AN ACT

To e s t a b l i s h an Immigration Entry and Deportation Law in the Northern Cbriana Is lands and f o r o the r purposes.

BE IT ENACTED B Y THE NORTHERN MARIANAS COMMONWEALTH LEGISLATURE:

Sect ion 1 . Short T i t l e . This Act s h a l l be known and m y be

c i t e d a s t h e "Commonwealth Entry and Deportation Act of 1983".

Sect ion 2. Leg i s l a t ive In ten t and Pol icy . I t i s the purpose of

t h i s Act t o organize t h e o f f i c e of immigration and na tu ra l i za t ion in

conformity with Pub1 i c Law 1-8, Chapter 3 , Section 5 , t o establ ish

hearing mechanisms, t o - r egu la t e the e n t r y of non-immigrating a l i e n s

i n t o the Commonwealth and provide ent ry and depor.tation procedures.

The Legis la ture a s s e r t s i t s au thor i ty over the sub jec t matter of

t h i s Act pursuant t o U.S. Public Law 94-241, 90 S t a t . 2G3, The

Covenant t o Establ ish a Commonwealth of t h e Northern Elariana 1 s ands

in P o l i t i c a l Union with the United S t a t e s of America, Section 5 2 .

The purposes of t h i s Act do not include def in ing "Cit izen of t h l

Northern Pariana Is1 ands" , author iz ing immigration, o r providing

f o r na tu ra l i za t ion of a l i e n s .

Section 3. Def in i t ions . The following words and phrases, : r

purposes of t h i s Act, have the following meanings unless a d i f f e f - - r

( a ) "Alien" means any person who is not or will not become

a c i t i z en o r national of the United Sta tes as defined by United

S ta tes law or in the Constitution of the Northern k'ariana

Islands, or who i s not a c i t i z en of the Trust Terr i tory of

the Paci f ic o r the Northern h r i a n a Islands, o r who i s not a

permanent resident .

( b ) "Appl i ca t ion f o r Admission" means the appl ica tion fo r

admission i n to the Commonwealth of the Northern Pariana Islands

by an a1 ien and not the appl i ca t ion f o r issuance of the Entry

Permit.

(c) "Attorney General" means the Attorney General of the

Commonwealth of the Northern Mariana Islands o r h is desicnee.

(d ) "Chief" means the Chief of Immigration or the

Immigration and Naturalization Officer.

( e ) "Class" means one of the nonimmigrant a l i en classes

defined in Subsection 17 of t h i s Section.

( f ) "Commonwealth" means the Commonwealth of the Korthern

Mariana Islands.

( g ) "Covenant" means U.S. Pub1 i c Law 94-241, Covenant t o

Establish a Commonwealth of the Northern Pariana Islands i n

Pol i t ica l Union with the United S ta tes of America.

( h ) "Crewman" means a person serving in any capacity on

board a vessel or a i r c r a f t .

( i ) "Dependent" means a person whose f inancial , mental o r

physical condition causes him to be unable t o provide f o r h i s

own basic human needs f o r food, she l t e r , and safe ty .

(j) "Entry" means any coning of an a l i en in to the

Commonwealth from a foreign port o r place whether voluntari ly

or otherwise, except t ha t an a l i en having a lawful perranent

residence in the Commonwealth of the F!orthern BWiana Islands

shall not be regarded as making entry i n to the Comnionwealt~

f o r the purpose of t h i s Act.

( k) "Entry Permit" means documentation authorizing the

entry of a non-immigrant a1 ien i n to the Commonweal t h includins

b u t not limited t o a passport stamp or v isa .

(1) "Examiner" means an employee or c lass of employees

of the o f f i c e of Immigration and Natural izat ion, designatec

individually by the Chief pursuant t o regulat ion, o r by :hc

Attorney General, t o perform the functions of an Exani ner.

Examiners a r e subject t o such supervision and shall p e r f o r

such dut ies as may be directed by the Chief pursuan t t o

regulation.

( m ) "Immediate Relative" means children under the a s c

of 21, spouse and parents.

( n ) "Immigration and Natural izat ion Officer" s h a l l r w r

t h e Immigration and Naturalization Officer as defined i n

Chapter 3 , Section 5 of Pub1 i c Law 1-8, who may be knom zc,

the Chief of Immigration.

