Draft Biala Windfarm VoluntaryPlanning Agreement

Draft Public Gate and Bypass(Grid) Policy

The community is encouraged to have their say onCouncil’s Draft Public Gate and Bypass (Grid) Policy.Public gates and bypasses (cattle grids) have existedon the Shire’s roads for many years without formalapproval. The Draft Policy seeks to both formalise theapproval of these structures and inform public gate andby-pass owners of their obligations and responsibilitiesunder the Roads Act 1993 and the Roads (General)Regulation 2008.Under the provisions of the Roads Act and the Roads(General) Regulation the occupier of the land benefitingfrom the gate and bypass is responsible for the maintenance of the structures, the road 20 metreseither side of the gate and associated signposting.Also, public gates and bypasses cannot be erectedwithout the issue of a Permit by Council.Under the Draft Policy, all landowners who have a public road passing through their property with stockgrids installed either on the boundary of the property orwithin the property will be required to bring the structureto a safe standard. Council will write to the owners totake action where a safety concern is identified. Council wishes to remind the community that asbestosmust be disposed of in a safe and lawful manner.It follows the discovery of illegally dumped asbestosmaterials at the Bigga, Taralga and Gunning WasteTransfer Stations and at the Crookwell Landfill.Council’s Acting General Manager Gary Woodman saidcutting corners by dumping asbestos illegally puts lives atrisk.“The dangerous nature of asbestos is widely known.Breathing in asbestos fibres can cause asbestosis, lungcancer and mesothelioma, which is why proper maintenance, handling and disposal of asbestos waste iscritical to avoid any possible risks,” Mr Woodman said.“Illegally dumped asbestos has the potential to jeopardisethe health and safety of Council staff and any members ofthe public who happen to come into contact with it.“The costs to Council are also substantial with significantresources and money required to remediate the site –money and resources that could be used for other projectsand services for the betterment of the community.“It is important to remember that asbestos removalists anddemolition workers are required to hold a licence if removing or demolishing 10 square metres or more ofasbestos and any demolition work including asbestosremoval requires a Development Application to be submitted and approved by Council before demolitioncommences.“An appointment must be made with Council to arrangeasbestos disposal at the Crookwell Landfill and allasbestos material must be properly wrapped.“Asbestos is not accepted at any of Councils waste transfer stations, which includes Taralga, Gunning,Collector, Bigga and Tuena.”For more information about asbestos disposal, includingfees, please contact Council’s Operations Division on4830 1000.For more information about asbestos handling andremoval please visit the SafeWork NSW website:www.safework.nsw.gov.au/health-and-safety/safety-topics-a-z/asbestos
