered on November 15, 1979.
4. A plat reflecting the location of these wells, along with wells within a one-half
mile radius of the 14-3 Well (the proposed injection well), is attached hereto as Exhibit “1” and
by this reference incorporated herein. Running Foxes operates all other oil and gas wells within
the one-half mile radius. Based on an on-line search of the Utah State Engineer’s records, there
are no water wells located within the one-half mile radius. The United States owns all of the
surface within the one-half mile radius except the SE¼ of Section 14, which is owned by San
Arroyo Livestock LLC.
5. Production from the 14-1 and 14-2 Wells is currently at stripper well levels due to
depressurization of the Dakota reservoir. Running Foxes proposes to re-pressurize the reservoir
from a down-dip position by converting the 14-3 Well to an injection well and pushing the
petroleum to recovery from the 14-1 and 14-2 Wells through waterflood operations in the
Subject Formation. Running Foxes believes and therefore alleges that the proposed waterflood
may potentially increase the daily oil production rate by three to five times.

6. Based on geologic analysis conducted by Running Foxes and others, the Dakota
sandstone reservoirs tend to be isolated traps. The sandstone reservoirs present in the 14-1, 14-2
and 14-3 Wells are not connected to adjacent wells perforated in similar sands. The Subject
Formation is confined both above and below by thick shales which, at the proposed injection
rates outlined in Paragraph 6 below, will not be breached. A type log is attached hereto as
Exhibit “2” and by this reference incorporated herein.
7. Running Foxes will shortly be filing an UIC-1 Form application with the Utah
Division of Oil, Gas and Mining (the “Division”) to convert the 14-3 Well to a Class II injection
well for enhanced recovery purposes, with proposed injection intervals in the Subject Formation,
and with an anticipated maximum injection rate of 20 bbls./day at a maximum surface pressure
of 600/psig. Injection water will be compatible produced water primarily from the 14-1 and 14-2
wells with additional produced water from the nearby Cisco Springs B-1, Cisco Springs B-2, and
Cisco SS 15-8 wells, all operated by Running Foxes. Said application will satisfy all criteria
required under Utah Admin. Code Rule R649-5-1 et seq., and in particular Rule R649-5-2(2), for
approval of said conversion and injection. A true and correct copy of the application as
submitted to the Division will be submitted as an exhibit in this cause.
8. The Subject Formation does not constitute an “Underground Source of Drinking
Water” as the term is defined in Utah Admin. Code Rule R649-1-1.

9. The value of the estimated additional recovery of oil substantially exceeds the
estimated costs incident to conducting the proposed enhanced recovery operations.
10. The Project Area, by virtue of the proposed conversion of the 14-3 Well to a Class
II injection well for enhanced recovery of production through the 14-1 and 14-2 Wells, qualifies
as an “Enhanced Recovery Project” as defined in Utah Code Ann. §59-5-101(7) and Utah
Admin. Code Rule R649-1-1, and should be certified by the Board as such.
11. Running Foxes believes and therefore alleges that granting this Request will be in
furtherance of the public policies of this State as set forth in Utah Code Ann. §40-6-1, et seq. to
promote greater recovery of oil without waste and with protection of the correlative rights of all
affected owners, and is just and reasonable under the circumstances. Prevention of waste will
occur because the waterflood operation constitute prudent and economical operations and avoid
the unnecessary dissipation of oil and gas and reservoir energy. Correlative rights are protected
by virtue of common production interest ownership throughout the Project Area and the geologic
characteristics outlined in Paragraph 6 above.
12. Running Foxes will, in accordance with Board rules, timely submit exhibits and
present testimony in support of these allegations.
13. Running Foxes will separately file a certificate of mailing listing all parties known
to it, based on a search of the respective Federal and County realty records and the records of the