(0) "Immigration Cer t i f ica te" means documentation

authorizing the entry of an a l i e n , other than a n o n - i m ~ i ~ r a n t

( p ) " I nspec to r " means an employee o r c l a s s o f employees

o f t h e O f f i c e o f Immigra t ion and N a t u r a l i z a t i o n designated by

t h e Ch ie f pursuant t o r e g u l a t i o n o r by t h e A t to rney General,

i n d i v i d u a l l y , t o per form t h e f u n c t i o n o f an i nspec to r .

I nspec to r s a r e s u b j e c t t o such s u p e r v i s i o n and s h a l l per form

such d u t i e s as may be d i r e c t e d by t h e C h i e f pursuant t o

r e g u l a t i o n .

(q ) "Non-immigrant" means every a l i e n who fa1 1s w i t h i n

one o f t he f o l l o w i n g c lasses:

(1) A des igna ted p r i n c i p a l r e s i d e n t r ep resen t i ns 2

f o r e i g n government which government i s recognized i n 1 aw

by t h e Un i t ed States, and members o f h i s immediate

f a m i l y ;

(2 ) A v i s i t o r f o r bus iness o r pleasure, (o the r t han

one coming f o r t h e purpose o f s tudy o r o f pe r fo rming

s k i l l e d o r u n s k i l l e d l a b o r o r as a r e p r e s e n t a t i v e o f

f o r e i g n press, rad io , f i l m , o r o t h e r f o r e i g n i n f o r m t i o n

media coming t o engage i n such voca t ion ) hav ing a

res idence i n a f o r e i g n coun t r y which he has no i n t e n t i ~ n

of abandoning and who i s v i s i t i n g t h e Commonwealth o f

t h e Nor thern Rar iana I s l a n d s t e m p o r a r i l y f o r business

(3) An a1 ien in immediate and continuous t rans i t

through the Commonwealth;

(4) An a1 i en crewman serving in good fai th as such

in any capacity required for normal operation a n d s e r v i c e

on board a vessel (other than a fishing vessel having i t s

home or an operating base in the Commonwealth) or

a i r c ra f t who intends t o land temporarily and solely i n

pursuant of his call ing as a crewman and to depart f roc

the Commonweal t h with the vessel or a i r c r a f t on w h i c n

he arrived or some other vessel or a i r c r a f t ;

(5) An alien who has been granted a Cert i f icate

of Foreign Investment by the Department of Commerce and

Labor;

(6) A foreign student, who i s an a1 ien h a v i n s a

resident in a foreign country which he has no intention c f

abandoning, who i s a bona f ide student qua1 ified to pursue

learning or other recognized place of study in t he

Commonwealth of the Northern Variana Islands, particul' r l y

designated by him and approved by the Immigration a n 5

Naturalization Officer pursuant to regulation;

( 7 ) A n alien who i s a bona fide representative o f

foreign press, radio, film, or other foreign infon-ation

media, who seeks t o enter the Commonwealth solely t o

engage in such vocation, and the spouse and cbildren c f

such representa t ive i f accompanying or following to

join him;

(8) An a l i e n having a residence in a foreign

country which he has no intention of abandoning j i ) w h o

i s of dist inguished merit and a b i l i t y and who i s

coming temporarily t o the Commonwealth of the Northern

I4ariana Islands t o perform temporary service of an

exceptional nature requiring such nieri t and abi 1 i t y ;

or ( i i ) who i s coming temporarily t o the Commonweal t h

of the Northern Plariana Islands to perform temporary

service o r labor, and has been ce r t i f i ed as an el i?it:l t

nonresident worker by the Department of Commerce a n d

La bor;

(9) An a1 ien who i s an immediate r e l a t i ve o f a

person who i s a c i t i z en o r national of the Uni t e c S c d t e ;

as defined by the Constitution or the Covenant, or o f

the Northern Kariana Islands, as may be defined by lab ,

or of a permanent resident;

( r ) "Office" means the Office of Immigration and

Naturalization establ ished by Section 5 of Chapter 3 o f

T i t l e I of Public Law 1-8, and includes the Chief of

Immigration and a1 1 immigration inspectors.

( s ) "Passport" means any travel documents issued

by competent au thor i ty showing the bearer ' s or ig in ,

iden t i ty and na t iona l i ty i f any.

( t ) "Permanent Resident" means a person granted

permanent r e s i d e n t s t a t u s i n t h e Commonwealth o f t h e

Nor thern b r i a n a I s 1 ands by o p e r a t i o n o f s t a t u t e .

(u) " T e r r i t o r y o r Possession" w i t h respec t t o t he

U n i t e d S ta tes i nc l udes t h e D i s t r i c t o f Columbia, t h e

Commonwealth o f Puer to Rico, t h e V i r g i n I s lands , Guam,

and American Samoa.

