On October 30, 2009, pursuant to the authority granted by Section 91.103 of the Los Angeles Municipal Code, the Department of Building and Safety (the "Department") investigated and identi fi ed code violations at: 3975 North Westin Avenue., Los Angeles, California (the "Property"). A copy of the title report which includes a full legal descripti on of the property is attached as Exhibit A.
fol lowing the Depa1tment 's investigation an order or orders to comply were issued to the property owner and all interested parties. Pursuant to Section 98.041 1(a) the order wamed that "a proposed noncompliance fee may be imposed for fa ilure to comply with the order with in 15 days after the compliance date specified in the order or unless an appeal or slight modification is fil ed within 15 days after the compliance date." The owners failed to comply within the time prescribed by ordinance. The Depa1trnent imposed noncompliance fee as follows:

Pursuant to the authmity granted by Section 7.35.3 of the Los Angeles Administrative Code, it is proposed a lien for a total sum of $ 4,139.81recorded against the property. It is req uested that the Honorable City Council of the City of Los Angeles (the "City Council") designate the time and place protest can be heard concerning this matter, as set forth in Sections 7.35 .3 and 7.35.5 of the Los Angeles Administrative Code.
It is further requested that the City Co uncil instruct the Department to deposit to Dept 08, Fund 48R, Balance Sheet Account 2200, any payment received agai nst this lien in the amount of$ 4,139.81 on the referenced prope1ty . A copy of the title report wh ich includes a fu ll legal description ofthe property is attached as Exhibit A. A list of all the names and addresses of owners and all interested parties entitled to notice is included (Exh ibit B). Also attached is a report which includes the current fair market value ofthe property including all encumbrances of record on the property as of the date of the report (Exhibit C).

The job site is located in an area designated by the department as a Hillside Grading Area. Provide a site plat which indicates the proposed location of the structure or grading area, pay the required fee and arrange for the department to 'conduct a grading pre-inspection. 91.107.3.1.4 LA.M.C.
Obtain the required permits and do not resume work until authorized to do so by the District Grading Inspector. 91.106.1.2; 91.106.1.2; 91.108.9 L.A.M.C

No person shall fail, refuse or neglect to comply with all orders issued by the department pursuant to the provisions of this· division. Any person violating
this subsection shall be guilty of a misdemeanor which shall be punishable by a fine of not more than $1,000.00 or tiy imprisonment in the County Jail for a period of not more than six months, or by both. The Department shall collect investigation fees. LAMC 91.7005.8.1 ; 11.00 (m) & 91.107 .5.1
This Order is issued pursuant to the provisions of LAMC 91.7005.7. If this substandard condition in not eliminated within the specified time limit, this
Department will record a "Certificate of Substandard Property" with the Office of the County Recorder.
Appeals to this order may be made pursuant to Section 98.0403.2 of the Los Angeles Municipal Code. ·.Please inquire about procedures.