Division, whose “legally protected interests” will be affected by this Request. There are no
respondents or adverse parties known at this time to Running Foxes.
WHEREFORE, Running Foxes respectfully requests:
1. That this matter be set for hearing on June 24, 2020;
2. That notice of such hearing be given as provided by law; and
3. That, upon sufficient evidence produced and testimony given at the hearing, the
Board issue an order:
a) Presuming the Division determines the UIC application to be submitted by
Running Foxes is complete and approves the same, approving the conversion of the 14-3 Well to
a Class II injection well for purposes of injecting water for enhanced recovery in accordance
with the terms and conditions outlined in said application;
b) Approving and certifying the Project Area, by virtue of the injection of water into
the 14-3 Well for the enhanced recovery of production from the Subject Formation through the
14-1 and 14-2 Wells, as an “Enhanced Recovery Project” in accordance with Utah Code Ann.
§§40-6-7(1) and 59-5-102(7) and Utah Admin. Code Rule R649-3-37;
c) Making such findings and orders in connection with this Request as it deems
necessary; and
d) Providing for such other and further relief as may be just and equitable under the
circumstances.

Notice is hereby given that the Board of Oil, Gas and Mining (the “Board”),
State of Utah, will conduct a hearing on Wednesday, June 24, 2020, at 10:00 a.m.,
or as soon thereafter as possible. The hearing will be conducted electronically as
allowed by Utah Executive Order 2020-1 (the “Executive Order”). In the event that
the Executive Order is lifted before the prescribed hearing date the meeting will be

Nafi Onat received Bachelor of Science (BS) and Master of Science (MS) Degrees in PetroleumEngineering from Middle East Technical University ("METU") in Ankara, Turkey. After a brief careerwith Mobil as a production engineering trainee, he joined Mineral Research and Exploration Institute("MTA"), as a Petroleum Engineer. His duties included supervision of Russian and Romanian drilling rigsoperating in Eastern Turkey under contract.
Nafi received his Ph.D. in Petroleum Engineering in 1975 from Colorado School of Mines, in Golden,Colorado, then returned to METU in Ankara, Turkey, where he taught undergraduate and graduatepetroleum engineering courses as an Assistant Professor and supervised preparation ofthesis for Master ofScience degrees.
In 1979 Nafi came back to USA and started working for Wenner Petroleum Corporation in Denver,Colorado as manager of operations. He oversaw all field operations, which involved design, supervision,and optimization of all drilling, logging, completion, testing, and production operations. After two years,Nafi was promoted to Vice President, Engineering, and he supervised the company's operations inMichigan, Ohio, Texas, Colorado, and Tennessee for the account of several oil companies and drillingfunds for whom, Wenner Petroleum acted as operator. As a project manager, he oversaw developing alarge Niagaran Reef oil and gas field from its inception to development and marketing for MichiganSeamless Tubing Company in Michigan.
In 1988 Nafi founded O, E. & P. Corporation in Englewood, Colorado and took over the operations fromWenner Petroleum Corporation. Nafi, as the President of the O. E. & P. Corporation operated Pentwaterfield in Oceana County, Michigan, and some 25 wells in Holmes and Wayne Counties, Ohio,
After nine years ofhands on experience in oil and gas fields, in 1989, Nafi turned over operations to otherlocal cornpanies and joined Resource Services International, Inc. ("RSI"), a petroleurn engineeringconsulting firm in Denver, Colorado, His responsibilities included reserves and economic analysis,comprehensive engineering studies for litigation involving hydraulic fracturing, recommendations to clientsfor optimization of field management, workover programs, coalbed methane well operations andperformance analysis. Nafi was involved with designing, supervising, and analyzing slick water and foarnfrac operations in Denver Julesburg basin CodellAtriobrara completions. He was instrumental in selectingdeeper re-entry candidates in the field for recompletion potential.
Nafi was involved with coalbed rnethane projects in San Juan and Raton Basins operated by EvergreenResources, and CBM operations in Eastern Kansas operated by Great Eastern Energy. He worked onhydraulic fracture design, reserve estimates and production optimization of the coalbed methane wells.

