ASBA visits OFAC Office - January 23 2017 As we reported at the Annual General Meeting ASBA was invited to host anldquoindustry awarenessrdquo session at OFAC Headquarters in Washington DC for theirCompliance and Enforcement staff ASBA representatives included

There were close to 20 OFAC Office of Compliance amp Enforcement (OCE) staff inattendance We prepared a slide presentation that included the following topics About ASBA Life Cycle of a Maritime Deal Basics of Chartering ndash concept and types of carriers Charter Parties and Maritime Law Types of ChartersTypes of Vessels Key Players ndash owneroperators charterers ship brokers and ship agents Role of the Ship Broker Role of the Ship Agent Industry Challenges in Dealing with OFAC Regulations OFAC staff was invited to ask questions of which there were many Our takeaways
The Office of Compliance and Enforcement (OCE) is tasked with theenforcement of sanctionsOCE staff is very familiar with banks and the movement of funds Banks havedeveloped systems to assist them in identifying fund transfers with sanctionednations companies or individuals Banks are required to report details of anypotentially illegal fund transfer
Companies or individuals involved in an OFAC violation however remote areconsidered in violation There is no easy escape if your company becomesinvolved in such a deal As you will recall from the session we hosted inStamford last June in order to receive favorable treatment from OFAC or areduced penalty a company must establish and adhere to their own internalprocedures to ensure that their company does all that is possible to identify allparties involved in the trade and that they arenrsquot on the SDN (SpeciallyDesignated Nationals and Blocked Persons) list before or during the trade Itshould also be noted that many PampI Clubs now require this type ofinformationOFACrsquos reach is international since most international fund transfers involve aUS bank or one of its subsidiaries
What to do if
Your Company becomes aware of a potential OFAC violation with a deal OFAC recommends that the company immediately file a ldquovoluntary self-disclosurerdquo of same providing full details of the trade as they relate to thesanction program Quality of the information when who how amp why notquantity is of greatest importance (DO NOT include your companyrsquos history)Funds have been wrongfully stopped One of the partiesrsquo name location orother information may be similar to one on the SDN list First provide yourbank with supporting information on counter-parties to attempt to clear up theissue before contacting OFAC OFAC may not have received information ofthe stopped transaction If you are unsuccessful in clearing up the issue withyour bank after a few days time you should then contact OFAC via the emailor telephone hotline with the facts of the deal Again quality not quantity
Best Practices
Check before fixing Use the OFAC email hotlineofac_feedbacktreasurygov provide as much detail as possible DONOT use ldquohypotheticalrdquo examples One can also call the OFAC telephonehotline (800-540-6322) Typically one must leave a voicemail but identifyoneself as an ASBA member and provide details about the transaction in themessage The OCE assured us that they listen to all voicemails and based onthe information provided will assign a staff member to return the call OCEindicated that calls are directed to staff familiar with the subject at hand and donot designate staff to a specific industry association or groupInclude ldquoASBArdquo in the subject line on all inquiries They cannot guaranteea faster reply however this will help them to better understand our membersand their issuesOFAC replies donrsquot necessarily provide clear cut guidance rather they provideassistance in interpreting the rules
If OFAC provides specific guidance on a request they will stand behind theirguidancesuggested course of action Be sure to retain all correspondence ifthe guidance was received by phone prepare a detailed memo of theconversation including the name of the OCE staff member and advice given OCE prefers not to receive emails which purport to confirm advice given butyour memo could be useful laterDo your Due Diligence Use the SDN list to check for the individualbusinessnames of all counter-parties Be sure that the commodity can be traded orshipped to the sanctioned nation

Alleged ports are often (but not always) in Turkey or North African countries
Request to remit funds to a third country with no apparent connection with
any of the parties to the fixture loading or discharge ports
Sudden request to change the account into which funds are to be paid
Communication is by email only and when you call the number provided and
the person answering the broker or charterers phone sounds like the same
person
Broker may have several cargoes in the market at the same time and the
similarities of the contact number of references and agents raise suspicion if
checked in detail
What to do if you are Suspicious
Call involved parties and liaise with a trusted agent in the loading port to
check if cargo is actually available Visit wwwfonasbacom for a listing of
ship agents around the world
Contact Chartering company to check if they have a cargo with description
offered
The crucial point is to check the identity of the involved parties when in doubt and
always before remitting any funds

Alleged ports are often (but not always) in Turkey or North African countries
Request to remit funds to a third country with no apparent connection with
any of the parties to the fixture loading or discharge ports
Sudden request to change the account into which funds are to be paid
Communication is by email only and when you call the number provided and
the person answering the broker or charterers phone sounds like the same
person
Broker may have several cargoes in the market at the same time and the
similarities of the contact number of references and agents raise suspicion if
checked in detail
What to do if you are Suspicious
Call involved parties and liaise with a trusted agent in the loading port to
check if cargo is actually available Visit wwwfonasbacom for a listing of
ship agents around the world
Contact Chartering company to check if they have a cargo with description
offered
The crucial point is to check the identity of the involved parties when in doubt and