( v ) "Visa" means a passpor t stamp ev idenc ing a

non-immigrant E n t r y Permi t.

Sec t i on 4. The Immigra t ion and N a t u r a l i z a t i o n O f f i c e r .

( a ) The Immigra t ion and Natu ra l i z a t i o n O f f i c e r es tab l ished

pursuan t t o Pub1 i c Law 1-8, Chapter 3, Sec t i on 6, s h a l l ce t h e

Ch ie f o f Immigra t ion and s h a l l be r espons ib l e f o r t he day- t o - d a j

s u p e r v i s i o n and a d m i n i s t r a t i o n o f t h i s Act.

( b ) The Ch ie f o f Immigra t ion s h a l l be appoin ted by an!!

served a t t h e p leasure o f t h e A t t o rney General. The Chief

Immigra t ion and Natu ra l i z a t i o n O f f i c e r s h a l l be exempt f roc

c i v i l serv ice.

( c ) The powers and d u t i e s o f t h e Ch ie f o f Immigra t ion

s h a l l be:

(1) t o a d m i n i s t e r t h e O f f i c e o f Immigra t ion and

N a t u r a l i z a t i o n e s t a b l i s h e d by P u b l i c Law 1-8, Chapter .?,

Sec t i on 5, i n c l u d i n g h i r i n g , c o n t r o l , d i r e c t i o n , and

supe rv i s i on o f i n spec to r s , examiners and a l l o t h e r

empl oyees o f t h e o f f i ce , i n con fo rm i t y ni t h such

civil service requirements as may by law apply;

( 2 ) t o patrol the borders of the Commonwealth.

For purposes of th is p a r t , patroll ing the borders of the

Commonwealth means conducting such ac t iv i t i e s as are

customary or reasonabl e and necessary t o prevent i l lecjal

entry of aliens;

(3) t o issue entry permits for non-immigrant a1 i e n s

as provided in this Act;

(4) to administer such immigration and naturzl i:a t i o r

programs as may be provided by law;

(5) t o supervise the entry of a l l persons intc t h o

Commonweal t h ;

( 6 ) t o inspect persons seeking to enter the

Commonwea 1 t h ;

( 7 ) to make investigations pursuant t o Sec;iorl :C

of th is Act.

( d ) The Chief of Immigration shall have such authority

as i s expressly conferred u p o n him by th is Act, or as my k

assigned to him by the Attorney General. The authcrity, d u t i c : ,

and responsibil i t ies of the Chief may by regulation t~ delecatcc

to such inspectors and examiners as may be employed by tkc

Office.

Section 5. Powers and Duties of the Attorney Generzl . Pursuan:

e x p r e s s l y c o n f e r r e d upon h im o r reasonab ly i m p l i e d f rom t h i s A c t .

(a) The A t t o r n e y General s h a l l execute h i s d u t i e s and

e n f o r c e t h i s Act .

(b ) The A t t o r n e y General may:

( 1 ) Promulgate such r u l e s and r e g u l a t i o n s , i n

accordance w i t h T i tl e 17 o f t h e T r u s t T e r r i t o r y Coac, dc,

may f r o m t i m e t o t i m e be u s e f u l o r r e q u i r e d i n execu t ing

h i s d u t i e s and e n f o r c i n g t h i s Act;

( 2 ) Represent t h e O f f i c e o f I m m i g r a t i o n and

N a t u r a l i za t i on;

(3 ) Have f i n a l r e v i e w o v e r d e c i s i o n s o f t h e C t i c f ,

I n s p e c t o r s , and Examiners;

(4 ) I s s u e war ran ts f o r t h e a r r e s t o f o r ordet-

c o n t i n u e d d e t e n t i o n o f a l i e n s pend ing e x c l u s i o n o r

d e p o r t a t i o n proceedings where i t appears i n h i s

d i s c r e t i o n t h a t a r r e s t o r d e t e n t i o n o f t h e a l i e n i s

necessary and d e s i r a b l e;

(5 ) Review t h e d e t e n t i o n o f persons a r r e s t e c our ~ u z n .

law, or who i s a permanent resident, shall immediately

be admitted into the Commonwealth upon proof of such

s tatus , unless entry i s otherwise prohibited by

law.

(1) A person claiming s tatus under th is

Subsection (a) must establish that fac t t o t h e

satisfaction of the Immigration Inspector.