In September of 1997, after nine years of consulting, Nafi founded Sure Engineering, LLC ("SE"), a
consulting company specializing in petroleum and natural gas engineering. As President of SE, Nafi hascontinued his consulting work involving domestic and international conventional and coalbed methaneprojects, reserve evaluation, well cornpletion, production optimization, and simulation studies, He workedon CBM project in Black Sea coast, Turkey with Dan Oil and Harnilton Brothers, and was involved withdiscovery and development of a large shallow gas field in Thrace Basin, Turkey.
Nafi worked as an officer and director of several public companies including Star Energy Corporation, anoil and gas production company from December 1999 to June 2006 and Texhoma Energy Inc., an oil andgas production company from June 2007 to June 2009.
Nafi appeared as expert witness at the Michigan Department of Natural Resources hearing and in DallasCounty Court, Texas.
Complementing l.ris extensive experience, Nafi also is associated with group of international consultantswhojoin him in projects on as-needed basis. These associates are academics and independent consultants.
While managing Sure Engineering, Nafi also joined ONE Energy Capital in August 2009 as a director, andshortly after he became the president of ONE Energy Operating Corp., Texas. During his employmentfrom 2009 until 201 I as the president and petroleum engineer ofthe company, his responsibilities includedoil and gas prospect evaluation for acquisitions, operating and managing company's oil wells, preparingworkover operations and determining re-entry and recompletion potential of the existing marginal wells.He resigned from ONE Energy International on March 22,2011 to be able to focus on his own consultingprojects. R649-5-L. Reouirements for Iniection of Fluids Into Reservoirs.
1. Operations to increase ultimate recovery, such as cycling of gas, the maintenance ofpressure, the introduction of gas, water or other substances into a reservoir for the purpose ofsecondary or other enhanced recovery or for storage and the injection of water into anyformation for the purpose of water disposal shall be permitted only by order of the board afternotice and hearing.
2. A petition for authority for the injection of gas, liquefied petroleum gas, air, water, or anyother medium into any formation for any reason, including but not necessarily limited to theestablishment of or the expansion of waterflood projects, enhanced recovery projects, andpressure maintenance projects shall contain:
2.1. The name and address of the operator of the project.
2.2. Aplat showing the area involved and identi$ring all wells, including all proposedinjection wells, in the project area and within orle-half mile radius of the project area.
2.3. Afull description of the particular operation for which approval is requested.
2.4. A description of the pools from which the identified wells are producing or haveproduced.
2.5. The names, description and depth of the pool or pools to be affected.
2.6. A copy of a log of a representative well completed in the pool.
2.7. A statement as to the type of fluid to be used for injection, its source and the estimatedamounts to be injected daily.
2.8. A list of all operators or owners and surface owners within a one-half mile radius of theproposed project.
2.9. An affidavit certi$ring that said operators or owners and surface owners within a one-half mile radius have been provided a copy of the petition for injection.
2.10. Any additional information the board may determine is necessary to adequately reviewthe petition.
3. Applications as required by R649-5-2 for injection wells that are located within the projectarea, may be submitted for board consideration and approval with the request forauthorization of the recovery project.
4. Established recovery projects may be expanded and additional wells placed on injectiononly upon authority from the board after notice and hearing or by administrative approval.

R649-5-2. Requirements for Class II Injection Wells IncludingWater Disposal, Storage and Enhanced Recovery Wells.
1. Injection wells shall be completed, equipped, operated, and maintained in a manner thatwill prevent pollution and damage to any USDW or other resources and will confine injectedfluids to the interval approved.
2. The application for an injection well shall include a properly completed UIC Form 1 andthe following:
2.L. Aplat showing the location of the injection well, all abandoned or active wells within aone-half mile radius of the proposed well, and the surface owner and the operator of any landsor producing leases, respectively, within a one-half mile radius of the proposed injection well.
2.2. Copies of electrical or radioactive logs, including gamma ray logs, for the proposed wellrun prior to the installation of casing and indicating resistivity, spontaneous potential, caliper,and porosity.
2.3. A copy of a cement bond or comparable log run for the proposed injection well aftercasing was set and cemented.
2.4. Copies of Iogs already on file with the division should be referenced, but need not berefiled.
2.5. A description of the casing or proposed casing program of the injection well and of theproposed method for testing the casing before use of the well.
2.6. Astatement as to the type of fluid to be used for injection, its source and estimatedamounts to be injected daily.
2.7. Standard laboratory analyses of:
2.7.L. The fluid to be injected,
2.7.2. The fluid in the formation into which the fluid is being injected, and
2.7.3. The compatibility of the fluids.
2.8. The proposed average and maximum injection pressures.
2.9. Evidence and data to support a finding that the proposed injection well will not initiatefractures through the overlying strata or a confining interval that could enable the injectedfluid or formation fluid to enter any fresh water strata.

lowing are the findings of that survey and the resulting chemicaltreatments
Analytical Procedure
The procedure utilized in this survey was designed to evaluate all constituents that could
reduce the efficiency of the system. Complete water analysis was performed on each sample
taken. Key fluid properties, such as pH, dissolved gases, bicarbonate, and total iron were deter-
mined in the field for accuracy. Computer modeling software was used in order to determine thepotential for calcium carbonate, calcium sulfate, and barium sulfate scale from each sarnpled
fluid.Bacterial inoculation studies were gompleted according to API procedures using a serial
dilution and incubation method. These tests were completed on each fluid sampled to determine
the presence and concentration of sulfate reducing, acid producing, and aerobic bacteria.
@Discussion - Water Analysis
Water samples were obtained from three wells. Bacterial inoculations, along with fluidpH, dissolved gas analyses, bicarbonate ion, and iron readings were determined on site. The re-
maining analyses were completed in the Fruita, CO technical services laboratory.
Dissolved HzS & COz
The results of the water analyses indicate that the vast majority of the wells contained
at least a trace amount of dissolved CO2. Dissolved CO2 has the ability to corrode surface and
subsurface production equipment and can lead to further production problems stemming fromthe formation of iron sulfide deposits.
Dissolved lron
The produced brine displays a mild to severe amount of dissolved iron. This is a measureof the total dissolved iron, which encompasses both native formation iron and that which is lostfrom production equipment. Although there is no method to accurately quantifiT native vs cor-rosion iron, the history of the producing zones, dissolved gas analysis, and bacteria inoculationstudies leads the IOS technical services staffto believe that a moderate to severe corrosionproblem exists.
Microbially lnduced Corrosion (MlCl
Bacteria inoculation studies indicate that several wells in this area display severe bacteriagrowth patterns. The most critical strain of bacteria that historically has shown to be most prob-lematic are sulfate reducing bacteria. Sulfate reducing bacteria or SRB as they are commonly re-ferred as can be extremely corrosive to the production equipment which is due in part to thedevelopment of localized bacteria colonies along pipe walls. SRB release HzS as a byproduct whichcan lead to the formation of iron sulfide deposits down-hole and in the surface production equip-ment. The followingtable shows the conversion between the numbers of bacteria bottlesturnedto the possible amount of bacterial colonies present within 1 mL of sample water.

Product Selection
The products recommended in this report are the result of extensive field and laboratory test-ing performed over years of continual monitoring and research, which has been combined with thework performed during this survey.
Deposit Analysis & Recommendation
The results of the deposit analysis indicate that the sample collected off TXO 14-1, and TXO
Mesa 23-1 was 100% hydrocarbon (paraffin). Upon further testing IOFS personnel discoveredthat-85% of the sample dissolved in PCO-5150 when heated to 140 "F. ln order to effectively removeparaffin from the production strin& IOFS recommends that 10 gallons of PCO-5150 be utilized totruck treat these well once every other week. PCO-5150 contains a robust solvent and dispersantpackage to aid with the removal of wax build-up within the wellbore. The treating rate will be opti-mized to 5 gallons per treatment after a 3-month period as long as no paraffin plugging issues arise.
Corrosion / Scale lnhibitor
CSW-9522 provided to be the best overall combination corrosion/ scale inhibitor chemistry forsolubility, compatibility, and water quality, and corrosion/scale control. CSW-9522 is an excellent wa-ter soluble corrosion inhibitor that provides a tenacious corrosion inhibitor film, is also effective as a
bio stat in controlling bacterially induced corrosion, and in application with high CO2 and H25 environ-ments; while as controlling the deposition of carbonate and sulfate scales downhole and in surfaceequipment. IOS recommend treatment rate @ 400 ppm continuously injected down the backside.
Biocide
After IOS has seen high bacteria count. IOS would like to determine the duration of biocidetreatments and the correct biocide , IOS will recommendation doing a bacteria kill study.