( 2 ) A person fa i l ing t o sa t i s fy the immigration

inspector of his s ta tus as defined in th i s Section E { a )

shall thereafter be inspected as an al ien.

( b ) Aliens. A 1 iens seeking t o immigrate t o t h c

Commonwealth may be admitted pursuant t o s ta tu te .

(c) Monimmiqrant A1 iens. Except as otherwise

specified herein nonimmigrant aliens who are n o t excluda5ic

pursuant t o Section 7 of th is Act may be admitted t o t n e

Commonwealth u p o n presentation of such entry permit a n a

other documentation as may be required by law. Immediate

relatives of non-resident workers may enter and remaic i r

the Commonwealth for such time as the non-resident w o r k e -

resides in the Commonwealth provided that such immediate

relat ive s tatus existed prior t o the entry of the

non-resident worker. Idothing in th is section shall kc:

deemed t o revoke, repeal, amend or otherwise a1 t e r the

requirements of Public Law 3-66, the Non-resident Korker

Act o f 1983.

( d ) Crew members. A1 i en crewmembers may be admi t ted,

subject to the provisions of th i s Act, i f his name appears

in the crew 1 i s t of the vessel or a i r c r a f t on which he

arr ives , providing the crewmember carries a valid

passport.

Section 7 . Excludable Aliens. The following classes of

a1 iens shall be excludable from entry into the Commonwealth:

(a) Aliens who have been convicted of a crime carryin:

a penalty of one year or more in prison;

( b ) Aliens who have been convicted o f a crime o f

moral turpitude;

(c) Aliens who have no demonstrable means of suppor:;

( d ) Aliens who have been deported from the C O I ~ ; C ! O ~ ~ P ? ~ : ~

and seek reentry within one year from the date of such

deportation;

(e) A1 iens who are stowaways;

( f ) Aliens who seek or have sought or have aided a n o t h e r

in seeking t o procure an entry permit, or other off ic ia?

documentation related t o entry, or otherwise t o enter t n c

Commonweal t h y by fraud, deceit , bribery or wil ful

misrepresentation of a material fac t or other unlawful

ac t ;

( g ) A1 iens who are not in possession of a lawfully

issued passport valid for a t leas t s ixty (60) days a f t e r

the date of entry and which authorizes the holder t o

o r a f f e c t t h e coming i n t o o r depar tu re f rom the Commonwealth of

an a l i e n member o f t h e Armed Forces o f t h e Un i t ed States wbo i s

i n t h e un i f o rm o f , o r who bears documents i d e n t i f y i n g h i n a s a

member o f such Armed Forces, and who i s coming t o o r depa r t i ng

f rom t h e Commonwealth under o f f i c i a l o rde rs o r pe rm i t o f suC!i

Armed Forces. Noth ing con ta ined i n t h i s Sec t ion s h a l l be

the period indicated in the required cer t i f icat ion.

Any extension, modification or renewal of such entry

permit shall likewise be granted only for such period

as the Department of Commerce and Labor or other

Commonweal t h agency shall have cer t i f ied .

(4) No person shall be required to leave t h e

Commonwealth as a condition of obtaining any extension,

modification, renewal or change of nonimmigrant

c lassif icat ion pursuant t o this Section 10.

Section 1 1 . Entry Inspections. All persons seekinc,; t c enter

the Commonwealth shall he inspected by the Chief or a desicnzted

Inspector.

(a ) A person seeking entry by r ight of status pursuan:

Section 16. Appeal of Exclusion t o Attorney General.

( a ) The decision of an Examiner t o deny entry may be

appealed t o the Attorney General by the person excluded. Such

appeal shall be reviewed within twenty-four (24) hours. The

request f o r appeal may be made verbally by the excluded pcrscn

t o the Examiner.

( b ) In resolving an appeal from an excluded perscr! the

Attorney General a t h is d iscre t ion may re ly sole ly on t h e

record of the examination, may supplement the record or mv

reexami ne.

( c ) The Attorney General shall have a l l the power d n ~

au thor i ty of an Examiner f o r purposes of executing th i s k c t i o r .

pending f inal decision of deportabil i ty upon a conclus i v c

showing in habeas corpus proceedings t h a t the Attorney General

i s not proceeding with such reasonable dispatch as m y be

warranted by the par t i cu la r f a c t s and circumstances i z the

case of any a1 ien t o determine deportabil i t y or excludabi? i t:.

When an a r r e s t warrant i s served the respondent shall have

explained t o him the contents of the pe t i t ion t o show csust- ,

the respondent shall forthwith be deported.