NOTICE OF HEARING BEFORE THE BOARD OF OIL, GAS AND MINING - DEPARTMENT OF NATURAL RESOURCES - STATE OF UTAH
THE STATE OF UTAH TO ALL PERSONS INTERESTED IN THE FOLLOWING MATTERS (Docket Nos. 2020-012, and 2020-013): Notice ishereby given that the Board of Oil, Gas and Mining (the "Board"), State of Utah, will conduct a hearing on WEDNESDAY, JUNE 24, 2020, AT10:00 a.m., or as soon thereafter as possible. The hearing will be conducted electronically as allowed by Utah Executive Order 2020-1 (the"Executive Order"). In the event that the Executive Order is lifted before the prescribed hearing date the meeting will be held in theauditorium of the Department of Natural Resources, 1594 West North Temple, Salt Lake City, Utah. DOCKET NO. 2020-012 CAUSE NO.196-51: In thematter of: Notice of Agency Action by the Division of Oil, Gas and Mining Seeking an Order: (1) Forfeiting the reclamation bond provided byNORTHSTAR GAS COMPANY, INC. OF TEXAS for the State 2-7 gas well (located in Grand County, Township 17S, Range 24E, Section 2, SaltLake Base and Meridian), the State 36-14 gas well (located in Grand County, Township 16S, Range 24E, Section 36, Salt Lake Base andMeridian), and the State 36-16 gas well (located in Grand County, Township 16S, Range 24E, Section 36, Salt Lake Base and Meridian); and(2) Authorizing the Division use the amount forfeited to plug and reclaim the wells secured by the reclamation bond. THE PURPOSE OF THEPROCEEDING will be for the Board to receive testimony and evidence regarding a Notice of Agency Action ("NOAA") filed by Utah Division ofOil, Gas and Mining ("Division"), that the Board enter an order: 1. Authorizing the Division totake any and all additional actions, as necessary, to recover the costs of plugging and reclaiming the Subject Wells to the extent the amountsforfeited are insufficient to complete the work; and 4. Grant further relief that the Board deems just and proper. DOCKET NO. 2020-013CAUSE NO. 191-08: In the matter of the Request for Agency Action of RUNNING FOXES PETROLEUM CORPORATION, A/K/A RUNNING FOXESPETROLEUM, INC., for an order: (1) Conditionally approving the conversion of the TXO 14-3 well, located in the SW¼SW¼ of Section 14,Township 20 South, Range 23 East, SLM, Grand County, Utah, to a Class II injection well for enhanced recovery; and (2) Approvingwaterflood operations in the Dakota D-1 Sandstones in the SW¼SW¼ of Section 14 of Township 20 South, Range 23 East, SLM, GrandCounty, Utah, and certification of said operations as an enhanced recovery project. THE PURPOSE OF THE PROCEEDING will be for the Boardto receive testimony and evidence regarding a Request for Agency Action ("RAA") Running Foxes Petroleum Corporation, a/k/a Running FoxesPetroleum, Inc. ("Running Foxes"), that the Board enter an order: 1. Conditioned upon approval of a complete UIC-1 application by the UtahDivision of Oil, Gas and Mining, approving the conversion of the TXO 14-3 Well (the "14-3 Well") to a Class II injection well for waterflood
enhanced recovery in accordance with the terms and conditions outlined in said approved application; 2. Approving waterflood operations inthe Dakota D-1 Sandstones, defined for purposes of this cause as: The stratigraphic equivalent of the interval between 1,518 feet and 1,530feet as shown on the Dual Induction Log of the TXO 14-2 Well, located 300 feet FSL and 820 feet FWL in the SW¼SW¼ of Section 14, T20S,R23E, SLM, (the "Subject Formation"), within the SW¼SW¼ of Section 14, Township 20 South, Range 23 East, SLM (the "Project Area"), andcertifying the waterflood operations within the Project Area as an "Enhanced Recovery Project" in accordance with Utah Code Ann. §§ 40-6-7(1) and 59-5-102(7) and Utah Admin. Code Rule R649-3-37; 3. Making such findings and orders in connection with this Request as it deemsnecessary; and 4. Providing for such other and further relief as may be just and equitable under the circumstances. Objections to the RAAand/or the NOAA must be filed with the Secretary of the Board at the address listed below no later than the 10th day of June, 2020. During the pendency of this action, a state of emergency has been issued as a
result of a global outbreak of the novel coronavirus disease 2019 (“COVID 19”). On
March 18, 2020, Utah Governor Gary R. Herbert issued an Executive Order suspending
strict compliance with certain provisions of Utah’s Open and Public Meetings Act as
codified in Utah Code Ann. §§ 52-4-201 et. seq. The purpose of the Executive Order was
to limit public gatherings in order to prevent, hinder and/or delay the spread of COVID
19, a highly contagious and infectious disease. The Board of Oil, Gas and Mining
(“Board”), in an effort to comply with the aforesaid Executive Order, as well as various
other directives that have been issued since, is attempting to truncate and streamline all
proceedings that come before the Board during this time. It is therefore:

ORDERED that, pursuant to Utah Administrative Code R641-113-100, a hearing
examiner is appointed to this matter. The hearing examiner is appointed for the purposes
of taking evidence and recommending findings of fact and conclusions of law to the
Board. The hearing officer shall conduct a hearing for the stated purposes on Tuesday,
July 14, 2020, at 2:00 p.m., or as soon thereafter as possible. The hearing will be
streamed live on the Department of Natural Resources YouTube channel at
https://youtu.be/8BLcSlOEaTI.
The hearing before the hearing examiner will be conducted as a formal
administrative adjudication in accordance with the rules of the Board as set forth in Utah
Administrative Code R641 et seq. and as provided for in Utah Code Ann. § 40-6-1 et seq.
and Utah Code Ann. § 63G-4-101 through 601.
The hearing examiner will receive testimony and evidence regarding the Request
for Agency Action (the “RAA”) filed by Running Foxes Petroleum Corporation, a/k/a
Running Foxes Petroleum, Inc. (“Running Foxes”) requesting an order (1) conditionally
approving the conversion of the TXO 14-3 Well (the “14-3 Well”) to a Class II injection
well for waterflood enhanced recovery; and (2) approving waterflood operations in the
Dakota D-1 Sandstones, defined for purposes of this cause as:

IT IS FURTHER ORDERED that the hearing examiner’s findings of fact and

AM, or as soon thereafter as possible.
IT IS FURTHER ORDERED that the July 14, 2020 hearing before the hearing
officer, as well as the July 22, 2020 Public Hearing before the Board, will be conducted
entirely through electronic transmission and/or electronic means and without a public
gathering at the location where Board hearings are normally conducted.
IT IS FURTHER ORDERED that in the spirit of the above-referenced March 18,
2020 Executive Order and pursuant to Utah Administrative Code R641-100-400, the
Board suspends strict compliance with certain procedural administrative rules that may
conflict with Running Foxes right to efficient and orderly administrative process and the
public’s health, safety and welfare under the present circumstances. Accordingly, the
strict time frame(s) specified in Utah Administrative Code R641-113-500 are hereby
suspended. The Board will remain flexible in accommodating any objecting party that
would be otherwise prejudiced if any objecting and/or prejudiced party proceeds with
reasonable diligence.

COMES NOW, Running Foxes Petroleum Corporation, a/kla Running Foxes
Petroleum, Inc. ("Running Foxes"), acting by and through its attorneys, Lear & Lear,
PLLC, and pursuant to Utah Admin. Code Rule R641-105-300, hereby respectfully
requests the Utah Board of Oil, Gas and Mining (the "Board") to continue the hearing in
this Cause currently scheduled to be virtually held before John Baza, Director of the Utah
Division of Oil, Gas and Mining (the "Division"), as the duly appointed Hearing
Examiner, on July 14, 2020 at 2 p.m., until August 11, 2020 at 1 p.m.
On July 9, 2020, Running Foxes informed its undersigned counsel that one of its
witnesses had suffered a medical emergency which will prevent him from participating
on July 14. As his testimony is a critical portion of Running Foxes' presentation in chief,
a continuance is required.
Running Foxes' counsel contacted counsel for the Division and for the Hearing
Examiner, as well as Mr. Baza, to advise of the situation and to determine alternate dates
and times that the hearing may be timely held to allow for consideration of this Cause by
the Board at its regularly scheduled hearing on August 26, 2020. All parties agreed that
the hearing may now be held on August 11, 2020 at 1 p.m. As no other party filed a
response or objection to Running Foxes' Request for Agency Action in this Cause, no
prejudice should result from granting the requested continuance.