Section 19. Appeal of Deportation Order. Appeal of an o rde r o i

deportation may be had as an appeal in any c iv i l case.

Section 20. Voluntary Departure. Any time pr ior t o actual

commencement of the hearing on the order t o show cause the respondent

may be permitted t o voluntari ly depart the Commonweal t h a t thr-

o f f i c e r s , purser agents, person in charge, owners or consianees of

any vessel or a i r c r a f t upon which any a l i en subsequently excluded

i s brought t o any port of the Commonwealth, shall assure return

transportat ion costs and costs of maintenance in the Cowonwealth

including food, she l t e r , medical care of an excluded a l ien .

However, costs shal l not be assessed under t h i s section i f the

excluded a1 ien arr ived in possession of a valid passport a c d

entry permit as required by Section 7.

( b ) I t shall be unlawful f o r any master, comaandint; o f f i c e r ,

purser, person in charge, agent, owner or consignee of an:J vess.1

(6) t o take any fee , deposi t or consideration on a

contingent basis to be kept o r returned in case the person

i s landed or excluded;

( 7 ) t o knowingly bring i n to the Commonweal t h d n y person

excluded or deported from the Commonwealth unless such person

i s lawfully en t i t l ed t o reapply f o r entry t o the Cormonwealth;

(8) t o knowingly bring, or attempt to bring or d i d ,

abet or a s s i s t in bringing any person i n to the Cornonwealth

in violat ion of any provision of t h i s Act or rules a n d

regulations promulgated.

( c ) Violations of any provision of t h i s Section a re punisnable

by c iv i l penalty of not more than $5,000 f o r each occurrence.

Section 23 . Health Requirements; Exarni nations.

( a ) kihenever an Inspector has reason t o be1 ieve t h a t a n y

person seeking t o enter the Commonwealth has any dangerous

contagious disease, o r has embarked a t a place or i s cwniny

from a country where any such disease i s prevalent or epider-ic,

he may cause such person t o be detained on board the v e s s e i o r

a i r c r a f t , or a t the port of a r r i va l and shall immediate!! r e f e r

the matter t o an Immigration Examiner.

( b ) Physical o r mental examinations required of persons

seeking t o enter the Commonwealth shal l be conducted h:i ;:

physician licensed in the United Sta tes o r by the Commonweal t k

of the Northern h r i a n a Islands. Upon conclusion of the

in writing t o the Immigration Examiner requesting the exanina t i o n .

The physician's report shall include any condition of serious

contagious disease, or any condition t h a t threatens the h e a l t h

or sa fe ty of the inhabitants of the Commonwealth, or t h a t could

require prolonged medical care and treatment while the person

i s in the Commonwealth.

Section 24. Registration of A1 iens.

( a ) Every a l i en who remains in the Commonwealth lon9er than

ninety (90) days shal l by regulat ion be required to be registered

with the Office. Registration may be renewable annual 1:;. T h e

Section 25. Unlawful Acts;

(a ) Unlawful Entry. Any person who unlawfully enters

8 another t o enter or attempt t o enter, for purposes of

9 committing any unlawful ac t , i s guilty of a felony and

10 shall be punished by n o t more than f ive years imprison~ent.

giving notice of intent t o land in advance of landing, a n d such

other requirements as may be necessary t o e f fec t and enforce t h i s

Act.

Section 27. Jurisdiction of the Commonwealth Trial Court.

The Commonwealth Trial Court has jurisdiction of a l l causes, c i v i l

and criminal arising under th is Act, unless such case i s d e t e m i n a b l e

by administrative action and specif ical ly made unreviewable.

Section 28. Disposition of Funds. All fees, civil a n d penal

f ines , and other monies collected pursuant to this Act shall be

credited t o the General Fund unless another disposition is

specifical ly required.

Section 29. Repealer. Chapter 2 of Ti t le 53 of the Trus:

Territory Code, and rules and regulations promulgated pursuan:

thereto are hereby repealed in i t s ent i rety.

Section 30. Severability. If any provision of this Act, o r d n j

rules, regulations, or order issued under th i s Act, or the appl i c a t i o n

of any such provision, rule, regulation, or order t o any p e r s o n or

circumstances shall be held invalid by a court of competent j u r i s d i c t i c c ,

the remainder of th is Act and other rules, regulations, or orders issuc:

under th is Act, or the application of such provision, rule, repula:ion,

or order to person or circumstances other than those t o wh ich i t i s n e l d

i nval id , shall n o t be affected thereby.
